IF YOU THINK THE HOUSE YOU WANT TO BUY IS PERFECT, YOU MIGHT BE! “Well, Mrs Bloggs, the trouble is that surveyors are such pessimistic little people that they always seem to manage to find something wrong.” This remark was made by an estate agent to a disgruntled vendor client whose perception was that the sale of her house had been jeopardised by an unfavourable survey report commissioned by her purchaser. To a point, the observation is fair enough but perhaps it would seem less condemnatory of surveyors if ‘pessimistic’ was replaced by something like ‘realistic’. If there is such a thing as a perfect property, one has yet to meet the surveyor who actually inspected it. The fact is that there is always something either wrong now or which could give trouble in the future. This should not surprise because – amongst other things - houses are built in often porous materials which expand and contract differentially on moisture/temperature changes and because nature’s plants and creatures are forever fighting for living space and food sources (and houses provide plenty of opportunities to these hungry cohabitants). Even if whoever said that house purchase is for most people the largest monetary commitment of their lifetime probably didn’t have any children, in truth house purchase is generally an expensive enough business. It is probably self evident that if you know nothing much about, say, cars it could be prudent to have someone who does to check out an intended second hand car purchase and surely the same argument is valid for houses too. If the argument should be extended to consideration of whether or not to have children is beyond the scope of this paper. A surveyor inspecting a house will report in detail commensurate with instructions received. Thus, if undertaking a mortgage inspection on the instructions of a Bank or Building Society lending money to the buyer, the surveyor’s primary concern is in the market value of the security. So far as structural issues are concerned, the surveyor owes a legal duty of care to the buyer (as well as to the client Bank) to notify of major structural defects which an ordinarily competent surveyor (distinct from an ordinarily competent anything else) undertaking such an inspection might be expected to discover. This means that unless there is a big and obvious-to-a-surveyor defect then the surveyor is unlikely to report specifically on defects. At the other end of the spectrum of inspections and costs is a Building Survey. This requires the surveyor to take the closest possible look at the property (without damaging or destroying it ) and the Report details all structural elements of the property (eg roof, chimneys, rainwater goods, walls, joinery, loft space, floors and so on) and its environment. Defects will be identified (eg there is a crack in the wall) and comment made (eg it is not serious or it is serious and xyz is the recommended course of action). Warnings will often be incorporated (eg materials used for a particular roof covering are expected to last for only x years and although this roof is presently watertight you should expect to have to replace within about y years).

Typically a Building Survey will comment on Services (drains, electric and gas installations, etc) on the basis of the surveyor’s visual inspection only but specialist tests will be recommended where appropriate. Typically the meat of a Building Survey Report on an ordinary house will be contained in about 20 pages of fairly close typed foolscap pages. For those requiring more than a mortgage inspection from a surveyor, a Building Survey may be the only sensible option if the property is pre-about 1850 or if it is unusually large or of unusual construction. However, about 30 years ago the Royal Institution of Chartered Surveyors identified that for many purchasers the costs of a Building Survey might not be justified and so was born an intermediate level of Survey inspection known these days as a Homebuyers Report. The biggest difference between this and a Building Survey is in the form of Report with its reduced narrative and costs. For example, a Homebuyers Report will not give dimensions, arrangements and explanation of roof rafters, purlins and struts but it will – like a Building Survey- identify if there is anything wrong and, if so, what ought to be done about it. Again, all structural elements are dealt with and Services are inspected only visually. For purchasers of flats the reality is that a Homebuyers Report is the only practical option for a greater detail than Mortgage Inspection Report. The main reason is that a flat occupies part only of a building. At Haywards whatever type of inspection we carry out, we’re happy to explain our findings and help you decide on your next step. Landlords Do you know what a Tenancy Deposit Scheme is? Are you a landlord of residential property? Perhaps you are a tenant? In either case are you aware of the new rules relating to tenant’s deposits? A landlord can no longer take money from a tenant to hold as a security deposit unless it is covered by a Tenancy Deposit Scheme (TDS).Although the Rules came into force more than a year ago, at Attwater and Liell Solicitors we find that many landlords and tenants are still not aware of the requirements. Failure to comply could be very expensive indeed for a Landlord. A TDS is designed to: • safeguard tenants’ deposits; and • facilitate the resolution of disputes arising in connection with such deposits. There are two different types of authorised schemes :1. Custodial Schemes Under custodial schemes, the tenant pays the deposit to the landlord who is then required to pay the whole of this amount into a designated scheme account. The scheme administrator will hold the deposit until it is paid to the tenant or landlord, in accordance with their agreement or following a court order, after the tenancy has ended. 2. Insurance-Based Schemes Under insurance-based schemes, the landlord retains the deposit and this is only transferred into a scheme if there is a dispute with the tenant at the end of the tenancy. The scheme will then hold the deposit until the dispute is settled. When the tenant and landlord reach agreement, the administrator will distribute the deposit amount to the relevant party. The scheme will need to pay the tenant regardless of whether the landlord has transferred the deposit to the scheme as required. There will be a cost for a landlord to belong to an insurance-based scheme. This fee or premium will be set by the scheme administrator. Both types of scheme must make available alternative dispute resolution mechanisms so that those involved can try to resolve disputes over the return of deposits without resorting to the courts. Any amount of money taken by a landlord from a tenant which acts as a security deposit is covered by the new rules, even if the payment is referred to as something different.

Landlords must: • deal with the deposit in accordance with an authorised scheme; • comply with the initial requirements of the scheme within 14 days; and • provide the tenant with the appropriate information relating to the deposit within 14 days of receiving the deposit. Until this is done, the landlord will not be able to regain possession of the property using the usual ‘notice only grounds’ for possession. Under Section 21 of the Housing Act 1988 a landlord can obtain an order for possession of an assured shorthold tenancy at any point after the first six months of the tenancy, providing any fixed term has expired and they give the tenant at least two months’ written notice. If a landlord has not arranged for a deposit to be dealt with in accordance with an authorised scheme or provided the tenant with the relevant information within 14 days of receiving the deposit, the tenant can apply directly for a court order for the landlord to repay the deposit to them or pay it into a custodial scheme. If the landlord has failed to comply with these provisions by the date of the court hearing, the court must make the order as requested and order the landlord to pay the applicant an amount equivalent to three times the deposit within 10 days. Landlords of properties let to assured shorthold tenants must make arrangements to comply with the new rules and have procedures in place to ensure that deposit monies are dealt with correctly. CHANCEL REPAIR NIGHTMARE One or two of you out there who have recently been through the house buying or selling process may have seen an item called Chancel Repair Search or Chancel Insurance on the Financial Statement. Although the cost is relatively small (approximately £18 for the search and between £100 to £150 for insurance) it is now another necessary evil to add to the costs those moving home must face.

WHAT IS CHANCEL REPAIR LIABILITY Under a law originally created during mediaeval times, the Church at parish level can claim contributions from land owners to repair the chancel of the local church. This type of liability has existed unchanged since the Reformation. The liability impacts on land in over 5,200 parishes in England and Wales and currently the liability is estimated to affect 3.5 million acres of land.

LEADING CASE The liability has been highlighted under the recent House of Lords decision in the case Aston Cantlow v Wallbank when Mr & Mrs Wallbank were obliged to pay a contribution in excess of £200,000 plus legal costs. Mr and Mrs Wallbank inherited their property but one field on the property was deemed to be “rectorial property”. This made the Wallbank’s lay rectors of the local church and therefore by virtue of the Chancel Repairs Act 1932 they were liable for the repair of the chancel.

LAND REGISTRATION ACT 2002 Under transitional provisions Chancel Repair Liability will affect land even though it is not registered at the Land Registry. After 2013 this liability will only impact upon new owners of registered land if it is protected by an entry at the Registry. The Law Society is calling for the abolition of Chancel Repair Liability and its replacement with a more sensible system for funding the maintenance of historic buildings. Chancel Repair Liability is unsatisfactory for a number of reasons since it is difficult to ascertain the existence or extent of the liability, increases the

cost of conveyancing and is discriminatory because it only benefits churches of one denomination Insurance is often recommended as the solution and policies are on offer from most general title indemnity insurers. There are often conditions imposed and those involved should not approach the Church whatsoever regarding the matter and the existence of a policy should not be disclosed. Failure to observe these conditions could invalidate the policy. While the situation is wholly unsatisfactory and yet a further burden on the house buying and selling process it seems to be the only way (unless the Government abolishes the Act) to deal with a problem which is likely to remain with us at the very least until 2013. One difficult issue for conveyancers is that the number of actual claims is very small and in the leading case the actual liability was expressly referred to in the title deeds. It may be easy to explain this liability to a prospective owner in a rural area but it is a very difficult matter to justify to a prospective owner who is buying a flat in a built up area.
