This trip will allow our select group of executives the first-hand opportunity to see how these facilities run including meeting leadership teams, R&D, QC, processing, etc. The word “transparency” is used, and overused, in so many ways today, but if providing the opportunity for our

Like them or not, regulations are the backbone of the dietary supplement industry. Here are three areas of regulation in play which will all have a major impact on supplement manufacturing and production in the years to come. SUPPLEMENT FACTS: COMPLIANCE DATES EXTENDED, BUT STILL LOTS TO ACT

E

ffective July 2016, the U.S. Food and Drug Administration enacted a major revision to the Nutrition Facts labels on foods in order to better provide updated nutrition information to assist consumers in maintaining healthy dietary practices and to help them make more informed food choices. Many of these changes also impact the Supplement Facts labels for dietary supplements. Based on comments it received, the FDA delayed the compliance date for the label changes for manufacturers with $10 million or more in annual sales to Jan. 1, 2020. Manufacturers with less than $10 million in annual sales will now need to comply by Jan. 1, 2021. As with the new food label, the agency will no longer require information on vitamins A or C (unless you’re making a specific claim or for product requirements) or calories from fat, although inclusion is allowed, if desired on supplement labels. However vitamin D, potassium and “added sugars” content must be declared, and there are new rules about how fiber and sugars are listed (see Fig. A).

Finally, since the number of calories derived from supplements is insignificant, the requirement that food manufacturers will have to follow around displaying calories on supplement labels will not apply for supplement manufacturers.

NDI MASTER FILES: A GOOD IDEA It’s been almost two years since the FDA proposed master files as part of its revised New Dietary Ingredient (NDI) guidance. NDIs, required for all new dietary ingredients introduced into the market after October 1994 as part of the landmark Dietary Supplement Health and Education Act, is the very last aspect of the law that has yet to be finalized.

Considering the complexity of many dietary supplement formulations and products, proactive supplement manufacturers are already well on their way toward researching, testing and then implementing the changes to their product labels and formulations well ahead of the extended compliance deadlines.

The concept of master files—a dossier containing detailed and confidential safety and manufacturing data—is used in pharmaceutical regulation and approval as well as in drug development, and the NDI draft guidance of August 2016 proposes this for supplement ingredients as well. But who gets to use these files for their own NDI notifications? Supplement brand Herbalife proposed the master file concept for supplements in 2011 comments to FDA in response to the agency’s first NDI guidance, and suggested that whomever submitted the master file could provide written permission to allow another company filing an NDI to rely on that information. “A system is needed to avoid unnecessary duplication as regards NDIs for the same product sold to different manufacturers,"

Herbalife said in its comments, “Also, a number of dietary supplement manufacturers produce products containing the same ingredients. Subsequent NDI notifications for supplement compositions relying in part upon the same ingredients would refer to the relevant master files and would not need to include additional safety data about the referenced ingredient." The United Natural Products Alliance (UNPA) thinks this is a useful idea as it gives companies greater control over their intellectual property and addresses the issue of research piggybacking—that is, companies citing research specific to other ingredients and processes, including safety and toxicology data, and then using that research to back their own NDI filing. The alternative would be for companies that have filed an NDI to simply share this proprietary information with their clients under a non-disclosure agreement where you would disclose all of the proprietary data to the client. Meanwhile, as industry waits for the publication of comments and FDA’s analysis of those comments from the revised NDI guidance and the issuance of a final regulation, FDA is attempting to understand if the master file process is of value to the supplement industry and is trying to gauge whether industry would utilize it. When you consider the not-insignificant administrative burden master files would create for the agency as well as

its well-known limited resources, it’s a question worth pondering. Who would pay for the master file administration? Are supplement user fees in our future to cover these costs? UNPA will report on this critical conversation as we learn more.

CALIFORNIA’S PROP 65: AUGUST 2018 COMPLIANCE DATE IS LOOMING

Key amendments to the labeling law:

California’s Proposition 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide warnings to Californians about “significant” exposures to chemicals that cause cancer, birth defects or other reproductive harm. The law requires the state to publish a list of chemicals known to cause cancer, birth defects or other reproductive harm, which is updated annually and now includes approximately 900 chemicals.

Unlike the delay in federal label changes mentioned above, the Prop 65 changes come into effect on Aug. 31 of this year. If you sell products in The Golden State— the world’s fifth largest economy—the clock is ticking.

upplement and nutritional manufacturing is a rapidly growing industry with U.S. sales topping $36 billion in 2017. But more products mean more recalls. In fact, 60 percent of FDA annual recalls of supplement products stem from labeling issues.

These issues include: Absence of an ingredient claimed on the label, inclusion of an ingredient omitted from the label, a higher or lower amount of the ingredient than what is claimed on the label, label layout that does not conform to regulations, undeclared allergens and illegal or improper use of content claims. Supplements may also be recalled due to contamination or because they meet the FDA definition of a drug and must be regulated as such.

Ingredient Tracking & Formula Creation Before using Genesis R&D Supplements, many of our customers were using spreadsheets and hand calculations for nutrition analysis, product formulation and costing, which is an error-prone and tedious process. Labels One of the most significant benefits of the Genesis R&D Supplements program is that it lets users quickly create regulatorycompliant labels for their product packaging. For Supplement Facts labels, the standard nutrients (such as calories, fat, carbohydrates, vitamin C, etc.) are governed by Nutrition Labeling and Education Act (NLEA) rules regarding nutrient name, nutrient order and when they can be listed on the label. They appear above the divider line and most will have a % Daily Value. The Other Dietary Ingredients will not have an associated %DV and are governed by different NLEA rules that specify the information and order needed.

In both cases, nutrients and Other Dietary Ingredients are only added to the Supplement Facts label if they are present in the product in a significant amount. Additional considerations are governed by the Dietary Supplement Health and Education Act of 1994, and they include guidance for listing blends, showing herbal sources and more. For each formula created, Genesis R&D automatically creates a regulatorycompliant label that conforms to the rules set out by both the NLEA and DSHEA. Users can fine-tune the label’s font, layout and items listed on it. Labels can be exported as a vector file to be used by graphic designers in creating the packaging.

Allergens The FDA requires labels to disclose the presence of any of the eight major allergens—milk, eggs, fish, shellfish, tree nuts, peanuts, wheat or soy—in foods or supplements.

In Genesis R&D, as long as the allergen data was correctly entered for the ingredient, any allergen statement for any formula using that ingredient will automatically list the allergen, and the allergen can be displayed on the label with the click of a button.

Chemical Impurities Tracking Chemical Impurities are components found in ingredients that (when consumed in high doses) are known to be toxic for humans. Legislation, such as California Proposition 65, requires companies to inform the public about the presence of certain materials in the products they sell. Genesis R&D lets users track and report chemical impurities while highlighting when the amount in a formula exceeds designated thresholds as laid out in Prop. 65 for lead, cadmium, mercury, tungsten and arsenic.

Percent Organics Tracking Using the word “organic” on a supplement package requires certain parameters to be met. When a supplement contains only organic ingredients, the bottle can say “100% organic.” To use "organic" on packaging, the product must contain at least 95 percent organically produced ingredients. The remaining ingredients can be nonorganic only if they aren't available in organic form, or if they are exempt per the National List. The packaging can also claim that the supplement was made with a specific organic ingredient, but only if the total amount of organic ingredients is at least 70 percent. With Genesis R&D Supplements, each time a formulation is adjusted, with added ingredients or changes in amounts, the percent organics is automatically recalculated; no hand calculations are needed. If the organics percentage is below the target threshold, the program will highlight the new total in red.

Reports and cGMPs A quick browse through the FDA’s warning letters and it’s clear that the industry struggles with Current Good Manufacturing Practice (cGMP) records and labeling compliance. ooking towards summer 2018, the trade war* launched by President Trump against China ranks as the top potential factor which will influence the future supply of ingredients. Once product list and timeline are confirmed, and the new tariffs* are charged upon the imported products from China, the prices will change dramatically in the ingredient industry because most of the key dietary supplements come from China such as Ascorbic Acid/Vitamin C, Taurine, COQ10, etc. The uncertainty is how many products will be listed and when the new tariff rates will take effect, for which, we will monitor closely.

Another important factor is the currency exchange rate between China and the U.S. RMB value has been increasing against the USD in the first half of the year and it looks like the trend will continue. The China exporters are trying to offer shorter payment terms so that they can collect the USD sooner to reduce the loss due to the currency. As to the supply from factories, the general situation is better now. Most of the products are back to normal. Some new factories launched the products that were tight at the end of last year to early this year, and some existing factories whose production were shut down due to different reasons are resuming their production. *As this issue goes to press, the trade war/tariffs are uncertain.

ACE K Price is increasing step by step for three reasons: 1. The factory is trying to make more profit from Ace K to compensate for the loss of their other ingredients 2. One of the major factories shut down 3. The currency exchange rate change B12 The pollution control still has great impact on the major factories and price remains very high. Some new factories are trying to produce B12 and we think it will become stable in the coming two months. BCAA Instant BCAA supply and demand are balanced so far and the price is stable. The individual Leucine, Isoleucine and value supply are tight. The major reason for this

is the factory of the individual amino acids supply most of their output to the Instant BCAA factories already and they are not worrying about the sales and only offer availability to the market when the deal is good. BETAINE ANHYDROUS/BETAINE HCL Generally, the price of Betaine becomes higher due to the starting material cost increase. The number of inquiries are much greater than earlier in the year and we think the price will stay firm. BIOTIN The price has dropped due to an improved availability from the major factories. BITARTRATE/CHOLINE CHLORIDE The competition between different

factories is more intense and different factories have adjusted their prices based on their capabilities. CAFFEINE SYNTHETIC/THEOBROMINE Prices are stable and at a high level. One of the major factories had some issues with the FDA which caused supply issues, but there are other factories who are running production normally. The cost of pollution treatment and also the difficulty of the production will keep the price stable at the current level. CALCIUM/MAGNESIUM/MANGANESE/ POTASSIUM GLUCONATE SODIUM/ZINC The antidumping investigation is still on for Gluconate Salt which influences the importation from China.

CALCIUM/MAGNESIUM/SODIUM BHB (BETA HYDROXYBUTYRATE) The inquiries keep increasing for the above three supplements and supply is very tight due to factory production schedule and starting material supply. CALCIUM CITRATE/MAGNESIUM CITRATE The import is switching from China to India due to the antidumping issue with Chinese material. CALCIUM D-PANTOTHENATE Some existing factories resumed production which has made the supply better for B5. However, the pollution control in Shandong province is strict and it causes some issues with the production. Generally, the price is not as high as earlier this year and is stable at its current level. CHONDROITIN/COLLAGEN The Chondroitin market is currently stable. Collagen is becoming more popular and customers are trying to use different types and different sources to reach the best delivery value and results. CITRIC ACID ANHYDROUS Price is stable and will be for one month but higher than earlier this year due to currency, production cost and duty fees. CLA OIL/CLA POWDER CLA price is generally stable but increased little by little due to production cost and the currency exchange rate. COQ10 Most blank orders are signed for the major demand in the U.S. and the price became soft due to good availability. CREATINE MONO Prices are higher than at the beginning of the year due to limited starting material. Some factories chose to relocate in order to avoid the pollution issue while some factories tried to step into production. We think the price will be high towards the end of the year, but when the new factories start to produce stably, it may stabilize the price and market as well. FOLIC ACID Production and demand are balanced, but current demand is far less than the production capacity, so the price is expected to be soft in the coming three months. GABA Price remains firm so far and demand is strong. The factories know the overall demand well and the market has developed in a healthy manner.

L-GLUTAMINE

L-ARGININE/L-CITRULLINE

Price has been stable and demand is very strong so far this year. The major factories may shut down for summer maintenance and price will stay firm or increase.

GLYCINE Price is currently stable and availability is good from different countries.

The oversupply issue is still not fixed and the demand of Arginine and Citrulline are increasing, but it is still less than the supply from factories. Current price is at the bottom and has little room to drop further. L-CARNITINES Production is still on and off due to pollution control and the starting material supply leads to an unstable supply. Price fluctuates a little bit up and down but is generally stable.

MSM Price is higher than earlier this year due to the starting material cost increase. NIACIN/NIACINAMIDE With the new factories coming in, and also with the expansion of production, price is decreasing. The factories sense this trend and are taking measures to control the output to stabilize the market.

L-GLUTATHIONE REDUCED Price increased fast and availability is limited. The recognition of this ingredient increased the usage both domestically and internationally.

PYRIDOXINE Similar to Vitamin B1 Thiamine, price is stable at a high level, but the demand is a little soft. Some factories are still planning to produce more, so it is expected the price will drop a little in the coming two months.

Supply is still very short due to the shortage of the starting material, and price keeps increasing.

Although availability is better compared with last year, the demand increased faster for the health benefit and recognition, so the price is staying firm or increasing. The number of inquiries and sales amount are both increasing as well.

The BASF Lemon Aldehyde factory resumed production since May and it is expected the supply will become available in June. Prices are dropping back to a more reasonable level and some customers are preparing extra stock in case of supply issues, so the demand is becoming less at current stage.

RIBOFLAVIN As we mentioned in the last update, some new factories have successfully launched the production and the supply situation is much better now. The price is also coming down to a more reasonable level. SODIUM HYALURONATE Supply is becoming tighter since April and the cost is increasing due to pollution control and labor costs. Price will stay firm for the next two to three months. SPIRULINA The quality has been greatly improved from China over the years and the price increased slightly due to labor costs and currency.

SUCRALOSE There is an issue of overcapacity and the major factories are still trying to gain the market share, so the price competition is intense. However, the profit is very low at the current stage, so it will be hard decrease more. TAURINE Price is lower than at the end of last year and supply is better due to better output from different factories. THIAMINE Price is still stable but the demand is a little less than earlier this year. The export to the U.S. is not as much as before.

We review every procedure related to cGMPs, food safety and hazard analyses. Audits and inspections are meticulously carried out for both new and existing factory partners.

We understand that above all else, the quality of the material and adherence to specifications are imperative. In order to establish quality, there needs to be consistency in practice and process. For that reason, we select random samples from our inventory and submit them to a battery of rigorous tests: identification, assay, constituent claims, heavy metal contamination, etc. We partner with accredited third party U.S. laboratories to perform these tests for us. Each compliant result strengthens the confidence of our factory partners even after they’ve been qualified.

Since we’ve already established a relationship with the factory during their qualification process, any additional information that might be needed is just a couple of emails away.

PRE-SHIPMENT TESTING & INSPECTION Our China-based Quality Control Unit reviews and approves shipments before sending them to the U.S. to ensure specification compliance. We even perform physical and microbial contamination tests in our China-based lab on random samples to verify manufacturer-supplied data. Once the ingredients arrive at our U.S. warehouses, our local team performs a secondary inspection to ensure the product and its packaging have not been compromised during transit.

Since ingredientsonline.com™ does not perform manufacturing operations, cGMPs remain the manufacturers’ responsibilities. However, we can control how we store the products as you’re adding them to your cart. Our warehouses are meticulously arranged to minimize cross-contamination.
