Dear NOAA Members, Our northeast Ohio apartment industry was under siege this past summer. It is a difficult financial time for most any business in the state of Ohio that is immobile. I liken owning an apartment building to being a sitting duck for everyone/anyone that feels the need to create more revenue for their community. Below are several examples of this type of predatory behavior. The first comes from the Northeast Ohio Regional Sewer District. They are working hard to create a new fee that looks much more like a tax. The NEORSD is spending vast amounts of public dollars in all varieties of media to gain support for this fee; a so called fee that will reportedly raise over $35 million a year that will be gathered from all commercial property owners. This is intended to stop the damage being caused by storm water rain that is running off of impervious surfaces.

Their initiative is being guided by staff, along with a small board of appointed directors. Six or seven people are sitting in a position to levy around $35 million in fees which will be charged each year to entities they do not govern, people who have not elected them, people with no say. I find the NEORSD board’s timing strange as we are at the threshold of a new form of government in Cuyahoga County. Why not wait? Shouldn’t the new county executive and county council decide if this imperative is worth the cost. I guess we all know the answer.

But consider this; if you have a winning lottery ticket in your hands that’s going to pay $35 million dollars a year, who’d want to wait? In the face of this type of financial attack, NOAAs Executive Committee decided the right thing to do was to get behind attorney Shelly Berns of the law firm of Berns, Ockner & Greenberger, LLC and to commit tens of thousands of dollars to represent all our members at the hearings. As of this writing (September 20, 2010) the fee is being suspended until further notice; see the article in this issue pertaining to this action. There are other financial fronts under attack as well. The PIPP (People in Poverty Project) appears on your gas bills, and if you haven’t noticed, the fee increase for each and every user has risen dramatically. While NOAA is on the outskirts of this battle, there are members who are working together trying to get equality on this issue with the rest of the state and other commercial property owners. Finally, this past Summer, the city of Bedford Heights deemed this an appropriate time to pass Ordinance 2010-053 Rental Licensing Fee. In a letter from Fred N. Carmen, Esq to Bedford Heights Mayor Fletcher Berger, Carmen says, “...it is clear that Bedford Heights Ordinance 2010-053 is unconstitutional.” Carmen’s client will not pay the fee and intends to sue the city. NOAA has many issues relating to not only the fee in this city, but other fees, such as; Mayfield Heights’ inspection fee (charged annually for an inspection that occurs once every 3 years). We are looking at options about correcting this injustice. Congratulations to all who entered the Key Awards. The event at the Silver Grille was spectacular. Shawn Rech and I met with WOIO TV 19 and it appears our award show will be moving from Fox 8, where we attracted over 20,000 viewers! Stay tuned for more news on the program and thank you for participating in our most dynamic and exciting program…The Key Awards! Finally, I’d like to welcome Ryan Flanagan to our staff at NOAA. Ryan has proved capable and is contributing to our marketing and overall success in the short time that he has been here. He has proved up to the challenge and is a fantastic addition to our team.

NOAA ISSUE WATCH: Impervious Surfaces NEORSD’s New Stormwater Fee: Taxation Without Representation? Do you own property located in the Northeast Ohio Regional Sewer District (NEORSD) service area? Does your property have impervious surfaces such as rooftops, traveled gravel areas, asphalt or concrete parking areas and patios? Did you know that NEORSD plans to implement a Regional Stormwater Management Program? And did you know that NEORSD planned to impose a “Stormwater Fee” on property owners based on the impervious surface area of their property beginning on July 1, 2010? Don’t feel badly, a lot of other property owners didn’t know either. Your Board of Trustees did not sit idly by. When it learned of the proposed Stormwater Management Program and the “Stormwater Fees,” it, along with other organizations and property owners engaged Berns, Ockner & Greenberger, LLC, led by Sheldon Berns, to fight the Stormwater Management Program. As a result of their efforts and the efforts of many cities, villages and townships who are members of NEORSD, NEORSD has put the “Stormwater Fees” on hold pending determination of a lawsuit challenging NEORSD’s authority to implement the Stormwater Management Program. It’s important for owners and management to quickly learn about NEORSD’s new stormwater fee, and the regional stormwater management program it’s being used to support. The Northeast Ohio Regional Sewer District NEORSD was created in 1972 by an order of the Cuyahoga County Common Pleas Court, “to provide for the collection, treatment, and disposal of waste water.” Since that time it has constructed and maintained waste water treatment facilities and interceptor sewers. On January 7, 2010, however, NEORSD’s board voted to greatly expand the scope of its activities by undertaking a regional stormwater management program.

Questions concerning NEORSD’s authority to regulate stormwater Serious questions exist concerning whether NEORSD has the authority to regulate stormwater under either its Plan of Operation or the section of the Ohio Revised Code governing regional sanitary districts. NEORSD intends to construct stormwater facilities and also intends to manage stormwater with respect to new developments. For instance, NEORSD’s member communities (cities, villages, and townships) will be required to submit plans for all new developments to NEORSD for review and NEORSD will have the right to adopt and impose storm water regulations on member communities. The result is the imposition of yet another layer of regulation in addition to existing federal, state, county, and municipal regulations. The scope of NEORSD’s authority, therefore, is of critical importance. Questions concerning the lawfulness of NEORSD’s proposed Stormwater Fee Equally serious questions exist concerning the lawfulness of the Stormwater Fee, including questions about whether the “fee” is really a “tax,” which would need to be voted upon by the electorate. NEORSD plans to pay for the construction of stormwater facilities and programmatic costs required by its Regional Stormwater Management Program by

NOAA ISSUE WATCH: Impervious Surfaces assessing District properties based on impervious surface area. From publicly available information, it appears that NEORSD intends to raise $38 million to $40 million per year in additional revenue through its Stormwater Fee, with approximately $23 million dollars per year being used for infrastructure related to stormwater management and the remaining funds presumably being used for programmatic purposes. Charges are to be assessed against all properties within NEORSD except for public road rights-of-way, railroad rights-of-way, and parcels owned by member municipalities designated as “non-self supporting municipal functions.” Thus, properties assessed by NEORSD will include property owned by nonprofit corporations such as healthcare providers, universities, and churches. The magnitude of the Stormwater Fees Based on available information, a sample 15-acre parcel, with an estimated impervious surface area of 12 acres (80% of the parcel), would have 175 ERUs. (An ERU is an Equivalent Residential Units, which is designated as an impervious surface of 3,000 square feet.) Imagine—if you will—the Stormwater Fee for large department stores, shopping malls, automobile dealerships, office complexes, hotels, parking facilities, healthcare providers, churches and other religious facilities, and university campuses—not to mention apartment complexes. Failure to spread costs of the Regional Stormwater Management Program to those benefited Leaving questions about its authority and powers aside, NEORSD, geographically speaking, does not 20 • Fall 2010

appear to be the correct entity to be undertaking so broad a task as regional stormwater management. Although all of Cuyahoga County is presumably intended to benefit from NEORSD’s program, not all communities within Cuyahoga County are members of NEORSD and, accordingly, property owners within these non-member communities will not be required to pay for any portion of the cost of the program. Non-member communities include Bentleyville, Chagrin Falls, Chagrin Falls Township, Fairview Park, Hunting Valley, North Olmsted, Rocky River, Westlake, and Woodmere. This would not be the case if stormwater management were a function of the new Cuyahoga County government or left in the hands of the cities, villages and townships who, themselves, are capable of managing stormwater, which many of them are doing. Lack of accountability to electorate and sensitivity to economic concerns The effect of NEORSD’s planned regulations and the Stormwater Fee on the already suffering economy of Northeastern Ohio raises additional serious concerns. Many believe that the last thing we need is another layer of taxes assessed against properties and another layer of bureaucratic regulation. This is particularly true of an organization such as NEORSD whose board consists of members who are appointed, not elected, without any accountability to the electorate. Most stormwater problems can be corrected by the cities, villages and townships in which such stormwater problems are located. To the extent that a regional stormwater problem exists, it should be undertaken by the new form of Cuyahoga County government that the voters of Cuyahoga County approved last November. The County will have a council elected by the voters to address legislative matters, i.e., determine what projects should be undertaken for the benefit of the public, when they should be undertaken, and how they should be paid for. Hopefully a sizable portion of the funds necessary for such functions would be available through federal and state grants. Most importantly, an elected body would consider the effect of its actions on the economic health of Northeastern Ohio.

Litigation concerning NEORSD’s legal authority to undertake a Regional Stormwater Management Program As mentioned above, serious questions exist concerning NEORSD’s legal right to implement its Regional Stormwater Management Program. On January 7, 2010, the day it voted to undertake the Regional Stormwater Management Program, NEORSD, itself, filed a lawsuit in the Cuyahoga County Common Pleas Court seeking a judgment declaring that it has the right to carry out the Regional Stormwater Management Program. We, along with other organizations and property owners, have intervened in the NEORSD lawsuit and have filed a counterclaim to enjoin NEORSD from implementing the Stormwater Management Program and imposing the “Stormwater Fees.” In addition, the Catholic Diocese of Cleveland and the Cleveland Metropolitan School Board have also intervened and they, too, have asked the same relief that we are asking. Twelve cities in Cuyahoga

County are also seeking an injunction against the Stormwater Management Program. There are now at least 26 cities, villages and townships that are actively opposing the Stormwater Management Program in the litigation and only 10 out of 62 cities, villages and townships who are members of NEORSD are supporting the Stormwater Management Program. One of Berns Ockner’s attorneys, Tim Duff, recently located a July 12, 2010 decision from St. Louis, Missouri, where a trial court faced with a program substantially similar to the NEORSD Stormwater Management Program held that the so-called “impervious surface fee” was not a fee, but was an unlawful tax. The argument that was made in that case is the same argument that our attorneys have been making in the NEORSD litigation. Industry Profile: Allan Pintner

Millennia Housing Management, LTD.

Allan Pintner, a primary member of NOAA since 1985 and currently broker emeritus

His lifelong fascination with football has enabled him to be involved with the rules and regulations of the game of football at all levels; from CYO football, high school, Division III, Semi-Pro and ultimately the NFL. “I hated working little kids football and CYO football because the parents and the coaches mixed all the rules up and invented some of their own to conveniently apply.” In addition to officiating he worked Division III college football as a referee for 17 years. He was also part of the Cleveland Browns Chain Crew, holding stake plugs in the ground and recording the penalties for the NFL. He spent oneyear as president of the Cleveland Football Officials Association. In 2006 the Cleveland Football Officials Association recognized Allan, and in 2008 he was the recipient of the “Bobby Brown’s Officials Award” from the Cleveland Browns Touchdown Club Charities, Inc. In addition he received an award from the Ohio Football Officials’ Association (college officials) for 20 years of membership.

Allan is an expert on everything “rules,” whether they involve the game of football, teaching, politics, or fair housing. Through his extensive knowledge of the rules and regulations of the real estate industry, most especially as they relate to multifamily affordable housing, he has proven this is an industry in which some can work for a lifetime, even after retirement. A self-proclaimed “Warner Road kid” from the southeast section of Cleveland, Pintner attended Cleveland area public schools, graduating from South High School in 1962. He went on to graduate from Kent State University in 1967 with a B.S. in Education with majors in Mathematics and Comprehensive Science. He added to his education by earning a Masters degree in Mathematics from Cleveland State University in 1972. “Mathematics is a discipline,” he said. “You must remember things

and how they interrelate. This training enables you to do the same type of thing with other rules whether they pertain to football or houses.” He taught math and science at Rhodes High School and Brecksville – Broadview Heights High School. He also taught night classes at Cuyahoga Community College, sharing his knowledge of everything related to math and science math and science with the exception of Chemistry. He even taught driver education and real estate. Allan believes that, “Part of being successful at teaching is the ability to find the answer when someone asks a question or a problem occurs. Knowing where to look and find the answer is critical to ultimately getting the correct result.” It was during his high school years when he played football as a quarterback and a corner back that how the game was played, (including the rules of the game)

In his 20’s he was involved politically as a Ward Leader in the city of Cleveland and then as a City Leader in Brecksville. A Ward Leader is a grassroots political position chosen by Precinct Committeemen who are elected on the ballot. Later he served in campaigns for Cuyahoga County Treasurer Jim Rokasis. Rokakis frequently tells people how Pintner was a coach at his junior high school when he was a student. “I have worked on Jim’s campaigns over the years. We have maintained personal and professional friendships based on respect. Jim was a Cleveland City Councilman at the time I was a Ward Leader. “Ultimately Allan decided to give up active political involvement because he began traveling four days a week, had two daughters and a wife who wondered “who was the guy who showed up on the weekend only to leave with a black and white striped shirt and whistle around his neck?” At an early age, Allan’s parents instilled in him the importance of being involved and to always give back to those or the groups that helped him. Thus, he has been active in trade organizations in virtually everything he has done. He stated,

“To be active in a trade organization such as NOAA requires a strong commitment by the employer even more so than the employees. Employers that do not recognize the importance of involvement in trade organizations, in the communities and in the political environment in which they operate are cheating themselves and their companies with short sighted action of not being involved. This holds them and their industries back”. Frank Sinito, President and Founder of Millennia Housing Management, LTD., was also incredibly supportive of his efforts to participate in trade organizations and political activities both from time and funding aspects. Allan was elected President of NOAA in 1999 and 2000. NOAA recognized Allan as “Manager of the Year” in 1992. His adventure into the world of real estate carried with it a whole new set of rules and regulations to learn about. Allan began when he was 29 years old, becoming a licensed real estate agent in the state of Ohio. He bought a few properties to manage, but did not become involved in multi-family housing until he was 41 years old, at which point he joined Associated Estates as a Property Manager responsible for over 1,200 apartments with Project Based Section 8. He responded to a blind ad for a marketing manager position and interviewed for the job only to find out that the company was Associated Estates and that he was ill prepared to be their marketing manager. Yet they believed he had the skills to be a property manager. His mentor as a Property Manager was Jerry Spevack (also a Past President of NOAA).

Industry Profile: Allan Pintner It was Jerry who made it apparent to him from day one the necessity of being involved in NOAA and the importance of understanding regulations as related to government housing. After four months as a property manager, Associated Estates needed to fill the spot of Director of Government Programs. His interview was with Meredith Potter Seikel, secretary of Associated Estates. She was a former undersecretary at the Department of Housing and Urban Development. “Meredith was a stickler for details including proper use of the English language; grammar, letter writing and all regulations.” His interview consisted of reading about 20 pages of the Federal Register about a proposed regulation that would pertain to affordable housing, then writing a onepage summary to the officers of Associated Estates describing what would be necessary to implement the proposed regulation. “I got the job and an additional new mentor. I view that as the learning experience that started and opened my career in affordable housing.”

Even though Allan recently retired, he continues to work with Millennia Housing Management, LTD. by assisting colleagues and partners with information on affordable housing and how their regulations interact when the programs overlap. He is also a licensed a residential appraiser, and is a licensed Real Estate Broker in Ohio and Michigan. Allan’s sincere commitment and dedication to the many rules and regulations of multi-family housing have insured that numerous industry professionals navigated these sometimes-complicated paths with assurance. After all, that’s the goal of a “rules guy.”

As a result of the frequent changes that related to affordable housing, trade groups were organized to better disseminate federal regulatory information. “Small companies do not have the luxury of a dedicated employee whose responsibilities include the regulatory environment.” who said this? The Ohio organization for affordable housing is the Midwest Affordable Housing Management Association, known as MAHMA was one of the organizations. Allan most recently served three terms as president. He is currently functioning as their representative to the National Affordable Housing Management Association (NAHMA). He is also serving
