In no event shall the liability and damages for claims relating to this site or any services provided here under exceed the amount of fees paid by the client under this agreement or $100, whichever is less.

ARBITRATION Any dispute or claim arising under or with respect to this user agreement will be resolved by arbitration under the provisions of the United States Arbitration Act. The parties shall be responsible for payment of their own expenses and attorney's fees.

INTERNET PRIVACY STATEMENT Your privacy is very important to us. Personal information is never collected by MEDICAL TREATMENTS MANAGEMENT, INC., "MTM" unless you affirmatively choose to make such information available to us. In keeping with the object of protecting your Privacy, we follow all the regulations pertaining to our Privacy responsibilities. When you become a client, additional information will be necessary to serve you. To that extent, you may be asked to provide information that is private in nature. This information will be used in identifying your health care needs and relevant information will be shared with our service providers. Information You Volunteer. We collect the personal information you knowingly and voluntarily provide when you use our sites, for example, the information you provide when you obtain a password, place an order online, complete an online survey, fill out a customer service request or request information about any of the professionals providing any medical or related services (“Provider”). In addition, we may delete information that identifies you personally and study the balance of the information we collect through our Sites to improve certain programs and services, to improve the content, functionality, navigation and usability of our Sites, to better understand the needs and interests of our customers and potential customers, and to better market certain programs and services. Service and Health Providers. We may share personal information collected through our Sites with companies and organizations that perform services on our behalf, for example, companies that provide support services to us (such as data storage and hosting services) or that help us market our products and services (such as third-party e-mail marketing companies). ENTIRE AGREEMENT This agreement and any supplemental terms, policies, rules and guidelines posted on the Site, including: the MTM Statement of Policies and Procedures, the MTM Health Team Product Terms and Conditions, the MTM Health Team Income Disclosure Statement, the MTM Health Team Compensation Plan Overview, the MTM Health Team Compensation Plan Details, the MTM Privacy Statement, constitute the entire agreement between the client and Medical Treatments Management, Inc., "MTM" and supersedes all previous written or oral agreements. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. The failure of Medical Treatments Management, Inc., "MTM" to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
