HILE I am writing this missive, an
extraordinary real life drama is playing out thousands of kilometres away in Thailand. Trapped by monsoon floodwaters in the Tham Luang caves in northern Thailand a team of young football players aged between 11 and 16 and their 25 year old coach, captured the attention of the world. Their fate remained unknown for nine days as search teams probed the waterlogged subterranean realm for any sign of life.
Some say that their discovery by a pair of British cave diving experts was miraculous and I would entirely concur. How these volunteers managed to keep up the search in pitch darkness through for almost two kilometres of muddy water and some incredibly narrow underwater passages, is surely the material for an epic movie. Initial euphoria over finding the boys alive quickly turned into deep anxiety as rescuers struggled to find a way to get them out.
And then they came to help. From across the planet, experts in their respective fields rallied together in a bid to save this group of kids. These are not high net asset value individuals, no VIPs, no politicians or celebs here… in fact, they couldn’t be more ordinary. But this episode has shown us the power of the human spirit and our ability to transcend the political, religious, social and cultural differences that separate us from each other. One made the ultimate sacrifice …and greater love hath no man than that navy diver who gave his life during the rescue bid. I don’t know how it will end. Some boys have been safely extracted and we hope for the best. The power of the human spirit is formidable when we come together in common cause to do something worthwhile. And this leads me to a project that is much closer to home but that we hope will unite our community in a similar way. As the Ballito region grows, so does the attraction for criminal activity and our security experts are concerned. A proactive approach to security is far preferable to a reactive one and here is where technology has such an important role to play.
By linking intelligent cameras to response hubs, we can detect the presence of flagged number plates on vehicles as they enter the area and respond to them appropriately. This has had the effect of minimising crime in areas where these systems are currently operational so we are going to help to install this system here. Together with RE/MAX Dolphin Coast, we will be holding a fund raising telethon live on the radio on Friday 20th July to encourage businesses and individuals to contribute financially to the initiative. Our aim is to install an additional five cameras to augment the two that are already operational and to do this we need to raise about R200 000. I believe that we can do it and we encourage you to tune in to 88.0FM on the 20th and to join us to help protect our community through this fundraiser. ne of the more contentious issues between a landlord and tenant is who is responsible for the general state of repair and on-going maintenance and repair issues that crop up within a tenancy. More often than not, landlords unfairly assume all liability rests with the tenant, while tenants are also guilty in their assumption that their landlord is responsible for all issues and costs. The landlord is expected to offer the property at the rental commencement in a condition ‘reasonably fit for the purpose for which it was let’. Rental regulations further expect that the landlord be responsible for repairs and maintenance defined in the lease contract or as found at the ‘incoming inspection’ of the property. The landlord is also required to keep and maintain the property in accordance with Health and Safety standards and any local and relevant law. THE LEASE AGREEMENT The liability of each party must be clearly set out in the lease. Many unreasonable leases will place the entire maintenance and repair of the interior of the property squarely on the tenant’s shoulders. However, this does not exclude the landlord from responsibility in this regard - especially if the property was not ‘reasonably fit’ in the first place. This generally accepted norm of tenants being responsible for the interior, and landlords for the exterior, is simply too vague and fraught with potential conflict. WEAR AND TEAR The highly contentious issue of wear and tear also arises regularly in disputes. The Cambridge English Dictionary defines ‘wear and tear’ as follows: “The damage that happens to an object in the ordinary use during a period.” Naturally the exception would be the negligent and or excessive use of an item or blatant abuse thereof. The courts would usually apply the ‘Reasonable Person’ test in establishing whether the damage of an item falls within the realm of ‘wear and tear’. The best source for answers on the subject would be the Rental Housing Act 50 of 99 and the regulation being the ‘Unfair Practices Regulations’ as an addition to the Act. It is most important to do a thorough inspection on the day of moving into the property with the landlord or agent and to document all the issues on the property. Take notes, photos or a video for future reference purposes. PAINTING AND DAMAGE OR TARNISHING OF PAINTWORK The original condition of walls and paint should be recorded at commencement of the rental, with the date of the last paint job taken into account. It is normal to expect discolouration and small chips over time. A fair and flexible approach should be acquired. If a tenant wants to hang pictures on a wall it should be reasonable to accept it as long as the tenant knows that he/she must fix the holes and match the existing paint in order to restore the property to an acceptable level. Maintaining of the paint work inside and outside is the responsibility of the landlord, except where it was damaged by the tenant. LEAKS, DAMPNESS AND MOULD These elements can be found in many homes, especially here at the coast. Gen-
erally speaking, mildew formation in a bathroom is a result of steam build-up and condensation on walls and ceilings. Severe cases of leaks, damp and mould need to be considered in each case and cannot always be assumed to be the tenant’s responsibility. Leaks due to cracks, burst pipes, poor drainage and out-dated equipment as well as maintenance to the building and roof will be the landlord’s responsibility. BLOCKED DRAINS This can often be due to roots growing in gardens and blocking gullies and drainpipes, but may also be caused by hair and other foreign objects of tenants blocking bath and shower drains. The merit of each scenario needs to be considered and ideally the plumber should be able to adequately report the cause so that the liability can be established. When it is established that it is due to hair or food being washed down the drain, then the tenant will have to pay for the unblocking. LIGHT FITTINGS, SWITCHES AND BULBS It is generally accepted that the changing of light bulbs is the tenant’s responsibility. However the repair to faulty switches and fittings is essentially the responsibility of the landlord, unless the damage caused by the tenant has been negligent or with malice. Any faulty electricity supply must be reported to the landlord immediately. GARDENS AND POOLS This is potentially big a source of conflict between tenants and landlords. Ideally a regular garden service appointment should be made for both parties to agree on. That way the care of the outdoor areas becomes the responsibility of a service provider. The best way to dispel this bone of contention regarding the repairs to damage can be addressed within the lease agreement. Once again a good record and clear description of the state the property must be handed over to a tenant, is very important - specifically the condition of pool pump and accessories. The garden is the responsibility of the tenant to maintain and keep in good condition. Permission must be obtained from the landlord before any changes to the layout of the garden can be done, for example the removal of trees or planting thereof. If pets are allowed then care must be taken in order to keep the garden clean and free of dog faeces. THUMA MINA CAMPAIGN Launched in KwaDukuza PENNY FOURIE
RESIDENT Cyril Ramaphosa launched the Thuma Mina campaign ahead of the 2019 general elections in KwaDukuza on Saturday.
ident called upon all South Africans to join hands in a common national crusade to build the nation through activities that improve people’s lives. “South Africa needs volunteers who resemble the values of Nelson Mandela and Albertina Sisulu when it comes to selflessness and service to the people and country,” he said. Ramaphosa’s Thuma Mina campaign aims to improve service delivery with the help of South Africans. “We need leaders who will be of service to the people and nation for no reward, tender or contract.” Ramaphosa also assured the crowd that the government had no intention to expropriate land under the controversial Ingonyama Trust.
Ramaphosa, accompanied by provincial and regional leaders and some members of the national executive, started with a cleanup campaign at SADTU Park and led a 5km morning walk to promote healthy living. This was followed by the handing of title deeds to community members in Ward 16. The main address kicked off at 12pm at the Groutville sports ground where thousands of people gathered to hear what Ramaphosa had to say. Speaking at the Thuma Mina launch, translating into Send Me, the Zulu title of the campaign, the pres-

If you’ve got some time before the event, ask your employees to write down some ideas of what they’d like to see on the table. This way, you can personalize your spread and make people happy to see their suggestions on the table. If a few people have asked for the same thing, you can make this a larger portion so you don’t run out!

d el ig hts HEALTHY CINNAMON ‘Bisckies’ These have been an absolute hit when it comes to delicious ways to entertain the kids this holiday season without all of the refined sugar and rubbish. Ideal for a family baking session or even just to stock up some tins or jars for tea time. At only 55 calories per biscuit don’t be surprised if you find your hand wondering back to the cookie jar too! Makes 60 biscuits 2 Cups Almond Flour 1 ½ Cups your choice of Gluten Free Flour (Our preference is oat flour or brown rice flour here) 1 heaped Tbsp. Cinnamon 1 tsp Gluten Free Baking Powder ½ tsp Salt 2 tsp Vanilla Extract 150g Pitted Dates ¾ Cup Coconut Sugar or Honey ½ Cup softened Butter or Coconut Oil Hot boiled water
1. Set your oven to 180 degrees Celsius. 2. Boil the kettle and pour the hot water over the pitted dates to get them nice and soft, set aside. 3. In a blender combine all of the dry ingredients, by pulsing a few times. 4. Strain the softened dates and add those and the rest of the wet ingredients into the blender. 5. Blend until your mixture starts coming together as a dough. 6. Roll into 3 equal balls of dough, wrap in cling film and refrigerate for 30 minutes. 7. Rub a bit of butter or coconut oil onto a clean surface and get your first ball of dough out of the fridge. With a rolling pin roll the dough out nice and thin (approximately 3 or 4 mm thick, as you want them to dry out and be nice and crispy) 8. Take a cookie cutter and cut your shapes out, pull the excess dough off around the edges, and gently lift your cut out biscuit with a spatula or egg lifter and place
on a greased baking tray. 9. Roll the excess dough together, roll it out, cut into shapes and pop onto a baking tray. Repeat this process until your ball of dough is finished or save dough in the fridge for up to two weeks to roll out and bake as you please. 10. Bake the biscuits for about 10 minutes, check on them continuously until they are golden, but not too dark around the edges. 11. Set to cool on a wire rack. 12. If they are still a bit soft in the centers, turn them over and bake for another 3 or so minutes. They do also harden as they cool, so don’t panic if they seem a bit soft when you take them out of the oven. 13. Serve the biscuits on their own or sandwich them together with icing or date caramel, decorate as you please and devour!

Let’s start off with an accolade – to all the retail outlets on the North Coast who have decided to ditch plastic bags in an effort to prevent them from clogging up the environment – and the ocean. As consumers we need to support the phasing out of plastic bags altogether – and make sure we have sturdy shopping bags in place to take the place of plastic, or make use of cardboard boxes if these are available in the shops. Thanks to readers who have sent through mails or phoned with regards to consumer issues. I’ve had several queries lately that are all related to refunds and returns, so let’s tackle these – with regard to the Consumer Protection Act (CPA)
REFUNDS AND RETURNS.
If you are a supplier of goods, one of the most important things you need to do is to make sure that your returns or refund policy is in line with the CPA. A goods return policy, coupled with great customer service is essential to avoid complaints and loss of business. It’s important to note that there is no general right to return. If a consumer regrets a purchase (they decide when they get it home that the item doesn’t suit them or their lifestyle) and they want to take the item back, they do not have a LEGAL right to do so, and it’s up to the supplier as to whether or not a refund will be given. In terms of section 20 of the CPA, if a consumer has not had the opportunity to inspect the goods received, and on unpacking them they see that they do

not meet the type or quality they were after, the consumer can cancel the order without penalty and the supplier will have to pay the costs to return the goods. If a consumer buys a product that is defective, and the product has been reduced in price because of the defect AND the supplier has pointed out the defect, and the consumer has agreed to accept the goods in a defective condition, then the consumer will not be able to return the goods. In terms of Section 56 of the CPA, all goods sold to a consumer are sold with an implied warranty of quality, which cannot be contracted out of or revoked. The warranty gives the consumer the right to receive goods that: are suited for the purpose that they are intended to be used for; are free of defects and in good working order and durable and usable for a reasonable period of time. If this criteria is not
met with, the consumer can (WITHIN A 6 MONTH PERIOD) return the goods OR get them replaced or repaired. However, the supplier has the right to inspect the goods beforehand as the fault could be minor (not switching a product on correctly for instance). If you purchase online or have an online store – then the ECT comes in to play. The ECT has its own consumer protection provisions, some of which will trump the CPA. Consumers have a general right to return a product for seven days after delivery, for any reason, without penalty – BUT the consumer must pay the costs to return the goods.
