ABOUT LEGISLATION TO REGULATE LETTING AGENTS In his 2012 Annual Report, The Property Ombudsman, Christopher Hamer, reiterates his call for some form of regulation of letting agents. At the very least Mr Hamer argues that all letting agents operating in the UK should be required by law to join the Ombudsman scheme. Mr Hamer says it is important that the Government heeds the current calls from TPO, trade associations such as ARLA and RICS and consumer groups such as ‘Which?’ for legislation to embrace lettings agents so they can be treated in the same way as sales agents and provide a consistency of redress for consumers. He notes that whilst the Government want to avoid over regulation, the private rented sector has grown dramatically over the last decade with more people, including an increasing number of families with children, using it to provide a roof over their heads. As a consequence of this growth the role of letting and managing agents has also grown dramatically and is now a £1 billion per annum business, handling some £14 billion per annum of clients’ money. Whilst around 60 per cent of lettings offices in the UK have voluntarily registered with TPO and follow its lettings Code of Practice, Mr Hamer argues that unless legislation is amended to require all letting agents to adhere to a set of common standards and offer their consumers a route to free redress, tenants and landlords alike will continue to be exposed to avoidable risk if they use one of the 40 per cent who do not affiliate themselves to TPO or one of the main trade associations. “The Government has made clear that it is looking to reduce the burden on businesses and has introduced its ‘Red Tape Challenge’ to de-clutter the statute books of unnecessary legislation. The Government also wishes to avoid imposing burdensome regulation on business, preferring instead that business sectors put their own houses in order. “However, those organisations involved in the property sector, including those with a consumer advocacy role, want some form of regulation to happen but realistically legislation is the only vehicle that can bring 100 per cent of letting agents within the fold. “Pressure for change is increasing with amendments to the Estate Agents Act 1979 (EAA) being put forward in Parliament on a number of occasions and I would caution the Government that this is an issue which simply cannot be put off any longer.” The Property Ombudsman also highlights the forthcoming changes to existing legislation and, in particular, the amendment to the EAA which will allow ‘passive intermediaries’ to act outside of the requirements of that Act, yet provide an introduction service for buyers and sellers. “The point I am concerned about here is if it says ‘estate agent’ on the tin, looks like an estate agent and acts like an estate agent then the consumer will assume they are dealing with an estate agent,” explains Mr Hamer. “However, they will be unaware that, like a private sale, there is no free access to redress through TPO if a dispute arises and will be misled into a less structured environment. I assume also that such offerings will be at a price much reduced on the charges by a recognised agent. Inevitably that will attract more sellers to use those services, more buyers will therefore be innocently drawn in and overall more consumers will be involved in a transaction where the only independent redress mechanism is potentially expensive legal action.” The Property Ombudsman’s 2012 Annual Report can be downloaded from: www.tpos.co.uk/annual_reports.htm

The Landlady The Landlady has a dithering lodger

A

bout a month ago, one of my long-term French lodgers sent me a text saying she needed to speak to me. Whenever someone ‘needs to speak to me’, I can assume that it is generally to deliver bad news in person, rather than via a text message or other form of electronic missive. On this occasion, I was correct with my anticipation of bad news, as the girl had decided to rent a flat on her own. Or rather, her parents had agreed to pay for her to rent a flat on her own. I wonder how these parents afford to pay for their offspring to rent a room in my house, let alone rent a whole flat by themselves. Although I was slightly disappointed – this girl has been a perfect house guest – I wasn’t surprised that Landlady Towers was not for her, as she’s quite a reclusive and quiet girl and relations between her and “March is not a good my other lodger seem to be quite tense at the best of times. time to have I have noticed that they tend to eat their dinner in a relay style an empty room...” to avoid each other, which is quite observant for someone who’s spent half of this year so far in Africa... Although the lack of students cluttering up the pavements around Churchill Square is probably quite a positive thing, I was duly concerned about how I was going to re-let the room at such short notice. I needn’t have worried, as the recession seems to have had an adverse effect on the influx of foreign students who seem to be falling over each other for the chance to learn English, although many of them seem to come in order to improve their English, then end up working here. Who can blame them with the economy in Europe being in its current state? Within two days, I’d re-let the room to a Turkish man, who intends to stay for one year. Two weeks later, just a week before she was due to leave, the French girl sent me a text saying she ‘needed to talk to me’ again. What more bad news could there possibly be? Had she destroyed her bed? Razed her wardrobe to the ground? Burnt a hole in the carpet? (Not an unusual occurrence.) No, she wanted to let me know that her flat had fallen through and she was staying for at least another month, which means I’ve put the cart very much before the horse. So, yet again I find myself sharing a bedroom with the charming, yet noisy Small Daughter. Deep joy...

Robert Nemeth celebrates Exeter Street Hall

E

xeter Street Hall was a hive of activity when I visited. The building and the surrounding streets of Prestonville were covered in a thick layer of snow, which meant that sodden coats were drying all around the building. But, most importantly, the all-important deadline of 31st January 2013 was approaching fast. St Luke’s Church was built in 1875 on the Old Shoreham Road. St Luke’s Church Hall – known fondly as Exeter Street Hall – was built around the corner nine years later, as confirmed by a ceremonial foundation stone on the building’s red-brick façade which was laid, presumably when construction was completed, on 6th May 1884. It was at the end of 2011 that residents of Prestonville were informed by the Church that the hall was to be put up for sale – and soon afterwards that a community campaign sprang up to purchase the building for the public good. £200,000 was to be raised by selling shares to anybody who wanted to chip in. Hundreds of people got “A community campaign involved. Leaflets were being batched, banners folded and lists checked. It was a highly-organised chaos in the kitchen behind. The front of the building consists of the main hall, which is situated between separate entrances for boys and girls. These doorways presumably date back to the original Sunday School. A multitude of gables (I counted ten) and medieval-themed fireplaces clearly define the building’s style as Gothic. A trap-door in the floor close to the boys’ entrance was simply dying to be lifted. It came up fairly easily, at which point a small crowd gathered to see what was below. It had clearly been explored before by successive tradesmen as electricity cables and gas pipes can be seen zigzagging across the cavity below. It is fairly deep though and itching to be navigated properly. When I visited, an impressive £138,850 had been raised with only around one week to go. A flood of last-minute share applications, and a £50,000 reduction in the selling price, meant that the hall was saved. When my wife and I decided in March 2012 to sell an investment property, a semi-detached house in Hove, we at first did not appoint Baron Estates as our sole agent. In retrospect this was a bad decision and after three months when a sale was not in the offing we asked them and two other agents to take on the sale. I was immediately impressed by Baron Estates: Ryan, Danny and especially Simon with whom I had most dealings were always cheerful and energetic. The sale itself posed problems because the house had been a licensed HMO until 2010 and a Certificate of Lawful Use had to be obtained; furthermore, the property needed much repair and refurbishment. Although there were many other calls on his time, Simon was one of the few agents who seemed to grasp the legal and planning implications; he showed great patience and reassured me whenever the situation became daunting. The sale of the property was completed in February2013 and I have no hesitation in recommending Baron Estates to other sellers and buyers.
