Judge Won’t Allow Holder Appeal Now In Contempt Case Josh Gerstein Politico November 19, 2013

A federal judge has refused Attorney General Eric Holder's request that he be allowed to proceed now with an appeal in a case where the House of Representatives is seeking to enforce subpoenas for documents related to the controversial Operation Fast and Furious gun investigation. In a ruling Monday afternoon, U.S. District Court Judge Amy Berman Jackson said her September 30 ruling rejecting Holder's request to dismiss the lawsuit was not such a close call that it deserved immediate review from the U.S. Court of Appeals for the D.C. Circuit. "While the Court agrees with defendant’s characterization of the matter as significant, that is not the test," Jackson wrote in her new four-page decision (posted here). Jackson's latest ruling means it is likely the Justice Department will have to produce a detailed log of what was withheld from the House Oversight and Government Reform Committee and why. Rounds of protracted litigation over the legitimacy of the withholdings seem all but certain, unless the sides come to an agreement which has heretofore eluded them. "The Court is not of the opinion that its denial of the motion to dismiss involves a controlling question of law as to which there is a substantial ground for difference of opinion," she wrote in her Monday order, issued just one business day after Holder's lawyers asked for the immediate appeal. "The ruling was based upon Supreme Court precedent and Circuit precedent, and it was decided in accordance with an opinion issued by another judge of this court in a substantially similar matter.... Defendant has not pointed to any precedent that would supply the grounds for a difference of opinion." Jackson noted that while she was turning down Holder's request for an immediate appeal, she has yet to rule on whether any documents have been improperly withheld from the House Oversight and

(PHOTOS: Eric Holder’s career) "If the Court ultimately orders defendant to do anything, he will have an opportunity to ask both this Court and the Court of Appeals to stay the execution of that order if the conditions for a stay – which are different than the conditions for an interlocutory appeal – are present. The Court expresses no opinion at this time as to how that motion would be resolved," wrote Jackson, an Obama appointee. A Justice Department spokesman and a spokeswoman for the committee did not immediately respond to requests for comment on the ruling. Former House Counsel Stan Brand said it was not a major loss for the Justice Department, though he understood why lawyers their hope to head off the dispute now and send it directly to the appeals court. However, he said there was no plausible avenue for that to happen in the wake of Jackson's ruling Monday. Brand said the next step would be detail-oriented litigation in the district court over what documents have been withheld and why. "They still have all their claims on the merits which could take months," Brand said. "There's still not order saying they must produce a single document. We're six months or more from that final decision and it will be appealed then."

The black-nationalist Department of Homeland Security employee who was placed on leave almost four months ago for running a website that espouses the mass murder of whites has still not been fired, an agency spokesperson told National Journal. The Southern Poverty Law Center first exposed Ayo Kimathi in August, prompting a small media firestorm that led DHS to place the procurement officer on administrative leave with pay pending review. DHS deputy press secretary Gillian Christensen confirmed that his status has not changed and that he is still on leave pending review. Kimathi, using the online nom de guerre "the Irritated Genie," called for "ethnic cleansing" of "blackskinned Uncle Tom race traitors" on his website, which envisioned a massive race war on the horizon. "In order for Black people to survive the 21st century, we are going to have to kill a lot of whites— more than our Christian hearts can possibly count," he wrote. In other postings, he warned that whites and their enablers like President Obama are trying to "homosexualize" black men in order to make them weaker, and suggested that a woman's primary role in life should be to "keep a strong Black man happy." He also seemed to hold anti-Semitic views, claiming in a Facebook post that his website was under attack from a conspiracy of "zionist smallhats, the Uncle Tom koons," and, naturally, "the haters." Kimathi, who has been at DHS since 2009, works for Immigration and Customs Enforcement and made $115,731 in 2012. Civil service laws make it difficult for the federal government to fire employees. Government Executive's Charles Clark reported in early September that DHS received complaints about Kimathi as long as two years ago. A former supervisor of Kimathi's told the SPLC that "everybody in the office is afraid of him," and worried that he would "come in with a gun someday and go postal." In September, a contractor at the Washington Navy Yard killed 12 people and injured eight others in a shooting rampage that also left him dead. Homeland Security has condemned Kimathi's political views and said his employment is under review, but as of Monday afternoon, he remains employed. That's not acceptable, says Josh Glasstetter of the SPLC, which researches hate groups of all stripes. "DHS should be tracking Kimathi, not employing him," he told National Journal. "This isn't a mundane human resources matter or a tricky First Amendment question. DHS should have investigated and fired Kimathi months, or even years, ago," Glasstetter added. Kimathi has claimed his website was merely intended for entertainment. "The Irritated Genie of Soufeese" replied to a request for comment sent to his website saying "we will not be making any statements on this unfortunate situation." Establishment seeks to assimilate or eliminate independent media The dinosaur media is in terminal decline but it will not go down without a fight, which is why the establishment is relying on a number of different techniques to remain relevant while strangling its competition. Print journalism is fast becoming a distant memory as the establishment press rapidly loses its audience to independent media outlets on the Internet. Far from accepting its fate meekly, the system has rolled out the big guns in a desperate bid to either eliminate or assimilate the burgeoning alternative press. The latest example is buried within the secretive Trans-Pacific Partnership agreement (TPP) and concerns “intellectual property enforcement.” Put simply, the agreement will mandate ISPs to remove online content without the need for a burden of proof or any kind of legal process, greasing the skids for aggressive and disproportionate censorship-driven takedowns. “If instituted, the TPP’s IP regime would trample over individual rights and free expression, as well as ride roughshod over the intellectual and creative commons,” reads a Wikileaks statement. “If you read, write, publish, think, listen, dance, sing or invent; if you farm or consume food; if you’re ill now or might one day be ill, the TPP has you in its crosshairs.” Another way the mainstream media is trying to strangle alternative voices that might challenge its narrative is by phasing out or banning article comments altogether. Studies confirm that article comment sections – for better or worse – are heavily swaying public opinion.

The New York Times alsorecently indicated that it is scaling back comments and removing them from some articles altogether. As an excellent Daily Tech piece highlights, Popular Science admitted that its decision to pull the comment section was in order to preach a “scientific doctrine” on global warming without being challenged. The move to kill off comments altogether comes after a largely failed attempt on behalf of major companies and governments around the world to hire armies of paid employees to troll comments by disseminating pro-establishment positions in a bid to shift popular perceptions. In 2010, the Canadian government announced it would, “monitor online chatter about political issues and correct what it perceives as misinformation.” Turkey, Israel, China, are just some of the governments openly hiring paid trolls to steer public opinion, while the Pentagon announced earlier this year that it is stepping up its public relations efforts in order to counter scandals about the U.S. government emerging on huge but non-establishment news outlets like the Drudge Report. Large mainstream news organizations like ITN are busy creating offshoot platforms that present themselves as “citizen journalism” yet are ultimately bankrolled and controlled by the establishment media itself. Meanwhile, large news organizations that initially operated somewhat outside of the influence of the establishment media, like the Huffington Post, are being quickly swallowed up by giant corporations like AOL. The mainstream media will attempt to use all of these methods and more to either supplant or destroy independent voices that are not controlled by the establishment, which is why independent media needs to be more watchful than ever if the Internet is to remain a bastion of free speech and continue to provide a genuine alternative to the corporate press.
