Marshall Mine, LLC, P. O. Box 790, Marshall, TX, 75671, has submitted a permit application to the Railroad Commission of Texas for a 2,422.9-acre project area to be located 9 miles south of Marshall, Texas, 1.5 miles north of the FM 1794 and 1 mile east of State Highway 59 in southern Harrison County and northern Panola County, Texas, within the U.S. Geological Survey Grand Bluff 7.5-minute quadrangle map. A General Location Map is provided as part of this Public Notice.

Section 133 details the proposed permit area’s fish and wildlife baseline information.
The initial five-year permit term area is located entirely in Area A of the propose Marshall Mine permit area and additional permit terms may be requested. Area A is located north of Sabine River and east of State Highway 59. Activities for the five-year permit term include construction activities (sediment pond, diversions, haulroads, and access roads) and mining activities (overburden removal, coal removal, and reclamation). The mining pits in Area A are designed in a slight northeast to southwest orientation with mining advancing to the northwest towards State Highway 59. The overburden will be removed mainly with a dragline, which Marshall intends to move to the site in 2013.
• Section 134 contains soils resources information, forage production standards for postmine soils, native soil data, information on topsoil and subsoil replacement materials, premine land use information, and the prime farmland investigation. • Section 135 contains detailed existing pre-mine land use information for the proposed permit area. Table 135-1 breaks down the existing premine land use by acre, and Exhibit 135-1 visually shows the existing premine land use throughout the proposed permit area. • Section 138 contains prime farmland information and the request for a prime farmland negative determination.
The application, consisting of one Application (7 volumes) and one Supplement (2 volumes), is on file for public inspection at the locations listed below. This application may be supplemented from time to time and interested persons should continue to check the application on file at the following locations:
• Section 139 contains the Operations Plan, including engineering techniques, proposed mining equipment (i.e. dragline, bulldozer, end dump, and track hoe), mining methods and procedures, and detailed mine maps. The equipment to be used for overburden removal and coal extraction can be found on Table 139-1.

• Section 144 describes the Fish and Wildlife Plan which will be utilized to minimize any impact on the proposed permit area and promote the enhancement of environmental values. • Section 145 contains the reclamation plan for the lands within the proposed permit area, which includes standards for postmine soils and information on topsoil and subsoil replacement materials. A detailed timetable for completion of each major step in this reclamation plan is presented in Table 145-1. • Section 146 describes the lack of expected impact on groundwater and includes, as Table 146-1, a summary of the long-term surface water monitoring program.

• Section 147 describes the post mine land uses within the 969.9-acre five-year disturbance boundary, which includes approximately one-half of Area A, the intended postmine land uses are as follows: wildlife habitat (947.3 acres), developed water resources (18.4 acres), and industrial & commercial (4.2 acres)..
Proposed buffer zone variances are requested for operations within 100 feet of the outside right-of-way for portions of the following roads to allow for construction and maintenance of drainage control structures, construction and maintenance of erosion control facilities, and any other normal husbandry practices required:
• Section 148 describes the reclamation plan regarding ponds, impoundments, banks, dams and embankments. Tables 148-1 and 148-2 provide information on the one sedimentation pond and four permanent reclamation ponds proposed for construction during the term of this permit. The sedimentation pond will be designed and constructed to detain surface runoff for 24 hours or until water quality is acceptable for discharge. Therefore, no hydrologic impacts are anticipated.
• The entire Harrison County Road 1307 (Washington Road), which is approximately 2,900 feet long. •
1,775 feet of the southernmost end of Harrison County Road 1308 (Holcomb Road).
• The western side of 320 feet of the southernmost end of Harrison County Road 1309 (Hezzie Cook Road). • The entire Harrison County Road 1328 (Ponderosa Road), which is approximately 5,600 feet long. Other information contained in the Application includes the following: • Sections 116 and 117 contain information related to ownership and right-of-entry for the proposed permit area and adjacent lands. • Section 121 contains the identification of other licenses and permits for the activities proposed in the application. • Section 123 contains the location and boundaries of the proposed permit area are shown in Section 123, Appendix 123-1 and the map printed with this notice. • Section 125 contains acres of coal and tons of coal to be mined within the five-year permit term (Table 125-1). 636,000 tons of coal (90 acres) are planned to be mined each year
