14.00 – 15.30 Chemical understanding for better manufacturing processes | Dr Will Watson, Scientific Update This presentation will discuss the importance of understanding the underlying chemistry for a process and consider how this strategy can be used for designing processes and process work-up for product isolation as well as aiding process reviews and problem solving. A number of short case studies will be included where mechanistic understanding helped in the identification and control of process impurities and where chemical understanding has been applied to the design of a work-up. The relationship between plant cycle time and efficient work-up will be discussed.

THE CHEMSPEC AGROCHEMICAL OUTLOOK CONFERENCE The Agrochemical Outlook Conference will offer a review of the global and European agrochemical markets from 2015. European fine chemicals holding strong Andrew Warmington, Editor, Speciality Chemicals Magazine When Chemspec Europe takes place in Basel on 1 – 2 June this year, the two best represented industries, as ever, will be pharmaceuticals and agrochemicals. Pharma and agro are like the yin and the yang: radically different in scale, yet always locked together by similarities in chemistry and development, marching out of step but with just enough in common that they cannot be entirely separated.

Because of all this, there was once a time when the concept of ‘the Life Sciences’ had considerable currency, also extending to the animal health sector. That idea is long gone and now the major integrated players have almost all exited from one or the other. Is there now scope for a modest revival of the concept? At the start of the 2000s, the contrast between the two industries was stark. Pharma was looking towards years of double-digit growth, fuelled by a booming pipeline, while the very future of chemical crop protection looked in serious doubt. Fast forward to about 2008 and, while pharma remains a massively bigger market, innovation had dried up, the FDA had become increasingly stringent about handing out approvals and R&D costs spiralled, even as a self-made ‘patent cliff’ loomed. All this was a disaster for the diversified chemical companies who had bought so much of the fine chemical industry, only to find that it does not really fit the Wall Street culture of quarterly returns and constant churning of people and assets. Those privately owned, focused firms who had ‘stuck to their knitting’ saw out the storm in much better shape. Even so, times were hard for a while.

Change of fortune Adding to the ‘perfect storm’ scenario, Big Pharma went off East on a massive scale, seeking cheaper suppliers in India and China. There was serious talk of the medium-term death of the European and US fine chemicals industries. Pharma’s nadir was reached in the late 2000s, just as the number of newly FDA-approved NCEs and NBEs reached a trough of barely 20 every year. Meanwhile, agro was enjoying a modest revival. Chemical crop protection, it emerged, was still vital to feeding a population growing in both numbers and wealth. Innovators in agro, moreover, had long since made a living from managing their products post-patent expiry, which Big Pharma virtually never did.

Fast forward to 2015 and there are indications that things are changing again. Suppliers to the agrochemical sector have endured some less prosperous years, while pharma has at least adjusted to the patent cliff and is finding more in its pipeline. The outlook seems more optimistic for fine chemical and API companies. Will this last? To address that question we need to look in more depth at what is happening in the market.

Between them, they account for the vast majority of fine chemical consumption. In both, products take years to pass through a development pipeline, with multiple stages of trials ahead of approval, with ever increasing costs due to ever more stringent regulations. Similar chemistries are often involved and the growing complexity of agrochemical actives has made many of the chemistry skills involved basically similar.

According to a recent report by Transparency Market Research, the world market for APIs was worth $119.4 billion in 2014 and is predicted to reach $185.9 billion in 2019. Although the market has suffered over the past few years due to patent expiries, Transparency says, demand for low-cost substitutes has led to an increase in demand for API manufacturing. The most marked trend within the pharma manufacturing sector is away from in-house manufacturing and towards outsourced manufacturing by CMOs. Consultant Dr Enrico Polastro states that the share of the merchant market in total API demand has increased from 45% in 1995 to 54% in 2014, with much of the increase coming since 2010. This doubtless reflects the recovery of the US market, which has most readily accepted outsourcing. Even so, the fact that some 70% of production in China and India is still captive is an indication of how much is still out there to be captured.

Come together One thing many CMOs point to as a driving factor is consolidation in the customer base. According to consultancy PharmaVentures, who have advised on many transactions, the aggregate value of deals was 63% up on 2014 at around $140 billion and double where it was in 2012 and 2013. 2016 should also see a new record. The CMO market is also growing faster – at 6.4%/year – than the pharma market as a whole (4.8%/year), according to IMS Health. This reflects Big Pharma’s pursuit of operational efficiencies to counteract the effects of patent expiries. One aspect of this is the desire to reduce complexity in the supplier base in order to speed products to market.

Back to the West The fine chemical and API sector remains extremely fragmented, with several thousand players and very few having sales of over $1 billion/year. Strict free market logic says that this industry must consolidate, yet it stubbornly refuses to read the script. On the contrary, the big players who once looked best place to lead such a consolidation have to varying degrees exited. The numbers active in China and India have, indeed, fallen, in India’s case from above 4,000 to more like 2,200, while the Chinese government is seeking to reduce many small, disparate companies to a few world-scale competitors. Nonetheless this is and will remain a fragmented industry. In the past year, several other factors have also strengthened the hands of Western CMOs. Many Big Pharma companies have brought back intermediate and API sourcing from India and China in search of reliable supply and/or because of regulatory setbacks, not least those brought about by more even enforcement of regulations and more FDA inspections abroad. The strong US dollar has also given European CMOs an unexpected recent fillip. The pharma industry as a whole is also becoming more productive, if only by buying the biotechs who are doing the real innovation. 2015 saw the highest number of FDA approvals, at 45, since 1996. They are also coming through faster. Since 2013, the average length of time taken for a drug to go from Investigational New Drug Application to approval fell from 7.3 years to 5.2, according to the Tufts Centre for the Study of Drug Development. This owed much to the accelerated launches made possible since 2012 when the FDA introduced ‘breakthrough therapy designation’. Of the new 45, 60% had some form of expedited review, while 56%, a higher proportion than for some time, were approved at the first time of asking. Meanwhile, the flow of NCEs at all stages of the pipeline has doubled from about 3,000 to 6,000 between 2005 and 2015. Whilst many challenges loom, for now at least, European suppliers of intermediates and APIs are almost all buoyant about the level of business. This observation applies pretty much equally at all stages of development.

The outsourcing process itself makes Big Pharma sites redundant and available at knock-down prices to any CMO who can make them work beyond the end of any lock-in contracts with the original owner. Some of the big players in the sector built themselves this way, while even those who once stood by the single-site concept have spread their wings. Whether this trend continues is one of the big open questions. Some analysts believe that it has already blown itself out, while clearly, in the longer term, an industry that has substantially shorn itself of manufacturing assets, will not have so many to dispose of. Others, however, think that the same logic will apply in solid dosage forms as well as APIs and that this will favour the increasingly fashionable ‘CDMO’ concept. Certainly, many examples exist of companies building up capabilities through acquisition, investments or both to deepen and broaden their offer. A true CDMO would have development and manufacturing capabilities for intermediates and APIs at every phase of clinical development and then commercialisation, as well as formulation. It would look, in other words, a bit like a Big Pharma company used to…! Where will this all lead? Some see tougher times ahead for smaller CMOs, who are already on average less profitable than the larger ones; some even describe CMO services as commodities by comparison with CROs, who can build more value-added strategic relationships with sponsors and, in some cases, stay with them all the way through the drug development process. A recent report by Frost & Sullivan argues that up to 30% of CMOs will leave the market in the coming years, in many cases because they lack either the scale or the flexibility to compete. Almost all recent analysts agree that, as drug development gets more costly and complicated, some form of consolidation will continue to enable suppliers to add ever more strings to their bows by offering a wider range of services.

Agro: taking a dip Phillips McDougall, put the market for crop and non-crop pesticides at $60.7 billion in 2013. At the time, after a year of exceptionally strong growth, Phillips McDougall forecast that the market would grow by in volume by 6.1%/year from 2014 to 2020 to reach 3.1 million tonnes and by 6.9%/year in value to reach $75.9 billion. Continued strong growth in the largest sub-category, herbicides, was projected to be the main driver.

this on European suppliers of intermediates and actives will not be positive, even though many still have strong customer bases elsewhere. One key way in which agro differs from pharma is the much smaller customer base. According to Phillips McDougall, the number of companies engaged in new active ingredient research fell from 35 in 1995 to 18 by 2012. Of these, 11 are relatively small companies in Japan and five account for the vast majority of new development. In recent months, there have been indications that this number may soon consolidate further. The news that two of the world’s largest chemical companies, who are also active in this fields, plan to merge has set off a chain of rumours about the others – and this is an industry with only six originator companies in the first place.

Agrochemical demand remains highly susceptible to unpredictable factors like the weather – or as one industry insider noted recently: “We’re only ever one drought away from another boom”. Similarly, the Zika virus is causing a surge in demand for insect repellents, according to Saltigo, which supplies a key active ingredient for one. Wet conditions, conversely, reduce pressure from insects and send demand for insecticides down rapidly. There has also been a clear long-term decline in the number of new agrochemical active introductions. From a peak of 70 in 2000, this is now under 30/year. Meanwhile, between 1995 and 2008, the average cost of bringing a new active ingredient to the market increased from $152 million to $256 million, due entirely to the ‘D’ element of R&D as more chemistry, toxicology, field trials, environmental chemistry and registration effort were all required. This figure is chicken feed in the world of pharma, but is a huge amount in agro. Even more than in pharma, therefore, the mantra is ‘fail early’. It is now actually rare for a product entering development not ultimately to move to market introduction, because companies will only invest at this stage if they have reasonable certainty of success.

The fundamentals, most agree, are still positive. In the 21st century, the world will have to grow more crops to feed people than in the whole of previous history, even assuming that the population peaks at 9 billion then tails off. This will have to be done on no more and probably less arable land than at present, while the land may also have to supply other needs, like fuels and materials. This simply cannot be done without chemical crop protection. Moreover, those who develop pesticides, just like those who develop drugs, will need more and smarter assistance from their supplier network than ever before, as they develop ever more structurally complex molecules, using ever more sophisticated technologies and jumping through ever more complex and stringent regulatory hoops.

Since then, the market has taken a dip, driven by a number of converging factors: economic weakness in the largest single market, Brazil, exchange rates, falling crop prices and so forth. This has directly impacted suppliers of chemistry services to the industry.

It all sounds like a perfect storm, yet the supplier base for the agrochemical industry – and indeed that for the pharmaceutical industry, which it still overlaps – is remarkably resilient and has weathered such storms before. Two-year downturns are seen as an occupational hazard. Those companies who exhibited at Chemspec Europe 2015 in Cologne and at other events since remain upbeat.

For all these reasons, the European fine chemicals business is here to stay. And Chemspec Europe is the number one venue where it comes together to do business.

Since 2009, expenditure on agrochemical R&D, although still increasing, has been eclipsed by that on seeds and traits. This reflects adoption of GM technology in the Americas and, probably in future, Asia. Europe is still holding out against GM, which is drawing R&D expenditure on agrochemicals developed for tolerance to GM away to other regions.

Shrinking base? The number of product introductions from Europe fell from 41 in 1990-99 to 12 in 2005-14, while its relative share fell from 31.3% to 16.4%. The hazard-based restrictions in EU Regulation 1107/2009 are also deterrents to R&D in Europe. The long-term impact of all

Several incoming and recent developments in 2016 will likely have a sizeable impact on the regulatory climate REACH, BPR and CLP already impose on businesses. This article will briefly consider some of the most significant modifications regarding implementing regulations, deadlines, software updates, Adaptation to Technical and scientific Progress (ATP) and the ongoing additions to the respective regulations.

REACH – Additions Amongst the changes around REACH are the usual prospective updates to the List of Restrictions, the Authorisation List and the Candidate List for Substances of Very High Concern (SVHCs). The latter of which recently underwent an addition of five substances to bring the total to 168, as at December 2015. The New Year brought with it new provisions in accordance with REACH; the Implementing Act on Joint Submission of Data and Data-sharing was published in the Official Journal on 6 January 2016, entering into force on 26 January 2016.1 This act lays down provisions on data sharing for REACH registration purposes and are built on the principles of fairness, non-discrimination and transparency under the REACH. In light of the Implementing Act, ECHA is planning to update its guidance on data sharing in due course. It is intended the act will be of benefit to all registrants but with a focus on SMEs in view of the 31 May 2018 registration deadline. Many more registrations are anticipated in the lead up to the 2018 deadline than the combined total of both the previous registration deadlines. It is anticipated that a high proportion of registrations will be made by SMEs, sometimes with little or no experience in registration and finding themselves in small Substance Information Exchange Fora (SIEFs) where they may need to take on the duties of Lead Registrant. The fine and speciality chemicals sectors are no exception to this and so the recent Act will almost certainly impact data sharing agreements during the SIEF and beyond.

REACH – Software Other major changes affecting REACH – particularly in view of the 2018 registration deadline - are the new software updates: IUCLID version 6, Chesar 3 and REACH-IT 3. Both IUCLID and Chesar are expected to be released at the end of April and REACH-IT at the end of May, respectively. Once REACH-IT has been updated to version 3, it will only be possible to submit dossiers in the format of IUCLID 6. Beta versions of IUCLID 6 and Chesar 3 are currently available, allowing users to familiarise themselves with the new look and some of the changes. It is anticipated the IUCLID 6 will have fewer free text fields allowing for increased automation available to Technical Completeness Checks. Because existing registration dossiers will need to be transferred from IUCLID 5 and users will

need to become familiar with the new software, it is advisable to delay registrations until after the updates are in place. However, it is appreciated this is not possible in all cases, i.e. where legal entities need to meet obligations before this time.

REACH – OSOR Both the implementing act and the software updates will strengthen the “One Substance, One Registration” (OSOR) principle and hence some changes will be directed at blocking “free-riders” who submit irrelevant or poor quality information in their dossiers; a recent landmark Board of Appeal case has essentially ruled in favour of retroactive application of the OSOR principle. As well as encouraging the data sharing in order to minimise costs to industry, the purpose of OSOR is to reduce the burden on the agency, harmonise information where possible and reduce animal testing. REACH-IT has already undergone a small update to prevent individual submission when there is a joint or individual submission already in existence. It should be stated that it will still be possible to opt-out of some information requirements and submit these on an individual basis even if in a joint registration, but this will automatically qualify each of the dossiers as priority for a Compliance CHeck (CCH) and it is not possible to fully opt-out of all the required endpoints. The dossier will still have to be submitted under a joint submission.

REACH – Guidance The agency will also be updating its guidance on requirements for substances in articles to reflect the recent ECJ ruling that clarifies the interpretation of 0.1% SVHC in complex components. Both of the updated documents will hopefully be available in the first half of the year. This is in accordance with the moratorium that stipulates changes to guidance should not be made in the two years leading up to a registration deadline (31 May 2016 in view of the 2018 deadline).

CLH – Consolidated ECHA have recently published an unofficial consolidate list of all the harmonised classification and labelling (CLH) entries, totalling at over 4000. New CLH entries are regularly added by ATPs. In accordance with Article 45 of CLP and also mentioned in Annex II

Conclusion To summarise the current regulatory climate: implemented, ongoing and soon-to-be developments in the regulations are best tackled by remaining informed of the most up-to-date information regarding legislative measures in order to plan for their arrival. A pro-active approach is vital to retaining competitiveness in commercial activities, not to mention for resource planning and business continuity. These approaches have never been more apparent given dynamic environment of REACH and other chemicals legislation.

An important deadline this year with regards to the Biocidal Products Regulation concerns biocidal products not covered by the repealed Biocidal Products Directive 98/8/EC that are now in scope of the BPR. Applications for the active substance(s) approvals that

to REACH - requiring an emergency telephone number be provided on Safety Data Sheets (SDS) – section 1.4, a draft Regulation on poison centres has been published, which is due to be added to the CLP Regulation. Resulting from these new-community wide rules on Poison Centres that are impending in 2016, there is no doubt that additional resource will be required for industry to meet these demands. The extent to which the fine and speciality chemicals sectors will be affected revolves around how mixtures used exclusively in industrial settings will be treated. There is the possibility of reduced information requirements, a question over whether submittals will be required at all, or if such mixtures will not receive any preferential treatment.
