Welcome to the 2015 Global 100 Awards Consisting of only 100 of the World’s leading firms and individuals, with votes received from our global readers, in over 163 countries worldwide. The purpose of the Global 100 is to provide the readership with a comprehensive understanding of those firms that are truly leaders within their chosen areas of specialisation. The Process; The Global 100 does not follow the usual process followed by many other publishers. The process follows a very specific, very comprehensive process, not commonly used elsewhere in the industry. Following the closure of the voting process, which follows a very strict format of self-submission and third party nomination, firms are shortlisted and selected as winners, in this elite group as follows; Assessment stage: For each category awarded a proprietary method of analysis ranks winners based on their domestic and international work. This ranking method produces a list of shortlisted firms, based on a very comprehensive set of criteria. Judging stage: Once all votes have been received, an independent panel of judges review the votes within each category. The judges will assess the following in their considerations: The strategic nature of work conducted. The complexity of work conducted. The scale of work conducted. Whether the work conducted was done so in a speedy manner, and within budget. Any ground-breaking or innovative processes used during completion of conducted work. The judges have been asked to focus strongly on the complexity and strategic significance of work conducted. The above criteria underlines the importance of the recognition each firm is receiving based on being recognised as a Global 100 winning firm. In summary, the Global 100 program provides a benchmark of the very best of the best industry leaders, exemplary teams and distinguished organisations. It is a requirement for all our programs of recognition to receive no less than 18% in votes from the global readership, currently in excess of 151,000. This policy is applied to further endorse the worthiness of the awards presented and any marketing carried out as a result of the process. The Global 100 - 2015 edition has been divided into six sections. You will find a full and comprehensive winners index towards the front of the supplement. We would like to extend our congratulations to all of the 2015 Global 100 award winners.

Kenya

KENYA’S GROWTH AS AN EMERGING MARKET AND ITS IMPACT ON LOCAL SERVICE PROVIDERS By Anne Mubia Kenya is known the world over for its adventurous tourist safari packages and for its strong, resilient and highly awarded athletes. Kenya is however, now attracting a different kind of attention as an investment hub full of opportunity. Over the past couple of years the world’s eyes have been focused on Nairobi as a possible Capital City in which to base operations for organizations looking to explore the emerging markets across Africa. Among the key reasons fuelling the world’s interest in Kenya include: -

10

d. Kenya’s strategic location i.e. excellent connectivity to major world-wide hubs that make it easy to work with most continents. This is noting that Nairobi is the transportation hub of Eastern and Central Africa and the Port of Mombasa supplies the shipping needs of more than a dozen countries e. Heavy investment by the Government in improving physical infrastructure especially roads and the upcoming standard gauge rail

a. Political good will and stability as led by the current Jubilee Government

f. The “Moving East” initiative where Kenya is seeking to engage countries in Asia like China to increase trade across countries in East Africa

b. Evolving legislation aimed at making Kenya an attractive investment destination

g. Increased exploration of oil and natural gas in the Northern parts of the country leading to discovery of commercially viable oil deposits

c. A well-educated, young and English speaking workforce creating a ready pool of local human resource

h. Good weather and climatic conditions, among other softer reasons.

Kenya

Kenya is developing at a remarkable rate. Insecurity, particularly external terrorist attacks, had threatened Kenya’s rapid pace of growth. However, with the Government’s refocus of human capacity and financial resources within the security docket, this threat is now being adequately addressed and managed. Part of the visible strategies adopted by the Government in improving security include: i. Increased recruitment drives and initiatives within the security forces ii. Introduction of the ‘Nyumba Kumi’ initiative where citizens are encouraged to know their neighbours iii. Aggressive public education on matters of internal security iv. Key changes at the helm of the security dockets beginning with the Cabinet Secretary in charge of Interior and Co-ordination of National Government and the Police Commissioner, and v. Increased investment in patrol/response vehicles, equipment and technology which have also been adopted as modern forms of security enhancement. Recent visits from key global leaders including President Barack Obama’s visit to Kenya for the Global Entrepreneurship Summit in July this year and the anticipated visit by Pope Francis later this month, have endorsed Kenya as a country of interest. The Obama visit saw both the US and Kenya Governments sign bilateral cooperation agreements that will boost Kenya’s security and economic efforts. The two countries agreed to deepen partnerships between them on matters security which included an action plan to fight terror and extremism that involves funding and training support. From an economic perspective, emphasis was placed on access to education by way of increased girl child and women focused initiatives. Increased visa validity periods to 5 years for students and possible direct flights between both countries are discussions that are underway. In addition to the above, Kenya is scheduled to host the World Trade Organization’s 10th Ministerial Conference in Nairobi in December 2015 and the sixth Tokyo International Conference on African Development (TICAD) in September 2016. These summits and conferences are forums where important ideas are propelled and they attract thousands of delegates. They effectively showcase Kenya’s potential for business through partnerships with the world. This is aimed at strengthening Kenya’s position as a leading business nation in Africa providing direct market access to 45 million people

and an opportunity to serve hundreds of millions of people across Africa. With these statistics, it is no wonder that many foreign global companies from Europe, the United States and the East, have taken a keen interest and set up their headquarters for Africa in Kenya. Based on the foregoing, Kenya’s dynamics are changing so as to adequately service and meet the standards of the world that is now wooing it. Nairobi in particular is attracting many known international retail and service providers to service both the businesses being set up as well as relocating individuals. The question thus arises, how will the entry of international service providers as players on the Kenyan market impact local service providers? Local service industries are numerous and varied. As such, they cannot be fully outlined or detailed in this article. However, they include the more traditional service lines such as finance, legal, engineering, advertising, insurance etc as well as the more modern service lines as led by advancements in mobile telephony and information technology. At present, the lead advantage that local service providers have is the strength of existing relationships and an intricate understanding of local business dynamics. This lead in the absence of other supporting factors will be quickly closed. Excellence in service provision will take center stage as both local and international service providers begin to compete on the basis of best practice and global standards. This will require changes where leaders of service provision firms will need to create structures that support client focused work environments that are a way of life for their organizations. Specialization will be required and the ‘jack of all trades’ model will no longer be viable nor sustainable. Competition will peak as local service providers compete amongst themselves and ultimately with international service providers. The beneficiaries of this competition will be clients as users of service. Tenets for quality service provision including integrity, innovation, continuous growth, teamwork, recognition and people focus will be key drivers in changing business dynamics in Kenya within the service sector. New relationships and alliances will be formed. Only those local service providers who are able to realize that the tide is turning and adapt fastest will survive and thrive. We as a Firm, embrace this season of change as part of development and look forward to growing with Kenya as a key business player on the African continent.

Alliott Group www.alliottgroup.net is a worldwide alliance of independent law, accounting and consulting firms. With more than 165 member firms in some 70 countries, the group meets the local and cross-border needs of its members and their clients.

Locally – by helping to raise the profile of our members within their respective markets as the firms of choice for servicing cross border business (for both inward and outbound investment)

The Group has two clear objectives. The first is to support accounting and law firms looking to maintain their independence run their business better and to grow their cross border service offering and then secondly to provide an alternative professional services resource for entrepreneurs and business a like as they look to do business in new markets.

New business – through the sharing of information and the development of third party relationships with organizations and the buyers of professional services

Referrals – creating an open and easy forum for members to assist their clients as they look to do business in other jurisdictions

Supporting professional service firms to become more strategic in supporting their clients’ needs

The principles of Alliott Group are passion – to bring energy, drive and resolve in supporting business growth; integrity – consistently making fair, honest and reliable choices; and excellence – capability to provide top quality services in an efficient and effective manner that exceeds expectations.

The Group’s long term goal is to support its accounting and law firm members in becoming recognised within their respective markets as a primary source of accounting and / or legal information and services to facilitate cross-border business.

Alcides Avila, Managing Partner of the Miami based law firm ARHMF stated that, “Alliott Group’s focus on enhancing the client experience is aligned with our core values and will benefit our domestic and international business clients.”

The Group looks to deliver real value for its members by focusing on business, and we look to support our members to develop business on three levels:

Member firms have a strong local market presence which provides them with an in-depth knowledge and understanding of business and cultural matters, enabling them to tailor specific solutions.

www.kmhmediagroup.com

Accountancy & Law Alliance of the Year - Global Market

They are able to co-operate with one another on a local, regional and worldwide level to access knowledge and best practices from like-minded professionals to give them a competitive advantage in servicing their clients. John Chesworth, Managing Partner of UK law firm member Harrison Drury commented that, “Being a member of The Alliott Group has increased our international reach, enabling our clients to benefit from the expertise of other business professionals, but also enabling us to develop new business opportunities, both domestically and overseas.” Alliott Group firms typically service SME and entrepreneurialled businesses seeking qualified and tailored solutions from professionals with the correct technical and industrial knowledge, as well as a full understanding of the local business environment. James Hickey, Alliott Group CEO, noted: “We are different to most other associations and networks in that we do not just focus on one aspect of business. Instead, through our alliance with national, regional and international accounting, legal and consulting firms, Alliott Group members can offer to their clients the resources one might expect only from a large multi-office service provider’.

Providing an alternative resource to business looking to open in new markets - International experience at a local level For any business either with existing international operations or considering expansion into a new market, an understanding of the local economy, business regulations and culture is essential. Alliott Group members can access both accounting and legal advice and support in some 70 countries while supporting the local needs of their clients in their home market. As businesses look to evaluate how they source external professional advice, and pressure is placed to reduce business costs, the independent firms within Alliott Group provide a good alternative to the larger accounting and law firms that traditionally serviced cross border businesses. The independent members within the Group have the same technical capabilities as the larger firms, but are able to provide a more tailored solution at a significantly reduced cost. There is an alternative to the big firm experience, and that is for businesses to utilise the growing market presence of Alliott Group and its worldwide coverage of independent accounting and law firms. A London based Financial Director of a leading US equity firm noted that, “Whilst Alliott Group offers international reach, its members provide the local expertise that is vital when entering a market for the first time.”

Big enough to cope, small enough to care Through the partner led service offering member firms provide, clients have access to a constant contact point enabling a better understanding of their business needs. Additionally, Alliott Group members’ advisory rather than transactional approach to doing business, allows development of a better understanding of a client’s operations and needs which in turn leads to longer standing business relationships and an added value approach to their service offering. A Managing Directory of a multi-national company with operations in Greece, India, Singapore and the UK responded to his experience of using Alliott Group members by saying, “it is uncanny how the size, the fee structure, the service levels and the culture of all of the Alliott Group firms who are looking after us are alike.” The real alternative to the ‘big firm’ experience The combination of accounting, law and consulting firms provides a ‘one-stop-shop’ environment allowing Alliott Group member firms to provide clients with an alternative source of professional support. Together, members are able to provide seamless national, regional or international coverage for their clients. In addition, the fullycoordinated multidisciplinary service offering that members have access to in turn helps them to explore opportunities, develop presence and take advantage of economic prosperity for their clients in any region. Independence and high professional standards are the key Each member firm is a separate and independent legal entity. Members undergo a thorough screening as part of their application process and are regularly assessed to ensure maintenance of a high level of professional standards across the Group. As a result, our members are among the most respected, forward-thinking firms in their respective markets.

Administration of the Group Alliott Group has a full time team of four staff within the Executive Office that is tasked with managing the day-to-day administration and meeting the strategic objectives of the group. The Executive Office is located in Petersfield, United Kingdom and the team is there to assist members wherever possible. The Group has a meetings and conference program that is open to members and their clients attend on a national, regional and worldwide level. “Alliott Group is all about the people within each firm. Attending conferences is a great way to build relationships to facilitate working together,” states Paul Grossbard of the Group’s Houston based accounting firm member Miller Grossbard Advisors, LLP.

Competition Economics Consulting Firm of the Year

EE&MC is an economic consulting firm fully specialized in competition law. Our main areas of expertise relate to the economic assessment in agreements, mergers, abuses of dominant positions as well as State aid and regulatory issues. EE&MC applies highly advanced econometric tools as well as solid scientific theories to support its clients in demanding cases. The company has a strong record on cartel damages calculations and merger assessments as well. The EE&MC teams in Brussels, Bonn and Vienna are managed by Prof Dr. Dr. Doris Hildebrand, one of the founders of the “more economics-based approach” in EU competition law (also known today as European School) in the mid-nineties. This approach is the firm’s special area of expertise: the application of European competition economics. The European approach is unique since it reflects the EU law on competition as it stands. EE&MC economic analyses are fully embedded in this legal framework. In this respect, EE&MC benefits from latest academic research on this subject at the University of Brussels (VUB). Professor Hildebrand leads the research cluster on European competition economics and policy (ECEP) at this university. She publishes and lectures extensively on the European approach. In contrast to the European approach, U.S. Chicago School focuses on efficiencies and the “big is beautiful” paradigm. Chicago School thinking is often applied by economists with U.S. roots. However, Europe does not welcome this U.S. approach since it is not part of our legal system and values. Instead the European approach applies economic analyses within the legal framework of Article 101 and 102 TFEU as well as the merger regulation. By applying this European approach the likelihood that the presented arguments are accepted by the European Commission or the national antitrust authorities is more likely. For clients this difference counts. Due to this particular know-how, the firms’ economists

are extremely successful in all areas of competition law enforcement. In addition, the firm is valued for its pragmatic and goal-oriented approach and its broad expertise in many sectors. EE&MC reports are easy to understand for non-economists which in turn increases the value of our working products. The firm works in all EU Member States, courts and with the European Commission. EE&MC analysts cover several European languages which makes it easy for the firm, for example, to support multi-lingual merger filings. Usually the firm advises on the board level. Board members know exactly what kind of services they are looking for. They search for the best economists with high reputation and strong empirical skills to solve their business problems. In particular, they appreciate the firm’s interdisciplinary approach, the strong network as well as the academic affiliations of most of the EE&MC economists. EE&MC’s biggest successes of the past 12 months is that the company is involved in a number of high profile cases. These cases are of particular interest since the outcome of these cases is going to shape outmoded approaches towards product as well as geographic market definitions. The company has a special area of expertise in retailing, media and various industrial products. Another booming area is cartel damages calculations. In these projects practical expertise counts and is decisive. EE&MC has a strong record on a significant number of cartel damage calculations already. Many EE&MC clients use the new European Commission’s Directive to claim successfully damages at national courts. The company is expanding with a special focus on hiring high academic potentials. For 2016, objectives are continuing to manage the expanding business of the company as well as continuing to focus on challenging cases.

Alternative Dispute Resolution Law Firm of the Year

TTA’s streamlined operating model allows it to provide superior legal advice at substantially lower rates and to offer flexible fee arrangements that are compelling. Very rarely is it actually in a client’s interests to take a case to trial. When parties are in the midst of fully contested proceedings, it can be difficult for them to have a sensible dialogue about settlement. The various options for ADR can be deployed to overcome this issue, but it takes experience and an understanding of the personalities involved to select the right approach and the right time to make the approach. TTA partners are highly skilled in this field and regularly achieve successful settlements in the best interests of their clients. The firm’s dispute resolution group regularly acts in high-profile international disputes including for investors, funds, directors, shareholders, banks, high net worth individuals and others from all

Cayman Islands

over the world, the vast majority of which have been settled out of court prior to trial. Recent settlements include a long running set of disputes involving financing of a flagship development in the Caribbean and a complex multinational quasi-partnership dispute. On the ADR side, the group has acted in more than 100 mediations, both as mediator and as representative of the parties. It also advises on other formal forms of ADR, such as early neutral evaluation, and regularly takes the lead on informal settlement negotiations. TTA regularly acts for investors, finds, directors, shareholders, banks, high net worth individuals and others from all over the world. Several of the firm’s lawyers have valuable industry experience, particularly the funds industry, which helps them better understand the sorts of issues their clients face day-to-day.
