CERVELLÓ: CÁTEDRA / CHAIR El pasado 12 de septiembre, Eduardo Torres y Beatriz Goena iniciaron el Visiting Scholar Program de la Universidad de Columbia (Nueva York). Cada año, el Visiting Scholar Program acoge a 20 juristas de prestigio de todo el mundo. Quienes son admitidos en dicho programa participan en los cursos de Derecho de la Law School y se reúnen periódicamente en foros para presentar su trabajo al resto de Visiting Scholars y Research Fellows, generándose interesantes debates, gracias a la calidad técnica y la diferente formación jurídica de los asistentes; además los Visiting Scholars pueden disfrutar de los magníficos recursos que ofrecen las distintas bibliotecas de la universidad. La Universidad de Columbia es miembro de la IVY League de Universidades Norteamericanas y la Columbia Law School es reconocida como una de las mejores del mundo. Torres fue becado por la Cátedra José María Cervelló en el año 2006 para cursar el Master en Asesoría Jurídica de Empresas en el IE Law School, obteniendo el premio al mejor alumno del master de la promoción 2006-07. Hasta la fecha, ha compatibilizado el ejercicio de la abogacía con los estudios de doctorado y master en Derecho Público (Procesal) en la Universidad Complutense de Madrid. Se trasladó a residir a Nueva York, siendo admitido en la Universidad de Columbia, donde se encuentra actualmente, desarrollando su tesis doctoral sobre la pre-trial phase en el procedimiento civil estadounidense. Goena se licenció en Derecho en junio de 2009. En 2010 cursó el Master en Derecho de la Globalización de la Universidad de Navarra, obteniendo la calificación de sobresaliente en la defensa de su tesina. Meses después, su trabajo de investigación La nueva responsabilidad de las personas jurídicas: un estudio desde las atenuantes del 31.bis.4 CP fue galardonado con el Premio José María Cervelló. Con el dinero del premio, ha financiado su estancia de investigación en la Universidad de Columbia. Allí prosigue sus estudios para la tesis doctoral, colaborando con el renombrado catedrático John Jr. Coffee, una autoridad en materia de responsabilidad penal de las empresas, tanto en Estados Unidos como en Europa.
Beatriz y Eduardo no se conocían personalmente antes de llegar a Columbia. El día de la presentación del Visiting Scholar Program Eduardo le comentó a Beatriz que “ya la conocía, puesto que había leído su excelente trabajo sobre la responsabilidad penal de las personas jurídicas por el que ganó el premio Cervelló”. A ambos la Cátedra José María Cervelló les abrió las puertas a una trayectoria profesional altamente prometedora, que ahora tienen la oportunidad de desarrollar en la Universidad de Columbia. Ambos afirman que su experiencia está siendo muy formativa, tanto en lo personal como en lo profesional. El becado y la premiada, coinciden en mostrar su enorme gratitud a la Fundación y a la Cátedra Cervelló “sin las cuales no habríamos conseguido llegar hasta aquí”. Eduardo y Beatriz esperan poder aprovechar al máximo su participación en el Visiting Scholar Program, tratando de hacer realidad el sueño de José María Cervelló: mostrar la importancia de que la sociedad actual cuente con excelentes juristas que sean, al mismo tiempo, excelentes personas.
Last 12 September, Eduardo Torres and Beatriz Goena started the Visiting Scholar Programme at Columbia University (New York). Every year, this programme accepts only 20 well-known jurists, from all over the world. Those who are accepted in the programme take part in the courses at Columbia Law School and they periodically get together to present their research works to the rest of the fellows in the programme. These meetings provide a great opportunity to learn, because they generate high quality and interesting debates between people who have different educations in Law. Moreover, all the Visiting Scholars can enjoy the excellent research resources available in all of the school libraries. Columbia University is an IVY League member and its Law School is known as one of the best in the world. In the year 2006, Torres received a scholarship from the José María Cervelló Chair in order to take the IE Law School LL.M. in Business Law Advice. He won a prize for being the best LL.M. student in his
2006/07 graduation class. Since then, he has both worked as a lawyer and studied for a master’s degree in Procedural Law at the Universidad Complutense of Madrid. Torres then moved to New York and was accepted at Columbia University to start his Ph.D. thesis, where now is studying the pre-trial phase of the U.S. Federal Procedure. In June 2009, Goena graduated in law. During the academic year 2009/10, she undertook a master’s degree in Global Law at the University of Navarra. Her dissertation was assessed as A+, the highest grade. In 2010, she started her Ph.D. thesis on the Criminal Liability of Corporations. Her paper “The New Criminal Liability of Corporations: a Study from the art. 31. bis. 4 Mitigating Factors” won the José María Cervelló Prize. With the money earned as a result of the prize, she has financed her research stay at Columbia University in New York. There, she is continuing her Ph.D. studies and is working with the well-known professor John Jr. Coffee, who is an authority on criminal liability of corporations’ matters, both in the U.S. and in Europe. Goena and Torres did not know each other before arriving at Columbia. It was during the Visiting Scholar Programme presentation day that he told her that he “had already heard about her, because he had read her excellent paper about the criminal liability of corporations, which won the José María Cervelló prize”. Both of them find that the José María Cervelló Chair has provided a priceless benefit at the beginning of a great and promising professional trajectory. Now, they are both enjoying this huge opportunity at Columbia University. The two of them say that their experience is highly educational, both in respect to personal matters and the professional ones. The Scholarship holder and the prizewinner, concur in showing their gratefulness to the José María Cervelló Chair and Foundation. “Without their help we would have never reached their outstanding academic career.” They hope that they can do their best in the Visiting Scholar Programme, as a way of bringing to reality what José María Cervelló had dreamed about. This is, to show the importance of generating and providing in today’s society excellent jurists who are, at the same time, excellent people.
