Former bodega clerk indicted in Etan Patz murder

Pedro Hernandez indicted by grand jury yesterday Manhattan DA calls evidence against him ‘credible and persuasive’ Still, questions about his mental capabilites persist Body of boy has never been found GETTY IMAGES

Six months after a former bodega clerk admitted to the cold case murder of 6-year-old Etan Patz, he has been indicted — the closest prosecutors have come to a possible conviction in this 33-year-old mystery. A grand jury yesterday indicted Pedro Hernandez, 51, on two counts of murder in the second degree and one count of kidnapping in the first degree. He was first arrested by the NYPD in May, after a member of his family told police he was responsible for Patz’s murder. In custody, Hernandez told police he lured the boy into a SoHo basement on May 25, 1979, by offering him a soda. He confessed to strangling Patz and then wrapping his body in plastic wrap and putting it in the trash. Shortly after, Hernandez moved from his West Broadway apartment, eventually to Maple Shade, N.J., where he was living when arrested. Police said Hernandez told his family over the years he had “done a bad thing and killed a child in New York,” prompting one relative to turn him in.

“Nothing that occurs in the course of this trial will answer what actually happened to Etan Patz.”

His own attorneys have raised the question as to whether mental health issues led him to make a false confession, but the Manhattan district attorney’s office said Hernandez’s confession will stand. “This indictment is the outcome of a lengthy and deliberative process, involving months of factual investigation and legal analysis. We believe the evidence that Mr. Hernandez killed Etan Patz to be credible and persuasive, and that his statements are not the product of any mental illness,” Erin Duggan, a spokesperson for the Manhattan DA, said in a statement. CASSANDRA GARRISON

Potential prosecution problems Paul Callan, former deputy chief of homicide in the Brooklyn district attorney’s office, said it’s unusual for a suspect to be indicted five months after an arrest, and it could suggest some holes in the case. “It’s a real uphill battle to get a conviction in such an old case,” Callan said. “Witnesses’ memories fade, physical evidence doesn’t exist anymore.” In New York, a defendant

“The grand jury has found sufficient evidence to charge the defendant, and this is a case that we believe should be presented to a jury at trial.” ERIN DUGGAN cannot be convicted solely on a confession. Prosecutors must present corroborating evidence, which could prove challenging, Callan suggested, especially because Patz’s body was never found. “The defense will come in and say they don’t even know that Etan Patz was murdered, maybe he was kidnapped,” Callan said. One point the prosecution might argue, he predicted, is that Hernandez confessed the crime to multiple people over the years with consistent detail. METRO/CG

Bon Jovi’s daughter Ex-NY lawmaker Meng arrested on drug charges admits soliciting bribe NEW YORK. Jon Bon Jovi’s 19-

year-old daughter, Stephanie Rose Bongiovi, was reportedly arrested upstate early yesterday morning on misdemeanor charges of possession of a controlled substance, possession of marijuana and criminally using drug paraphernalia, following an alleged heroin overdose. Kirkland, N.Y., police were called to a Hamilton College dorm around 1:51 a.m. to assist medical personnel who was already present and attending to an unresponsive female. A search by a drug task force exposed a small amount of heroin, marijuana and drug paraphernalia. METRO/DT

NEW YORK. Former New York state lawmaker Jimmy Meng pleaded guilty to soliciting bribes yesterday in exchange for helping an associate avoid prison time. Meng, 69, a former state assemblyman, admitted in Brooklyn federal court that he asked for $80,000, packed in a fruit basket, to pay off prosecutors and help the associate obtain a lenient sentence for tax crimes. Rather than fulfill the promise, Meng planned “to keep the money,” he told U.S. District Judge Allyne R. Ross. “Your purpose here was to obtain for yourself the $80,000?” Ross asked during the brief

Meng’s daughter, Grace Meng, a state assemblywoman and Democrat from Queens, was elected earlier this month to the U.S. House of Representatives. Grace Meng said in a statement that she was “deeply saddened” by the case. His sentencing is scheduled for March 12. BLOOMBERG

LIPA utility head resigns in Sandy's chaotic aftermath

BRUCE BENNETT/GETTY IMAGES

A utility company head resigned this week, in what could be the beginning of a fallout from blackouts after Hurricane Sandy. LIPA Chief Operating Officer Mike Hervey resigned late Tuesday after harsh criticism from customers and politicians over the still-ongoing restoration of service from the superstorm two weeks ago. Hervey's resignation came on the same day that Gov. Andrew Cuomo launched an investigation by a special commission into the state's utilities and their response to Superstorm Sandy. He said the problems exposed by the storm would require a major overhaul of the power industry. More than two weeks after the storm struck the region, about 45,000 LIPA customers

The lawsuit accused the Bethpage, N.Y.-based company of instead offering rebates only to its “most favored” customers on a discretionary basis, and only after they requested them. Cablevision spokesman Charlie Schueler said the complaint “misstates the facts” and is without merit.

A bulldozer and boardwalk chunks in Rockaway.

Some New Yorkers are fighting to preserve the remnants of the Rockaway Boardwalk. The boardwalk, which was largely demolished during Hurricane Sandy, was constructed from a blend of tropical trees that can last three times as long as domestic species and are extremely resistant to insects. But New Yorkers Cathy McHale and Scott Francisco say the wood is being thrown out, without any effort to reuse it. "Repurposing is very appealing if the wood has enough life left in it," Francisco said. Francisco said that bulldozers have already broken a lot of the boards. “Our plan is to salvage enough to create a section of boardwalk that would be a memorial constructed from the original wood, Francisco said. “But it’s probably not going to be a huge section because so many of the boards are broken. This Sunday, McHale and Francisco plan on gathering a group of volunteers at the 91st Street community garden to begin recovering material.

Can it be saved? Whether the wood can be repurposed depends on how long it has been exposed to outdoor elements. Francisco noted that different sections of the boardwalk could be a wide range of different ages and species, but estimated that the small samples of just one

Former CIA Director David Petraeus and the top U.S. commander in Afghanistan, General John Allen, both recently intervened in a child custody battle on behalf of the twin sister of the Florida woman at the center of a scandal that has engulfed both men, court documents show. Petraeus and Allen wrote letters in September to the District of Columbia Superior Court in support of the twin sister, Natalie Khawam, as she sought to gain more visitation rights with her son, according to a review of the court file. The letters deepen the mystery of how two Tampa socialites developed close access to top military officials and raise questions about the specific nature of those relationships. It is unclear why Petraeus and Allen, two of the U.S. military’s biggest names, felt the need to formally interject in a nasty custody dispute of someone they characterized as a family friend. The court files also provide a glimpse into the connections Khawam had built with Washington elite, including U.S. Senator John Kerry of Massachusetts. Defense officials said earlier on Tuesday that Allen is under investigation for alleged inappropriate communication with Khawam’s sister, Jill Kelley. Kelley is a fixture in military circles in Tampa, where she was a volunteer social liaison at MacDill Air Force Base. REUTERS

Goldman names 70 to coveted partner status

GETTY IMAGES

Goldman Sachs Group Inc. named 70 employees to join its so-called partnership, the fewest in the firm’s 13 years as a public company, as sluggish revenue growth pressures expenses. The promotions to partner, which take place every two years, are down from 110 in 2010 and 94 in 2008. Partners, known as participating managing directors, typically receive a $900,000 salary, up from $600,000 two years ago, and a cut of a special bonus pool that’s awarded primarily in stock, according to a person with knowledge of the firm’s policies. Goldman Sachs, the fifthbiggest U.S. bank by assets, confers the status on a group of employees to continue a tradition from the firm’s 130 years as a private partnership, which ended with a 1999 public offering. The designation places an employee among an elite at a company whose alumni include two former U.S. Treasury secretaries and the president of the European Central Bank. Among the newly promoted are Jason H. Brauth, head of investment-grade credit trading; Gerald Ouderkirk III, who

Israel launches Gaza offensive, kills Hamas commanders

Abercrombie & Fitch shares soar after good results

Israel launched a major offensive against Palestinian militants in Gaza yesterday, killing the military commander of Hamas in an air strike and threatening an invasion of the enclave that the Islamist group vowed would “open the gates of hell.” Operation "Pillar of Defense" began with a surgical strike on a car carrying the commander of the military wing of Hamas, the Iranian-armed Islamist movement which controls Gaza. Within minutes of the death of Ahmed Al-Jaabari, big explosions were rocking Gaza, as the Israeli air force struck at selected targets just before sundown.

Teen clothing retailer Abercrombie & Fitch Co. stunned investors yesterday with unexpectedly improved thirdquarter results and a fullyear outlook that exceeded Wall Street forecasts, sending shares up as much as 30 percent. The company got a handle on excess inventories that had sparked a round of discounting that worried investors. It also had pockets of sales strength in places like Scandinavia and China that helped revenue exceed expectations. Even troubled markets like Spain were not as bad as expected. Abercrombie & Fitch was “being highly disciplined” with inventory management and was working to ensure sales growth

outpaced that of inventory, Chief Executive Mike Jeffries said on a call with analysts yesterday. The company ended the quarter with total inventory that was 21 percent lower than a year ago. Shares of the company, which hired Goldman Sachs Group Inc in September to help ward off pressure from investors, were up 28 percent at $40 in afternoon trading on the New York Stock Exchange. The stock has lost about a third of its value since hitting $57.56 a year ago. REUTERS

Congress urged to probe Chinese cyber espionage The U.S. Congress should conduct an in-depth assessment of Chinese cyber spying and consider imposing tougher penalties on companies that benefit from industrial espionage, a federal advisory group said yesterday. The recommendations by the bipartisan U.S.-China Economic and Security Review Commission reflect its stated concern that China has

become “the most threatening actor in cyberspace.” In its annual report to Congress, the commission said the most notable trend in Chinese cyber espionage over the past year had been “increasingly creative and resourceful targeting” across government, industry and civil society. Among these are steppedup efforts to defeat so-called two factor authentication, it said, referring to the use of a security token in addition to a traditional password. REUTERS

McAfee says he was framed for murder Belize's prime minister urged anti-virus software pioneer John McAfee to help the country's police with a murder inquiry, calling McAfee “bonkers” for recent media statements. “I don't want to be unkind, but he seems to be extremely paranoid — I would go so far as to say bonkers,” Prime Minister Dean Barrow said. McAfee claims he is being framed by Belize poice over the murder of neighbor and U.S. citizen Gregory Faull. REUTERS

Politics in the House

Israel launched a major offensive against Palestinian militants in Gaza yesterday, killing the military commander of Hamas in an air strike and threatening an invasion of the enclave that the Islamist group vowed would “open the gates of hell.” The onslaught shattered hopes that a truce mediated on Tuesday by Egypt could pull the two sides back from the brink of war after five days of escalating Palestinian rocket attacks and Israeli strikes at militant targets.

Nancy Pelosi told fellow Democrats in the House yesterday that she is willing to run to be their leader again. Seen as a crusading reformer by backers and a reckless liberal by Republican critics, Pelosi, 72, announced her decision later at a news conference at the U.S. Capitol. “I have made a decision to submit my name to my colleagues to serve once again,” she said. Democratic lawmakers said Pelosi, who became the first woman to lead a party in Congress, is a cinch to be reelected House minority leader.

Sens seek to block Rice’s promotion Senior Republican senators vowed yesterday to block any future promotion of Susan Rice, the U.S. ambassador to the United Nations, over her handling of the Sept. 11 attack on the U.S. mission in Benghazi, Libya. Rice has been mentioned as a possible successor to Secretary of State Hillary Clinton. Republican lawmakers, however, question Rice’s initial description of the violence as a spontaneous outburst rather than a planned attack. REUTERS

2 Metro+Rihanna How was RiRi’s first night on her 777-tour (seven countries, seven shows, seven days)? We were there in Mexico City last night — one of an exclusive group of reporters — and will have all of the details tomorrow.

THE WORD

Metro’s Dorothy Robinson shares her take on the world of gossip

Sexiest man alive (the nonmilitary version, anyway)

I

t’s the time of year that housewives and dentist office waiting rooms around the world pant for: People magazine naming its “sexiest man alive.” This year’s boldfaced and bare-chested winner? “Magic Mike” star Channing Tatum.

Elmo is off the hook The 23-year-old man who claimed he was only 16 when he had a sexual relationship with Elmo puppeteer Kevin Clash has recanted his claim, according to the Los Angeles Times. The unidentified

Not that Tatum himself necessarily believed it when he got the news, though: “My first thought was, ‘Y’all are messing with me,’” he says. “I told [wife] Jenna [Dewan-Tatum] after we’d been in the bathtub washing our dogs because they’d gotten skunked.” And as for the physique that helped land him the title, Tatum says it’s a work-related benefit. “When I’m not training, I get really round and soft,” he admits. Personally, I can’t believe former CIA Director David Petraeus and General John Allen didn’t make the cut. With their smooth moves, you’d think they’d be shoo-ins.

accuser “wants it to be known that his sexual relationship with Mr. Clash was an adult consensual relationship,” a statement from his attorney reads. Clash had taken a leave of absence from “Sesame Street” when the allegations made headlines earlier this week. “I am relieved that this painful allegation

Angry like the wolf ...

PETA gets angry at ‘Twilight’

has been put to rest,” Clash says in a statement. The same goes for Sesame Workshop, the company behind the children’s show. “We are pleased that this matter has been brought to a close. We are happy that Kevin can move on from this unfortunate episode,” the company’s statement reads.

The folks behind the “Twilight” series spared no expense for the final film’s premiere this week, going so far as to feature live wolves on display for guests at the after-party, according to Radar Online. “Outside the tent before you entered the party there was a really small cage with three wolves in it,” a source says. “The handlers were keeping people away and yelling at the wolves to pose for photos like stars on a red carpet.” And it comes as no surprise that PETA is not thrilled. “Didn’t it dawn on the ‘Twilight’ event organizers that real wolves do not belong at a party with blaring music and flashing lights?” a PETA spokeswoman says in a statement to the website.

Trump can’t stop the Twitter Offering his thoughts on the presidential election isn’t enough for Donald Trump, who’s using his Twitter account to weigh in on other weighty

matters. For instance, when it comes to “Twilight” co-stars Robert Pattinson and Kristen Stewart and their reconciliation, Trump apparently has little faith in Stewart. “After Friday’s ‘Twilight’ release, I hope Robert Pattinson will not be seen in public with Kristen,” Trump wrote. “She will cheat on him again!” The tweet immediately drew the ire of the “Twilight” fan base, so Trump next took his case directly to Pattinson, tweeting, “Robert, I’m getting a lot of heat for saying you should dump Kristen — but I’m right. If you saw the Miss Universe girls, you would reconsider.”

Pitt and Jolie’s pizza party Brad Pitt and Angelina Jolie know how to show their kids a good time when they visit Pitt’s parents in Springfield, Mo. It involves letting them run wild at local restaurant Arris’ Pizza, according to Us Weekly. “The place shuts down for the night and the kids raise a ruckus. They jump on tables and even throw food at each other,” a source says.

‘Vamps’ of a different color

Director Amy Heckerling discusses her blood-sucking rom-com and why it has nothing to do with ‘Twilight’

E

dward and Bella aren’t the only bloodsuckers in town. Veteran director Amy Heckerling, whose teen comedies “Fast Times at Ridgemont High” and “Clueless” have become modern classics, tried her hand at the vampire genre. But it was never her intention to jump on a bandwagon. “I mean, I wrote this before ‘Twilight’ came out and I didn’t read the books. … That was a whole other world I’m not a big fan of,” Heckerling explains. “I don’t know where they live — out in the northern West Coast kind of area — I’m a city person

and I wanted to feel what it would be like to just always stay young, to go to school, to have a part-time job, to have friends, to go out and do the things that I think would be fun to do endlessly.” And so we have “Vamps,” starring “Clueless” actress Alicia Silverstone and “Don’t Trust the B— in Apartment 23” star Krysten Ritter. The ladies play roommates who look for love in Manhattan while also trying to avoid the urge to suck the blood of their suitors. The rules for how a vampire lives, eats and sleeps are different for each and every story

told about them. But when creating her own vampire universe, Heckerling turned to the classics for inspiration. “What I liked was in Bram Stocker’s ‘Dracula’,” she says. “I feel like he laid out a nice history and set of rules. But then the Anne Rice situation of ‘Interview with the Vampire’ — the main character did not have to kill people. For me, I think people are sympathetic if you don’t kill people. It’s just a quirk of mine. I went with [the idea] that they needed warm running blood from a mammal. These girls were trying to be nice and do as little harm as

ike many people, I went into “Twilightâ€? expecting to hate it and came out of it addicted. Watching the series has been bittersweet, because as mentally stable adults we’re just not capable of loving that desperately. If Bella had met Edward in her 20s, there’s no way she would have been willing to risk everything and turn herself into a vampire so she could be with him. With more experience, she would have rationally concluded their lives were on different trajectories and opted to move on. After living through the breakup of your first love, your entire perspective changes. It’s not the ending of the relationship that jades you as much as the realization that you can get over it. You thought the world was going to end ‌ but it didn’t. And with this knowledge, love becomes a choice instead of a compulsion — because if you fall in love with someone who’s bad for you, you know that walking away is actually an option. As an adult you have something else going for you too: a sense of purpose. At this point you’ve worked hard for your career, done crazy things for it —

ust like how “Fifty Shades of Grey allows women everywhere to fantasize about S&M sexcapades they probably wouldn’t enjoy in real life, “Twilight has let us fantasize about a love that’s probably too irrational for this stage in our development. When we love now, we know the person we care for so deeply doesn’t actually have the wisdom of two lifetimes, run at the speed of light and have skin that sparkles in the sun. As amazing as he seems to us, he is merely human. Knowing this allows our love to have boundaries — which, for our sanity and safety, is a good thing. — Amber Madison is a Manhattan-based relationship expert and dating coach. HOW CHEESY MUSIC =

GREAT SEX The science of songs: As new research reveals the importance of music in our love lives, we look at how the songs we listen to can make the good things in life even more pleasurable

I

t appears that when it comes to romance, music can be used as form of brainwashing. The songs you choose are just a subtle way to suggest and initiate sex. Music psychologist Dr. Daniel Müllensiefen, from Goldsmiths, University of London, discovered that music was a key element of the seduction game and consequently, how successful you are in the bedroom. The playlist you listen to in the moments leading to and during sex is crucial. Forty percent of people admitted that the music they listened to dur-

ing sex was more arousing than the touch or feel of their partner.

Time of your life Although both sexes favored songs that were happy and tender, men tend to make more of an effort to adjust to the taste of their date in order to ensure success in the bedroom. This could explain why the soundtrack from the iconic ’80s romantic movie “Dirty Dancing” was voted as best for sex. It’s not just the music that’s important, but what we associate

with the songs. Dr. Müllensiefen observed: “Music activates emotional pleasure centers in the brain — the same areas that are activated when we have sex or take drugs. If you have a soundtrack to a film that as a whole is associated with romance and sex, that might work for the entire sexual episode. Listening to the soundtrack re-ignites the feelings we experienced whilst watching the film.”

anger and talking about someone’s Kool-Aid or who “hates,” let’s look at the historical record and how we can do better. The middle class has stagnated. Our jobs have been shipped abroad. Most income growth as gone to the top. In 2012, Wall Street supported the GOP, not the Dems. Ten right-wing billionaires and the corporations they control support the GOP for every billionaire supporting Dems. You wanted it — now you’ve got to keep the agreement You people realize that President Obama is not really proposing a tax increase on people with an income of over $250,000 — right? What President Obama is proposing is a tax cut for the middle class. This so-called tax increase that the Republicans have gotten their minions up in arms about is a tax cut that G.W. Bush signed that was supposed to last only 10 years. After the 10 years, it was suppose to go away. EVERYONE AGREED TO THIS. But now the upper 5 percent is demanding that

they get to keep it forever. The health of the country be damned — because as we have learned (the hard way) during Reagan’s and Bush’s administrations “trickle down” economy DOES NOT WORK. In both cases it lead to a recession. So people — step back, take a deep breath and stick to what you agreed to. BARBARA MILUSKI, VIA E-MAIL

Tips for your tea If you’re more the type who chooses an Earl Grey over a latte, check out these tips from Tetley — now celebrating its 175th anniversary — on how to properly enjoy your tea. Black tea and blackbased tea blends are typically the only ones served with milk. Rather than stirring tea, the correct way to incorporate milk is to place the teaspoon in the 6 o’clock position in the cup and gently fold the milk from 6 o’clock to 12 o’clock. Never leave the spoon in the mug or in an iced tea glass;

remove it and set it on a plate or napkin Milk, rather than cream, is preferred, so as not to overpower the flavor of the tea. Though some add the milk before the tea, adding it after the tea is poured ensures that the right amount is added. Sugar should be added after milk; one to two teaspoons is the standard amount. Though a practice of many, it is not the correct etiquette to wrap the string of the tea bag around the spoon and squeeze. The bag should be removed and set aside. Though most tea today is drank from mugs, if you’re using a traditional tea cup, you should never loop your finger through the handle. Instead, grasp it with your thumb and first two fingers. Tim Tebow stayed above the fray yesterday following a Daily News story in which an unnamed teammate called him “terribleâ€? and another implied he was an “athleteâ€? and not a quarterback. “Some frustration, some sadness. It is never fun to hear criticism, but at the same time it is something that I’ve always used as motivation and you try to get stronger from it. That’s how I approach it,â€? Tebow said. “I always find the good and positive in every situation, and the positive in this is to work a little harder, improve and build better relationships with your teammates.â€? For head coach Rex Ryan, the bigger issue was not the comments themselves but the anonymous nature of the quotes, even calling them “cowardlyâ€? at one point. “If you’re going to make a negative comment, that’s fine,â€? Ryan said. “We don’t say it always has to be a bed of roses. Again, put your name to it and all that. I think people will respect you a lot more.â€?

Knicks face first tests on road trip The Knicks are the only remaining unbeaten team, but other than beating the defending-champion Heat in the season opener, they’ve feasted on also-rans. If they want to flex their muscles and show they’re elite, they need to beat the next two road opponents — the Spurs (71) and the Grizzlies (5-1).

ON TV TONIGHT Knicks at Spurs 8:30 p.m., MSG

Put bluntly, New York still has a ways to go before the naysayers believe the hype. Knicks’ forward Steve Novak admitted as much, saying that while the fast start is great

they haven’t done anything truly of note yet. “We just don’t put too much stock into it,’’ Novak said. “We know we’re the only undefeated team and we hear all that, but it’s just so early, and we all know what a long year it is. Head coach Mike Woodson acknowledged his squad needs to do the little things to beat

contenders like the Spurs. “Road wins are tough to get, so you have to be really locked in and focused as a unit. You can’t turn it over offensively and you have to play at a high level defensively, said Woodson. “All those things have to happen for us to be successful for us to win on the road.
