A potentially weak Crown case means one of two men facing serious charges in relation to a shooting in downtown Kamloops earlier this month can’t be kept in custody, a judge has ruled. Trevor Taylor was granted bail in Kamloops provincial court on Wednesday, Nov. 23. The 26-year-old was arrested alongside Brandon Schell, 27, at the Victoria Street McDonald’s on Nov. 7. Two days earlier, Schell is alleged to have shot 51-year-old Arthur Burley in the shoulder in a downtown apartment — an attack police believe is linked to the drug trade. The Crown said Taylor was present during the shooting. Schell is facing one count of attempted murder and remains in custody. Taylor was charged with uttering threats and obstruction of justice. It is alleged he threatened three witnesses to the shooting hours after it took place. The Crown alleges Taylor said: “Remember what happened last night? You say anything [to police], the same could happen to you.� However, Kamloops provincial court Judge Chris Cleavely

acknowledged there’s not a lot of evidence linking Taylor to the threats. The witnesses told police the threats came from a man named “Tre.� Cleavely said the only real link is the fact that nickname could conceivably be short for Trevor, and that Taylor was arrested alongside Schell. Court heard the witnesses were shown photo line-ups by police — and none identified Taylor as the man who was with Schell when the shooting took place. “It would appear clear the Crown faces serious challenges in establishing Mr. Taylor’s involvement,� Cleavely said. At about 2:30 a.m. on Saturday, Nov. 5, Burley was shot in an apartment in the 400-block of Seymour Street. There has been no update on the 51-yearold’s condition, but police have said they expect him to make a full recovery. Taylor was released bail with a $2,000 deposit. He’ll be bound by conditions requiring him to report to a bail supervisor and obey a strict 9 p.m. to 7 a.m. curfew. He’s also been ordered to have no contact with Schell, Burley or any of the three witnesses. Taylor and Schell are both slated to return to court today (Nov. 24) for arraignment.
