The lease is made between the developer and myself (there is no management company as a party) who has retained the freehold and delegated management to a local management agency. The developer has now been struck off at companies house for none filing and the management agency is threatening to resign over none payment of service charge/insurance rent. If there is no party to enforce payment how do we resolve this? A Not simply, assuming again there is no charge on the freehold then the title is “Bona Vacantia” or “property without owner”. If the developers company had its registered office in parts of Merseyside/Lancashire then the Duchy of Lancaster has title. If the developer had its registered office elsewhere in England (excluding Cornwall) then the Crown has title via the Treasury. The Duchy of Lancaster largely follow the same practises as the Treasury. Both will look to the residents to form a company to acquire the title. The price is calculated by a fixed formula (see website www.bonavacantia.gov.uk). The forms for completion by the residents are also on the same website. It is clearly in the interests of the residents to form themselves a company to acquire the title. They need to be persuaded to do this by the very fact their value is affected by ability to sell/remortgage. If the tenants do not wish to proceed then you could still look to a handful of tenants or a third party to acquire. The enfranchisement/rights of pre-emption laws do not bind the Crown. Once the Duchy of Lancaster/Treasury solicitor have transferred title to the residents company, then the company can take action against the tenants for the arrears of insurance rent and service charge. The leases will also need to be varied to ensure that when leases are sold on in the future – membership rights in the company have to transferred as well and any directors appointments resigned. It’s in a great location, right in the heart of the commercial quarter. The developers are well known for good quality builds and I think it’s a perfect fit for young professionals. There are great amenities on my doorstep and I’ve got my own parking space on Old Hall Street. I’m very pleased with it.

The apartment is really spacious. I was renting before so it’s nice to have the space and privacy. I really enjoy spending time here.

Probably the living room. I’ve got a bit of a Cuban cigar collection and a few other pieces I brought back from Havana last year. There’s a hand carved cobra I bought in Marrakesh and some hand crafted chop sticks from Japan. I actually saw them being made in front of me. You’ll also find my pool cue and a few pool trophies which I won while I was at Lancaster Uni’.

It’s a lovely space. I want to have a herb garden to help with cooking so I’m trying to grow chives and basil out there.

I’d say I’m a wannabe chef. I like to cook but I know there’s room for improvement! I’m a fan of Far Eastern food and also really into game at the moment, like venison. I’m starting to try exotic foreign meats like boar and kangaroo as well. I just like to discover different dishes.

I’ve gone for chocolate brown and green. I bought the sofa from SCS and the lime green rug from IKEA. The next focus is the walls. They’re white at the moment and I’m planning a feature wall. I’m looking for a local artist to create something themed around the natural colours, in keeping with the rest of the room.

There aren’t that many one bedroom apartments that I’ve seen with a bedroom this size. I’ve added a couple of pictures I brought back from Japan and a signed Liverpool shirt. Because I bought the apartment it was a complete open canvas.

My favourite piece is my leather arm chair. It’s finest leather and it was designed and made in Italy. I had to have it really! It’s a completely bespoke item and my central piece of furniture. I’ve also got one of the Mankey Monkeys which I bought at action.

I like my boy’s toys so I’d like to have a surround sound system and a home cinema. Bang & Olufsen is round the corner so it would be rude not to!

A good budget for property entrepreneurs? The new coalition government described the budget as ‘tough but fair’. The headlines to date have been dominated by the VAT increase to 20%, but what is the likely effect on the property sector? For buy-to-let landlords the key change came (as widely predicted) to the Capital Gains Tax rate. The rate of Capital Gains tax has risen from 18% to 28% for higher rate taxpayers but remains at 18% for basic rate taxpayers. This change applies from the 23 June 2010. The annual exempt band stays at £10,100 for 2010/11 and will thereafter rise with inflation. At first glance keeping the lower rate of 18% for basic rate taxpayers seems quite generous, but this will only have a limited benefit as in many cases the capital gains themselves will be likely to push taxpayers into the higher rate band. Overall however the new rate of 28% is significantly less than the 40 or 50% many people feared and is unlikely to significantly deter activity in the property sector. The VAT increase will eat into profits for buy-to-let landlords as they are unable to pass on VAT to their tenants. However the fact that the increase has been delayed until 4 January 2011 does give some time to plan ahead. Much harder to assess will be the impact of housing benefit restrictions. This will potentially hurt landlords in the private sector supporting local authorities who do not have the property stock to house people. The Government has promised to cap housing benefit payouts. There was good news for Furnished Holiday Lettings. The very beneficial tax treatment enjoyed by property owners who have qualifying holiday lets will not be withdrawn as previously threatened, but there will be a consultation document relating to possible changes next April. Finally for developers, builders and contractors, the combination of falling corporation tax rates and increasing personal tax rates for those on higher incomes will be yet another incentive towards becoming a company. Using a very simple example, individual earning profits of £175,000 would pay total tax and National Insurance of £72,400, after incorporation the same person could pay tax of only £62,365. As with many decisions you really do need to take independent financial and tax advice. The rugs designed by Patricia Urquiola are made from Chenilletex a new techno fabric that won’t fade or rot, even in the most unpredicted of climates. The collection comes in a standard size of 3mx2m and are available in Kernel fabric, paddock red or brown.

Elvis Costello has pledged his support to a Liverpool home building charity. The former SFX schoolboy spoke to Liverpool Habitat for Humanity chairman Rev Dr Shannon Ledbetter while in town for his homecoming gig at the Philharmonic. The star pledged to help out at their site in the Granby-Toxteth district, where the notfor-profit organisation is building 32 new homes, the next time he was in town. He said: “What they’re doing is great. It can become a symbol for the city. If they can get 32 houses built then why not 64? If people see it’s something they can lend their efforts to, it’s equal parts physical effort and equal parts philosophical.”

A Liverpool fundraiser with a passion for classic Liverpool anthems has followed up the success of his “The State” album, with a compilation of Liverpool bands from the late ‘70s and early ‘80s. M62 Liverpool features favourites from bands including Echo and the Bunnymen, A Flock of Seagulls, China Crisis, OMD and Teardrop Explodes. Profits from the album sales will be distributed to C.A.L.M (Campaign against living miserably) and the locally based Mark McQueen foundation. The album is currently available at HMV on Bold Street. 

The Rocky Horror Show will find its way to the Liverpool Empire in October, with Christopher Biggins taking up the role as narrator. The Richard O’Brien musical has drawn a cult following over the past 30 years, with audiences always more than willing to dress up for the occasion! The Rocky Horror Show runs at the Empire between 4 and 9 October.

16 July – 7 August, Royal Court --Dave Kirby’s comic story of life in a Liverpool city council depot, set to a blues soundtrack, is back at the Royal Court. Liverpool’s third annual samba carnival is a celebration of samba music and culture with groups from all over England and Paris performing on the streets of Liverpool city centre. The Rio-themed carnival promises fun for all ages and sets off from Cambridge Street at 8.30pm on Saturday 17 July.

Rod will perform at the Echo Arena on 21 July as part of the Liverpool Summer Pops Festival, with tickets selling out at an incredible rate, cementing his reputation as one of Britain’s biggest live acts. Indeed, it’s a favourite venue for Sheila Kirk, a landlord accreditation officer on the Public Protection Business Unit at Liverpool City Council. On this bright summer’s lunchtime, the cosy Mediterranean interiors welcome diners to enjoy a full range of freshly prepared Greek specialties. In recent years the scheme has become an invaluable resource for landlords and tenants across the city, and the council is now keen to spread word of its resources to those who may well find it useful. CLASS promotes landlords who have joined the voluntary landlord accreditation scheme on the Council’s web-site. Private landlords put forward their properties for accreditation and

We encourage landlords from the private rented sector, to register their properties with us - it’s such a simple process which really opens up the doors on communication in that sector. We like to listen to landlords about their concerns and their ideas to help them to improve their businesses.” She added, “Essentially, for a landlord to have their property listed means that they have shown that the property is maintained to a good standard and provides a good home for the tenant. It’s in our mutual interest to ensure that Liverpool offers a well-maintained and supported rental sector with a wide choice of properties, in different areas, as that’s how the city can grow and

prosper.” Our main courses of sardines and halibut arrive with enormous portions of salad, rice and chips –seasoned with sea salt and oregano for an authentically Mediterrannean taste. It’s a veritable feast, but to the owner’s credit that the meals are served promptly to enable an enjoyable lunch hour, or a relaxing evening. We discuss Sheila’s career, covering 34 years in the city council, which includes an extensive stint in the homelessness service, as a caseworker, liaison officer for travellers, and managing a supported housing scheme. In her spare time, Sheila has given many years to supporting the Girl Guiding Association, and enjoys spending time with her family and holidaying whenever possible in the United States. Her daughter, now at university, will be living in student

accommodation and this is an area Sheila feels passionately about, for all UK cities, and Liverpool especially. She adds; “Liverpool has become increasingly popular with students from across and outside the UK, as we have three universities and renowned courses, so student accommodation is in demand. We always advise students and their parents, whether they’re from Liverpool or new to the city, to look for accredited landlords to rent their properties from. That way, they know that for any concerns they may have, they have another point of contact.” Indeed, it seems that with passionate, local people behind CLASS, the hardworking service with its Olympic-ranking dedication to housing in the city could transform the way the rental sector is viewed in the city.
