Background: Mesothelioma is nearly always employment related and caused asbestos dust inhalation. Only one out of 1,000 cases will the disease develop from natural causes. Mesothelioma is a form of cancer most commonly affecting the external lining of the lung (pleura). There is no cure but treatment can ease symptoms and extend life expectancy. There are other asbestos related conditions such as asbestosis, pleural thickening and pleural plaques. These diseases will only develop where the sufferer has had substantial exposure to asbestos dust over a period of time. Mesothelioma can be different as the sufferer may have only been exposed to a minimal amount of dust. In mesothelioma and other asbestos conditions there will be a considerable delay from when the sufferer was last exposed to asbestos up to date between exposure and the onset of symptoms. Most people think asbestos is relatively recent however history books tell us that the use of asbestos goes back thousands of years. In Greek and Roman times, asbestos fibres were used for many things, from lamp wicks to burial clothes. Asbestos was revived when the Industrial Revolution occurred and from the late 1800’s up to the 1970’s it was used to routinely insulate pipes, boilers, ovens and walls. As electricity became more common, asbestos was used in insulation of wiring. It was applied as insulation on steam locomotives as well as in ships and used in a composite for brakes linings and insides of brake drums on cars, trucks and buses. It can also be found in roofs, exterior walls, guttering and tiles. Finally it was also used in flooring materials, air handling systems, domestic appliances and boilers, plus in other products such as fire blankets and water tanks.

Our Recent Successes Ben Mitchell, represented a mesothelioma sufferer who had worked for various employers at chemical plants and power stations. Proceedings were commenced quickly in the Royal Courts of Justice in London in order for the claim to be dealt with as quickly as possible. Liability was quickly conceded. However, the main issue was in respect of the Claimant’s pre-existing health factors, in particular his prostate cancer which was unfortunately discovered at the same time as he first experienced symptoms of mesothelioma. As well as instructing a consultant chest physician, to provide a report on the clients mesothelioma for the purposes of pursuing the claim it was necessary to obtain a report from a Consultant Urologist to deal with the issue of the prostate cancer having an impact on the sufferers life expectancy in the absence of him contracting mesothelioma. The Urologist was able to give a full opinion on the prostate cancer and its likely implications for our client’s long term survival. He assessed, the chances of our client’s long term survival on account of the prostate cancer. The claim concluded for an award of £175,000 in under 12 months and within the clients life time. He was able to move to more suitable accommodation which he and his wife had hoped to do in any event. Mr B WAS still able to continue with a reasonable quality of life in the full knowledge that his wife’s financial future was secure. Ben Mitchell, represented a mesothelioma sufferer who had worked for British Rail and breathed in the deadly dust when he worked alongside coach builders who were applying asbestos sprayed insulation to the outside of carriages. Liability was conceded very quickly. The client sadly died before the case could settle. He left behind a wife and a teenage son with mental disabilities who was dependent upon his father as the primary carer. His wife was also dependent upon her husband financially. A claim to recover compensation for the loss of financial dependency was straight forward. The compensation claim for the financial expense the son would have to incur for the rest of his life was very complex. He would have to have health carers look after him as a direct replacement of the services his father provided him, all coming at a substantial cost. Care Case Management expert reports, and evidence given by experts in mental illness was all obtained in order to establish the potential monetary loss to the family. The claim settled for over £ 800,000.00. The compensation was placed in a special trust and the family could look to move on with their lives safe in the knowledge that the sons care needs were going to be met for the rest of his life.
