International Cuisine BRINGING YOUR FOOD HOME FOR YOUR CUSTOMERS Getting it out the door made easy Imagine having a fleet of food delivery drivers at the ready, but only paying for when you actually use them. No worries about no-shows or lost drivers. No concerns about too many orders and not enough people to get them out the door in a timely manner. Since 1995, International Cuisine has become New Jersey’s premier restaurant delivery service by offering that very convenience for our clients, completing over 10 million deliveries in the process. We provide locally based drivers, trained to be professional and courteous to both you and your customers. Each driver is equipped with a GPS device and a commercial-grade insulated delivery bag to guarantee your food gets where it’s going as quickly as possible at the temperature at which you want it served. Simply call International Cuisine and we dispatch a driver to your location (or multiple drivers as volume of orders warrants). Hand the driver your properly packed food together with the delivery information. The driver places your food in an insulated bag, plugs the delivery information into a GPS and heads to your customer(s) by the most efficient route possible. The driver then returns to you with signed credit card slips and/or cash payments. In terms of costs, there is a nominal delivery fee (currently $3.00 per order) which you bill directly to your customer, plus a percentage of each delivery sale based on the food subtotal (exclusive of tax & tips).

A partner for your success We are partnered with you for our mutual success – we only make money when you do, so it is in our best interest to help increase your sales. To this end we promote your business on our website and through targeted direct mailings. Our drivers will also distribute your menus in the neighborhood while between delivery calls. Typically our clients start to see a benefit from the increased exposure within six weeks of signing with International Cuisine as we immediately begin online and direct mail promotions, as well as menu distribution. Our ongoing marketing efforts are made at absolutely no cost to you!

International Cuisine WORKING TOGETHER Order and Packing Guidelines At International Cuisine, we treat your food like the time sensitive, fragile product it is. Repeat customers are as important to us as they are to you. To ensure the optimal delivery dining experience for your customers, we recommend the following procedures: FOR ORDER TAKERS: • At the start of the call let the customers know that there is a nominal delivery fee (exclusive of any tip) so they aren’t surprised later • Repeat back the order before giving a total – this not only confirms that the order is correct, but gives the customer the opportunity to add items to the order • Ask if the customer needs plastic-ware, and how many sets if so • Give the customer a realistic time for delivery; for example, if the kitchen is backed up or if there is heavy weather, let them know that additional time may be needed • Make sure that all delivery information is clearly marked down for the driver ƒ Name; Phone; Address; Apartment, floor and/or buzzer number; City; Zip code FOR ORDER PACKERS: • Pack one order at a time and pull all items for each order aside to avoid confusion; double check the items against the order ticket so nothing is forgotten • Place heaviest items in the bottom of the bag • Put an extra bag around anything that could potentially leak and pack cold items separate from hot • Label each bag of an order, including the number of bags in the order (ex. Bag 2 of 4) • Seal each bag securely – staple, tie or tape – to avoid tampering, accidental loss of product and/or addition of foreign substances • Tell the driver which bags are hot and cold or need special handling

Delivery Driver Responsibilities Each driver for International Cuisine is responsible to: • Treat your premises, personnel, product and patrons with courtesy and respect • Deliver your food by the most expedient route and/or in the order you specify • Return to you with credit card receipts and/or cash payments as quickly as practicable

THE FINE PRINT While International Cuisine makes every attempt to deliver your food in a timely manner, there are sometimes uncontrollable circumstances which may inhibit our ability to execute our duties to our accustomed performance standard. These may include, but are not limited to: ƒ Inclement/extreme weather such as heavy rain, hail or blizzards ƒ Road closures due to construction or accidents ƒ Parades or special events which necessitate detours or block off certain areas entirely Should any of the above situations obtain, we will notify you as soon as possible so you may manage your customers’ expectations. International Cuisine adheres to a Drivers’ Safety First policy. In situations where we feel our drivers’ safety is at stake (storms, flooding, etc) International Cuisine reserves the right to halt operations until such time as we feel the hazards have passed. International Cuisine will be responsible for the cost of any food not delivered due to our/our drivers’ fault (ex. food dropped by driver). International Cuisine will not be responsible for the cost of food not delivered through no fault of our own (ex. customer on an unplowed or otherwise impassable street; wrong delivery address given to the driver). Any incomplete deliveries requiring a driver to return for additional food for an address and/or resent deliveries required due to errors on the restaurant’s part shall be the sole responsibility of the restaurant. In such circumstance(s) the restaurant shall pay any additional delivery fee(s) as necessary. We cannot guarantee the inclusion of time sensitive promotions in our full marketing program unless information and materials are given to us with adequate lead time. Please keep International Cuisine updated as to changes in menu so we may promote what you are doing, not what you have done. Also, please be sure to provide our drivers with up-to-date versions of your take-out/delivery menus so they may distribute them as appropriate. Service Description: International Cuisine/IC-Delivered.com [ICD] will provide food delivery services for The Restaurant, at the location(s) listed above, beginning on the Service Start Date listed above, through and ending on the Service End Date listed above. The Restaurant agrees that it will use ICD exclusively for its entire take-out service deliveries.

ICD’s hours of operation (subject to change) are: Sunday: Noon to 10 PM ; Monday through Wednesday: 11 AM to 10 PM; Thursday & Friday: 11 AM to 11 PM; Saturday: Noon to 11 PM ICD will accept the last call for a delivery 15 minutes prior to the end of operating hours for that day (ex. 9:45 PM Wednesday). ICD operates seven days a week with the following exceptions for holidays (subject to change): - New Year’s Eve & Day; Easter Sunday; Thanksgiving Day; Christmas Eve & Day

ICD adheres to a Drivers’ Safety First policy. ICD will be responsible for the cost of any food not delivered due to our/our drivers’ fault (ex. food dropped by driver, etc).

ICD will not be responsible for the cost of food not delivered through no fault of our or our drivers’ own (ex. customer on an unplowed or otherwise impassable street; wrong delivery address given to the driver; customer not answering phone or door, etc).

Any incomplete deliveries requiring a driver to return for additional food for an address and/or re-sent deliveries required due to errors on The Restaurant’s part shall be the sole responsibility of The Restaurant. In such circumstance(s) The Restaurant shall pay any additional delivery fee(s) as necessary.

Service cost: The Restaurant will collect a $3.00 service charge from its customers per each order, payable to the delivery driver(s) for each order. The Restaurant will also pay the driver(s) any tips placed on a credit card for each order, assuming such tips are added by its customer(s). In addition, The Restaurant will pay ICD a service charge of ____________% of the dollar amount per order. The amount owed is based on the food/drink/product subtotal and is exclusive of tax and tip. Catering deliveries may include additional tolls, fees and mileage to be added to the standard delivery fee.

Notes:

All drivers are employees of ICD and are ICD’s responsibility. They are to adhere to ICD’s Code of Conduct in all matters, including dress code and interaction with The Restaurant’s staff & customers. Any infractions will result in disciplinary action by ICD.

The Restaurant is responsible for packing & labeling all orders for the driver(s). Drivers are not to handle any order until such time as The Restaurant’s staff tells them to take the order. It is The Restaurant’s staff’s responsibility to ensure that all orders are correct, complete, properly packed and labeled.

In addition to our delivery services, ICD will also provide ongoing promotion/marketing efforts to help increase delivery business for The Restaurant. Such efforts include but are not limited to direct mailing, posting The Restaurant’s menu on the ICD website and having drivers distribute The Restaurant’s delivery/take-out menu in the local area. All marketing efforts are complimentary.
