A newly opened furniture store in downtown Palo Alto wants to take that to the next level: by selling furniture mostly made locally, by hand and with repurposed materials. At Inhabiture, across from City Hall, much of store manager Matt Maddox’s job consists of seeking out independent designers. “A lot of furniture makers who are making unique pieces don’t promote themselves very well. They’re focused on the artistic aspect. It’s hard to find those people,” Maddox said. Hanging in a small hallway is a cage-like light fixture, “made from the track of an old assembly line. It was done in Carpinteria (not far from Santa Barbara) by a little group of three: a mother and her two sons. We fitted it out with LED lightings and brought it

MILLION-PLUS-DOLLAR HOMES ... Palo Alto topped November sales of “luxury homes” — those that sold for more than $1.5 million, according to Coldwell Banker Residential Brokerage — compared to a year ago. Palo Alto sold 35, with Los Altos closely trailing at 33. Homes sold faster (on average 45 days, compared to 57 days a year ago), and sales averaged 101 percent of the asking price, up from 98 percent last year, according to the Silicon Valley Luxury Housing Market Report. The most expensive home sold in Santa Clara County in November was a five-bedroom, seven-bath home in Saratoga that went for $4.65 million. Information: 925-275-3085

In another corner of the store stands a narrow workbench, complete with a monkey-wrench mechanic to bear down on wood for the cutting. It was made in France in the 1940s. Beyond these independent designers, Maddox counts four designer/owner/builder companies among its clients, all based in California. Cisco Brothers in Southern California provides the store’s line of upholstery goods, made without fire retardants or toxic chemicals. Noir provides larger pieces of furniture: Jarboe ($3,500) is a bookcase that doubles as a room divider. It is made from timbers and flooring salvaged from industrial buildings torn down in Los Angeles. Much of Inhabiture’s furniture pieces seem to carry one-of-a-kind stories of origin rather than a shared construction process. Linebarger shared part of the company’s philosophy: “Most of our products are made here in California; we’re looking at keeping jobs local. We offer reclaimed materials. are organic, reclaimed or salvaged. We’re happy to see the other furniture stores here, because we offer something a little different, one-of-a-kind pieces, things you do not find in chains.” Linebarger recently moved his business, previously called VOX Design, from Mountain View to Palo Alto, adding the furniture store to his architectural design and green-building company. The expansion is motivated by the idea that “we can not only design and build a green home, but furnish it as well,” Maddox said. “The people that are here, our customer base, they tend to be thinking along the lines of sustainability. They’re the right demographic for us. They care about the same things we care about,” Linebarger said. Encasing the store’s steel signage is one of Inhabiture’s “living walls,” fitted with pockets of soil and succulent plants to fill them. Similarly, the rest of the downtown store serves as a showcase for Inhabiture’s design and construction services. Growing demand and competition have made sustainability — in construction and furniture both — more

affordable, according to Inhabiture’s vice president of sustainability, Ken Arends. “People think that green costs more. Our motto is: It is of no additional cost to you at all. Zero. Because of competitive markets now, it’s so much easier to achieve a green standard in building at no additional cost,” Arends said. A few blocks away, West Elm took over and renovated the 11,000-square-foot corner location at 180 University Ave. Owned by WilliamsSonoma, the store sells modern furniture and houseware. West Elm also provides a small platform for products from Etsy, an online retailer carrying the work of independent artists. On a table right by the checkout counters sits some of the website’s ceramic tableware, specifically drawn from an artist based in Oakland and another in Palo Alto. “We’re the only corporation that’s allowed to work directly with Etsy. They’ve tried to keep it very small, local and artist-focused. We reached out to them to let them know what our mission statement is, to be a launch-

pad for some of their artists,” said Caleb Anderson, the assistant store manager. Seeking the unusual, West Elm doesn’t focus only on local artists. “It’s been a quickly evolving brand in the last couple of years. It used to include very clean lines, whereas now we’re starting to collaborate more with up-and-coming artists,” Anderson said. In their travels and research for a recent collection on South African culture, West Elm’s design team encountered an artist selling wire, beaded birds, he said. The birds are just under 10 inches in height, and handmade with wire and glass beads of black and white. “He was selling them out of the trunk of his car. He had a handful of them in there. In order for us to be able to fill that order, he had to employ 12 people to help him handmake all of these birds. So it helped him launch his brand within his community. I moved out of an apartment more than three years ago. I knew that I didn’t leave the place in perfect condition, but I figured I would call it “even” if my landlord kept my security deposit. Instead, I received a letter from him telling me that he was keeping my security deposit and that I owed him another $800 for additional damage to the property. I thought that claim was totally unfair so I didn’t respond. Now, three year later, that landlord has served me with a small-claims court lawsuit for $1,000 in damages. Isn’t this lawsuit too late? In order to give you accurate advice, some questions need to be answered. First, was your rental agreement with this landlord in writing or was it oral? The statute of limitations to enforce the terms of a written agreement is four years, which means this lawsuit is still timely if you had a written agreement. On the other hand, a claim based on an oral agreement must be brought within two years. Another question is whether the original letter from your landlord was timely. California Civil Code Section 19505.5 requires a landlord to provide a written accounting of a tenant’s security deposit to the tenant within 21 days after the tenant vacates. Did your former landlord meet this requirement? If not, you have a strong argument that the entire deposit should be refunded. If the judge feels that landlord’s delay was in bad faith, there is an additional penalty that you could claim equal to twice the deposit amount, in addition to refund of the deposit itself. Did the landlord’s letter include documentation of the amount of damages claimed? Under Section 1950.5, any deductions for repairs or damages or cleaning that total more than $125 must be accompanied by receipts or invoices supporting them. In addition to these issues, you also have the right to attack whether the claimed damages were reasonable, since you felt there was no significant damage to the property when you left. In this type of case, the landlord has the burden of proving that the damages were justified. If you have any photos or other documentation of the conditions when you left, your case will be stronger. Depending on the answers to these questions, your local mediation program might be able to help you negotiate a compromise settlement of these claims. There is no “open-and-shut” case in the small-claims court because the procedure is informal and the parties represent themselves. Both sides have an incentive to settle prior to the court date to save the time and stress of a trial. In addition, the party winning at trial will have to collect the judgment awarded, which can often prove more difficult than winning the case at trial.

I recently stopped at a rental property to apply for a two-bedroom apartment after I saw a “vacancy” sign while driving past it. I had my two young children with me at the time. When I spoke to the on-site rental agent, she told me that the available unit was on the second floor. She said I could not apply for that unit because they did not rent second-floor units to families with young children. She said the owner had nothing against children, but the units have open balconies. The owner felt there was too much danger that small children would be injured falling off the balconies. I am finding it hard to find a decent rental and I thought this community would be perfect for me and my family. Is it legal for the owner to exclude me from the second floor? Families with one or more children under age 18 living in the household are protected from discrimination under the fair-housing laws. This “familial status” discrimination applies to refusals to rent or sell to families with children. It also prohibits treating families with children differently than other residents in the terms and conditions of housing. Limiting these families to certain parts of a rental community, or certain floors in a building, are included in the prohibited discriminatory practices. Here it sounds like the landlord was concerned that the open balconies on the second floor would constitute a safety risk for your children. However, that justification does not permit violation of the familial status protections. Landlords can establish reasonable safety rules that apply to everyone, but safety rules cannot apply only to children. In this case, if the landlord is concerned that the open balconies are a safety risk, the landlord could address the risk by taking some action or making some modification that would be likely to mitigate the risk. Excluding children instead of addressing the risk may seem more economical to a landlord, but the result is that families like your family find themselves excluded from significant portions of the housing market.
