Well here we go again, a rather popular statement recently. Hope all have had a busy summer; I know I have. Number of auctions has increased, prices fairly flat, lots of work for lower amount of income. This is how it works, seems like you’re hot, then you’re not. Our next meeting is in October. We will be working on the convention ,along with dealing with the government and outside pressures to regulate the auction profession. We were cruising along working on the real estate class and found out this week that the department has decided that the class will be better taught by the real estate division. The recent law from the consumer department is affecting the sale of automobiles, boats, motor cycles and other titles vehicles as to drive train warranties. (See article by Josh Evans for more details). We will be working on an agenda as to how we want see what the auction industry will look like in the next few years. The consumer protection rules are going to make it harder to do business with the consumer. I look for more rules to come about, like the eBay rules’; giving the purchaser more say so as to how business is done. Caveat emptor is disappearing; the purchaser will have more leeway to back out of legitimate deals. On the brighter side, the convention is shaping up to be epic with the preliminary bid calling, charity auction, classes and information to be gained; looks like one not to miss out on hoping to have the largest convention attendance ever. Mark your calendars for the Feb 16th19th, 2018. We are always looking for ideas for classes and seminars. If you have a topic or class suggestion, please give us a call and well see if we can make it happen. The Board is always looking for ways to improve the organization. ISAA Discusses Impact of New Requirements for the Sale of Used Automobiles with the Attorney General Recently, ISAA Board Chairman Darrell Adcock, CEO Amy Cheatham, and lobbyist Josh Evans had a lengthy conversation with staff at the Attorney General’s office regarding new requirements for the sale of used automobiles. Members will recall that effective this fiscal year, recent changes to the Consumer Fraud and Deceptive Business Practices Act (815 ILCS 505) now requires a disclosure statement and a warranty (15 days or 500 miles on powertrain) accompany the retail sale of any used automobile. During the most recent Board meeting, members had several questions about the scope and applicability of the law changes, particularly as they applied to both the sale of used automobiles at auction by auctioneers or auction companies with or without a dealership license. ISAA staff has taken several of these questions to the Secretary of State and the Department of Financial and Professional regulation, and with this call had an opportunity to discuss specific scenarios with staff at the Attorney General’s office. The consensus on the call was that the changes to the Act do affect auto sales by auctioneers regardless of whether a dealership license is held or not. This means
that the current law requires that a disclosure statement and warranty correspond to the sale of any vehicle at auction. The Attorney General’s office confirmed several times on the call “someone” needs to furnish these documents, but stopped short of saying directly whether that needed to be the seller or the auctioneer. However, if the auctioneer or auction company is listed as the seller on the bill of sale, then it was strongly implied the auctioneer or auction company must furnish the disclosure statement and be held accountable to the warranty requirements. In addition to confirming interpretations of the statute, the ISAA was able to raise scenarios of concern with the Attorney General’s office (particularly consignment sales and the sale of confiscated vehicles), which were recognized as issues by that office. We continue to await responses from the Secretary of State and the Department of Financial and Professional Regulation, however, it may be important moving forward that the ISAA prepare guidance on the impact of and requirements of the law to its members. In addition, discussions are likely needed to decide whether or not the current law should be revised to account for the unique nature of the sale of used automobiles at auction. Overall, this was an informative call and the ISAA is thankful that staff with the Attorney General’s office took time to share their thoughts on the law changes and listen to concerns raised by the industry.

Anthony Emig is the 2017 Champion August 15th was a great celebration of Agriculture Day at the 2017 Illinois State Fair, as the ISAA held its 34th Annual Illinois State Championship Calling Contest. The showcase of auction talent on stage at the Illinois State Fair is sponsored by ISAA, Thomas Factory Outlet in Olney, IL, and Farm Credit Services. “The competition is always heavy and its warm and welcome arms every time we get here. It’s my pleasure to be here today and it’s so exciting to be the new Champion in 2017,” said Emig. “I can’t tell you how excited I am to go represent the ISAA at the International Championship in Jacksonville, Florida,” continued Emig. Anthony is owner of Anthony’s Auctions based in Trenton, Illinois, which is a full-service auction company specializing in Estates, Farm, Commercial, and Residential Real Estate, and Business Liquidations. Anthony will represent the ISAA and all Illinois auctioneers at the 2018 Illinois International Auctioneer Championship in Jacksonville, Florida.

The ISAA is also pleased to announce Cody Hanold of Hanold Auctioneering out of Brighton, Illinois as our 2017 Reserve Champion. Cody is a first-generation auctioneer, who’s company is a full-service auctioneering company. On behalf of the Illinois State Auctioneers Association, we’re very proud of Anthony for winning the 2017 Illinois State Championship Calling Contest and we know he’ll do a great job representing Illinois at the 2018 International Auctioneer Competition in Florida. We want to thank Anthony and all the participants that made the State Championship a great event.

WHY FACEBOOK?
People spend a lot of time on Facebook so it should be easy to reach them right? Not exactly. Between competing with the sea of messages in your followers news feed and fighting a Facebook algorithm that determines whether they even see your message, it can be difficult for your content to impact your followers. 10 Facebook Tips For Getting A For Content 1. Post consistently: The goal is to make people not only expect, but to look forward to seeing your content show up in their newsfeed. 2. Use videos: Video is popular with mobile users and the majority of Facebook users log in from their mobile devices. 3. Create events: Creating a public Facebook event enables all Facebook users to invite other people to your posted events. It’s a great way to use your followers to generate a larger audience for you. 4. Ask Questions: Encourage your followers to engage by asking them questions. Their comments and feedback will help you create a dialogue. 5. Like and respond to comments in your posts: Not only does this help humanize you with your followers, but the more engagement
there is with your posts, the more followers that Facebook sends your content to. 6. Ask people to like, share and comment on your posts: You would be surprised at how simply asking them will help increase engagement and again, the more engagement you have, the more people will see your content. 7. Boost your content: If you are having issues with reaching people organically, you can boost for as little as $1 per day. 8. Use your insights: It’s a great way to find out who and when people are engaging with your posts. 9. Pin posts: You can pin a popular post to the top of your Facebook page so that it’s easier for people to find. 10. Be creative: Not only are you trying to compete against other businesses, you are competing against the content of your followers friends and families. So, how do you compete against a video of grandma dancing? Use fun, imaginative and engaging images and videos of your own! Want one more tip? Don’t be all business…be social! Always remember, it’s called social media for a reason.

s I write this I am in Jacksonville, Florida where we are conducting a Board orientation and annual strategic planning session for the NAA Leadership. Today is the day of the Eclipse. I was kind of bummed when I realized I was going to be gone from Lawrence, KS (which is REALLY close to the path of totality) and instead would be in Jacksonville, which ONLY has 90% of the eclipse (ONLY!). Here’s the deal – it ended up being pretty cloudy in Lawrence, KS today (no one saw anything) and it is raining here in Jacksonville. I guess what I am trying to say is that Robert Burns was right “the best laid plans of mice and man often go awry.” I’m sure you can appreciate my distress – how many times have you planned your auction for every contingency and then BAM, something happens. Your live personal property auction is scheduled and a storm pops up and your tents may not be enough shelter, your online auction is disrupted by a power outage (that happened to me as a customer on my first online auction…that’s a story for another day).
happens if a tornado, fire or hurricane destroys your building? What happens if there is a death in your staff or what happens if you pass away? What happens if you have a cyber attack? These things are more than event based – they could threaten your entire business, your livelihood or that of your family’s. I would encourage you to begin today to build a Business Continuity Plan. Include in it everything you might need in the event of an emergency. Start small – collect in one document all of your bank accounts and the name and telephone number of important professionals in the life of your business – your attorney, your CPA, your tax advisor. Have you written down who handles your technology issues so that someone can find it if you are not available? List it in your business continuity plan. List the business names and numbers for your insurance company and the utility companies (seems like a strange request, but you will be surprised how easy this will make things). What papers do you need to make sure you don’t lose? Do you have a copy of your auctioneer’s license or of your incorporation papers? NAA has developed a Business Continuity Plan and we update it every two years. I keep a hard copy of it at my house; the Board has access to it at all times and my staff has access to it through “the cloud.” We want to make sure that if something happens to our building in Overland Park, Kansas or if something happens to me, that NAA will still be there for our 3900 members.
So what do you do? You go to your handy, dandy back-up plan – because as a professional, you will have a back-up plan. You’ll bring all of the personal property inside and hold your auction or you’ll reschedule it if necessary. Rescheduling an auction may be the problem of the day for you, but what happens if your entire business is threatened? What

Start developing your own Business Continuity Plan today and if you missed the eclipse today – start planning for the next one in 2024!

Hachmeister Memorial Scholarship Application The Illinois State Auctioneers Association will award one scholarship in the amount of $500 to a qualified candidate.
