Introduction: -

Protests require a lot of decisions in a short period of time - The decisions are complex and uncertain - To the extent it’s possible, plan ahead

- This 5 item checklist is a tool to help you parse out what’s important

Jennifer Schaus & Associates – GOV CON WEBINAR SERIES - 2017 - WASHINGTON DC

www.JenniferSchaus.com

Item 1: Check The Deadlines. Check the Deadlines. Check the Deadlines. - Many Valid Protest Grounds Are Waived If Not Raised BEFORE BIDS GO IN - After Award or After Debrief – 10, 5, but really 4 day GAO deadline - Different Timeline for Different Acquisition Types (FAR 15 vs. FAR 12) - Non-Technical protests (Size, NAICS Code, HUBZone) Have Shorter and Different Deadlines

Item 2: How Good Was Your Proposal Really? (Check Your Compliance Matrix) -If your proposal wasn’t

good enough, it’s much harder to win a protest

-Sometimes the Government is right

Item 3: Check The Issues Different issues have different likelihoods of success Contrast: (a) regulatory compliance issue; (b) OCI issue; (c) Technical evaluation issue; (d) Allegation of government malfeasance issue;

Item 4: Check The Agency and the Acquisition Type Certain Acquisitions are Easier To Successfully Protest Than Others -Large IDIQs, but to some extent it depends on the protest grounds Certain Agencies are More Likely To Reverse an Acquisition Decision Certain Acquisition Types Are Non-Protestable On Most Grounds (Task Orders @ $10M Civilian, $25M DoD)

Item 5: Check The Office Politics - Most Contractors Deal With The Project Team, But The CO Makes The Acquisition Decision - What is the Relationship Between the Project Team and the CO - What is the Relationship In That Agency Between COs in General and Legal (deferential legal to CO, other layers of review) - What is “Really Going On” – Bid Protests are all about plugging holes in incomplete information
