Got Questions? When employees transfer a chemical from the original container to a secondary container, the secondary container must follow the GHS labeling requirements. The only exception is when the chemical is in the sole control of the employee who poured the chemical from the original container to the secondary container during the same work shift.

Q & A

Employers should be aware of the limitations on the consumer product regulations under 1910.1200(b)(5)(v). Many cleaning chemicals and lubricants are sold in stores, but employees use them in greater volume or frequency than consumers. In that case, you must keep SDSs for the chemicals, train employees, and implement a Hazcom program. Employers are not required to create a Hazcom program or have SDSs for household chemicals when the employees use the chemicals sparingly, similar to how they’d be used at home.

What are the labeling requirements if a chemical is poured into a secondary container? Label it with the product identifier, words, pictures, symbols, or a combination thereof. Can we use HMIS or NFPA labels to label secondary containers? You can use your own system for in-house container labels as stated in 1910.1200(f)(7). You must train your employees on your in-house labeling system. Are we to label secondary containers with expiration dates? No requirements exist in the regulations for expiration dates to be put on chemicals containers.

When it comes to labels on containers of hazardous materials in the workplace, employers may use the same GHS-style label found on the container, or label workplace containers with alternatives such as third-party systems (e.g., National Fire Protection Association (NFPA) or Hazardous Materials Identification System (HMIS)) in addition to the other required information. Any container of hazardous chemicals in the workplace must at a minimum include the product identifier and general information on the chemical’s hazards.

EDITOR TIP You must label all chemicals with the product identifier, words, pictures, symbols, or a combination thereof as stated in 1910.1200(f)(6). A Letter of Interpretation dated June 20, 2017, titled “Labeling of Secondary Containers” states that “paragraph (f)(6)(ii) does not require that workplace labeling include the manufacturer’s name and address, precautionary statements, or hazard statements.” The purpose is to provide employees with at least general information regarding the hazards of the chemicals and help them find specific information regarding the physical and health hazards, like finding the SDS for the chemical. Keep in mind that this applies to all chemical containers in the workplace including secondary containers that other employees will use during different shifts. If you see containers that aren’t labeled, or if a label is no longer readable, your employees may need training on these requirements.

Must we update the labels on containers already in our workplace?

The employer is not responsible for updating labels on shipped containers, even if the shipped containers are labeled under HazCom 1994. The employer must re-label items if the labels are removed or defaced. Must container labels be in English? OSHA requires labels to be legible, in English, and prominently displayed. Other languages may be displayed in addition to English.

If I label a drum with the HazCom-required pictograms, do I still need the DOT markings?

The OSHA pictograms do not replace the diamond-shaped labels that the U.S. Department of Transportation (DOT) requires for the transport of chemicals, including chemical drums, chemical totes, tanks, or other containers. Those labels must be on the external part of a shipped container and must meet the DOT requirements set forth in 49 CFR 172, Subpart E.

While the DOT diamond label must appear on the outside shipping container, where required, chemicals in smaller containers inside the larger shipped container do not require the DOT diamond but do require the OSHA pictograms. What is a health hazard? OSHA defines a “health hazard” as “a chemical which is classified as posing one of the following hazardous effects: acute toxicity (any route of exposure), skin corrosion or irritation, serious eye damage or eye irritation, respiratory or skin sensitization, germ cell mutagenicity, carcinogenicity, reproductive toxicity, specific target organ toxicity (single or repeated exposure), or aspiration hazard.”

To comply with the training requirements in the Hazard Communication Standard (HCS), employees must be provided with a general understanding of the information on labels and SDSs and know how to access the SDSs. They must be made aware of the protective measures available in the workplace, how to use or implement those measures, and who to contact if they have questions or an issue arises.

What is a physical hazard?

OSHA defines a “physical hazard” as “a chemical that is classified as posing one of the following hazardous effects: explosive, flammable (gases, aerosols, liquids, or solids), oxidizer (liquid, solid or gas), self-reactive, pyrophoric (liquid or solid), self-heating, organic peroxide, corrosive to metal, gas under pressure, or in contact with water emits flammable gas.” How often must you provide HazCom refresher training? You must provide “effective” HazCom training to your employees at the time of their initial assignment and whenever a new physical or health hazard the employees have not previously been trained on is introduced into their work area. For example, if a new solvent is brought into the workplace, and your employees have never had training on the hazards of similar solvents, training must be conducted for employees in those areas where they will be exposed. Are in-plant labeling systems permitted under the HazCom Standard? Yes. If your in-plant or workplace labeling system meets the requirements of 29 CFR 1910.1200(f)(6)(ii), you may continue to use it as long as it, in conjunction with other information immediately available to your employees, provides information on all health and physical hazards of the hazardous chemical. Must I train in languages other than English? OSHA requires that you train your employees in a manner and language they understand. If you communicate work instructions and other workplace information to employees in a language other than English, you must provide safety and health training to your employees in the same manner. Similarly, if an employee’s vocabulary is limited, the training must account for that limitation. By the same token, if the employee is not literate, telling them to read training materials will not satisfy the employer’s training obligation.

OSHA has provided the following extended compliance dates to meet the new SDS requirements: December 1, 2013 — Employees must be trained on the new label elements and SDS format. June 1, 2015 — Chemical manufacturers and importers must provide SDS with the chemical.
