Divorce & Separation In Australia, we have a "no fault" system of divorce, based fundamentally upon the principle of an "irretrievable breakdown of a marriage. It is a sad fact of life that, sometimes, relationships do not work out, and it is not necessarily the case that anyone is to blame for that.
Pursuant to the Family Law Act 1975 (Cth) an application for dissolution of marriage shall be based on the ground that the marriage has broken down irretrievably-considered to have occurred when: (i) The parties have lived separately and apart for at least 12 months (ii) There is no reasonable likelihood of them getting back together Additionally:
(iii) There must be adequate arrangements for any children under the age of 18yrs. (iv) The required 12-month period of separation begins on the day at least one of the parties considers the marriage to be over and communicates this to other. (v) An application for divorce can be filed at the Family Court at any time after the parties have been separated for >12 months. (vi) The parties to a marriage may be held to have separated and to have lived separately and apart, notwithstanding that they have continued to reside in the same residence or that either party has rendered some household services to the other. In these situations, the parties alleging separation must satisfy the Family Court as to why the parties continued to live under the one roof, and they can demonstrate that there has been a change in their relationship, gradual or sudden, constituting a separation. Evidence of separation under one roof in each marriage relationship is different; the facts showing separation under one roof vary from case to case.
