Informal Complaints in Australia – A Work Place Right (Sunnyvale, CA) - Do you face physical and mental health problems at work or you are depressed, bored, frustrated or just plain weary! In Australia informal complaints can be made to the employer and this is considered a “workplace right” of any employee. An employee who complained to her employer about being incorrectly paid was “able to” make complaints in relation to his/her employment in Australia and was protected under a recent decision of the Federal Magistrates Court. The magistrate took a broad view of this situation in which an employee exercised a workplace right by complaining or inquiring and applied section 341 of the Fair Work Act 2009 (Cth), to this case. Employees are thus protected against adverse action (Devonshire v Magellan Powertronics Pty Ltd [2013] FMCA 207).
