BUSINESS REVIEW 2011 New laws That May Impact Your Business A number of legislative and regulatory changes will toke effect in 2011 that may impact the operations and planning of local businesses.

' Keeping our members informed of the nature and timing of these types of changes is on important part of the Chamber's mission," stated Kim Cousins. President and CEO of the l ake Elsinore Valley Chamber of Commerce. ' We encourage all members to review this information and contact the Chamber staff with any questions: continued Cousins.

The following is a list of new lows that have recently gone into effect or will take effect in 207 J: Workers' Compensation Notice Requirements The posting and notice requirements were amended in 2010 to require additional information about Managed Professional Networks (MPNS) . Employers with MPNs that provide treatment for workers' compensation claims must display the required workers' compensation poster (Notice to Employees - Injuries Caused by Work) as well as additional information about the MPN(s) the employer uses. The workers' compensation pamphlet must also include information about MPNs. Workers' Compensation for Roofing Contractors AB 2305 extends the requirement that contractors with a C-39 roofing classification obtain and maintain workers' compensation insurance. even if they have no employees. This requirement was set to expire on January 1. 201 L and is now extended until January 1, 2013. Additionally. after January 1. 2011 .. any .active license will be suspended if the C-39 roofing clasSification was removed and the licensee is found to have ~mployees and lack a valid certificate of workers' compensation Insurance. Workers' Compensation Stop Orders 56 1254 authorizes the registrar of contractors to issue a stop order (effective immediately on service of the order) to any contractor (licensed or unlicensed) wholailed to secure workers' compensation coverage for his/her employees. Additionally, employees affected by the work stoppage must be paid by the employer for lost time. up to 10 days, while the employer seeks to comply with the law. Failure to observe the stop order is punishable bya misdemeanor (up to 60 days in county jail) and/or a fine of up to SlO,OOO. The legislation also implements 0 means by which the employer may protest the stop order and request a hearing on the matter. Organ and Bone Marrow Donor leave California employers with 15 or more employees must now provide the following paid leaves to employees who choose to donate organs or bone marrow: • Organ donors - must be provided a 3O-day (workdays) leave of absence In anyone-year period

• Bone marrow donors - must be provided a leave of absence up to five workdays in anyone-year period The statute says that such leave does not run concurrently with the Fomily and Medical leave Act (FMLA) . However, slate law cannot override federal law. Therefore, leave for the purpose of donating bone marrow or an organ may run concurrently with FMLA if the employer is a covered employer and the employee is eligible for FMLA. Heal Illness Regulations Revised A revised heat illness standard went into effect November 4, 201 O. In addition to revisions related to shade and other sat.e~ preca.utions, the new standard includes changes to training requirements for both supervisory and nonsupervisory employees. Such training is now required to be given before employ~s begin work that ' should reasonably be anticipated to result In exposu re to the risk of heat illness ,' GINA Regulations Finalized

!he U.S. Equal Emp!oyment Opportunity Commission (EEOC) ISSUed final regulations on November 9 that implement the employment provisions (Title II) of the Genetic Information Nondiscrimination Act of 2008 (GINA). GINA prohibits use of genetiC information to make decisions about health insurance and employment. and restricts the acquisition and disclosure of genetiC information. GINA applies to private employers with 15 or more employees and generally prohibits employers from requ,,:sting an applicanrs or employee's genetic information, even .f the employer never uses that information. Furthermore. under AB 4oo. employers would also be requ ired to post information regarding employees' right to paid sick leave. thereby adding onto the already numerous and burdensome posti ng requirements in Ca liforn ia. The costs for these mandates alone will overwhelm businesses in California that are already struggling to survive in this economy. As recen tly reported in the February 2011 Institute for Women's Pol icy Research on the effect of the pa id sick leave program in San Francisco. 15.2% of the employees surveyed were laid off or had their hours reduced after the program was implemented: 14.1% of the employees surveyed received fewer bonuses or had their benefits reduced; and 21 7% of the employees had increased work demands. Out of the industries surveyed. businesses with 24 employees o r less were the most negatively impacted by the paid sick leave program . In addition to the increased business expenses and potential loss of jobs AB 400 will create. AB 400 will also dramatical ly increase an employer's risk for lega l fees and costs. Not only does AB 400 create a private right of action for employees to sue for any alleged violation with the right to recover back wages. liquidated damages. withheld sick days. attorney's fees. reinstatement. and inj unctive relief. but it also creates a rebuttable presumption of retaliation . Specifically. under AB 400 it will be presumed that an employer reta liated aga inst an employee if the employer takes any corrective action within 90 days of an employee's complaint or opposition to an employer's practice or pol icy regarding mandated paid sick leave. AB 400 also imposes penalties against an employer for failure to post the required notices imposed by this section. as well as maintain records regarding employees' accrued sick leave. California was recently raled one of the top ten litigious states in the nation. AB 400 will certa inly emphasize that point with the various vehicles for litigation it creates .

July 2011 Lake Elsinore Valley Chamber Opposes Mandated Sick Leave Proposal The Lake Elsinore Valley Chamber of Commerce opposes a statewide proposal CAB 400) which will mandate that all employers. except those with collective barga ining agreements. provide any employee who has worked in Ca lifornia for seven days with paid sick leave with an accrual rate of one hour for every thirty hours worked. After the 90th day of employment. employees would be allowed to utilize their paid sick leave to care for themselves or a family member, Under AB 400. any unused sick leave accrued in the preceding year could be carried over to the next year. which is a significant change in existing law. 'AB 400 would unreasonably expand employer costs and liability for new mandated paid sick leave benefits covering al l employees: stated Kim Cousins. President and CEO of the Lake Elsinore Valley Chamber of Commerce. Rate regu lation is a distraction that avoids the difficult task of driving down the cost of medical care. It does nothing to lower the underlying causes of esca lating medicol costs. A 2004 RAND study. ' Should California Regulate Hea lth Insurance Premiums?" concluded that if costs continue to rise while premiums are frozen. then rate regu lation CQu id lead to reduced quality and quantity of care, and ultimately insurers CQu id leave the California market. Furthermore. California has two new tools to ensure against excessive premiums: • The federal Patient Protection and Affordable Care Act includes a provision a lready in effect to limit the medical loss ra tio, which limits the amount health plans and insurers can spend on administration versus direct medical costs . • AB 1163 passed the legislature and was signed by the Governor in 201 0, effective this year. This new law provides ra te transparency and review. Not enough time has passed to sufficiently review the impact of these p rovisions. However, to date. it can be said that the review process has brought such tra nsparency and heightened awareness to premium increases that during the process, some health plans have rolled back increases. ·The legislature should give these and other provisions o f the tederal health care bills still to be implemented time to impact the rising cost of hea lth care: stated Kim Cousins, President and CEO of the Lake Elsinore Va lley Chamber of Commerce. ·Simply capping rates will not make the costs in the healthcare system disappear but instead will limit choices and quality for employers and their employees." Imposing price controls on policies fai ls to take into account the major causes of rising medical care costs and therefore cou ld lead to limiting access, and ultimately limit employers' choice of affordable health p lans for their workforce. AB 153 (Skinner - D) Inte rnet Sales Tax Lake Elsinore Valley Chamber Position: OPPOSE AB 153 would require online-only out-of-state retailers to collect state sales taxes for purchases sold in Ca liforn ia. AB 153 wou ld redefine a retailer engaged in business in this state as (1) any retailer entering into ag reements for a commission or other consideration, (2) who d irectly or indirectly refers potential purchasers, whether by an Internet-based link or an Internet Web site, or otherwise, to the retailer, and (3) provided the total cumulative sales p rice from all sales by the retailer to purchasers in this state that are referred pursuant to these agreements is in excess of $10.000 within the p receding 12 months. The Cha m ber opposed similar legislation last year that was eventua lly vetoed by the Governor. We are concerned that retailers will cut contracts with online advertisers in Cal iforn ia ultimately eliminating an important source of revenue, which income tax is pa id on. for many online entrepreneurs and other Cal iforn ia-based organizations . 34

AB 318 would require that after January 1. 2011 the Franchise Tax Board must compile information on any tax credits reported by a company who is a publically traded and by June 30. 2013 and each year thereafter the information must be published on a state web site. AB 318 unfairly targets public com panies by taking advantage of current law to exploit companies by placing additional reporting mandates and burdens upon them. S8 378 (Dutton - R) Flexible Work Week lake Elsinore Valley Chamber Position : SUPPORT SB 378 would allow employers (optional for those with 5 or fewer employees) to establish an alternative workweek schedule that allows an employee to work up to 10 hours a day, 40 hours a week. Cu rrently. employees must approve by a secret ballot election of at least 2/3 of the affected employees in a read ily identifiable work unit is required for adoption of an a lternative workweek schedule. As the law stands today, individual employees do not have the right to seek and arrange individual flexible schedules with their employers . SB 378 will provide individual workers much needed flexibility to perm it four-day workweeks for workers desiring to find a balance between work and personal lives.
