J. J. Keller Is Here To Help! The CDL Drug and Alcohol Clearinghouse is a repository to collect information on drug and alcohol violations occurring under a motor carrier’s DOT testing program. As of January 6, 2020, motor carriers, medical review officers (MROs), consortium/third-party administrators (C/TAPs), and substance abuse professionals (SAPs) must provide information when a driver: • Tests positive for drugs or alcohol; • Refuses drug and alcohol testing; and • Undergoes the return-to-duty drug and alcohol rehabilitation process. Motor carriers must query the database on two occasions: • During the hiring process, and • Annually for current drivers. Effective 1/1/2020, The FMCSA has increased the minimum random drug testing rate to 50% for 2020, for all commercial drivers subject to testing under Part 382. The rate had been 50% prior to 2016, but was lowered to 25% through 2019. The FMCSA was forced to revert to 50% because the industrywide positive drug test rate climbed to 1% (that is, 1% of drivers tested positive for drugs according to FMCSA’s latest annual data for 2018).

WORKPLACE POLICY Workplace Violence is Prohibited This company prohibits violence in the workplace and makes every attempt to maintain a safe workplace.

What is workplace violence? Workplace violence can take many forms. It can include verbal abuse, physical assault, or homicide, as well as online threats through email or social media. It can occur at work, or outside the workplace.

What should be done following an incident of workplace violence? • Obtain medical evaluation and treatment as needed. • Report all incidents and threats of workplace violence to a supervisor or other designated representative.

Who is vulnerable?

• Promptly report any violent incidents to the local police.

Workplace violence can strike anywhere, and no one is immune. Some workers, however, are at increased risk. Among them are workers who: • Exchange money with the public; • Deliver passengers, goods, or services;

• Discuss the circumstances of the incident with the employer and staff members. Employees should share information about ways to avoid similar situations in the future. • Ask if your employer offers stress debriefing sessions and post-traumatic counseling services to help workers recover from a violent incident.

• Work alone or in small groups;

• Discuss possible changes in your company’s workplace violence prevention program during regular employee meetings.

• Work late night or early morning hours; and/or • Work in high-crime areas or in community settings where they have extensive contact with the public.

What protections does OSHA offer? The Occupational Safety and Health Act’s (OSH Act) General Duty Clause requires employers to provide a safe and healthful workplace for all workers covered by the OSH Act. Employers who do not take reasonable steps to prevent or abate a recognized violence hazard in the workplace can be cited.

How can you get more information? OSHA has various publications, standards, technical assistance, and compliance tools and offers extensive assistance through its many safety and health programs: workplace consultation, voluntary protection programs, grants, strategic partnerships, state plans, training, and education. Resources such as OSHA’s safety and health program management guidelines identify elements that are critical to the development of a successful safety and health management system. Information is available at www.osha.gov. To file a complaint by phone, report an emergency, or get OSHA advice, assistance, or products, contact your nearest OSHA office, or call (800) 321-OSHA (6742) or TTY (877) 889-5627. To file a complaint online or obtain more information on OSHA federal and state programs, visit www.osha.gov.

Email and Social Media The company reserves the right to monitor and audit the operation of its Internet system and periodically review all records stored on its server, including company email. Employees who send emails using company accounts represent the organization. Use proper grammar and proofread and spell-check all emails. Company email and Internet access is primarily for business use. If the personal use of email or the Internet interferes with business expectations, disciplinary action may result. Social media (which includes any means of communicating information or posting content on the Internet) should be used on work time only when business-related and authorized by your supervisor or manager. Many employees use social media outside of work, but employees should remember that the use of social media comes with certain risks. Employees are responsible for what they post online, even when such posts are made during personal time.

How can employees protect themselves? Nothing can guarantee that an employee will not become a victim of workplace violence. These steps, however, can help reduce the odds: • Attend personal safety training programs to learn how to recognize, and avoid or diffuse, potentially violent situations. • Alert supervisors to any concerns about safety or security and report all incidents immediately. • Avoid traveling alone into unfamiliar locations or situations whenever possible. • Carry only minimal money and required identification into community settings.

Be wary of engaging in any online conduct that adversely affects your job performance, the performance of fellow employees, or otherwise adversely affects customers, suppliers, or the company’s legitimate business interests. Participating in such conduct may result in disciplinary action.

Keep in mind that speaking directly to coworkers is often a much more effective means of resolving work-related issues than posting complaints on a social media outlet. Sexual Harassment

is against the law and will not be tolerated Sexual harassment is a form of sex discrimination that violates Title VII of the Civil Rights Act of 1964. Title VII applies to employers with 15 or more employees, including state and local governments. It also applies to employment agencies and to labor organizations, as well as to the federal government. State laws may also prohibit sexual harassment, and may cover organizations with fewer than 15 employees. “Sexual harassment” can include unwelcome sexual advances, requests for sexual favors, and other verbal or physical harassment of a sexual nature. Harassment does not have to be of a sexual nature, however, and can include offensive remarks about a person’s sex. For example, it is illegal to harass a woman by making offensive comments about women in general.

Facts about sexual harassment

The illegal use, possession, distribution, or manufacture of controlled substances is strictly prohibited. Employees are not allowed to be under the influence of illegal drugs or alcohol while at work.

Drug and alcohol tests may be conducted

Sexual harassment can occur in a variety of circumstances, including but not limited to the following: • The victim as well as the harasser may be a woman or a man. The victim does not have to be of the opposite sex. • The harasser can be the victim’s supervisor, an agent of the employer, a supervisor in another area, a co-worker, or a nonemployee such as a contractor or even a customer. • The victim does not have to be the person harassed but could be anyone affected by the offensive conduct. • Unlawful sexual harassment may occur without economic injury to or discharge of the victim. Although the law does not prohibit simple teasing, offhand comments, or isolated incidents that are not very serious, harassment is illegal when it is so frequent or severe that it creates a hostile or offensive work environment or when it results in an adverse employment decision (such as the victim being fired or demoted). Although less serious conduct might not be unlawful, it may still be deemed a violation of a company policy and could result in disciplinary action or termination.

What should a victim of sexual harassment do? • Inform the harasser directly that the conduct is unwelcome and must stop. • Write down what happened; include details such as dates, times, locations, and possible witnesses. • Use any employer complaint mechanism or grievance system available. A victim should report harassment to the employer even if the victim did not confront the harasser to explain that the conduct was unwelcome. Sexual harassment should also be reported by a person who witnesses improper conduct. • A discrimination complaint may be filed with the federal Equal Employment Opportunity Commission (EEOC) or a state agency.

Equal Employment Opportunity Commission investigations A victim has 180 days to file a charge of discrimination with the Equal Employment Opportunity Commission (EEOC), or 300 days if the charge is also covered by a state or local law. When investigating allegations of sexual harassment, the EEOC looks at the whole record: the circumstances, such as the nature of the sexual advances, and the context in which the alleged incidents occurred. A determination on the allegations is made from the facts on a case-by-case basis. It is also unlawful for an employer or individual to retaliate against a victim, witness, or other person for filing a discrimination charge, for testifying, or for participating in an investigation, proceeding, or litigation under Title VII.
