THE COMMON LAW IN EUROPE: PUBLIC AND PRIVATE PERSPECTIVES This unique Summer School offers students an introduction to the Common Law system, as it operates in Europe and interacts with European Law. Using examples from two EU common law jurisdictions, Ireland and the UK, the Summer School focuses on key principles of the common law, from the perspective of both public and private law.

PRACTISING THE COMMON LAW IN EUROPE

JUNE 17-30 | 2017

INTRODUCES STUDENTS TO THE OPERATION OF THE IRISH, AND EUROPEAN, LEGAL SYSTEMS, FOCUSING ON THE OPERATION OF THE COURTS, LEGAL ACTORS, AND THE ADMINISTRATION OF JUSTICE. THE COURSE ALSO HELPS STUDENTS TO DEVELOP THEIR LEGAL WRITING, ADVOCACY, AND NEGOTIATION SKILLS, BY ENGAGING IN PRACTICAL EXERCISES LED BY LEADING ACADEMICS AND PRACTITIONERS. STUDENTS WILL GAIN EXPERIENCE IN HOW TO STRUCTURE LEGAL ARGUMENTATION, AND IN THE USE OF LEGAL PRECEDENTS AND OTHER SOURCES OF AUTHORITY. IN ADDITION, STUDENTS WILL HAVE THE OPPORTUNITY TO PRACTISE ADVANCING ORAL LEGAL ARGUMENTS TO COURTS AND OTHER TRIBUNALS, AND TO DEVELOP THE SKILLS NEEDED TO ENGAGE IN COLLABORATIVE NEGOTIATION.

PRINCIPLES, RIGHTS AND FREEDOMS: A CONSTITUTIONAL FRAMEWORK JULY 1 14 2017 -

examines key elements of the Constitution of Ireland, by analysing core concepts like the separation of powers and the principles governing constitutional litigation, interpretation, and amendment. The scope of the course also covers the nature and theory of fundamental rights, examining, for example, rights relating to privacy, the family, freedom of expression, and personal liberty. The course examines the implications of membership of the European Union and the Council of Europe, including fundamental rights guarantees under EU Law and the European Convention on Human Rights. Issues addressed include the relationship between the individual and the state, the reconciliation of competing rights and interests, and tensions between international human rights bodies and domestic institutions.

CRIME AND JUSTICE: PRINCIPLES AND PROCESS JULY 15 28 2017 -

INVESTIGATES THE FUNDAMENTAL CONCEPTS AND POLICIES THAT UNDERPIN THE CRIMINAL LAW IN IRELAND, AND THE PRACTICES THAT SERVE TO COORDINATE THE CRIMINAL JUSTICE SYSTEM. THE COURSE LOOKS AT THE PRINCIPLES OF CRIMINAL LIABILITY, THE FAULT ELEMENT IN CRIME, AND ANALYSES PARTICULAR OFFENCES (E. G. HOMICIDE AND SEXUAL OFFENCES) AND DEFENCES (E. G. SELF-DEFENCE AND CAPACITY). THE COURSE ALSO ANALYSES THE CRIMINAL PROCESS LAW, FROM ARREST/SUMMONS, THROUGH BAIL/DETENTION, ENTRY OF PLEA TO TRIAL, AND SENTENCE. IN ADDITION, THE INFLUENCE OF ARTICLE 6 OF THE EUROPEAN CONVENTION ON HUMAN RIGHTS ON DUE PROCESS PROTECTIONS IN IRISH AND UK LAW, AND THE IMPACT OF THE EMERGING CRIMINAL LAW JURISDICTION OF THE EU ARE CONSIDERED.

FORTRESS EUROPE: MIGRATION, SECURITY AND THE LAW JULY 29 AUG 12 2017 -

THIS COURSE ANALYSES THE LEGAL CONTEXT FOR MIGRATION INTO THE EU, AND MIGRATION BETWEEN EU MEMBER STATES. IT HAS A PARTICULAR FOCUS ON REFUGEE LAW, UNIVERSAL HUMAN RIGHTS NORMS, AND THE IMPACT OF THE EUROPEAN CONVENTION ON HUMAN RIGHTS (ECHR). THE COURSE ANALYSES CONTEMPORARY TRENDS IN GLOBAL MIGRATORY MOVEMENTS AND INTRODUCES STUDENTS TO KEY CONCEPTS OF IMMIGRATION, ASYLUM AND NATIONALITY LAW, AT THE DOMESTIC, EUROPEAN, AND INTERNATIONAL LEVELS. IT QUESTIONS THE EXTENT OF FUNDAMENTAL RIGHTS PROTECTION FOR NON-CITIZENS UNDER UNIVERSAL HUMAN RIGHTS LAW AND THE ECHR. IT EXPLORES THE SPECIAL LEGAL REGIME FOR REFUGEE PROTECTION IN INTERNATIONAL AND EU LAW AND SCRUTINISES THE LEGAL DEFINITION OF A ‘REFUGEE’. THE COURSE ALSO INTRODUCES STUDENTS TO THE DEBATES SURROUNDING LEGAL RESPONSES TO IRREGULAR MIGRATION.
