Court of Appeal Rules For California Lemon Law Attorney and Against Fletcher Jones Motorcars in Contract Falsification Lawsuit Orange County, California Court of Appeals rules that California lemon law attorney can pursue his consumer client's claims against the Newport Beach, CA Mercedes- Benz dealership in court, rather than being forced to arbitrate. Orange County, California (I- Newswire) April 01, 2012 - California's Fourth District Court of Appeal, Division 3 (the Orange County, California Division) has denied the appeal of Fletcher Jones Motorcars in its lawsuit between the popular Newport Beach, California Mercedes- Benz dealership and prominent California lemon law attorney Michael R. Vachon, Esq. California's Orange County Court of Appeal ruled on March 26, 2012 that Plaintiff Christy Lewis (who is represented by California lemon law lawyer Michael R. Vachon, Esq.) may continue to litigate her lawsuit in court, as opposed to being forced to "arbitrate" her claims against Fletcher Jones Motorcars. The court of appeal case is titled Lewis v. Fletcher Jones Motor Cars, Inc. (Orange County Court of Appeal Case No. G045603). Lawsuit Allegations Against Fletcher Jones Motorcars The lawsuit's complaint against Fletcher Jones Motorcars (as filed by Ms. Lewis's California lemon law lawyer) alleges that Fletcher Jones Motorcars falsified the down payment amounts listed in the vehicle lease contract signed by Ms. Lewis. The complaint further alleges that the Fletcher Jones Mercedes dealership did this in order to get Ms. Lewis financed for an automobile lease for which she otherwise would not have qualified. Ms. Lewis's California lemon law attorney alleged that falsifying the down payment amounts is a breach of California's Vehicle Leasing Act, and gives the plaintiff a right to a complete refund. Ms. Lewis's CA lemon law attorney has also alleged in the lawsuit's complaint that Fletcher Jones Motorcars forced her to sign a document stating that she would have to pay Fletcher Jones Motorcars $10,000 if she exported her Mercedes vehicle outside of North America. The complaint alleges that this is a breach of the Vehicle Leasing Act's "single document rule," which mandates that all vehicle lease contracts be stated in a single document that includes all of the agreements between the consumer and the dealership. California lemon law attorney Vachon filed Ms. Lewis's lawsuit against Fletcher Jones Motorcars in the Orange County Superior Court in Santa Ana, California (Orange County Superior Court Case No. 30-2011-00441338). According to Orange County lemon law attorney Michael R. Vachon, Esq., these types of falsified down payment lawsuits (such as the one asserted against Fletcher Jones Motorcars) have become one of the most frequently- filed types of non- California lemon law lawsuits being filed and litigated by California lemon law attorneys, even though these lawsuits do not involve any violations of the California lemon law statute. Fletcher Jones Motorcars Tried to Force Plaintiff to Arbitrate Her Claims Approximately four and one- half months after Ms. Lewis's California lemon law lawyer filed her lawsuit in the Orange County Superior Court, Fletcher Jones Motorcars filed a motion requesting that the trial court force Ms. Lewis and her lemon law attorney to arbitrate her claims against Fletcher Jones Motorcars, rather than litigating them in court. Ms. Lewis's attorney, like most lemon law lawyers in Orange County, California, is on record as stating that arbitration is unfair to consumers because it does not permit them to conduct the discovery they need to gather evidence to prove their claims. The Orange County trial court judge hearing the case (Hon. Thierry P. Colaw), after reviewing the briefs and legal arguments submitted by California lemon law lawyer Vachon, denied Fletcher Jones Motorcars's motion, and found that the Newport Beach Mercedes dealership had waived its right to compel arbitration by waiting too long to file its motion, and by trying to win the case outright in court in several potentially dispositive motions. Fletcher Jones Motorcars filed a notice of appeal on August 3, 2011, announcing its intention to attempt to overturn Judge Colaw's ruling on the arbitration issue. Orange County Court of Appeal Sides With California Lemon Law Attorney and Against Fletcher Jones Mercedes Dealership On August 3, 2011, Fletcher Jones Motorcars filed a notice of appeal asking Orange County's Court of Appeal to overturn Judge Colaw's ruling. The Court of Appeal then ordered Fletcher Jones Motorcars and Ms. Lewis's California lemon lawyer to file written briefs outlining their respective positions, and then the Orange County Court of Appeal heard oral argument on March 21, 2012. Just five days after the oral argument (a remarkably short time for issuing a court of appeal ruling), the Orange County Court of Appeal released its decision denying Fletcher Jones Motorcars's appeal. The Court of Appeal accepted - in their entirety - Ms. Lewis's California lemon law attorney's arguments regarding why Fletcher Jones Motorcars had waived its right to compel arbitration. Accordingly, unless Fletcher Jones Motorcars petitions the California Supreme Court for review, California lemon law lawyer Vachon will be free to pursue Ms. Lewis's legal claims against Fletcher Jones Motorcars in court, rather than being forced to arbitrate her claims. California Lemon Law Attorney Now Attempting to Contact Other Fletcher Jones Motorcars Customers Now that the Orange County Court of Appeal has affirmed Ms. Lewis's right to sue Fletcher Jones Motorcars in court, her California lemon law attorney is not trying to locate and talk to other Fletcher Jones Mercedes customers, to see if Fletcher Jones Motorcars falsified the down payment amounts in their lease contracts. He has requested that Fletcher Jones Motorcars customers call him to discuss their transactions, and stated that he is willing to review their documents to determine whether or not Fletcher Jones Motorcars falsified down payments, violated the California lemon , or breached any of California's other consumer protections statutes.
