Mr. J. Michael Spratt Email: michael@agpllp.ca Dear Mr. Spratt: Thank you for your recent correspondences to Premier Doug Ford concerning Ontario's legal aid system. On behalf of the Premier, I am pleased to provide a response. As you know, Legal Aid Ontario (LAO) is responsible for the administration of Ontario's legal aid system and operates independently from government. The province recognizes the importance of enhancing access to justice for low income Ontarians. Ontario's legal aid system helps ensure that Ontarians have access to the legal services they need, regardless of their ability to pay, by issuing certificates to eligible clients, providing duty counsel, and through community legal clinics, among other services. There are, however, gaps in the system, meaning that many low-income individuals are unable to access legal supports. Following the Auditor General's 2018 Annual Report, the government has committed to conducting a comprehensive review of legal aid to ensure that services and supports are responsive and easy to navigate, and will also look at ways to create a more integrated and effective legal aid system, w.hile eliminating unnecessary duplication and overlap. I appreciate your concern abuut the provision of legal aid in Ontario, and I can assure you that the government will continue to work with LAO to provide access to justice and effective legal aid for low income Ontarians. Again, thank you for taking the time to contact the Premier and for sharing your thoughts on this matter. MORNING MESSAGING Ford makes wrong cuts at LegalAid • Toronto Sun Legal aid cuts will clog Ontario'salready crowded courts. lawyerswarn Social Sharing - CBC Legal Aid Ontario stops payingfor outside lawyers at bail hearings• CP24 Summary:

Several major outlets, includingthe Toronto Sun, the CBC, and CP24, are critical of the decision to cut funding for bail hearingsled by private lawyers, instead relying on duty counsel to take on bail. hearings. The articles includequotes from private lawyers and duty counselstaff who say that the move will create a "coveragecrisis" in bail court, and that duty counselwill not be able to take on as many routine cases if they're havingto spend more time on complexcases. Dana Fisher, a duty counsel at Toronto's College Park courthouse, and a union spokespersonis quoted in many of the articles. Fisher said in a news releasethat moving to duty counsel bail hearings" ...could leave people facing charges unjustlylocked up for an unreasonableamountof time as they await their turn for bail." Criminal lawyer MichaelSpratt is also quoted, warning of "massivedelays" at Toronto's Old City Hall courthouse.Jesse Robichaudand the Attorney Generalwere quoted in various articles, with CP24 quoting the Attorney Generalas saying "People who are in bail court already have a legal aid lawyer, duty counsel is there - they do most of the cases across the provincealready. So we're just not paying for another lawyerto come in." Suggested messaging:

Accused people will continueto receive representationin bail court.

LAO staff lawyers (duty counsel)alreadydo the vast majorityof bail services, and will do more starting on July 7.

Private lawyers can continueto bill for bail hearings for more complexcases, includingthose in LAO's Big Case Managementprogramand matters set for trial.

We are pleased to see that LAO is taking steps to be fiscally responsibleand ensure that legal services can continueto be providedto financially-eligible,low-incomeOntarians. 1
