August is now here and the summer is slipping away fast. I hope this news letter finds you busy with work and some time to enjoy the summer activities. It is hard to think about it but the fall season is just around the corner and we will once again be gathering at our monthly member meetings. Sharon has some really good informational meetings set up, for us this year, along with some fun ones too. Stop in the office and see Sharon, she likes to see everyone! RENOVATE, REPAIR AND PAINT has had some
changes. At the urging of NAHB, they have extended the deadline to be registered to December 31st. After that it won’t make the deadline to get on the EPA list. Beginning February 1st, Building officials will have to verify with the EPA website that the contractor, pulling the permit for a home built before 1978, is registered. Once the Department of Health takes over, they will be relying on a TIP call to report anyone working on a home, built before 1978, that may not be registered. This will include painters, flooring people, drywallers, HVAC, plumbers, electricians as well as contractors. I know that this may seem like a real pain, but it has to be done. Any questions, please give Sharon a call. More classes will be done in October, November and December. There also will be online classes, with 3 hours of class time for hands on. These will be held in October, however, the online classes do not count towards builder credits, but the hands on will.

Where is the summer going? One more month and school starts again. I do look forward to fall, when the meetings start and committees need to get geared up for the different events. Due to only one house being committed for the Tour of Homes, it has been canceled. We will probably go back to doing the tour the week after the Home & Garden Show. Committees need to start meeting to get the basics ready, so I can get the correct info on the website. If you would like to serve on a committee, on the board of directors, or serve on the BAM board, we are looking for people. Many committee and board members will be done with their terms. The BAM board meets about 4 times a year, and can be a very interesting and learning process on how the state association works. There is also the opportunity to be on a state committee when you are on the BAM board. Please call me if you are interested. Enjoy this last month of summer and hopefully everyone can be busy.

Gubernatorial Candidate Tom Emmer Visits BAM On Monday, July 12, 2010 Gubernatorial Tom Emmer who received the Republican party nomination visited BAM’s office and talked with Government Relations committee members. Members discussed the current regulatory environment for the industry and the importance of housing to the overall economy. Members of the committee intend on meeting with all endorsed candidates for Governor. BAM To Participate In a Construction Gubernatorial Forum August 25th The Builders Association of Minnesota is partnering with a wide-range of infrastructure, building and development associations to organize a major party candidate Gubernatorial Forum and Debate. The forum is scheduled for Wednesday, August 25 from 8:30AM to 10:00AM at the Northland Inn and Conference Center located in Brooklyn Park. Work is currently underway to secure commitments from the candidates and finalize other details. The focus of the forum will be job creation, economic development, infrastructure investment, and sustainable initiatives. There is no charge to attend the forum, although pre-registration will be required. Details and registration information will be available soon. BAM Sends Letter To EPA, Lead Rule Last week BAM sent a letter to the EPA with regard to an amendment to the Lead: Renovation, Repair and Painting regulation published May 6 in the Federal Register that would additionally require remodelers to conduct lead paint clearance testing after completing renovation projects on homes built before 1978. This proposal would require professional remodelers to do the work of a lead abatement contractor and, the letter states, “It reaches beyond the original rule’s intention to protect children from lead exposure.” BAM asked the EPA to consider reinstating the opt-out amendment for homeowners, and urged them to be reasonable with the regulatory environment they are overseeing. These costly new requirements are an imposition on the overall cost of housing and maintenance of the existing housing stock. As always, we will keep you updated on any progress that is made.

NAHB Plans For Reorganization I want to draw your attention to the letter and materials I received from NAHB Chairman Bob Jones. I hope you will take the time to review the report NAHB created on Positioning NAHB for the Future. This report discusses what our industry will look like in the future and the impacts it will have on association work. I recommend these documents as critical reading for all leaders in the association. The NAHB Executive Committee is meeting this week in Washington, D.C. and BAM’s State Representative Mike Gohman will be attending. I am sure BAM will be having a rigorous debate on the report at our next Board meeting on July 21 in Duluth. NAHB Files Lawsuit Against EPA Over New Lead Rule A coalition of housing industry groups joined the National Association of Home Builders (NAHB) in announcing it will file a lawsuit against the federal Environmental Protection Agency (EPA) for removing the “opt-out” provision from its Lead: Renovation, Repair and Painting rule. The provision, which expired July 6, let consumers allow contractors to bypass extra preparation, cleanup and recordkeeping requirements in homes where there were no children under 6 or pregnant women, thus avoiding additional costs. “Removing the opt-out provision more than doubles the number of home subject to the regulation,” said NAHB Chairman Bob Jones. “About 79 million homes are affected, even though EPA estimates that only 38 million homes contain lead-based paint. Removing the opt-out provision extends the rule to consumers who need no protection. The group will challenge EPA’s action on the grounds that the agency substantially amended its LRRP regulation without any new scientific data and before the regulation was even put into place on April 22, 2010. Needless, to say BAM is thrilled about this case and we will be watching very closely!
