Australia Amends Liability of Directors and Officers: Update from Nair & Co. International Expansion Services Team (Sunnyvale, CA)- In order to simplify the process of imposing criminal liability on directors and managers of Australian Companies, the Council of the Australian Governments (COAG) has decided that all Australian jurisdictions will have a common code. This code shall outline the circumstances under which personal criminal liability on managers and Directors will be imposed. The new code will override the current diverse legislations in various states and territories which govern the liability of a director or manager in case where a company commits a crime, says Nair & Co. which provides international expansion services for companies setting up foreign operations. Australian states and territories are in the approval process to bring in legislation, to confirm with the new COAG agreement (Victoria has recently enacted such legislation).
