Dr. Kermit Gosnell, the Philadelphia abortion doctor who on Monday was found guilty on three murder charges, agreed yesterday to waive all appeals rights in exchange for life in prison without the possibility of parole, said officials with the city district attorney’s office. He will not receive the death penalty. Gosnell was immediately sentenced for the deaths of babies known as “C” and “D.” He will be sentenced on the death of baby “A” at 9:30 a.m. today. A press conference will be held at 11:30 a.m. today. The gag order in place for Gosnell remains until after today’s sentencing, the DA’s office said. Gosnell was found guilty of murdering three babies in the now-shuttered Women’s Medical Society Clinic in West Philadelphia that serves low-income women looking for late-term abortions. METRO

Other charges Gosnell also was found guilty of involuntary manslaughter in the case of Karnamaya Mongar, 41, of Virginia, who died from a drug overdose after going to him for an abortion. •

He also was found guilty of performing 21 abortions after 24 weeks of pregnancy at his clinic, which served mostly low-income women in a largely black community.

Utleys going to bat for all of furry kind For the animals. Chase and Jen Utley continue working hard for pets that have been abused and neglected. Chase and Jen Utley are relatable. Sure, Chase is arguably the best second baseman in Phillies history — but it’s his and his wife’s work off the field that connects them with the city. Tonight, the Utleys will hold their six annual AllStar Animals Casino Night, an event that benefits the Pennsylvania SPCA, where Jen is a member. “If you’re someone who cares about animals, you see the problem never dies,” Jen said of animal abuse. And the Utleys do it because they love animals. “This stems from my life and Chase’s life as well,” Jen said. Naturally, the Phillies organization has played a huge role in it all. “Ever since day one,” Chase said, “we’ve had tremendous support from my teammates and my organi-

Utleys, SPCA pushing for cost of care legislation Both Buckley and the Utleys are working with legislators on a bill that would require abused animal owners to pay for their pets’ care during the animals’ stay at the SPCA while the owners are tied up in legal proceedings. Right now, the SPCA pays for vet care, food and shelter for 75 animals in protective custody. The legislation would call for $15 a day

for the animals’ care. “If that passes,” Buckley said, “and the owner says they won’t put up the money, then we are able to surrender the animals and put them up for adoption.” Jen Utley said there have been animals locked up in court cases for two years. “At some point, we’re draining all of our funds for these animals that should be our property,” she said. “Instead, these criminals who are not positive members of society are allowed to own these dogs and not pay for them.”

And it starts with educating city kids, they said. The Utleys visit schools and work on murals that depict kindness. The Utleys will start work with Vare Middle School students and muralist David Guinn on their third mural in Grays Ferry. Tonight’s event is also special to SPCA CEO Jerry Buckley. “This is the single biggest fundraiser,” Buckley said. “With Chase and Jen, it’s all very genuine. They do not stand on ceremony. Jen rolls up her sleeves. She’s here and she’s involved and it means a great deal to this organization.”

Father: School covered up fight caught on video Fear. The dad says Chester High School ignored an assault on his son that went viral online. Alphonzo Green said Chester High School officials tried to cover up the vicious attack on his 16-yearold son that was captured on a cell phone video. “They were going to cover up the story,” Green said, “and then it ended up going viral.” Green’s son was allegedly attacked in the school’s library May 7. The

Green said a gun was pulled on his son on school property days earlier, and his son was a victim of “Fight Week,” where freshmen or newer students are allegedly targeted. Green said his son will be home-schooled for the rest of the year.

Police bust prostitution ring at NJ senior citizens’ home A prostitution bust at an Englewood, N.J., senior home last month netted three arrests, among them a 75-year-old man, according to a report from The Record. Authorities said a recent rise in crime that had residents of the Vincente K. Tibbs Senior Citizen Building living in fear spurred 24/7 police patrols of the complex. Residents of the building, which is run by the Englewood Housing Authority and serves lowincome residents aged 62 and older, were increasingly complaining about drunk and drug-addled strangers wandering the halls and passing out in lounge areas and claimed they were finding used condoms in the recreation room. An undercover investigation allegedly revealed James Parham, 75, and his neighbor Cheryl Chaney, 66, were using cocaine and running a prostitution ring out of

US agency backs lower blood alcohol limit for drivers The top transportation safety agency voted yesterday to recommend a lower blood alcohol limit for drivers, advancing its campaign to cut down on drinking-related road deaths through a stricter definition of impairment. At a meeting in Washington, the National Transportation Safety Board called on state authorities to reduce the legal limit by nearly 40 percent to 0.05 percent. All 50 U.S. states now have a blood alcohol content limit of 0.08 percent for drivers aged 21 and over, and younger drivers are held to stricter standards. REUTERS

Russia expelled a U.S. diplomat yesterday after saying he had been caught redhanded with disguises, special equipment and wads of cash as he tried to recruit a Russian intelligence agent to work for the CIA. Russia’s Federal Security Service said Ryan Fogle, a third secretary at the U.S. Embassy in Moscow, had been detained overnight carrying “special technical equipment,” a disguise, a large sum of money and instructions for recruiting his target.

The Foreign Ministry summoned U.S. Ambassador Michael McFaul to discuss the case on Wednesday and released a statement demanding that Fogle leave Russia without delay. “Such provocative actions in the spirit of the Cold War will by no means promote the strengthening of mutual trust,” it said. Russian television showed grainy footage of a man identified as Fogle being arrested, and the staterun Russia Today channel published photographs on its website that it said showed Fogle being detained in a blond wig. In one photograph, a man lay face-down on the ground with his arms being pinned behind his back. Another image showed two wigs, as well as three pairs of glasses, a flashlight, a mobile phone and a compass. Also displayed was a wad of $650 and a letter addressed to a “dear friend.” REUTERS

The Atlantic City prosecutor’s office charged 33-year-old Anthony Senatore with six counts of endangering the welfare of a child and one disorderly persons charge for allowing minors access to a loaded firearm. The 4-year-old boy, whose name has not been released, accidentally shot his friend in the head on April 8 while playing with a .22-caliber rifle outside Senatore’s home in Toms River, New Jersey. Vermont is poised to become the third U.S. state to allow doctorassisted suicide, after its legislature passed a bill allowing physicians to prescribe lethal drugs to terminally ill patients. The bill passed late on Monday, and the governor has pledged to sign it into law. Vermont’s measure includes a number of safeguards. Both the patient’s primary physician and a consulting doctor must agree the patient is suffering from a terminal illness and is capable of making an informed decision to request deathinducing drugs. On the Cumberbatch Benedict Cumberbatch’s character is really creepy. How do you deal with bad guys like him in real life? You come across people like that on a Saturday night, drunk and in the mood for a fight. You can see that longing for violence. Have you ever picked up on it? I tend not to go out. But it’s a testament to Benedict’s acting in that he’s possibly one of the sweetest people. I did see him get carb rage once. He was working out for a shower scene that didn’t end up in the movie — a lot of girls will be disappointed — and he’d had no carbohydrates for two days. That’s as close as he gets to showing any kind of madness — carb rage.

It’s hard to think of a geek who’s had better luck than Simon Pegg. In his career, he’s impressed one of his favorite filmmakers, George A. Romero, with “Shaun of the Dead.” And he’s become Scotty, chief engineer aboard the starship Enterprise, in J.J. Abrams’ much-loved reboot of the “Star Trek” franchise whose sequel, “Star Trek Into Darkness,” comes out today. As a cherry on top, Abrams is about to tackle the “Star Wars” sequels, although Pegg isn’t harassing his boss for spoilers. There’s a new “Star Wars” film coming, obviously, from “Into Darkness” director J.J. Abrams. What’s your strategy to get J.J. to tell you something about it? I don’t need a strategy. If J.J. wants to tell you something, he will — and if he doesn’t, it’s because he wants to keep things close to his chest. So you didn’t get him drunk or anything? I respect him too much for that. I’m very happy to be kept in the dark because I haven’t seen a good “Star

However, the audacious title comes from O’Hara’s childhood. “It’s one of those little silly names that parents make up instead of saying the explicit names for your private parts. Angelina Jolie made headlines yesterday by announcing that she underwent a preventive double mastectomy after testing positive for a mutated BRCA1 gene, which indicates a strong predisposition to breast and ovarian cancer. In her New York Times Op-Ed piece, “My Medical Choice,” Jolie reveals that her doctor estimated she had an 87 percent risk of breast cancer and a 50 percent chance of ovarian cancer. “I decided to be proactive and to minimize the risk as much I could,” she writes. Now, post-mastectomy, her risk of breast cancer has dropped to below 5 percent. Jolie’s mother died of cancer in 2007 at age 56. BRCA1 and BRCA2 are two genes that, when mutated, have been linked to genetic breast and ovarian cancer, as well as other types of the disease. Both women and men are susceptible to the faulty genes. Patients can undergo a blood test to see if they have the mutated genes, and genetic counselors can help patients decide on the best course of treatment for them. That might be a prophylactic (preventive) mastectomy, taking drugs like tamoxifen or raloxifene — which are proven to lower breast cancer risk — or simply continuing cancer screenings. Indeed, the aggressive procedure Jolie had is not for everyone, says Dr. Fred Jacobs, chief medical officer of the eastern division of the American Cancer Society: “That decision needs to be made in conjunction with a very experienced medical oncologist and a

genetic counselor who can make sense of the data the woman has.” “If a woman has a family history which suggested that an evaluation for the BRCA mutation would be medically indicated, and they did it and she had [the mutated gene] — which increased the risk of them getting cancer to a very high number — then it’s a very personal thing,” he adds. “Do you want to live with that risk, or do you want to take aggressive action to reduce it, meaning a rather extensive surgical procedure? [Jolie] spent three months doing it. That requires a bit of a commitment for a disease you don’t have.” Dr. Jacobs also says that Jolie’s experience does not mean that everyone needs to be genetically tested. Only women with a strong family history of cancer should consider undergoing it, according to the U.S. Preventive Services Task Force, and that number is just 2 percent of the popu-

In the future, he adds, “[We] may be able to attack the gene and prevent it from expressing itself in a way that would result in a risk of cancer.” Until then, postprocedure follow-ups and recovery equal a total recuperation time of multiple months. Though Jolie greatly reduced her risk of developing cancer, Dr. Jacobs notes that her risk isn’t totally zero, as some breast tissue always remains post-mastectomy. Still, he’s quick to commend the actress and director on her decision. “She took the matter into her own hands and said, ‘I’m not gonna sit back and wait for this, I can’t live with that. Other women might be able to, [but] … I want to take charge of my life, and this is available to me.’ It’s a perfectly reasonable thing that she did for her.”

The Indians started lefty Scott Kazmir, the pitcher Utley homered off in Game 1 of the 2008 World Series, but starting Kevin Frandsen at second made sense. He’s hitting .405 with a .582 slugging percentage against lefthanders. It’s a small sample set for Frandsen (29 at-bats). Still, he needs to get out there. “I would like to play as much as possible,” Frandsen said. “Charlie said he’ll get me in when he can. But I knew what I signed on for when I came back with the Phillies for this season. You have to play Chase Utley at second base. He has to be there. We all know what kind of player he is.” And then there is Freddy Galvis. The young utility player is hitting .280 with five extra base hits in 50 at-bats. Manuel has made no secret how much he wants to get Galvis in the lineup. “It’s just not Chase,” Frandsen said. “Freddy is a good young player. Everybody needs to play. I want to get at-bats, but it’s more about the team. I just want to help us win. That’s the bottom line. I’ll do whatever I can for the team. That’s what it’s all about.”

No Phillie has played in more games than Chase Utley this season. The veteran second baseman, who missed massive portions of 2011 and 2012 with bad knees, has looked just fine in 2013. Utley, who had played in 39 games, leads the Phils in homers (seven) and and RBIs (24), while sporting a .289 average. Utley didn’t start last night against Cleveland. “I think it’ll be good for Ut,” Charlie Manuel said. “I’ll try to monitor him and keep him off his feet at times.” Must play Chase

The worst-kept secret, next to the true condition of Andrew Bynum’s creaky knees, was revealed late yesterday afternoon when the Sixers introduced Sam Hinkie. He’ll serve as the team’s president of basketball operations and general manager. The fact that eight front-row seats marked “Reserved” remained vacant was the first clue this wasn’t exactly breaking news. Of course, following a 34-38 season in which little went right, they should be used to empty seats by now. Once he picks Doug Collins’ replacement, Hinkie’s job will be to fill them — just the way his old team, the Houston Rockets, did after pulling off a deal to land All-Star

As to where Bynum, last year’s spectacular bust, may fit in the equation is anyone’s guess.

“Andrew is an unrestricted free agent, like hundreds of other young men,” said Hinkie. “I’m duty-bound to consider him.” Hinkie wouldn’t guess how long it may take to build a viable contender. “The most recent history in this league shows that superstar players matter,” he said. “Big moves may only come around every 10 years or so. The question is, how are you going to handle it to put yourself in the best position to make one?”
