Labour Promises Rental Property Ring Fencing

ecently, Labour announced its monetary policy. Included in this was a very interesting proposal to give the Reserve Bank an additional tool through compulsory Kiwi Saver that might be a more productive mechanism to control inflation than simply rising interest rates.

Unfortunately though the monetary policy statement also included a policy to introduce ring fencing of rental property losses on top of the existing policy to introduce a capital gains tax. When National came to power it considered a raft of measures under the banner of improving fairness in the tax system. Ring fencing was considered then and was rejected in favour of the removal of the deduction for depreciation on buildings. Property investors have accordingly been paying higher taxes in recent times due to the removal of this deduction and of course simply as a result of lower interest rates.

But with interest rates now rising again it is possible that property investors will move back into losses, especially those that are heavily leveraged. Ring fencing has no impact on investors who can remain profitable and so only impacts those geared at a level where losses are inevitable.

The Labour party policy to ring fence losses is very unwelcome. Ring fencing is hated for its sheer unfairness. The property losses that a property investor suffers are now genuine cash losses. They arise simply because the costs of owning a rental property and making it available for rent exceeds the rent that can be collected when money is borrowed to buy the property. These losses are no longer bolstered by the ability to depreciate the building. No other sector is required to ring fence its loss thereby preventing it from being offset against other incomes that remain taxable.
