US Bank also made two separate $2,000 donations to the North Dakota National Guard Foundation.

• BW Insurance Agency was named 2011 Agency of the Year for BWIA. The award is given to the agency that generates the highest revenue growth throughout the year.

Nor-Son receives two state awards from Associated Builders and Contractors Nor-Son, Inc., received two awards from the Minnesota Associated Builders and Contractors at the 2010 Excellence in Construction Banquet Feb. 2. Pyramid Awards were given to Nor-Son, Inc., in the Residential Single Family–$1-5 Million category for The Summer Kitchen, and in Healthcare–$1-5 Million category for The Garden House at St. Mary’s.

ABC’s award program is designed to recognize publicly the quality and innovation of Merit Shop construction and to honor all members of the construction team, including the contractor, the owner and the design team responsible for the project.

news briefs M & J Construction receives honorable mention award from the Asphalt Roofing Manufacturers Association M & J Construction received an honorable mention award at the second annual Quality Asphalt Roofing Case-Study Awards Program from the Asphalt Roofing Manufacturers Association. QARC is the only national awards program in the country that recognizes outstanding new commercial and residential asphaltic roofing projects.

Rebuilding Together FargoMoorhead Area, Inc., and Accent Contracting help veteran stay in his home Rebuilding Together FargoMoorhead Area, Inc., and Accent Contracting teamed up to help an 82 year-old war veteran stay in his family’s home. Accent Contracting donated about 200 labor hours to the project, while volunteers helped remodel the bathroom and move the washer and dryer upstairs to help the home owner’s limited mobility with stairs.

Rebuilding Together FargoMoorhead Area, Inc., has completed ten similar projects in the area this past year.

Heritage Homes named U.S. Chamber winner Heritage Homes has been named a Blue Ribbon Small Business Award winner by the U.S. Chamber of Commerce.

The awards program honors companies that demonstrate excellent business practices in several areas, including strategy, employee development, community involvement and customer service.

Adopt-A-Student Challenge Adopt one of the HBA of F-M’s 2012 Herdina Academy students for the low price of $75. Adopting a student will help the Academy defray the cost of the materials, instructor fee and helps us keep registration fees low for students.

Kentucky tornado victim help The home building industry is one big family across the nation. Recently communities in Kentucky were ravaged by strong thunderstorms and tornadoes. Remodelers Council Picnic April 27 The Remodelers Council celebrates May as National Home Remodeling Month and is hosting a free barbecue at the HBA of F-M, 1802 32nd Ave. S., Fargo, April 27. Sponsored by Ferguson Bath, Kitchen, & Lighting Showroom, the picnic runs 11 a.m.

- 1 p.m. The Council welcomes employees of all Council member companies and anyone interested in joining the group.

The local Remodelers Council is affiliated with NAHB’s Remodelers group and has its own dues structure.

HBA proposes bylaws amendments The HBA of F-M is proposing bylaws amendments that range from housekeeping items to changes regarding removal of directors, progression of leadership and reinstating voting rights to ex-officio members. Each HBA member company should have received a mailing outlining all amendments, or you may visit the members only section of www.hbafm.com to view the document.

HBA needs YOU to spread the word: Vote NO on N.D. Measure #2

Your HBA of F-M was created to give the local home building industry a voice in government and public affairs. The main reason for our continued existence Terry Becker is to stay on top of those issues that will Terry Becker impact your business and the future of our Construction, LLC collective livelihood. There are a couple of major issues at the top of our list right now: N.D. Measure #2 and Fargo’s proposed river setback ordinance.

In addition, it is an election year, and it’s our job to research the candidates and promote those to you, our members, who care about building industry issues.

N.D. Measure #2: Spread the word

We have been telling you about this issue for months now.

It is a ballot measure to eliminate property taxes in North Dakota. Your HBA has taken a position against the measure and urges you to vote no June 12. There are many reasons why you should, and hopefully you have made the decision to vote no. If you agree, we would like you to help us spread the word about the reasons why N.D. Measure #2 is a bad idea. Tell your family, co-workers and friends. We have buttons, posters and fact sheets available for pick-up at the office: 1802 32nd Ave. S. in Fargo. Home Builders Care Build fundraising gets shot in the arm

With Lake Agassiz Habitat for Humanity’s Tour de Habitat last month, and another generous donation from State Bank & Trust, fundraising for the Home Builders Care Build has now exceeded $26,000! Thank you to everyone who participated in the Tour and designated their funds for our build: it raised over $12,000. And thank you to State Bank & Trust for the additional $8,000 from its Pay It Forward program. We appreciate the support!

We still have a long way to go to reach the $80,000 mark.

I encourage your company to consider pledging $100 to close that fundraising gap. You can pay it in installments or all at once, or if you would like to donate a different amount, we welcome anything. Send your donation to Home Builders Care Foundation, the HBA’s charity, that will forward monies to Habitat for Humanity. Donations are tax deductible and will count toward the HBC’s Framework for the Future long-term fundraising initiative. See the form on the left to pledge.

Fargo’s proposed flood setbacks

Your HBA has been monitoring an ordinance proposed by the city of Fargo on river setbacks. It prohibits new construction within 350 feet from the centerline of the Red River and Wild Rice River, and within 175 feet from the centerline of the Sheyenne River. The HBA supports these setbacks for new homes and developments, but we are concerned about what may happen if the rules apply to existing homes. The new requirement would create a situation in which a home could not be rebuilt if more than 50 percent of it was destroyed. If a home cannot be rebuilt, what effect does that have on obtaining mortgages for potential buyers and for existing owners renewing their insurance and refinancing? Read more about this on page 11.

Elections are coming: Back your PAC with $20.12

You have probably seen promotions for fundraising for the North Dakota Association of Builders political action committee (NDAB-PAC). If you haven’t already sent in your contribution, I urge you to do so. It is our goal to get as many of our members engaged in supporting PAC as possible. No amount is too small. Club 2012, launched by the National Association of Home Builders, asks members to contribute just $20.12 to make housing “one voice stronger.”

BUILD-PAC, which is NAHB’s PAC, could easily be one of the largest in the nation if all members participated by contributing. Remember, your contribution is divided amongst NAHB’s BUILD-PAC, NDAB and your local HBA when you contribute it to NDAB-PAC. Your dollars have helped us keep building industry issues on the forefront of the minds of lawmakers.

Parade of Homes features 65 homes by 37 builders

Spring is here and it’s time to get outside and celebrate a great building season by visiting the HBA of F-M’s 52nd Annual Parade of Homes. The Parade runs April 28 – May 6 and features homes in Dilworth, Fargo, Mapleton, Moorhead and West Fargo. Hours run noon – 5 p.m. weekends and 6:30 – 8:30 p.m. weekdays.

Renderings, descriptions and maps will be included in the Parade of Homes magazine available starting April 23 at all Hornbacher’s locations or the HBA office, 1802 32nd Ave. S., Fargo. An insert will also be included in The Forum April 22.

NDAB holds board meeting, legislative summit

The North Dakota Association of Builders held its biannual legislative summit in conjunction with its spring board meeting in Grand Forks. The main purpose of the summit Tyrone Leslie, was to plan for the upcoming Heritage Homes 2013 legislative session. Joining me at the summit were Terry Becker, Terry Becker Construction, LLC; Don Dabbert, Jr., Dabbert Custom Homes; Carlita Dietz, Jay Dietz Construction, Inc.; Jason Eid, Eid-Co Buildings, Inc.; Darrick Guthmiller, Kochmann Brothers Homes; Nancy Kelly, Heartland Labor; Bob Kochmann, Kochmann Brothers Homes, Inc.; John Koerselman, Red River Drywall & Painting Services; Ken Krajsa, State Bank & Trust; and Paul Lindemann, Lindemann Finish Carpentry, Inc.; along with Bryce Johnson and Rocky Schneider, Home Builders Association of Fargo-Moorhead.

The board meeting is always full of interesting updates from the state. The housing industry in North Dakota faces a lot of unique challenges: dealing with the increased workloads due to a booming energy sector; increased competition as out-of-state contractors flock to the area looking for work; and dealing with water management issues across the state. From what we heard from the other directors, and in looking at the state’s permit report, construction activity is booming in North Dakota and it is an exciting time to be in our industry.

Legislative Summit

With the increased construction activity in the state and the issues created due to the need for flood protection, the 2013 legislative session looks to be a busy one. With the expectation for numerous bills being put forward by other groups to deal with funding for cities and counties facing increased demands, property tax incentives and reductions, flood protection funding, special assessment financing, along with numerous unknown issues, it was decided as a board to not move forward with any of our own legislation at this time.

HBA has busy spring working with local cities

Fargo to vote on sales tax measure Residents of Fargo will get a chance to vote on a halfcent sales tax measure this June. The sales tax would be used to pay for infrastructure projects and flood protection.

The current sales tax paid by Fargo shoppers is 7.5 percent: 5 percent for the state; .5 percent for the county; and 2 percent for Fargo. A Fargo half-cent infrastructure sales tax is set to expire in June; one could see the current proposal as an extension of the expiring one.

The HBA is currently evaluating the issue and has not taken a position.

Fargo to start 2012 I-Code adoption The city of Fargo has released its hearing schedule for the adoption of the 2012 I-Codes. The hearings will start in September with the International Building Code, followed by the International Residential Code and others.

West Fargo to adopt Landscaping Ordinance West Fargo is modernizing several requirements for its new development process. Amongst the updates, it is combining various planting requirements into one landscaping section. The HBA has met with the city regarding these updates and is currently reviewing the proposal.

North Dakota 2.0 to hold Fargo summit

USDA Rural Development announced the capstone event to North Dakota 2.0 scheduled for April 17 in Fargo. Introduced last fall, North Dakota 2.0 is an initiative focused on bringing people together to capitalize on the state’s abundance of opportunities while addressing its immediate needs.

Adam Davidson and Alex Blumberg, award-winning hosts of National Public Radio’s Planet Money, will highlight the summit as keynote speakers. They will be joined by featured speakers Paul von Ebers, president and CEO at Blue Cross Blue Shield of ND, and Jasper Schneider, state director of USDA Rural Development.

Afternoon break-out sessions will include a session on housing and future challenges facilitated by HBA Director of Public Affairs Rocky Schneider. Other breakout sessions will cover community development and enrichment; business and venture capital; and infrastructure demands.

Fargo drafts River Setback Ordinance

The city of Fargo has drafted an ordinance that would amend the Land Development Code to include building setbacks for lots along rivers. The ordinance is modeled after a similar ordinance already in place in Cass County. It has been received by the City Commission and will now go to a hearing before the Planning Commission in April.

The HBA has reviewed the language and is generally supportive of the contents. One area of concern HBA representatives expressed at a recent City Commission meeting was regarding what effect the proposal would have on the ability of existing homeowners, and potential homeowners, to attain mortgages and insurance for their homes.

The draft ordinance includes the following: Setbacks for unplatted lots • The building setbacks for unplatted lots will be 450 feet from the centerline of the Red and Wild Rice Rivers and 175 feet from the Sheyenne River or 100 feet from the FEMA floodway, whichever is greater. The 450-foot zone will be broken up into a 350-foot minimal disturbance zone and a 100-foot limited disturbance zone, each having a different set of rules.

Setbacks for platted lots • For areas that are platted and have not yet been built upon, approval from the City Commission is needed to acquire a building permit. There are five criteria in the ordinance that a project must meet.

• For platted lots already built on, there would be new regulations overlaid upon the property. Enlargement or alteration of the structure that is already within the disturbance zone would be allowed as long as it did not extend closer to the river. Any such enlargement, alteration or interior remodeling may not exceed the limits of the “substantial improvement” provisions of Fargo’s floodplain management regulations.

New subdivision requirements • The ordinance would require new subdivisions to identify disturbance zones and to dedicate the areas for drains. Drains would require an area equal to 175 feet on either side of the centerline, along with an allowance for the city to acquire an additional 150 feet.

President’s Message

The NDAB’s Legislative Summit and Board of Directors Meeting was held in Grand Forks mid-March. Issues and potential legislative initiatives were discussed during the summit, including property taxes, building Eddy Mitzel codes and inspections, and other NDAB President business-related topics. NDAB will be working with local associations and others to gather more information in preparation for the 2013 Legislative Session.

• Enhance the N.D. Professional Builder program to increase builders’ image and awareness.

Get Tax Credits: Housing Incentive Fund

The North Dakota Housing Finance Agency (NDHFA) is encouraging state taxpayers to support the ND Housing Incentive Fund (HIF) with a contribution.

“The projects that received allocations and new projects that are in the pipeline need the continued support of North Dakota taxpayers to remain on track,” said Mike Anderson, NDHFA executive director. “The Housing Incentive Fund still needs more contributions to ensure that projects can begin construction as soon as possible.”

NDHFA has allocated $4.3 million in flexible financing for the development of 306 new rental units. Nine housing development projects received conditional commitments for $3.9 million during a funding round that ended Dec. 31, 2011. The projects in Beach, Belfield, Crosby, Grand Forks, Kenmare and Williston join two projects in Crosby and Minot that previously received allocations worth $440,000.

NDHFA is reminding taxpayers that now is a great time to earn a tax credit. Taxpayers making a contribution into the fund receive a dollar-for-dollar tax credit against their state income or financial institution taxes. For taxpayers making quarterly estimated tax payments, a contribution to HIF may be used to offset their estimated payments. The agency will continue to issue tax credits to contributors on a first-come, first-served basis until HIF’s $15 million maximum authority is reached.

Contributors to the fund can target their dollars to a specific project or ask that their contribution be designated for use in a specific community.

Out-of-state property owners pay $127M

Out-of-state property owners, with addresses from Canada, the United Kingdom, South Africa and Dubai, are among those who currently pay Doreen Riedman property taxes in our state...to the NDAB Executive tune of at least $126 million annually.

Why would North Dakotans, all 660,000 of us, want to take on that added burden? Why allow commercial property owners (big box stores, Wal-Mart, Target and others) to keep $90 million in North Dakota property taxes in their pockets?

Info for employers on claiming the Small Business Health Care Tax Credit

If you are a small employer with fewer than 25 full-time equivalent employees that earn an average wage of less than $50,000 a year and you pay at least half of employee health insurance premiums…then there is a tax credit that may put money in your pocket.

The Small Business Health Care Tax Credit is specifically targeted to help small businesses and taxexempt organizations. The credit can enable small businesses and small tax-exempt organizations to offer health insurance coverage for the first time. It also helps those already offering health insurance coverage to maintain the coverage they already have.

Here is what small employers need to know so they don’t miss out on the credit for tax year 2011: • Qualifying businesses calculate the small business health care credit on Form 8941, Credit for Small Employer Health Insurance Premiums, and claim it as part of the general business credit on Form 3800, General Business Credit, which they would include with their tax return.

NAHB remodelers applauds Sen. Inhofe bill to improve lead paint rule and reduce regulatory burden The National Association of Home Builders Remodelers commended Sen. James Inhofe (R-Okla.) for introducing the Lead Exposure Reduction Amendments Act of 2012 (S. 2148) to improve the lead paint rule for homeowners and remodelers who must comply with the costly work practices and record keeping requirements of the rule. The bill was introduced with five original co-sponsors: Sens.

Charles Grassley (R-Iowa), David Vitter (R-La.), Michael Enzi (R-Wyo.), Tom Coburn (R-Okla.) and Roy Blunt (RMo.).

“We applaud Sen. Inhofe and his colleagues for sponsoring this bill to make much-needed improvements to EPA’s lead paint rule during this busy time in Congress,” said 2012 NAHB Remodelers Chairman George “Geep” Moore Jr., GMB, CAPS, GMR, a remodeler from Elm Grove, La. “If this effort is successful, it will reduce the regulatory burden for remodelers facing costly penalties for first-time violations like misfiled paperwork and allow homeowners to make the final decision about renovations in their homes.”

The Environmental Protection Agency’s Lead: Renovation, Repair and Painting rule applies to homes built before 1978 and requires renovator training and certification, adherence to lead-safe work practices, containing and cleaning dust and record keeping.

By removing the opt-out provision in July 2010, EPA more than doubled the number of homes subject to the LRRP rule, adding an estimated $336 million per year in compliance costs to the remodeling community – without making young children any safer.

“We need to concentrate our efforts on helping the families that this law was designed to protect,” said Moore.

“We support the intent of the lead paint rule to prevent childhood lead poisoning and believe that the provisions in this bill will encourage greater compliance by home owners. Common sense exemptions for emergency renovations and online recertification training are necessary improvements for remodelers and home owners to fully comply with the rule.”

The bill would reinstate the opt-out provision to allow home owners without small children or pregnant women residing in the home, not the government, to decide whether to require LRRP compliance, allow remodelers to correct paperwork errors without facing full penalties and provide an exemption for emergency renovations. It would also eliminate the requirement that recertification training be “hands on,” preventing remodelers having to travel to training facilities out of their region.

The introduction of companion legislation is being sought in the House of Representatives.

• Tax-exempt organizations can use Form 8941 to calculate the credit and then claim the credit on Form 990-T, Exempt Organization Business Income Tax Return, Line 44f.

• Businesses that couldn’t use the credit in 2011 may be eligible to claim it in future years. Eligible small employers can claim the credit for 2010 through 2013 and for two additional years beginning in 2014.

• For tax years 2010 to 2013, the maximum credit for eligible small business employers is 35 percent of premiums paid and for eligible tax-exempt employers the maximum credit is 25 percent of premiums paid.

• Beginning in 2014, the maximum credit will go up to 50 percent of qualifying premiums paid by eligible small business employers and 35 percent of qualifying premiums paid by eligible tax-exempt organizations.

Valerie Fiske, Park Co. Realtors, joined the HBA of F-M at the end of 2004, but she is no stranger to the construction industry.

Her father was a custom home builder until his retirement in 1996, when her brother took over. Today, Fiske is a senior sales associate at Park Co. Realtors serving the FargoValerie Fiske, Park Co. Realtors, received April’s Member of the Month Moorhead area. award.

Fiske’s involvement with the Parade of Homes Committee started when John Dietrich, Choice Financial Group, invited her to a Parade of Homes Committee meeting at the beginning of 2006. From there, she saw the impact the Association had on the industry.

“I think it’s important to give back to an industry that has supported my family for so many years,” says Fiske.

She currently serves as the vice chair of the Parade of Homes Committee and the HBA staff has chosen Fiske for April’s Member of the Month because of her willingness to get involved and her dedication to the committee and Parade.

“Valerie brings great energy to the Parade of Homes Committee and is always willing to volunteer,” says Alison Streyle, HBA events coordinator. “She takes the extra step to make sure committee items are accomplished on time, which is very helpful from a staff perspective, and I truly appreciate her efforts!”

Fiske has also stepped up to meet HBA President Terry Becker’s challenge and made a donation to the Home Builders Care Build for Habitat, scheduled to break ground this May. Monetary donations help pay for labor and

material costs associated with a Habitat for Humanity build.

Fiske is not only involved with the HBA, but serves her community through the public relations and RPAC committees with the Fargo-Moorhead Area Association of Realtors; serves on the North Dakota Association of Realtors membership committee; and volunteers with the West Fargo Volunteers Organized in the Interest of Children’s Education (WF VOICE) and United Way. She is also a busy soccer, basketball, football and softball mom to three children with her husband David.

Fiske enjoys working out at the gym in the mornings and cooking, when she has free time.

Fun Facts about Valerie: My favorite color: Purple, and so was my first house that I built in 1996! It had dark purple carpet, plum countertops, purple paint and purple marble around the fireplace!

Last trip I took: Over spring break I traveled to Phoenix, Ariz., wth a friend and our six kids.

Hometown: Fargo Dream job: I’m living it! There’s nothing better than going to work and enjoying what you do every day. I love real estate and new construction is my passion!

The first thing I would do if I won the lottery: Take an extended vacation somewhere warm and near water.

Building Official’s Corner: Remembering...

Remember your flood proof inspections

It will be more and more often the case that your projects will be located in a flood plain and a flood proof Ron C. Strand foundation will be required. It may Fargo Inspections be a city requirement, or it may be a Administrator voluntary action requested by you or the property owner. When that is the case, make certain that either you or your concrete subcontractor are aware of, and call for, inspections of your foundation systems at the appropriate times.

Recently, this has started to be a problem. We have done our best to allow some latitude on these inspections, provided you had someone qualified to certify compliance of your work (self-certifying has never been accepted).

But this must come to an end. You are responsible for complying with the laws governing this work. These laws are both local and federal and include the requirements for inspections and testing if required. I’ve sung this tune to you before, and some of you either don’t remember the words or didn’t believe that we would strictly enforce these requirements. Start believing. Calls to me will not save you from the extra time and expense that missing these inspections will cause you.

There are seven facets of the foundation phase of your construction that require inspection. They are footing, foundation wall, waterproofing of the foundation wall, installation of the drain tile system, sewer line, sewer back flow valve and the floor.

According to the terms of the ordinance being considered, building permits within these areas may only be issued upon the granting of a waiver to the moratorium by the City Commission. Some of the conditions being considered under which the City Commission may grant a waiver include: • the extent to which the property is already protected from the risk of flooding; • the extent to which the soil is sufficiently stable to support the proposed building or structure without slumping or shifting of the soil; • the extent to which the proposed building or structure may be elevated to such a level as to mitigate against the risk of flooding; • the adequacy of area available to install emergency flood protection if the proposed building or structure were in place; • and the extent that the proposed building or structure is accessory to a principal building or structure (is the accessory building or structure to either be constructed to an elevation to appropriately minimize risks of flooding or, in the alternative, be designed and constructed so as to tolerate being flooded).

Remember flood proofing certificate paperwork

Remember your paperwork on the front end of permit applications in the flood plain. Permits will not be issued without submission of the required information which includes a preconstruction flood proofing certificate. This certificate must be prepared by a professional engineer of your choice.

Remember the river lot moratorium

The Fargo river lot moratorium still exists and will continue until the City Commission enacts ordinances finalizing rules for developments along our rivers both with the city and within our extraterritorial jurisdiction. When planning a project along a river or drain, make certain of the rules that will be applied to your project, as well as the process that will be used to review your planned project.

This moratorium pertains to all lots, or parts of lots, that lie within 450 feet of the river centerline along the Red and Wild Rice Rivers and within 175 feet of the centerline of the Sheyenne River. No buildings may be constructed within 100 feet of the floodway line.

The City Commission has directed that all such proposed development be reviewed by a staff level committee made up of members of several city departments

HBA wraps up another successful Home & Garden Show

The 51st Annual Red River Valley Home & Garden Show can put another successful year into the record books after the 2012 show held Feb. 24-26 at the Fargodome. Over 330 exhibitors showcased their skills and talents to give consumers a wide variety of services to learn about and products to see.

Even with blustery weather on Sunday, consumers from around the region created great crowds throughout the weekend, with total attendance at William Moss teaching a about 8,000. This year, 2-for-1 admission hours seminar on tips for growing were featured each day and brought in over 1,500 successful plants. consumers over the weekend – with waiting lines reaching outside the Fargodome on Saturday!

by HGTV hosts John Gidding and William Moss along with seminars by the platinum sponsor Accent Kitchen & Bath.

Attendance totals for seminars was just under 1,000.

The Kids Workshop sponsored by The Home Depot and the children’s playground DECKMASTERS Hoops for Charity raised $316 for the Home Builders Care supervised by the YMCA of Cass & Build for Habitat.

Clay Counties and the North Dakota State University’s Human Development and Family Science Club were both busy as usual with hundreds of children at each. A special thank you to DECKMASTERS for donating all the proceeds of the Hoops for Charity game for a total of $316 designated to go to the upcoming Home Builders Care Build for Lake Agassiz Habitat for Humanity.

Clay Dietrich is owner and president of Dietrich Homes, Inc. He was elected to the HBA of F-M board of directors this year and served previously from 2002-2004. He is also active with the Parade of Homes Committee, Clay Dietrich participated in the Home & Garden Dietrich Homes, Inc. Show, is a regular Parade of Homes participant and has hosted “featured homes” on the Parade, raising funds for Home Builders Care Foundation. Dietrich is regularly called upon to be a spokesperson for the Association or offer feedback on issues related to building codes and city interactions.

Dietrich is retired assistant fire chief for the city of Moorhead and former president of the Moorhead Youth Hockey Association. Away from work and family, he enjoys fishing whenever possible!

Moorhead proposes growth and development initiatives

After two years of working with the HBA on ways to streamline the development process within the city and reduce infrastructure costs, Moorhead is ready to propose a series of growth and development initiatives to boost construction activity within the city.

Officials hope to move forward with the proposals and have them in place and ready for this year’s construction season. Along with the seven areas the proposals cover, the city is working on a complete rework of how the city operates with, and markets to, the construction industry. Officials have said it has a renewed focus and is excited to be working toward a common goal of growth and prosperity in Moorhead.

The seven areas covered by the proposals include: 1. A reduction in required widths of local roads and right-of-way.

2. Modified arterial road spacing.

3. Increased access to multi-family developments from arterial roadways.

4. Cost-saving options to allow sidewalks on one side of the street only; eliminate cul-de-sac sidewalks.

5. Match Fargo and West Fargo term for financing special assessments to reduce monthly payments.

6. Provide more options and choice of the engineer and bid process related to public infrastructure.

7. Assure the “timely” installation of park amenities in newly developed areas.

Building & Development Summit planned for April 11

Moorhead is also working on a Building & Development Summit to be held April 11. Moorhead wants to grow and be a partner with the building industry. The Summit would be a chance for Moorhead staff and officials to talk with the industry on its new approach and share what the city has to offer.

A strong housing market has brought many buyers to the market much earlier this year than in recent years. New buyers searching for the perfect starter home, as well as the moveup buyers, taking advantage of the low interest rates can increase their purchase power by as much as 25 percent.

This allows buyers to purchase a $200,000 home today with the same monthly payment as purchasing a home worth $150,000 a few years ago. We are also seeing many people listing their homes earlier this year and planning to build a new home with one of the many great builders in Fargo-Moorhead. Interest rates will not stay at these levels for long and buyers may never have an opportunity like this to purchase a new home.”

What do you think is the biggest challenge facing the industry today and how are you dealing with it?

“The biggest challenge facing our industry today, I feel, is larger investors and banks having stricter guidelines with real estate mortgage lending. The recent housing crisis that began late-2008 led to many banks and investors tightening up guidelines and only allowing home loan approvals for those with high credit scores and large down payments.

This has even been prevalent in our local market even though we have a strong housing market. We have been diligent in making sure we offer a wide variety of products by aligning with top investors that have more of a common sense approach to underwriting. This allows us to approve loans easier than customers may be finding in dealing with their bank. We educate our customers throughout the lending process to ensure they understand and are comfortable with their loan. This makes for a smooth and quick process for customers. I believe this gives us an edge over competition in that we are able to offer more loan products to our customers than banks and national mortgage companies can. Valley Mortgage takes pride that we are a local company serving all of Minnesota and North Dakota. We always meet our customers in person. We have very experienced loan officers, processors and underwriters in our office ready to assist and advise customers into their first or next home.”

The foundation, created in 1993 by the Home Builders Association of FargoMoorhead, is a local 501(c)3 nonprofit charitable organization.

It was established with funds donated

by HBA members, fundraising events and the HBA itself. The purpose for its creation was to provide an outlet for the builder, remodeler, and companies related to the building industry to show the community that there is more to the building industry than demolition, construction, and remodeling.

The HBA of F-M handles the administrative duties for the foundation at no charge. Any contribution designated to the foundation goes directly to the foundation and its charitable work.

Anything your company can provide will be greatly appreciated. Remember that Habitat homes are modest and all donations make up the value of the house and mortgage, so please plan accordingly. Habitat projects are built on a strict schedule so please take this into account as you consider your donation. The Herdina Academy for the Construction Trades is coming up June 4-16 and we need HBA members to help us out with this project as well. First, if you know of any students, ages 15 to just entering college, who are interested in the construction industry, this Academy is for them. The two-week course is a comprehensive introduction to many specialties in the home-building industry.

Tour de Habitat raises over $24K

On March 3, 16 teams biked their hearts out to raise money for the 9th Annual Lake Agassiz Habitat for Humanity’s Tour de Habitat at Courts Plus Fitness Center.

Nine of the 16 teams designated funds to the Home Builders Care Build for Habitat, and $12,050 will go directly to the build. Check out the team pictures to the right. Team member names and money raised can be found on page 29.

Top fundraising members included HBA of F-M’s own John Gunkelman, Dakota Construction of Fargo, Inc.; Dave Anderson, Dave Anderson Construction; and Bryce Johnson, HBA of F-M. HBA Education ‘season’ wraps-up

As 2011 came to a close, the HBA of F-M Education Committee was able to look back at a successful year of classes and begin preparing for the busy year ahead. 2012 started off with four education opportunities in January alone, and the committee is continually working on the 2012 schedule.

Electrical contractor continuing education

Jan. 13 was the start of the first continuing education class for the year. The electrical contractor license renewal class brought in 71 attendees and was taught by Tim Pull, North Dakota State College of Science.

Minnesota contractor continuing education

Minnesota contractor license renewal classes were held Jan. 18 and Feb. 1. at Butler Machinery Training Facility. A total of 93 contractors attended. Thank you to Kurt Wenzel, City of Moorhead, for instructing the first session each day, and for Darrell George and his team at Building Products, Inc., for instructing the remaining sessions.

This year’s topics included: Minnesota Hot Topics– Building Code; Assembling & Estimating Stair Systems; Siding Best Practices; Correct Ventilation; and Lite Metal Beams & Tall Walls. The classes received positive feedback and the Education Committee will review suggested future topics for next year this spring. Lunch & Learn

Every month the HBA is proud to offer lunch & learn opportunities for its members. Lunch & learns are 90-minute classes, usually held at the HBA office, that cover a variety of topics throughout the year. So far in 2012, the HBA has been able to partner with North Dakota

Association of Builders to offer lunch & learn classes on radon-resistant building and cost effective ways to insulating basements. We have also held classes called “Take Your Home Show Booth or Parade Home Over the Top in 2012” and “Home Energy Score.” Upcoming classes will include topics about avoiding cracking concrete, problems local inspectors see most, balancing combustion air and proper air exchange, and water heater code changes.

• Concrete has so much potential to enhance any project’s marketability because of its aesthetics and perception of value. However, if cracks or other issues distract from the aesthetics, a positive enhancement can turn to a negative.

This committee develops education programs for the Association. It provides an abundance of choices to fulfill continuing education credits required by Minnesota for builder licensing. The committee’s purpose is to assist the development, professionalism and profitability of HBA members and the industry.

New Member Development & Retention

This combined committee looks for new and creative ways of recruiting and welcoming new members, and develops programs to remind members of the value of their membership. It explores reasons why members join and leave, is responsible for contacting all members and also reviews the NAHB membership status report on a monthly basis.

• The membership status as of 1/31/12 is: 805 members with 214 builders and 573 associates with a retention rate of 90.5 percent. 30, 60, 90 days past due accounts were reviewed and assigned. February call results were reviewed, and March calls were assigned (calls are made 60-90 days prior to member renewal date).

Parade of Homes

A “Parade of Homes” is designed to promote HBA Builder members to consumers. It serves to boost home sales and raises the level of recognition for Builder members.

This committee is responsible for all aspects of coordinating and promoting the spring and fall Parades.

• Spring Parade of Homes dates are set for April 28 – May 6. The Parade of Homes Committee decided to discontinue the Spring Parade judging. A new Parade of Homes Celebration is in the works for the May 10 General Membership Meeting. This evening event will celebrate all the Builders and homes on the Parade and give all Builder participants a chance at one of multiple cash drawings, door prizes and

more!

• The Fall Parade of Homes will run Sept. 8-9 and 15-16, 2012.

Public Issues

The Public Issues Committee is responsible for keeping tabs on governmental action that affects the industry and then informing the industry on the status of those issues.

• The Public Issues Committee has been working on many issues, most recently Fargo’s building setback ordinance and half-cent sales tax extension proposal, Moorhead’s infrastructure cost review and building and development summit, and West Fargo’s landscape ordinance changes. You can read about all of these items in this Plains Builder.

• The committee is also organizing Candidates Forums for upcoming city and county elections: Cass County Commission, Fargo Commission and West Fargo

Remodelers Council

This council represents the remodeling industry in the local HBA of F-M through national Remodelers membership. It has its own dues and community service projects and is the committee behind planning the Fall Home Show.

• The HBA, HBC and RC are partnering up with Lake Agassiz Habitat for Humanity for a build in May 2012. Cash donations are being accepted but materials will also be needed. We request that the materials donated are basic.

The mortgage for the family is determined by what goes into the home. Thanks for considering and more information will be coming. We are currently asking for cash donations to reach our $80,000 goal and in-kind donations will be needed also.

• RC reviewed items for the Fall Home Show. It will be held at the Fargo Civic Center Sept. 28-29.

• A Remodeled Home Tour is in the works for 2012. This tour is to spotlight what can be done by simply remodeling rather than building new. It will be in conjunction with the Fall Parade of Homes and ONLY be held on the second weekend due to the homeowners needing to have their homes open to the public. Watch for updates in the newsletter and Parade publications.

Remember soils observation and testing

Soils observation and testing during your construction project may be required. Such observations and reports are becoming nearly a necessary part of your foundation work to safeguard against problems for your property, yourself and the city. Every precaution needs to be taken to be as certain as possible of your site’s ability to support the load of the planned structure. If you have not already secured a soils observation or ordered testing, your inspector may feel that an observation or spot testing may be advisable and he will inform you of the requirement. The criteria for such testing will not change from our process last year so there should be no surprises.

Remember smoke alarms are required

The inspectors report that they are finding homes without sufficient smoke alarms for which there are permits for ongoing work. Remember that the building code requires that smoke alarms exist throughout the home, even in those areas where the permitted work is not taking place. Typically these required alarms will not be required to be A/C, nor interconnected, but that does not mean that a functioning, battery-operated alarm is not required. Even though it is not a part of your project, you should still speak to the owner about any alarms that are missing or non-functioning to avoid delays in the successful completion of your final inspection and certificate of occupancy (if needed).

Please review Section R314 of your 2009 IRC for the specifics of smoke alarm installation.

Remember your final inspection and certificate of occupancy

Your final inspection must be successfully completed and your certificate of occupancy issued prior to the building being occupied. We will do everything possible to accommodate your inspection calls in a timely manner and followup with issuance of the certificate but we will not be able to do so if you fail to contact us for the inspection. Remember that building inspections are not voluntary.

Remember that the 2012 code adoption hearing schedule begins this year Remember that Fargo will begin reviewing the 2012 editions of the International Codes for possible adoption by the City Commission in mid-2013.

The process will include a series of hearings conducted by the Fargo Board of Appeals from September 2012 to March 2013. The purpose of these hearings is to review the differences between the 2009 and 2012 editions of these codes.

Everyone is welcome to participate and share their comments or concerns at these hearings. The HBA of F-M has a copy of the proposed hearing schedule.

He worked for Twin City Construction’s Components Division that later became Fargo Truss in 1985. When Fargo Truss’s owners divided the company in 1991, he transitioned over to Northland Truss Systems, Inc. He enjoyed working with people and the constant challenge that truss and component design presented. As design/sales manager at Northland Truss, he was very involved in the process.

Scheuring says, “I got to a point where I was able to make things work for people that they were having a hard time with, and that was very satisfying.”

‘Avoiding the crack: Concrete durability and the contractor’

Concrete has so much potential to enhance any project’s marketability because of its aesthetics and perception of value. However, if cracks or other issues distract from the aesthetics, a positive enhancement can turn to a negative. This seminar will bring home the issues of concrete aesthetics in the home builder’s world, and reinforce much of what current technology and craftsmanship can provide. Items of discussion will include early age cracks, surface defects, decorative concrete problems, aesthetic preservation, and repairs.

Speaker: Dave Sethre, marketing director, ND Ready Mix & Concrete Products Association and executive director, ND Chapter, Inc. - ACPA. Sethre has been with the concrete associations in North Dakota since 1996. Previously, he provided consulting engineering services in a broad scope of areas, and has been a county highway engineer working with roads and bridges.

‘Stay out of hot water: Federal residential water heater energy code changes’ •

In 2015, energy conservation standards set by the U.S. Department of Energy will become effective, affecting usage of water heaters in homes. While 2015 may seem like a long way off, contractors can prepare now to ease the transition for home buyers they are currently working with. Equipment warranties last anywhere from six years to a lifetime: plan for the change now to avoid problems in three years!

During this June’s state primary election, North Dakotans will be asked to vote on Measure 2.

Measure 2 is a constitutional amendment that would abolish the property tax. The measure mandates the North Dakota Legislature replace the lost revenue from other sources.

Keep It Local North Dakota is a non-partisan, broad-based coalition dedicated to preserving local control by defeating Measure 2 and is the largest public policy coalition in North Dakota history. Together, our coalition’s members represent the interests of more than 250,000 North Dakotans.

Our coalition simply believes that local governments are more accountable to you and your neighbors.

Measure 2 takes local control away from more than 2,100 local governments.

Measure 2 says the state legislature must “fully and properly fund all legally imposed obligations of state government,” but it does not define what those obligations are.

Currently, funding for senior services, law enforcement, fire protection, parks and recreation are not statutorily required. The legislature will not be bound to fund them.

Measure 2 would force your local government to ask the legislature to fund local needs and compete with other local governments for resources.

Measure 2 takes your right to decide what’s best for your community away from you and places this power in the hands of the legislature.

Measure 2 will likely require other tax increases.

If Measure 2 passes, North Dakota would lose more than $800 million annually.

Measure 2 mandates the legislature to replace the lost revenue from other sources.

Measure 2 shifts the tax burden to other state fees and taxes, such as income and sales taxes.

Other local taxes would have to increase as well.

North Dakota cannot fund local governments through oil and gas tax revenue.

The oil and gas industry is not a reliable tax base because it is susceptible to outside market forces.

Out-of-state property owners would pay no tax but still receive services.

Non-resident property owners currently pay $126.8 million (16.7%) of property taxes.

Measure 2 would leave this property untaxed.

Much of the oil and gas tax revenue has already been allocated through statutory and constitutional mandates.

Measure 2 could place most of the burden for local funding on one industry in one part of the state.

Measure 2 imposes one-size-fits-all government on North Dakota.

What’s right for Williston is not right for Wishek; what works in Fargo will not work in Fessenden; the needs of Bismarck are not the same as the needs in Bowman; Grand Forks is not Garrison; Dickinson is entirely different than Drayton.

If Measure 2 passes, the legislature will have to determine the specific needs for your community and county. This will likely result in a one-size-fits-all approach to local funding.
