ENROLLMENT CONTRACT Marymount of Santa Barbara, Inc. The completion of this contract by both Marymount of Santa Barbara, Inc. (known as Marymount) and the parents or guardian of the student identified in the signature blank of this contract (known as student) confirms the enrollment of the student for the academic year 2013-2014. PAYMENTS The $2,000 enrollment deposit (per child) and a signed copy of this contract are due February 6, 2013. This deposit is NON-REFUNDABLE, and will be credited toward the total tuition due for the 2013-2014 academic year. Tuition and fees are shown on the enclosed schedule. These funds will be paid in accordance with the option selected below. Upon signing this enrollment contract, the parents become liable for the entire contract amount. In signing this contract, parents acknowledge their obligation to pay the fees for the full academic year is unconditional and that after July 1, 2013 no portion of tuition and fees paid or outstanding will be refunded or canceled in the event of absence, withdrawal, or dismissal of the student from the School. CANCELLATION AND LIQUIDATED DAMAGES Enrollment may be canceled in writing, without penalty (except forfeit of the enrollment deposit) prior to July 1, 2013. If enrollment is canceled after July 1, except as otherwise provided herein, parents or guardians financially responsible for students are obligated to pay the full annual charge. Parents agree that the payment of the full amount of such charges is a reasonable estimate of the amount of damages which the School will suffer should such circumstances occur. TUITION REFUND INSURANCE PLAN In view of this obligation, parents understand that participation in the Tuition Refund Insurance Plan is required unless the full year’s fees are paid by June 15, 2013 (Payment Option 1) in which case the Plan is elective. A brochure describing the details of this plan is included with this mailing. The Plan will insure tuition (prepaid and due) in the event of separation of the student from the school, according to the terms of the Policy. Parents understand that the Tuition Refund Plan becomes effective on August 1 in the event of the student’s inability to attend school due to a covered medical reason. Coverage for non-medical departures (voluntary withdrawals and dismissals) does not become effective until the student has attended fourteen consecutive calendar days commencing with the student’s first day of attendance in the academic year. Additionally, parents authorize Marymount to collect any claim payment to which they are entitled under the Tuition Refund Plan and credit it to their account, paying any excess to parents. Parents agree to pay Marymount whatever balance remains unpaid after any payment by the Plan is credited to their account within 30 days after receipt of a final, itemized bill. DELINQUENT ACCOUNTS Delinquent accounts present a serious financial problem for Marymount. If payment is not received by the 10th of the month, Smart Tuition will assess a $35 follow up fee. Any account that remains delinquent may be assessed additional fees and may affect the student’s ability to attend school.
RE-ENROLLMENT All previous charges to the student’s account must be settled before re-enrollment will be accepted. For continuing students, an offer of enrollment is contingent upon the student’s satisfactory completion of the prior school year. PARENT RESPONSIBILITY Married parents are jointly and severally liable for all amounts owing Marymount under this agreement even in the event of dissolution of marriage. PROMOTIONAL PHOTOS Parents authorize Marymount to use their child’s photo, image, or likeness for any school related purpose, including school publications and print advertisements in publications such as the Santa Barbara New-Press. LEGAL ACTION Marymount reserves the right to take appropriate legal action to enforce the terms of this agreement. The prevailing party shall recover its costs and attorney’s fees in such action. It is agreed that the only proper venue for any litigation arising out of this agreement or the attendance of a student and Marymount shall be in Santa Barbara, California. GUIDELINES FOR STUDENT BEHAVIOR Students may be separated from the School if their behavior or academic work does not meet the School’s standards. Parents agree that it shall be the student’s responsibility to abide by all school rules, including those described in the “Guidelines for Student Behavior,” which apply to all students and are made a part of this contract by this reference. Parents have reviewed the Guidelines and agree to support them. Parents acknowledge that (a) from time to time the Guidelines may be amended, (b) other school rules will be promulgated in assemblies and other communications, (c) those amended rules will be applicable to all students, (d) the student is obliged to demonstrate conduct which is ethical, considerate, and respectful, and (e) failure to abide by school rules may result in probation, suspension, dismissal or other action at Marymount’s discretion. EXPULSION FOR IMPROPER BEHAVIOR BY THE FAMILY Marymount believes that a positive and constructive working relationship between the School and the student’s parents or guardian is essential to the fulfillment of the School’s mission. Therefore, the School reserves the right to require a student to withdraw from Marymount, or not to re-enroll the student, if the School determines that the actions of the parents make such a positive and constructive relationship impossible, or seriously interfere with the School’s accomplishment of its educational purpose. The decision of Marymount in making these determinations shall be final. INTEGRATED CONTRACT This contract is an integrated contract and supersedes any oral understanding. RELEASE Parents voluntarily release, discharge, waive, and relinquish all claims or actions that parents or their child(ren) may have against Marymount, its officers, agents and employees, for bodily injury, emotional distress, property damage, and/or wrongful death, arising out of any Marymount activity, including, but not limited to, those claims or actions arising out of any negligence on the part of Marymount, except those claims due to fraud and willful injury by Marymount. This release shall extend to any and all Marymount activities, including athletic
and recreational activities and field trips. Parents agree to indemnify and hold harmless Marymount, its agents or employees, for any injuries or damages arising from such activities. Please select the appropriate Payment Option below (check box).

Six payments: Tuition and fees, less Enrollment Deposit, are paid in 6 equal monthly payments through Smart Tuition. The first payment is due by August 1, 2013 and the last payment is due by January 1, 2014. Tuition Refund Insurance is mandatory as is the Annual Smart Tuition Family fee of $45.
Ten payments: Tuition and fees, less Enrollment Deposit, are paid in 10 equal monthly payments through Smart Tuition. Once your signed agreement and deposit are received, the Business Office will generate a document detailing tuition and fees for the 2013-2014 for your family.

Tuition Refund Insurance Tuition Refund Insurance is mandatory for payment plan Option 2, Option 3, and Option 4. Tuition Refund Insurance is not required for Option 1, but is highly recommended to protect the parent’s tuition investment. Please note that a child must attend school for 14 consecutive calendar days before the Tuition Refund Insurance policy will take effect. Enrollment Deposit The Enrollment Deposit is a non-refundable $2,000 payment, which is applied toward tuition. Deposits received after the registration deadline will be accepted only if space is available in the class. Your child may not be able to enroll for the fall if the Enrollment Deposit is not received by Wednesday, February 6, 2013. Tuition Payment Plans Tuition and fees for the academic year will be billed in accordance with the terms of one of the tuition payment selected on your contract.
