Chinese Foreign Ministry denies ‘preparatory work’ reports on Bajo de Masinloc

MANILA, March 22 (PNA) -- The Chinese Foreign Ministry on Wednesday denied earlier reports that they are about to start preparatory work this year for an environmental monitoring station on disputed Bajo de Masinloc (Scarborough Shoal) which is within the Philippines’ 100 mile special economic zone (EEZ). It took the Chinese government five days to deny the statement made by Sansha City Mayor Xiao Jie that China is planning to build structures on Bajo de Masinloc which was published in Hainan Daily newspaper recently. The same paper corrected the false report. “China places great importance on the preservation of

For cases filed after October 7, 1998, Student Loans are only dischargeable if: 1. You can prove that having to repay it would impose an “undue hardship� on you (as defined below), OR, For cases filed PRIOR TO October 17, 2005, 2. If the PROGRAM under which your student loan is issued, insured, administered is a FOR-profit, PRIVATE (non-government) entity, it may be dischargeable. (However, if the program itself, such as LAL, GSL, etc. receives nonprofit funding by participation of nonprofit entities, the loan is not dischargeable in bankruptcy). To obtain a discharge based on undue hardship you must prove all of the following: 1. that you cannot maintain, based on current income and expenses, a ‘minimal’ standard of living for yourself and your dependents if forced to repay the loans; 2. that additional circumstances exist indicating that this state of financial affairs is likely to persist for a significant portion of the repayment period of the student loans; and, 3. that you made good faith effort to repay the loans, for example, by past payments for several years, etc. Making payments is not always required if you didn’t ever have the money to pay the loans. Forbearances may be sufficient. NEW: The Ninth Circuit recently ruled (in April 2003) that courts have the authority to issue partial discharges of student loans, in cases where the debtor shows the ability to repay some, but not all, of the loans. This is a huge improvement in the ability to possibly discharge some of these debts, because before the rule was if you could afford to repay any of the loans, you had to repay it all. HEAL Loans are subject to a higher standard of scrutiny and are much harder to discharge. For other alternatives to dealing with Student Loans, including income contingent repayment plans, and non-bankruptcy methods of canceling the debt, check out the following website: http://www.ed.gov/offices/OSFAP/ DCS/loan.cancellation.discharge.html Can you be denied a student loan because you or your parents file bankruptcy? Section 525 of the Bankruptcy Code prohibits discriminatory treatment by any governmental or other student loan program on the basis of filing a bankruptcy. In other words, a student loan agency cannot deny your loan application based on the filing, by you or anyone you know, of a bankruptcy. Discharging taxes and removing tax liens Certain types of tax obligations, such as income taxes, may be discharged under specific circumstances. Many required factors must be met before any tax can be discharged under Chapter 7 or Chapter 13. In Chapter 7, the minimum requirements for discharging federal or state income taxes are: (1) it has been over 3 years since the returns were last DUE (including extensions), (2) the returns were timely filed or it has been at least 2 years since the returns were filed, (3) there was no fraud involved or attempts to evade the tax, AND, (4) the taxes were not assessed within the last 240 days. If it has been over 3 years since your returns were last due and they have not been assessed in the last 240 days, BUT you have not yet filed the returns or there was some kind of fraud involved in filing them, then they may be dischargeable in a Chapter 13. Again, discharging taxes is an extremely complicated area, and you should definitely consult with a knowledgeable attorney before deciding whether to file based on dischargeability of your taxes and before you take any further steps with your taxes (such as filing past due returns) Sometimes filing a late return can work against you as far as being

able to discharge those taxes in a Ch. 13, so definitely speak to an attorney before doing anything. Tax Liens that have attached to property will survive a bankruptcy. What does that mean? It means that the lien will stay against your property regardless of your discharge of the underlying debt. So, when you ultimately sell that property, if there is extra money available, the lien will be paid first from those proceeds unless you have the lien removed. Discharging fraudulent debts or fraud debt judgements Debts that you incurred which were the results of an intentional or even negligent misrepresentation on your part are not dischargeable in a Chapter 7. Examples of these might be if you misstated your income on a credit card application, made false statements in order to induce someone to give you a loan, ran up your credit card debt shortly prior to filing bankruptcy, used your credit card or obtained a loan without any intent to repay it, or if someone has obtained a court judgment against you based on fraud. However, the news isn’t all-bad. These types of debts may be discharged in a Chapter 13. Retirement accounts and pension plans Whether or not you can exempt amounts held in a retirement account depends on numerous factors, including which set of exemptions you choose to use (you need to discuss this with your attorney – in California, there are two sets of exemptions). According to the United States Supreme Court, if your retirement plans is ERISA approved, meaning that it contains a trust “anti-alienation� provision making it impossible to transfer or withdraw the funds prematurely, and it is automatically exempt. Individual Retirement Accounts may be exempted only up to the amount reasonably necessary for the debtor’s support and maintenance, taking into account all other anticipated and existing sources of income and expenses. Obviously, exempting retirement funds is very tricky and requires the expertise of an experienced bankruptcy attorney. Getting rid of liens, abstracts of judments and trust deeds against your property The bankruptcy code enables a broad range of powers, which can enable you to avoid liens that were placed against your personal property or real property (like a house). It is too complicated an analysis to deal with here, but if you has liens against your property; make sure to discuss this with your attorney. Types of liens you may be able to get rid of include judgment liens recorded against your home or specific personal property. Also, in a Chapter 13 junior trust deeds against your home may be able to be removed under certain specific circumstances. This is not an option in a Chapter 7, so make sure to discuss this with your attorney. Paying taxes with your credit card Debts incurred on your credit cards to pay taxes to the IRS will usually NOT be dischargeable in chapter 7 but may be dischargeable under Ch. 13. Public urged to ensure online security in using free public WiFi networks MANILA, March 22 (PNA) – Global cybersecurity firm Kaspersky Lab has urged the public to protect their online security as the government pursues its initiative to provide free public WiFi Internet nationwide. With the prevalence of free networks, criminals set up fake free Wi-Fi networks, which would cost Internet users dearly when their login credentials are stolen from them. Kaspersky advises the public to avoid public WiFi and to connect to the Internet from home or through mobile only since it is difficult to detect these fake free networks. “An open, free internet network is like a double-edged sword. It is free but is also definitely risky. It is perfectly fine to feel excited about the anticipated public Wi-Fis in the entire Philippines. But we urge Fil-

ipinos to be very cautious, too. We would encourage them to first arm themselves with cyber savvy habits and knowledge to stay safe in a free network,” Sylvia Ng, general manager of Kaspersky Lab Southeast Asia, said in a statement. To protect themselves from free WiFi threats, Internet users should never trust open WiFi networks that require no password as cybercriminals often create them to hack users’ personal data; turn the WiFi off when not in use; and consider using a virtual private network (VPN) as it encrypts sent and received messages, among others. Once Senate Bill 1277 or the Free Internet Access in Public Places Act is signed into law, all government offices and public facilities, such as schools, transport terminals, hospitals, and public libraries nationwide will have free Internet access.

She is expected to take Accountancy in De La Salle University. She noted that despite the hassle they went through during luggage check-in, she looked forward to visiting Taiwan. Like the Pinedas, she and her family have no plans to visit Laoag and Hong Kong having visited there before. Businessman Isidro Belga Jr., 52, for his part, was tagged along by his doctor sister and her doctor colleagues that’s why he was there. It was also his first cruise experience. Belga said that she has toured the entire ship already and has yet to plan what he will do next. He now looks forward to docking in any of the three stops. He explained that he felt lucky to be able to file a leave from work and enjoy peace and quiet time away from the city.

KAOHSIUNG, TAIWAN, March 20 (PNA) – Although majority of cruise passengers tend to belong to the older population --particularly the elderly -- younger passengers are slowly starting to see its appeal. On Sunday, Hong Kong-based cruise line Star Cruises began its three-month home port deployment of one of its lines, Superstar Virgo, to Manila for the first time. The 13-story Superstar Virgo will have a six-day, five-night cruise from Manila starting Sunday (March 19) then proceed to Laoag, Kaohsiung, Hong Kong and back to Manila on Friday (March 24). Cecilia Pineda and her husband Remie, now on their third Superstar Virgo cruise, are both retirees and want nothing more than to go out of their homes but at the same time, stay indoors. Mrs. Pineda said she and her husband would no longer need to leave the ship when it docks in Loaoag and Hong Kong because they have both been there. However, she said that she is still has to decide whether they would tour a little bit of Taiwan. Her only concern is that it would require much walking as she now uses a cane to support her. Regardless if they leave the ship or not, Mrs. Pineda said she is sure that the ship has amenities to keep them both busy. She said her husband would visit the gym while she would sometimes watch the magic shows onboard. The Pinedas carry dual-citizenship, Filipino-US, decided to go on a cruise not just for a vacation but also to meet people from all walks of life. Mrs. Pineda said that since they

Special session sought to tackle impeach rap vs Robredo MANILA, Mar. 22 (PNA) – Lawyer Oliver Lozano has asked the House leadership to call for a special session of Congress in April to tackle the impeachment case he filed against Vice President Leni Robredo. During a media forum on Wednesday in Quezon City, Lozano said Speaker Pantaleon Alvarez should already initiate the impeachment process against the Vice President through a special session at the House of Representatives. “I sent a request to Speaker not to wait until May… This impeachment can be done in April if there is a special session,” Lozano said. Lozano expressed confidence that the Robredo ouster move will prosper in the lower chamber, noting that there are at least a hundred congressmen who will support the impeachment try against her. A vote of at least one-third of all the members of the House is necessary before it can be transmitted to the Senate for trial. “There is a sufficient number of representatives that will favor the impeachment… There are 100 representatives already,” Lozano said. “There’s no such thing as a weak or strong impeachment complaint. Impeachment is a numbers game,” he added. Lozano described Robredo as a “thorn” that hampers the Duterte administration’s pursuit of radical change. “These dishonest and disloyal misrepresentations of the Vice President have shamed our country,” Lozano said. On Monday, Lozano, together with perennial senatorial candidate Melchor Chavez, delivered a copy of their impeachment complaint to the Speaker’s office requesting for proper endorsement. A complaint filed by any citizen should get the endorsement of a sitting congressman before it will be referred to the House committee on justice for hearing. Lozano is a known serial impeachment filer who filed impeachment complaints against former presidents Gloria Macapagal-Arroyo and Benigno Aquino III. In their complaint, Lozano and Chavez cited betrayal of public trust and culpable violation of the constitution as grounds for impeachment against Robredo. They explained that Robredo allegedly committed acts of injustice stemming from a video message she sent to the United Nations Commission on Narcotic Drugs where she criticized the conduct of the administration’s anti-drug campaign. “She (Robredo) betrayed the people by shaming the nation with her dishonest message to the United Nation,” the complaint read. Alvarez earlier said he is studying the possibility of filing an impeachment complaint against Robredo, whom he accused of having a hand in the first impeach move against President Rodrigo Duterte.

DILG chief: ‘Palit Ulo’ not true

MANILA, March 21 (PNA) – Interior Secretary Ismael Sueno has denied Vice President Leonor Robredo’s allegations of a “Palit Ulo” scheme in the Philippine National Police’s (PNP) anti-illegal drugs operations. “I respectfully request the Vice President to please corroborate her statement,” Sueno said in a news release issued by the Department of the Interior and Local Government (DILG) Tuesday. “It would help if Vice President Robredo presents to us solid proof about this so-called ‘Palit Ulo’ scheme so we can act on it immediately.” The vice president, in a message to a United Nations conference in Austria, spoke of the alleged scheme where a member of a family takes the place of a drug suspect who could not be found. In a statement, the bureau said that a certain Ariel Roselle Victorino, also known as Ariel Roa Victorino, allegedly a relative of President Rodrigo Duterte, was reported to have produced a letter stating that he would take over the post of the Customs chief. The letter was supposedly signed by Executive Secretary Salvador Medialdea. Likewise, the BOC noted that it had also received complaints that Victorino had been extorting money from customs employees, brokers,

and even smugglers in exchange for protection and immunity from suit. With this, Faeldon urged the public to disclose the names of other individuals who have been involved in extorting money in exchange for protection. It noted that he has several pending criminal cases in the courts for estafa and fraud. National Bureau of Investigation records revealed that it had arrested Ariel and one Hershey Victorino for reportedly duping five applicants for a US visa. The BOC added that (Ariel) Victorino was accused of extorting money from garbage contractors after claiming to be the chief of Manila’s Department of Public Service in June 2013.

CBCP official lauds PNP’s anti-terror measures MANILA, March 22 (PNA) – An official of the Catholic Bishops’ Conference of the Philippines (CBCP) has applauded the authorities particularly the Philippine National Police (PNP) for its immediate action against possible terrorist threats in the country. “We commend our law enforcers for uncovering possible terrorist threats to our country. They’ve done their job effectively and let’s hope that they’ll continue to do so,” said Fr. Jerome Secillano, Executive Secretary of CBCP Public Affairs Committee (PAC). At the same time, the Catholic priest asked the people to be calm and vigilant.

“The public needs to remain calm and not let fear overcome them. They have to be more vigilant though as they perform the Holy Week observances,” he said. Gov’t one-stop-service centers serve 500,000 OFWs in 7 months MANILA, March 21 (PNA) – The government’s One-Stop-Service Centers for OFWs (OSSCOs) have served close to half a million vacationing and would-be overseas Filipino workers in different regions in the country since its establishment seven months ago. The Department of Labor and Employment (DOLE) reported that a total of 494,611 individuals were provided services in OSSCOs at the main office of the Philippine Overseas Employment Administration (POEA) as well as in the 16 regional service centers. “DOLE, together with our attached agencies established OneStop-Service Centers, want to continue to ensure the speedy and timely delivery of various government

services to our clients,” said DOLE Secretary Silvestre Bello III in a statement. He added that a total of 463,423 OFWs have availed of the services at the POEA Main Office in Mandaluyong City, since its launch in August 15, 2016 and until March 3. The number includes, responses to 183,222 queries; receipt of a total of 257,448 documents for processing; issuance of 20,775 certificates; and provision of hands-on assistance to 1,980 clients. Bello added the 16 regional service centers recorded a total of 31,189 clients from their respective times of establishment until early this month. The OSSCOs have been established to shorten the processing time for all necessary OFW documents.

Presidential Communication Operations Office Undersecretary and chairperson of the 15th Meeting of the ASEAN Senior Officials Responsible for Information (SOMRI) Noel George Puyat said the ASEAN is pursuing to increase its online presence in various social media accounts such as Facebook, Twitter and Instagram to create awareness within the region. “We are sharing information on different platforms just to push the awareness,” Puyat said in a press briefing held Tuesday at the SMX Convention Center in Bacolod City. He said the initiative is in line with the ASEAN Strategic Plan for Information and Media 2016-2025 that will guide the development and cooperation of information and media sector towards supporting other community pillars and sectors with their communication needs; advocating the policies and initiatives implemented by ASEAN; and communicating with our peoples through different platforms to promulgate the benefits of ASEAN’s development. Under the said plan, ASEAN aims to utilize information and communication technology (ICT) across different groups as a means to connect with the regional and global community. Among the measures to be implemented include using new media in disseminating information on ASEAN consolidation, solidarity, diversity and unity; facilitating development of ICT apps to promote the creation and production of digital content and dissemination of ASEAN content to different groups, engaging managers of new media platforms with ASEAN integration content and collaborating with other sectors to facilitate technology development and improve accessibility in the information and media sector. Furthermore, the PCOO official said the department is conducting ASEAN roadshows to different barangays across the country to deliver talks and answer questions from various audiences in order to share knowledge to the public. It has also been distributing reading materials in different dialects to explain ASEAN and the role of the Philippines in the regional association. PCOO has also visited schools, interacted with students and engaged with local government units, members of the academe and local media to discuss important issues on ASEAN that can impact their lives. Four killed, at least 20 injured in London attack

LONDON, March 23 (PNA/Xinhua) – Four people have been killed, including the stabbed officer and a male terrorist, and at least 20 injured in an attack on the Houses of Parliament Wednesday afternoon in a terrorist attack, police announced. Metz Police Assistant Commissioner Mark Rowley confirmed the deaths in a briefing at New Scotland Yard. The police officer died after being stabbed outside the House of Parliament. Several others are critically injured after a vehicle ploughed into crowd on Westminster Bridge just outside the Parliament. Mark Rowley, the national lead for Counter Terrorism Policing and the Acting Deputy Commissioner said in a statement that the attack started when a car was driven over Westminster Bridge, hitting and in-

juring a number of people and three police officers. “The car then crashed near to Parliament and at least one man, armed with a knife, continued the attack, trying to enter Parliament,” said the statement. The terrorist who stabbed the police officer was shot by police officers who raced to aid their colleagues. The terrorist was taken to hospital and died. The injured officers was also rushed to hospital for emergency treatment. Hospital authorities in London said at least 10 people were being treated. London Ambulance said an injured woman was pulled alive from the River Thames. Among the injured, three are French students, who were on a school trip in London when the

attack happened, French foreign ministry confirmed. As the incident continued, hundreds of people fled from the scene, fearing a bomb attack on Westminster. Business in the Houses of Parliament was immediately suspended, with around 500 politicians, staff and visitors moved to a safe area as the building was placed in a security lockdown. Specially trained officers were combing the parliament buildings for bombs or explosives. Downing Street issued a statement saying Prime Minister Theresa May was safe after security police whisked her from the Houses of Parliament to 10 Downing Street. May was planning to hold a special meeting later Wednesday of Britain’s main security advisors, known as the Cobra committee.

The London Eye, one of the capital’s biggest tourist attractions, was shut down, leaving many people spending several hours in the pods high above the River Thames. Commander BJ Harrington of the Metropolitan Police said a major terrorist incident had been declared. “Although we remain open minded to the motive, a full terrorism investigation is underway led by the Met’s Counter Terrorism Command,” said Harrington. Media in London reported that Foreign Office government minister Tobias Ellwood, a former captain in the British military, ran to the aid of the stabbed police officer. The attack came just days after the Met staged its biggest ever terrorism exercise on the River Thames, as part of preparations for any attacks on the Houses of Parliament.

DOF eyes establishment of PHL bank in Bahrain to assist OFWs, facilitate trade MANILA, March 22 (PNA) – Finance Secretary Carlos Dominguez III is exploring the possibility of opening a subsidiary of the Land Bank of the Philippines (LandBank) in Bahrain to cater to the banking needs of overseas Filipino workers (OFWs) living there and facilitate trade and investments between the Philippines and the island-kingdom. In his recent meeting with members of the Bahrain Chamber of Commerce and Industry, Dominguez informed them that he will advise President Duterte to look into this possibility as well as schedule a presidential visit to Bahrain, where possibly as many as 100,000 Filipinos reside and work.

A Philippine educational institution, the AMA International University-Bahrain, founded by Ambassador Amable Aguiluz V, has also been established in Salmabad, Bahrain’s industrial center. “We are at the moment converting and acquiring a bank to be a subsidiary [of LandBank] to provide for the needs of our overseas workers. I will certainly advise the President to make sure he visits Bahrain and look into the possibility of establishing a bank there for ease of doing business between us,” said Dominguez, who chairs the LandBank Board. Dominguez was referring to a government plan to acquire and convert the Philippine Postal Bank

into a LandBank subsidiary, which will be partly owned by OFWs. A bank dedicated to the needs of OFWs was among the promises of President Duterte to Filipino migrant workers. Dominguez’s statement was in response to the suggestion by the Bahrain delegation on the establishment of Philippine banks in Bahrain to help strengthen financial relations between the two countries. The delegation, led by His Excellency Khalid Abdulrahman Almoayed, the chairperson of the Bahrain Chamber of the Commerce and Industry (BCCI), also broached the possibility of the two countries working together to help the Philippines broaden its market for halal goods overseas, and expanding Bahrain’s investments here. “We have to work together on halal matters. The halal market is a big market that the Philippines [can tap],” Almoayed said. In the meeting, Almoayed cited BCCI’s concerns regarding the Philippine government’s requirements for the recruitment of Filipino workers to Bahrain, which he said “involved a lot of paperwork.” Dominguez said he will refer BCCI’s concern to the Secretary of the Department of Labor and Employment. “I will suggest that we refine our regulations... The President’s commitment is to simplify these steps.” The finance secretary also discussed with the delegation the three priority goals of the Duterte administration, which are to reduce the poverty incidence in the Philippines from 21.6 percent to 14 percent by 2022, nurture a law-abiding society, and create a climate of peace with armed insurgents here as well as establish cordial and strong relations with members of the international community. To reduce poverty, Dominguez said the Duterte administration is investing heavily in both urban and rural infrastructure and increasing public expenditures in social services to improve transport and logistics networks across the country, create jobs and spur development, especially outside Metro Manila.

Credit/Debit Card pre-authorization on rental cars does not constitute payment A month ago, this author rented a car for almost a month due to a collision repair. As a standard procedure with all vehicle rental companies, as stated on car rental companies Credit Qualifications Requirements, in order to enable them to process the rental, the car rental agent requires renters to submit two types of identification (IDs) such as a driver’s license and a major Credit or Debit Card for “pre-authorization or authorization hold,” which is the “practice within the banking industry of verifying electronic transactions initiated with a debit or credit card and holding its balance as unavailable UNTIL either the merchant (or car rental company on this case, clears the transaction, or settlement; “ otherwise, the ‘hold fails off’). In the case of debit cards authorization holds can fall off the account thus rendering the balance available again, anywhere from one to eight business days after the transaction date, depending on the bank’s policy. In the case of credit cards, “holds”may last as long as thirty days, depending on the issuing bank. Stated in the Credit Card Requirement of the Hertz Rent-A-Car vehicle I’ve rented from, to qualify to rent the Hertz vehicle, the renter must present a drivers license and a major credit or debit card, which this author did. A month had passed and to my surprise, Hertz Rent A Car processed the car rental payment WITHOUT prior notice to me and they automatically deducted the total month’s car rental fee from my debit card. Furious for the unprofessional way Hertz Rent-A-Car processed the transaction, I drove all the way to the collision car shop and they said they’ll deal with Hertz for the last time, because apparently I was not the only one they have done this before. Apparently, there was a blogger named Steve Elliott also wrote about the experience of a certain Perry Capurro, who rented a car from Hertz Rent-A-Car in Harrisburg, Pennsylvania regarding his unfavorable experience with the same company. So, unless Hertz Corporation changes their credit card preauthorization policiies, they will end up losing customers like us.

MANILA, March 21 (PNA) – The Quezon City government, Metro Manila Development Authority (MMDA), and Land Transportation Franchising and Regulatory Board (LTFRB) on Tuesday afternoon signed a memorandum of agreement on eliminating illegal bus terminals in the city. The memorandum, which aims to decongest EDSA and secondary roads that are used as alternative routes to the northern and southern portions of Metro Manila, was signed by Quezon City Mayor Herbert Bautista, MMDA chairman Tomas Orbos, and LTFRB chief Martin Delgra. Bautista warned illegal bus operators of permanent closure if they continue to refuse to abide by local and national laws on bus terminal operations. “Land always has use. Condominiums and other business establishments could be built on the (land occupied by) illegal bus terminals,” he said. The mayor further said he will recommend a standard design for bus terminals to better manage the traffic in Quezon City. For his part, chief of the QC Business Permit and Licensing Office, Garry Domingo, said, “We are hell-bent on enforcing the law. Only compliant bus terminals will be issued business permits.” He pointed out that passenger buses should follow the “nose-in, nose out” policy upon entering or leaving their terminals, as other vehicle ploys could further aggravate the traffic situation along EDSA.

ZTE Corporation pleads guilty to illegally sending US tech items to Iran WASHINGTON, March 23 (PNA/ Sputnik) – A Chinese telecommunication company, ZTE Corporation, has admitted in court that it has been violating US sanctions on technology sales to Iran, the Department of Justice said in a press release. “ZTE Corporation pleaded guilty today to conspiring to violate the International Emergency Economic Powers Act (IEEPA) by illegally shipping US-origin items to Iran, obstructing justice and making a material false statement,” the release stated on Wednesday. According to a court document, ZTE secured contracts with Iran

for illegal shipments in December 2010. Under the contracts, the Chinese company agreed to deliver the “self-developed equipment,” and receive payments for the projects and oversee the entire network. ZTE temporarily stopped unauthorized sales of American equipment to Iran in 2012, but then resumed its business and renewed licenses nearly a year after. The company attempted to conceal all information related to dealings with Iranian customers, the release noted. The corporation will now pay nearly USD 900 million in fines to the US government, the release added.

may elaborate that those are usually gone in the first week that the door opens in which to apply for the H-1B (which is April 3.) It is time to apply right now, so don’t wait. However, there are many type of business visas that do not require a college degree. For example, there is the O-1 Visa. The business visa attorney explains that the O-1 is for people who are extraordinary in whatever it is that they do. There are several requirements for the O-1 as would be elaborated by the business visa attorney. You must be able to establish that you have extraordinary ability in your field. Essentially, the O-1A visa is for people who are recognized as being at the very top of their field and who are coming to the United States to continue work in that field. To establish eligibility for an O-1A visa you must either have received a major, internationally recognized award, similar to a Nobel Prize, or submit evidence that affirmatively answers at least 3 of the 8 categories as put forth and explained by the business visa attorney. Those areas are as follows: Have you received a lesser nationally or internationally recognized prize or award for excellence in the field of endeavor? Are you a member of any associations which require outstanding achievements of their members as judged by

recognized national or international experts? Is there published material in professional or major trade publications or major media about you which relates to your work in the field? Other questions/categories as explained by a business visa attorney are as follows: Have you participated on a panel or individually as a judge of the work of others in the same or in an allied field of specialization? Have you made original scientific, scholarly or business-related contributions of major significance? Have you authored scholarly articles in professional journals or other major media? Have you been employed in a critical or essential capacity for organizations and establishments that have a distinguished reputation? Have you or will you command a high salary or other remuneration for your services? Yet other types of business visas involve investments. For example, there are the E-2 and the L-1. These are visas for persons who want to either start their own business in the U.S., or in the alternative, to open up a branch office in the U.S. Thus, the business visa attorney will explain that the E-2 will require about $100,000 investment, but you can run your own business and come to the United States to make your dream come true. The L-1 requires much less investment, but would require that you have very good records for the company you are running in your home country. The typical business visa attorney will know that many countries do not keep good records and are running businesses without invoices and contracts and tax records. These

types of businesses are not very good businesses for the L-1. Another type of related investment visa is the E-1 and the E-1 deals with trading with your home country. Therefore, if the business does at least 50% of its work trading with the home country, then the E-1 might be the best way to proceed forward. The B1 can be used if you want to come into the United States to negotiate contracts for your company in your home country, or if you have to do temporary training or attend conferences. These are very short duration visas and can be quickly issued. Another type of business visa if you’re from Canada or Mexico is the TN Visa. The TN is somewhat related to the H-1B, except there are no limitations on the amount of TN’s and some TN’s do not require a college degree. Clients with wage garnishment, huge sales tax, freak accident seek BK relief Freak Accident Liability I think I want to discuss the client with the freak accident first. First client is 45. This is really a very unusual case. In fact, I have never encountered a case like this before in the last 30 years. Client has a rental condo that needs plumbing repair because of water leak coming out of the walls. He hires a plumber that he knows from work. Plumber determines that the leak is coming from a water pipe that is inside the wall. So he cuts a hole through the wall big enough for him to work on the leaking pipe. He uses a blowtorch to seal the leak. The blowtorch accidentally sets the inside of the wall on fire. They try to stop the fire from spreading. They fail to stop the fire from spreading. The condo burns down. The fire spreads to the other condos in the building. Eventually, the entire building is on fire and is destroyed. The building has a master insurance that covers the repairs for building so the building is reconstructed and everybody gets their condos back in shape. So what is the problem for client if the insurance has paid for everything and all the damage caused by the fire? The problem of course is that the insurance company will sue client to recover whatever they can from client and client does not have liability insurance for the fire. I don’t know what else to call this but a freak accident. This is potentially a multimillion liability for client in the future. If client qualifies for Chapter 7 relief then he has no worries anymore because Chapter 7 will just wipe out all of his potential liability for the damage caused. If he does qualify, he can wipe this out and have a fresh start. What we can learn from this accident is that if you should have a plumbing problem and the plumber

uses a torch, you better stand behind him with a big fire extinguisher! So, just in case the same thing happens, you can immediately use the fire extinguisher on the fire to kill it and prevent your house from being burned down by a plumbing problem. WAGE GARNISHMENT The second client is 63. She had car repossession some time ago. As far as she knows, the repo deficiency was about $25K. Must have been an expensive car with that kind of deficiency. She has just received a wage garnishment order for $40K based on the repo deficiency judgment! She still works and earns a gross of $5K monthly. How does the wage garnishment work? It will take 25% of her gross wages, or $1,250 a month until the $40K is fully paid at legal interest of 10% a year. She can’t live with such a big deduction from her wages. She won’t be able to pay her rent of $1,100 if the garnishment is done. She also owes about $30K of credit cards. She needs Chapter 7 relief to stop the garnishment, wipe out the judgment of $40K and all of $30K of credit cards. She will get a fresh start without the burden of accumulated debt. She will be able to reestablish credit immediately. She still has a car payment. She will also be able to get new credit cards as soon as she is done with her bankruptcy because there are banks that specialize in giving new credit cards to debtors who have just come out of bankruptcy. HUGE SALES TAXES The third client is 66. He operated

a business for several years but did not pay sales tax for his products as they got sold. He owes $120K of sales tax. He closed his business last year. However, before he closed his business, he was audited by the State and it was determined that he owed $120K of sales tax. Well, that’s bad news. Nobody wants to owe $120K of sales tax at the age of 66; in fact, no one at any age would want to owe so much sales tax. I mean, at 66 you get full benefits from social security but if you owe $120K of sales tax, then your social security will just go to pay the sales tax. Now what kind of retirement is that? That would be like living in the twilight zone, wouldn’t it? Now the question is, are sales taxes dischargeable in Chapter 7? In California, sales taxes are dischargeable. The reason they are dischargeable is because they are transactional taxes. They are not taxes, which are held in trust by debtor. If they were held in trust by debtor then there would be a fiduciary relationship that was breached and that would make the tax not dischargeable. So sales taxes are not excepted from discharge, therefore they are dischargeable. The caveat is that the legal prerequisites to discharge the sales tax must be met. CREDIT CARDS If you owe credit card debt that eats up a significant portion of your net income, it’s time to get rid of them now with a Chapter 7 wipe out or Chapter 13 reorganization. It’s time to get a fresh start and become productive again. If you owe $30K of credit cards, the minimum payment is $1K a month just for interest payment to keep them current. In three years you will pay $36K of interest but still owe $30K of principal. Get out of financial quicksand now with Chapter 7 or 13. Owe nothing but

keep all your assets, your house, your cars, your retirement accounts and everything else you own and more of your net income for your future financial well being and the financial well being of your family. Even Walt Disney filed for Chapter 7 twice before he became successful. Hershey also filed for Chapter 7 before his Hershey chocolate business became successful. Orange County also filed for bankruptcy to protect itself a decade ago. Several Catholic dioceses filed for bankruptcy protection from child molestation lawsuits just several years ago. So, if there is too much debt, bankruptcy is a prerequisite for future success and productivity. It’s the right step to take and the simplest and best solution to take. Thailand, PHL vow to boost military cooperation to address security issues BANGKOK, March 22 (PNA/Xinhua) – Thailand and the Philippines pledged here Tuesday to boost military cooperation between the two countries to address security issues like terrorism and illegal drugs. The pledge was made at a joint press conference after the meeting between Thai Prime Minister Prayut Chan-o-Cha and visiting Philippine President Rodrigo Duterte. “We stress the need to address traditional and emerging threats to our collective security and stability. This includes transnational crimes such as terrorism and violent extremism, piracy at sea as well as the trafficking of persons and illicit drugs,� Duterte told the press. Thailand, like the Philippines, continues to wrestle with the spread of illegal drugs. During their meeting, the two leaders also believed that the South China Sea “should be a sea of peace, stability and sustainable development� for the sake of the region and its peoples. The two also witnessed the signing of agreements on tourism, agriculture as well as science and technology aimed at boosting economic growth in their countries. This is Duterte’s first official visit to Thailand.

PHL, Thailand renew deal on tourism cooperation MANILA, March 22 (PNA) -- Tourism officials of the Philippines and Thailand have renewed a 23-yearold tourism cooperation agreement during the official visit of Pres. Rodrigo Duterte to Bangkok this week. Philippine Department of Tourism (PDOT) Secretary Wanda Teo and Thai Ministry of Tourism and Sports (MOTS) Minister Kobkarn Wattanavrangkul signed the Implementing Program of Tourism Cooperation 2017 to 2022 at the Santi Maitri Building of the Government House of Thailand on Tuesday. Philippine Pres. Duterte and Thai Prime Minister Prayut Chan-o-Chan, meanwhile, stood as witnesses. Teo said the implementing program is rooted in a Memorandum of Agreement (MOA) on tourism cooperation signed in Manila between the Philippines and The Kingdom of Thailand on March 24, 1993. Under the agreement, officials and staff of both countries shall visit each country to build their capacity in the areas of tourism development, administration and finance, human resource, marketing and promotions and standards and regulations. It also allows the Philippines and Thailand to actively encourage their respective local travel agents to develop a joint promotional program that would market destinations in

both countries under one tour package. Teo said this development would also encourage tourism educational institutes in both countries to exchange technical materials, send experts to give lectures and provide information on the opportunities for tourism-related training. Thailand joins China, Cambodia and Turkey as Philippines’ partners with new tourism cooperation agreements signed within nine months of the Duterte administration. “Philippines’ tourism program may yet gain an added boost with this concrete commitment for tourism cooperation with Thailand as a result of President Duterte’s fruitful official visit in Bangkok this week,� Teo said. “There is so much we can learn from Thailand in terms of tourism development strategies, noting that it tops south East Asian countries in terms of visitor arrivals,� she added. Manila-based travel and tour operators, who accompanied Teo’s group, said the shared tourism program could raise the awareness of the Thai market and other international markets about the Philippines destinations. In 2016, visitor arrivals from Thailand jumped by 8.8 percent at 47, 913 visitors. Thailand accounts for 10 percent of the total arrivals from ASEAN.

Negosyo Centers serve over 750,000 entrepreneurs nationwide By Kris M. Crismundo

MANILA, March 21 (PNA) – More than 750,000 entrepreneurs have been served by the Department of Trade and Industry (DTI) through its Negosyo Centers nationwide. “There are 759,223 total clients served to date, to include business name registration and other Negosyo Center services,� DTI Undersecretary for Regional Operations Group Zenaida Maglaya said in a chance interview. She noted that for business name registration alone, Negosyo Centers have facilitated at least 438,619 clients -- 52,284 entrepreneurs in 2015, 283,487 entrepreneurs in 2016, and 102,848 entrepreneurs for this year. Under Republic Act No. 10644 or the Go Negosyo Act, DTI is mandated to establish Negosyo Centers, which are tasked to assist in business registration, provide business advisory services, promote business information and advocacy, and monitor and evaluate business processes for mi-

cro, small, and medium enterprises (MSMEs). The government targets to establish a total of 1,700 Negosyo Centers in all cities, as well as in first- and second-class municipalities in the country. According to Maglaya, DTI opened 452 Negosyo Centers as of end-2016. This covers 100 percent of cities and 50 percent of first- and second-class municipalities throughout the country. DTI eyes to launch a total of 150 Negosyo Centers this year. Maglaya mentioned that the department has allocated PHP530 million for the establishment of Negosyo Centers for 2017. She said DTI aims to partner with local government units (LGUs) to host Negosyo Centers. “We’re partnering with LGUs for the next Negosyo Centers since DTI provincial offices are now saturated. Our offices in the province already have these facilities,� the DTI official said.

2 Malaysian seafarers rescued from ASG in Sulu By Priam F. Nepomuceno

MANILA, March 23 (PNA) – Fleet-Marine units under Joint Task Force Sulu have successfully rescued two Malaysian seafarers from the clutches of the Abu Sayyaf Group (ASG) bandits in Pata, Sulu Thursday early morning. The rescue took place around 2 a.m. off the seawaters of Kalinggalang Caluang near Pata island, in the said province. Capt. Jo-ann Petinglay, Western Mindanao Command (WMC) spokesperson, identified the rescued Malaysian as Tayudin Anjut, 45 and Abdurahim Bin Sumas, 62. The two were rescued by combined elements of the Philippine Marine Ready Force Sulu led by Major Angcap, Marine Special Operations Group, and Marine Battalion Landing Teams 1 and 3 after eight months of captivity. Both victims were immediately brought by the troops to the Sulu military station hospital for medical check-up and interview. “The rescued kidnap victims are weak and in a sickly state when they were rescued by our troops. Military doctors are now attending to them as we speak in our hospital in Sulu,” WMC head Major Gen. Carlito G. Galvez Jr. said. Earlier, the Marines received information that ASG sub-leader Alhabsy Misaya with about 30 fully armed followers and two Malaysian hostages were hiding at the mangrove area of Barangay Karudong in Kalinggalang Caluang, Sulu. This prompted government troops

to focus their efforts at the reported area in order to rescue the victims. “This accomplishment is a product of the combined efforts of our soldiers and the different stakeholders in putting pressure on the kidnappers for the past months,” Galvez said. “Following the successful operation of the Marine troops in Capual Island last Feb. 7, where eight Abu Sayyaf members under Misaya were killed, our troops on the ground have maximized their intelligence monitoring and have been closely pursuing the group of Misaya to safely rescue the hostages,” he added. “WMC troops are continuing pursuit against the kidnap for ransom groups to rescue the remaining kidnap victims and continue the pressure on the Abu Sayyaf to release their hostages and possibly for them to surrender to authorities,” the WMC chief stressed. Anjut and Sumas were among the five Malaysian crewmen of Tugboat Serudung 3 who were kidnapped on July 19, 2016 at the sea waters of Dent Haven, Tambisan, Lahad Datu, Sabah by the group of ASG sub-leader Sibih Pissih. They were reported missing after their tugboat and barge were recovered without crew members in Tanjung Labian, Lahad Datu Sabah.

MANILA, March 21 (PNA) – Solicitor General Jose Calida on Tuesday said detained Senator Leila De Lima fabricated the jurats in her petition and attached affidavit of merit filed before the Supreme Court (SC). ”The Notary Public did not go to Crame. I have affidavits. The notary public met with her she must be imagining things baka espiritu ng lawyer,” Calida told reporters when sought for a comment before the continuation of oral arguments on the petition filed by De Lima questioning the legality of her arrest in connection to the drug raps filed against her. He said the jurat in her petition was signed by the Senator when there is no record in Camp Crame that she was visited by the notary public. Under Rule II, Section 6 of the Rules on Notarial Practice, a Jurat is an act in which an individual appears in person before the notary public and presents an instrument or document. Said person, who must be personally known to the notary public or identified by the notary public through competent evidence of identity, signs the instrument or document in the presence of the notary and takes an oath or affirmation before the notary public as to such instrument or document. Without the jurat or if it is fake, Calida said it will appear that no petition has been filed. De Lima maintained that the jurat was authentic, insisting that the notary public met with her in Camp Crame. In a press conference held in Manila, Atty. Alex Padilla legal counsel of De Lima said that the Office of the Solicitor General’s statement on the alleged defect in the notarization of her petition to the SC is a false allegation. According to De Lima, the notary public met with her at Camp Crame for the former to notarize the petition that she signed. De Lima further said that, contrary to the OSG’s claim, the notary public was, in fact, in Camp Crame, when the Senator was brought there. De Lima points out that the OSG, by repeatedly attempting to resort to the basest of technicalities, and in lieu of substantial arguments against the merits of her Supreme Court petition, is scraping the bottom of the barrel for whatever argument is left to support her continued illegal detention. The senator said that the OSG attack is obviously borne out of desperation.

Duterte’s birthday wishes: More strength, time with family

MANILA, March 23 (PNA) – President Rodrigo Duterte’s birthday wishes are simple – more strength to complete his work and a quiet time with his family. “So my wish really, my prayer to God is that bigyan niya ako ng konting lakas na lang to do our -- work, time because it is needed,” he said during a press briefing held at the Ninoy Aquino International Airport upon arriving from his official visits to Myanmar and Thailand. The President, who will be turning 72 on March 28, said that 24 hours is not really enough for the presidency, unless one wants to sleep more than just about four hours. “I only ask God that give me a little bit of time, a little strength to surmount the problems of the country and that I’d be able, not really to solve but maybe mitigate some of the rigors of governance,” Duterte said. He also said that the only gift he would like on his birthday is time with his loved ones. “I would be very glad to spend my time with my newest grandson Stone and the rest of my children and grandchildren. That would have been the greatest gift that I can ask in this planet. Iyon sa akin tama na,” he said. Duterte said that he could no longer ask for more since God has already given him everything. “Naibigay na ng Diyos ang lahat ang dapat ko. Bello to combatants: ‘Observe restraint’ MANILA, March 21 (PNA) –Chief Peace Negotiator Labor Secretary Silvestre Bello III on Tuesday asked combatants to “observe restraint” to avoid further bloodshed. “We are really saddened by these unfortunate incidents. We have communicated with our counterparts and they vowed to look into it,” Bello said after learning that another firefight occurred in Misamis Occidental last March 18. “We remain firm and confident that we can still proceed according to the agreement we just signed in Utrecht to swiftly reinstate our respective unilateral ceasefires while we work on the terms of an interim bilateral ceasefire agreement,” he pointed out. It has come to his attention that the Western Mindanao Command is now conducting pursuit operations against New People’s Army (NPA) rebels after the communist camp was overran in Tudela town. MANILA, March 22 (PNA) – Malacañang on Wednesday assailed the New York Times (NYT) article portraying President Rodrigo Duterte as a ‘thug’ and a ‘brutal strongman’ and said that the op-ed piece is nothing more than a ‘well-paid hack job’ out to embarrass the President and intimidate him over his independent foreign policy. In a statement, Presidential Spokesman Ernesto Abella slammed the NYT article as a “cynical and unfair narration of President Duterte’s rise to power in the context of violence.” “One would expect more from The New York Times. Their article, ‘Becoming Duterte: The Making of a Philippine Strongman,’ sounds like a well-paid hack job for wellheeled clients with shady motives,” the Palace official said. In the said NYT article published March 21, Richard Paddock described Duterte as a man who” relishes the image of killer-savior.” “Mr. Duterte and his friends have long cultivated legends of his sadistic exploits, like throwing a drug lord from a helicopter and forcing a tourist who violated a smoking ban to eat his cigarette butt at gunpoint. It is a thuggish image that Mr. Duterte embraces,” the NYT correspondent wrote. “Whether Mr. Duterte has done what he says -- the killings he claims to have carried out are impossible to verify -- he has realized his gory vision in national policy. First as a mayor, now as president of the Philippines, he has encouraged the police and vigilantes to kill thousands of people with impunity,” Paddock said. Abella pointed out however that the NYT report “deliberately fails to mention the many initiatives the President made when he was Davao City mayor.” “Davao City, under the leadership of President Duterte as mayor, is hailed as one of the safest cities in the world where residents follow an anti-smoking and a midnight alcohol ban,” he said.

“Moreover, Mr. Duterte ensured that Davao City Hall is a responsive government known for its efficient delivery of government services,” Abella added. He also enumerated some of the notable programs initiated by Duterte in his home city. While Davao City mayor, Duterte established a one-stop shop for business permits; a Central Communication and Emergency Response Center, or Central 911, which links residents who need assistance with emergency resources of the government; provided a Lingap Para sa Mahirap health financial assistance; and free primary and secondary education in public institutions as well as access to college education for underprivileged but deserving students among others. The Palace official also took exception over the NYT report vilifying Duterte’s “coarse manner” and “outrageous comments.” “President Duterte does not engage in western liberal niceties to promote his agenda, to rebuild a nation with compromised internal structures,” he stressed. “He is a rough-hewn outsider who vowed to reduce poverty; restore trust in the government by addressing crime, corruption and illegal drugs; and reinforce peace agreements with ethnic Moros who experienced historic injustice, and the CPP/NPA/NDF who have been fighting for social justice for decades,” he said. The Presidential Spokesperson -- who was erroneously named in the article as Duterte’s Press Secretary -- said that overall, the article looked more like a subtle jibe to intimidate the President over his independent foreign policy. Since taking office, Duterte has veered away from the United States, the Philippines’ historical ally, and pursued warmer relations with China and Russia. “One gets the feeling NYT is not interested in presenting the whole truth, only that with which they can bully those who attempt an independent foreign policy,” Abella said.

MANILA, March 21 (PNA) – The Philippine Navy (PN) is ready to deploy its sole survey and hydrographic ship, the BRP Gregorio Velasquez (AGR-702), if ordered to survey Benham Rise. The statement was made by Armed Forces of the Philippines (AFP) public affairs office chief, Col. Edgard Arevalo, when asked what assets could the military field should President Rodrigo Duterte and Defense Secretary Delfin Lorenzana formalize the order calling for the mapping of the 13-million-hectare Benham Rise, which the UN Convention on the Law of the Sea (UNCLOS) confirmed as part of the Philippines’ continental shelf in 2012. “In most probability, the BRP Gregorio Velasquez will be the one to be deployed,” Arevalo said in an interview with the Philippine News Agency (PNA) Tuesday. Arevalo said the ship is the Navy’s sole asset capable of conducting oceanagraphic and hydrographic survey. The BRP Gregorio Velasquez (formerly the R/V Melville) was one of two former American ships pledged by then president Barack Obama during his visit to the Philippines during the APEC Leaders Summit in November 2015. The other ship was the USCGC Boutwell, which has been renamed to BRP Andres Bonifacio (FF-17), the third Hamilton-class cutter in the Navy’s service. BRP Gregorio Velasquez was commissioned

into PN service in June 2016. The R/V Melville was used in the 1976 movie “King Kong”, starring Jessica Lange, specifically because of its hypoid propulsion drive at that time, which allowed it to move sideways. This type of drive is used on research vessels for station keeping in the ocean over drill and coring sites. According to policy, auxiliary research vessels are to be named after national scientists, hence her namesake, Dr. Gregorio Velasquez, a pioneer in Philippine phycology. Velasquez pioneered the intensive study and collection of the Philippine blue-green algal species. He was named National Scientist in 1982. He was also conferred a Distinguished Science Medal and Diploma of Honor by the Republic of the Philippines (1956), the John Simon Guggenheim Memorial Foundation Fellowship (1956-1957), and the Republic of the Philippines Cultural Heritage award in 1972. He was in the World’s Who’s Who in Sciences in 1970. Arevalo meanwhile clarified that the Chief Executive and Lorenzana have yet to give specific orders for the military to patrol Benham Rise, as well as parts of the West Philippine Sea. “Up to now there is still no instruction from President Duterte and Secretary Lorenzana for us to patrol the Benham Rise and the West Philippine Sea. But we are always ready to defend our territory and sovereignty,” he added.

In a country where religion and politics have influenced the development of the Philippines for so many years, the debate regarding the death penalty bill is putting President Duterte against the influential Catholic Church. Supporters of the bill, including myself, see it as a common sense legislation that will help deter criminals from committing crimes, particularly on illegal drug trafficking. If the bill becomes law, it would deteriorate further the already fractious relationship between President Duterte and the Catholic Church. The Philippines is perhaps the only country in Asia today that does not impose the death penalty on criminals convicted of drug trafficking. No wonder, the Philippines has now more than three million drug addicts based on the latest records of the Philippine National Police. The Philippines is also known as the “dumping ground” of illegal drugs coming from South American countries and Mexico before these banned substances are shipped to United States and in Europe. The Catholic Church, meanwhile, views the death penalty bill as an attack on life and church values. The Church also claimed that death penalty has never been proven effective as a deterrent to crime. The Church also argued that while victims of heinous crimes deserve justice and reparations, criminals remain children of God who should be given a chance to repent and reform. The Catholic Bishop Conference of the Philippines (CBCP) has also issued a pastoral letter and called on the people to close ranks and uphold the sanctity of life and make a stand against the proposed capital punishment which was abolished by the government in 2006. The CBCP is claiming that the proposed capital punishment will only affect the poor since they could not afford to hire good lawyers to represent them. The feisty President Duterte, who won by a landslide in last year’s presidential election, has launched an aggressive campaign against crime, particularly on illegal drugs, and promised to revive the death penalty. Duterte prefers hanging than the electric chair as his mode of execution. So far, Duterte and his allies have won the first round against the Catholic Church on the proposed restoration of death penalty. The Lower House, spearheaded by House Speaker Pantaleon Alvarez, voted last week to restore the capital punishment. The death penalty has already been forwarded to the Senate for deliberations. Although I expect the bill to encounter rough sailing due to the threat of Liberal Party (LP) senators to block its passage, it will ultimately become into law because

I do not know how strong the Catholic Church could flex its powers to influence the outcome of the results when the time comes for all senators to cast their votes whether to bring back the death penalty or not. Although Catholicism has been the predominant religion in the Philippines, I think that the Catholic Church influence in the country is waning. The proof is the passage of the Reproductive Health Law despite the intense lobbying and threats of church leaders against politicians, including threats to call civil unrest and to excommunicate then President Benigno Aquino. Filipinos must have gotten tired on how the Catholic Church has bullied and threatened politicians if they fail to give in to whatever request they make. The Catholic Church has been successful in asserting its influence on our political leaders and has played major roles in to ensure the success or failures of our leaders, including our past presidents. And the Church still thinks that its 70 million or so faithful still believe in its doctrine. This I do not believe. I think time has changed. The Filipino younger generation has developed their own ideas beyond the church. I think the Church is losing its members to the charismatic groups that have mushroomed all over the country. They should find a way to bring back their members to their fold and compete with other religious sects which have attracted millions of disgruntled Catholics because of alleged sex scandals involving priests. A survey conducted by the Social Weather Station (SWS) showed that majority of Filipinos no longer agree with most of the Catholic Church stance on several issues. The apparent declining support of Filipino Catholics to the Church must have motivated Duterte and his allies to bring back the death penalty. Once the death penalty bill is approved by Congress and signed into law by President Duterte, the Catholic Church will have another battle to worry about – divorce. It was reported that some lawmakers are seriously pushing for a divorce to become legal in the Philippines. This is another battle between President Duterte and the Catholic Church on issues concerning morality.

MANILA, March 22 (PNA) – The Court of Appeals dismissed the petition filed by Volunteers Against Crime and Corruption (VACC) seeking to stop the conversion of the historic Army and Navy Club in Manila into a boutique hotel and a casino gaming facility. In a six-page resolution dated Feb. 28 but was released to media on Wednesday, penned by Associate Justice Ramon Ramon Garcia and was concurred by Associate Justices Leoncia Dimagiba and Jhosep Lopez, the CA’s Fifteenth Division dismissed VACC’s petition for certiorari and prohibition for violating the principle on hierarchy of courts. This means the Oceanville Hotel and Spa Corp. will continue the conversion of the facility. The CA explained the petitioner’s violation of the principle on hierarchy of courts that while it has concurrent jurisdiction with the Regional Trial Court in issuing the writ of certiorari, direct resort is allowed only when there are special extraordinary or compelling reasons that justify the same. “Unfortunately, the present petition for certiorari is bereft of any compelling reason or circumstance to warrant an exception to the rule,” CA explained. The appellate court also noted that the decision of the Manila City government to enter into an agreement with private entities for the development of the Army Navy Club and the approval of the development by the National Historical Commission of the Philippines (NHCP) cannot be considered a judicial, quasi-judicial or ministerial action that can be a subject of a petition for certiorari. “The City of Manila’s execution of the lease contract with Oceanville Hotel and Spa does not fall within the ambit of judicial, quasi-judicial or ministerial function as the same is within its prerogative, powers and authority in the exercise of its executive function. On this court alone, certiorari and prohibition will not lie,” the CA ruled. The group’s petition primarily seeks the nullification of the agreement among respondents Philippine Amusement and Gaming Corporation, the city government of Manila, National Historical Commission of the Philippines, Oceanville Hotel and Spa Corporation and Vanderwood Management Corporation for the development of the Army Navy Club and to enjoin them from converting the said property into a boutique hotel and casino game facility, VACC’s proper remedy is to file a civil action for annulment of contract which falls under the jurisdiction of the trial courts. ”Neither certiorari nor prohibition is the remedy in the present case. Wherefore, the instant petition for certiorari is hereby dismissed. Accordingly, this case is considered closed and terminated,” the CA decision read. Named respondents in the petition were the Philippine Amusement and Gaming Corporation, the city government of Manila, National Historical Commission of the Philippines (NHCP), Oceanville Hotel and Spa Corporation and Vanderwood Management Corporation. In 2014, the Manila city government entered into a lease contract with Oceanville for 25 years. The contract also allows Oceanville to sublease any part of the Army and Navy Club. The NHCP then approved Oceanville’s redevelopment plan to renovate and restore the facility for the purpose of turning it into a boutique hotel, a plan which was also approved by the city government of Manila. Ocenaville then entered into memorandum of agreement with Vanderwood for the sublease of a portion of the facility for 20 years or from November 2014 to November 2034. Vanderwood then started construction of a casino gaming facility which it then subleased to PAGCOR for a period of 15 years. It added that the city government is also mandated to ensure and protect the preservation and enrichment of culture adding that the facility is a visible and tangible representation of the Philippine culture and tradition.

If you continue to borrow just to pay debts, here’s what will happen If you are in debt and don’t have enough to pay your debts each month after taking care of living expenses, you may be tempted to borrow money from credit cards to pay your other debts. At first blush, it may seem like a “brilliant” idea. Don’t do it. If you do, you are playing a game you’re certain to lose. It’s only a matter of time before you would realize how foolish this “brilliant” idea actually is. Eventually, if you do end up filing for bankruptcy later, it also possible that creditors will object to your discharge on the grounds that you used the creditors’ money with no intention to repay. The intention may be inferred from the fact that you were using your credit cards right prior to bankruptcy filing at a time that you knew (or at least had reason to know) that once your credit cards are charged up, you won’t be able to pay back the money that you used and that you would have to file for bankruptcy to discharge what you owe. This is quite common in bankruptcy practice as most people are not aware of the fact that it is not a good idea to have a lot of large pre-filing cash advances and charges if Bankruptcy is the route one is left to take. In some cases, you may end up having to pay your creditors back if they get a judgment against you in bankruptcy court. Of course, I am speaking in

general terms and that there may be facts unique to every case which would result in a different analysis. But the point is, using your credit cards right prior to bankruptcy filing may give creditors a reason and a basis to object and thus this would defeat your purpose in filing. Borrowing to pay back other debts is like digging a hole that gets deeper and deeper. It’s only a matter of time before you can’t get out. Well, you say, “How about getting a debt consolidation loan? Wouldn’t that solve all my debt problems if I could consolidate all my debts into just one loan?” First of all, the interest on a debt consolidation loan is usually high especially if you’re credit is not that good. Secondly, banks that give out debt consolidation loans will usually ask for collateral to secure the loan. If you are a homeowner and there is sufficient equity in your property to protect the creditor’s interest, you may qualify if you are willing to give the bank a trust deed on your property. If you do this,

however, make sure that you’re not just acquiring another debt you won’t be able to pay. The best type of debt consolidation you will ever find is the kind of debt consolidation that federal bankruptcy law allows for individuals who are eligible (Chapter 13). What is Chapter 13? Chapter 13 is the section of the Bankruptcy Code that allows you to reorganize your finances when debts have become unmanageable. For instance, if you can’t afford to even make the minimum payments on your credit cards, you may consolidate all your debts into one affordable monthly payment. In Chapter 13, your monthly payment is generally determined by the amount of your surplus income each month after living expenses are paid. If you have “regular income” from any source such as employment, pension, social security or even family contributions, you may be eligible for a Chapter 13 debt consolidation. Depending on your income, you can get completely out of debt in only 3 years unless the plan requires a longer term (up to 5 years) in order to be approved. In most cases, it is possible to cut your monthly debt payments in half or even less. The interest on credit card debts is reduced to zero in Chapter 13. Thus, all your payments go towards the principal amount owed. Compare this

with the 23-29% interest you’re paying on your credit cards. I’m sure you realize that if you are only making the minimum credit card payments, it will take you forever to pay off your debts! Chapter 13 also has certain benefits which space won’t allow me to discuss here. Some of these benefits include stopping a foreclosure to save your property, stopping a car repossession, paying back delinquent IRS, State and property taxes, and consolidating student loans. The peak sales volume last seen in 2004, inflated by speculator acquisitions and excessive mortgage money, is unlikely to return for decades, when interest rates cyclically peak. Relocating Baby Boomers going into retirement later this decade will be the primary propelling force in both selling homes and buying replacements beginning around 2019. Their Generation Y (Gen Y) children will add to the sales volume at the same time as they find jobs at better pay levels and become first-time homebuyers. Gen Y influence will peak in sales volume at

the end of this decade as they complete their shift from renting to owning. Once Californians feel the effects of two or three years of healthy employment growth, their confidence about the future will improve. They will once again be willing to invest in the economy since the expectations for tomorrow are projections based on yesterday’s most recent experience. Only then will occupying homebuyers – end users – return in sufficient numbers for sales volume to swell significantly. In 2018, sales volume will begin to pick up in earnest, peaking in 20192021. Employment and labor force participation will have reached beyond its 2007 peak, and grow quickly. Then, California will once again see home prices jump beyond the rate of consumer inflation. Mortgage lenders with an eye for excess profits will then begin to loosen their lending standards to whatever extent federal regulators permit or lawyers divine. The memory of the grim mid-2000s will be politely pushed aside, and mistakes might be repeated by all participants – lenders, builders, brokers and buyers. These metros with the largest jumps in year-over-year median price were Fargo, ND (up 19.9 per cent); Burlington, VT (up 18.4 per cent); Tampa, FL (up 15.9 per cent); Indianapolis (up 14.3 per cent); and Dallas-Fort Worth (up 13.9 per cent). WHO congratulates PHL for 1.1-M decline in number of smokers By Leilani S. Junio

MANILA, March 22 (PNA) – The World Health Organization (WHO) has lauded the country’s leadership in promoting significant interventions leading to a dramatic decline in the number of smokers from 2009 to 2015. “The decrease in tobacco use that we’ve seen here in the Philippines for the last years is truly remarkable, also from a global perspective,� WHO country representative, Dr. Gundo Weiler, has said. Weiler was referring to the 2015 Global Adult Tobacco Survey (GATS) report, which showed a 1.1 million drop in the number of smokers in the country from 17 million in 2009 to 15.9 million in 2015. The GATS Survey is used to monitor adult tobacco use and track key tobacco control indicators across countries. In the Philippines, the survey was conducted in collaboration with the Philippine Statistics Authority, with technical assistance provided by the US Centers for Disease Control and Prevention (CDC) and WHO, among others. The analysis and writing of the report was funded by the Department of Health. Weiler noted that with the nearly 20 percent reduction in the number of smokers, the Philippines has achieved the level of international practices. “You see such a dramatic change. Change can only be brought about based on a very strong political commitment,� the WHO official said in an interview. Weiler said the current administration’s sound leadership, as demonstrated by President Rodrigo Duterte in Davao City when he was still mayor, and the long-time advocacy of Health Secretary Dr. Paulyn Ubial, has contributed a lot to the reduction. He also cited the other factors that led to the reduction, among them the implementation of the Tobacco Reform Law in 2012 or the “anti-cancer tax� as stipulated in Republic Act 10351; the implementation of the Graphic Health Warning in cigarette packs; and the creation of anti-smoking ordinances by local governments. Weiler expressed hope that these interventions would be further strengthened by the much-awaited Executive Order on a smoke-free Philippines that is expected to be signed by the President soon. Noting that some 87,000 Filipinos die of smoking-related illnesses every year, he said these interventions are needed to protect the youth and children, from whom would come the next generation of smokers. “While this is truly a great achievement, we need to redouble our efforts and intensify the interventions that have proven to be effective,� he said.

Still others question why the government should penalize them for choosing not to own health coverage? “Obamacare is imploding�, according to President Trump. And if the Republicans don’t act soon, the American people will continue to suffer. High prices and less choices! No less than Mark Bertolini, Aetna

It mandates plans that limit choices. It imposes regulations that curtail competition. It forces government spending that is unsustainable. What will be repealed in Obamacare? And, as Congress debates health care reform, the proposed American Health Care bill aims to provide “universal access to health care, more choices, lower cost, and put patients in control� of their health care. WASHINGTON, March 23 (PNA/ Xinhua) – U.S. researchers said Wednesday they have developed a low-cost and easy-to-use smartphone device that can accurately measure semen quality in seconds. More than 45 million couples worldwide are affected by infertility, but current standard methods for evaluating semen quality, which require testing in a clinical setting, are expensive, labor-intensive and slow to return results, according to the study published in the U.S. journal Science Translational Medicine. “Men have to provide semen samples in these rooms at a hospital, a situation in which they often experience stress, embarrassment, pessimism and disappointment,� Hadi Shafiee, principal investigator at the Brigham and Women’s Hospital, said in a statement. “We wanted to come up with a solution to make male infertility testing as simple and affordable as home pregnancy tests.� In the new study, Shafiee and colleagues created a portable device that quantified sperm concentration and motility in seconds, using the processing power and camera found in widely-available smartphones. The analyzer, assembled for a total materials cost of less than five U.S. dollars, consists of an optical attachment that can connect to a smartphone and a disposable microchip onto which a semen sample can be loaded. The researchers analyzed 350

specimens, demonstrating that the device was able to detect abnormal semen with either insufficient sperm concentrations or low levels of motility with an accuracy of 98 percent. “This test is low-cost, quantitative, highly accurate and can analyze a video of an undiluted, unwashed semen sample in less than five seconds,� said Shafiee. What’s more, the test was so user-friendly that 10 volunteers with no formal training correctly classified more than 100 semen samples. Study co-author John Petrozza, director of the Massachusetts General Hospital Fertility Center, called the ability to bring point-of-care sperm testing to consumers or health facilities with limited resources “a true game changer.� “More than 40 percent of infertile couples have difficulty conceiving due to sperm abnormalities,� Petrozza said. “This development will provide faster and improved access to fertility care.... we have really been able to create a product that will benefit a lot of people.� The researchers said the smartphone-based fertility test could be also used by men to monitor their semen at home after undergoing vasectomies or by animal breeders to confirm the virility of a sample.

CDC considers travel to Mexico, Latin America a potential risk for infection SACRAMENTO – The California Department of Public Health (CDPH) advises spring break travelers vacationing in warmer climates to protect themselves from mosquito bites and avoid unprotected sex in areas with known transmission of the Zika virus. “Spring break is the perfect time to have fun in the sun, but it is important that people take precautions to prevent Zika,” said CDPH Director and State Public Health Officer Dr. Karen Smith. “Unfortunately, the mosquitoes that spread Zika enjoy warm weather too.” The Centers for Disease Control and Prevention (CDC) considers any travel to Mexico and most of Latin America to be a potential risk for Zika virus infection. Local transmission of the Zika virus has been reported in many areas of Mexico, including states with popular tourist destinations such as Ensenada, a coastal city approximately 85 miles south of San Diego, Baja California Sur (Cabo San Lucas) and Sonora, which borders Arizona. Zika virus can spread through mosquito bites and can also be transmitted by both men and women during sex. Sexually active people who travel to areas with Zika transmission should use condoms or other barriers to avoid getting or passing Zika. Condoms will help reduce the chance of sexual transmission of the Zika virus, but should not be the only form of contraception for pregnancy prevention. Most people who are infected with Zika do not experience symptoms (fever, rash, joint pain and red eyes), but they should still take precautions to avoid sexual transmission. In particular, young women who could become pregnant, pregnant women and couples considering pregnancy need to be cautious because Zika virus can cause severe birth defects. Couples planning pregnancy when either partner has been

exposed to Zika virus should speak with a health care provider about a safe time to try to get pregnant. A health care provider can also provide information on the most effective contraceptive methods. Pregnant women are urged to avoid travel to areas with known Zika transmission if at all possible. If travel is necessary, it is extremely important to take steps to prevent mosquito bites. While there has been no local transmission of Zika virus in California to date, CDPH has confirmed 524 cases of travel-associated infections in the state. Florida and Texas have experienced locally transmitted cases of Zika. People traveling to areas with known Zika transmission should take steps to avoid mosquito bites: – Use insect repellents containing DEET, picaridin, IR3535, oil of lemon eucalyptus or para-menthane-diol for long-lasting protection. If using sunscreen and insect repellent, apply sunscreen first and then the repellent. Pregnant women and women who are breastfeeding should choose an EPA-registered insect repellent and use it according to the product label. Do not use insect repellent on infants less than two months of age. – Wear long-sleeved shirts and long pants. – Use air conditioning or window and door screens to keep mosquitoes outside. If mosquitoes may come indoors, sleep under a bed net. – Reduce the number of mosquitoes outside by emptying standing water from containers, such as flowerpots and buckets. Trump signs bill pushing for crewed NASA mission to Mars by 2033 WASHINGTON, March 22 (PNA/ Xinhua) – U.S. President Donald Trump on Tuesday signed into law a bill that set a goal for the country’s space agency NASA to send humans to Mars by 2033. The bill, known as the NASA Transition Authorization Act, authorized USD19.5 billion budget in spending for NASA for the fiscal year 2017. The bill reaffirmed “our national commitment to the core mission of NASA,” Trump said, according to a pool report. “It supports NASA’s deep space exploration including the space launch system and the Orion spacecraft ... It advances space science by maintaining a balanced set of mission and activities to explore our solar

system and the entire universe.” Under the bill, NASA was directed to further advance human deep space exploration, including establishing “potential human habitation on another celestial body and a thriving space economy in the 21st Century.” It also ordered the agency to develop a human exploration roadmap for “the long-term goal of human missions near or on the surface of Mars in the 2030s” and specifically asked for a feasibility study of a Mars human spaceflight mission to be launched in 2033. LA resident convicted in tax fraud in refunds for ‘employees’ of ghost companies SANTA ANA, California – A Los Angeles man who participated in a scheme that filed fraudulent tax returns with the Internal Revenue Service seeking more than $800,000 in refunds was found guilty today of federal charges. Julien Jitt Noel, 36, who lived in Placentia while he participated in the scheme, was convicted this morning of one count of conspiracy to defraud the United States and five counts of aiding and assisting in the preparation of false and fraudulent tax returns. After a five-day trial, a jury in United States District Court deliberated for approximately one hour before finding Noel guilty. The evidence presented at trial showed that, starting in late 2008 or early 2009, Noel and two co-conspirators prepared and filed fraudulent tax returns, most of which were filed in the names of individuals whose identities had been stolen. The fraudulent tax returns indicated that the taxpayers were employed by a shell company called Picaso Fashions, a business that did not employ the taxpayers and never had any employees. The tax returns indicated that Picaso Fashions had excessively withheld income tax for each taxpayer, and each fraudulently filed tax return sought a tax refund the

taxpayer was not entitled to receive. Members of the conspiracy filed 69 false individual federal tax returns during 2009 that claimed tax refunds totaling $621,589. Noel and one of his co-conspirators established other fake companies to serve as fraudulent employers. In relation to these other bogus companies, Noel filed 45 fraudulent tax returns in 2009 and 2010 that sought $195,344 in refunds.
