Ginsburg V. City Of Ithaca And Cornell University Case Study

Title: Ginsburg v. City of Ithaca and Cornell University et al., 839 F. Supp. 2d. 537 (N.D.N.Y. 2012).

Parties: Plaintiff: Howard I. Ginsburg, as Administrator of the Estate of Bradley Marc Ginsburg, Defendants: City of Ithaca and Cornell University. Court: United States District Court. Procedural posture: The case is before the Northern District of New York after the plaintiff, Howard I. Ginsburg, filed an amended petition as the administrator of the estate of his deceased son, Bradley Marc Ginsburg, asking that the City of Ithaca and Cornell University be held negligent for Bradley s wrongful death as well as personal injuries and conscious pain and suffering. Facts: On or about February 16 or 17, 2010, a freshman Cornell student, Bradley Ginsburg, committed suicide after jumping to his death off the Thurston Avenue Bridge in Ithaca, New York. Investigation showed that Bradley exhibited no visible warning signs associated with someone thinking about ending their life, but the father alleged that the City of Ithaca and Cornell University failed to take appropriate precautions to secure the bridge after 26 prior suicides on it and the other six bridges near campus between 1990 and 2010. Issues: 1) Did Cornell University through planning with the City of Ithaca exercise sufficient control over the design, construction, and maintenance of the Thurston Avenue Bridge where they could not be held liable for any alleged hazards on the bridge that might cause injuries or death? 2) Did the City of Ithaca and Cornell University takes adequate steps to ensure the safety of individual s using the bridge at any time after the prior deaths were committed? Holdings: 1) No. Between the years of 2006 through 2007 Cornell University played a major part in the City of Ithaca s redesign and rebuilding of the Thurston Avenue Bridge but was irresponsible due to their failure to express the importance of adding railings and other preventive suicide measures over aesthetics even with the prior knowledge of past suicidal events. Galindo v. Town of Clarkstown, 2 N.Y. 3d 633, 636 (2004) states that a party that owns or controls the property has a duty to exercise reasonable care under the circumstances in

Difference Between Round And Square Donuts

Comparing the volumes of a round and square donut. Which of these two donuts better fits in a dozen box?

January 25, 2015

Everybody loves to have a donut every once in a while. It s a tasty desert that nobody can deny; children all the way to adults love it. I am personally a huge donut lover! When I usually walk through the mall I find different coffee shops selling square donuts, and not only round ones. This is what sparked the idea in my head that there is a chance that the square donut can be economical where it is a win win chance for both producers and consumers. I do want to prove that producing and purchasing a different form of donuts is more economically beneficial for ... Show more content on Helpwriting.net ... While if the producers were to depend on producing round donuts, the donut box would not be completely filled at the corners, leaving empty spaces at the corner and between two consecutive donuts. The percentage increase in the amount of donut found per donut suggests as well that it is better for the producers to make square donuts, which in this case benefits the consumer as well. One thing that must be taken into consideration when finding the volume of a square donut is that the corners of this donut are not perfectly edged, which means that even though it fits into a rectangular box better than a round donut, there are still very minimal empty spaces that are not covered. Overall, my aim in this experiment is to prove how it will be efficient to produce a square donut and depend on it, because it will be a new trend that everyone wants to try, there will be more dough per donut, price change wouldn t be higher than that of a round donut since the diameter of the circle and the length of the side of the square donut are the

Internet Usage Of Social Media

OVERVIEW: Internet usage has become a heavily integrated and important characteristic of current and contemporary society. It would be rare to meet anyone who has not yet used any aspect of the Internet. In fact, according to the article, Social Media Update 2016 written by Shannon Greenwood, Andrew Perrin, and Maeve Duggun of the Pew Research center, 86% of Americans are currently internetusers (Greenwood et al.) This percentage includes teenagers, emerging adults, and adults. Below are observations of the different trends in internet usage of these different age groups.

TEENS: The Pew Research center refers to the age group of teens as those being between the ages of 12 to 17. Amongst this age bracket, 87% of those (...) now use the... Show more content on Helpwriting.net

In addition to sexting, cyberbullying has become a major issue online. The article, Cyberbullying 2010: What the Research Tells Us, 32% of teens have experienced (...) forms of online harassment (Lenhart). Though there is no way to completely stop the existence of these problems the application of Education about internet usage, dangers, and consequences amongst teens will lessen the exposure of both inappropriate contact and content through online communication.

EMERGING ADULTS: I will be referring to the age bracket of 18 29 as the emerging adult group. Similarly to the teens, emerging adults of today s society heavily use and rely on the internet and internet technologies as forms of communication and entertainment. Andrew Perrin and Maeve Duggen of the article, Americans Internet Access: 2000 2015, observes that 96% of 18 to 29 year olds use the internet (Perrin at al.) Among the 96% of internet users in the age group, 90% of them use social networking sites, as reported by the article Social Media Usage: 2005 2015 (Perrin). A majority of social media networking traffic comes from

1787 Constitution Clauses

While examining the 1787 Constitution, specifically in article 1, I noticed a few clauses that I found particularly interesting. Section 3, clause 2, informed me that senators are split into different classes with altered election periods. For example, one third of the Senate contains first class senators who are open to election every 2 years while second class expires every 4 and third class every 6. Which allows the senate to be a continuous body. Also in section 8, clause 7, states that congress has the power establish Post Offices and post Roads . Personally I ve always assumed that roads and post offices were determined by the states but now that I m thinking about it, I can see where leaving this responsibility to the states may cause

Essay An Injustice for All in Sonata Allegro Form

An Injustice for All in Sonata Allegro Form Wideman s quotation from Brothers and Keepers could be interpreted to say a number of different things. The interpretation I could make is no person could explain the reason things are the way they are in life. In trying to come up with a logical answer they dwell on it and it becomes even more confusing. Afterwards they settle upon the conclusion that things happen for a reason and not in any kind of order. Wideman also claims that people do not have the power to control their own destinies. They are simply a product of their own environments and the events that make and shape them. John Edgar Wideman s Our Time is an essay... Show more content on Helpwriting.net ... The epilogue helps me to kind of understand where John and Robby are coming from but still does not justify their actions. How rediculous would it life be if every time a close friend or family member died someone would go on a crime spree. But metaphorically speaking it gives us a canvas paint a picture on. After the epilogue Wideman jumps straight into an important part of the story, the death of Robby s friend Garth in Robby s point of view. This is important because this is what sparks Robby s behavioral changes. Then John, as an outsider looking in on the situation moves onto how he views Robby. He understands Robby s behavior is wrong but he lets it go because of all the awful things that Robby has gone through growing up. Wideman now finds that his mother is starting to accept that Robby is a product of his environment and the events lead up to his wrong doings. John visits Robby in prison and finally opens the lines of communication between each other. They decide to write a book together but John doubted himself. John did not trust himself with Robby s story because he was tempted to make it his own. The first story Robby talks about is his friend Gar in the hospital. Gar seems very sick, he s stuck in a hospital bed. He was misdiagnosed by the doctors and dies because of it. After the death of Gar, Robby turned into a hardcore gangster. He vowed to make it to the top of the street world . This was his own choice. No one told him he had to

Analysis Of Much Ado About Nothing

Adapting a William Shakespeare play can prove to be a challenge, as so many have done so, making it difficult to stand apart. Accordingly, Plymouth State University added a modern twist to the play Much Ado About Nothing, and, despite certain missteps, I considered it successful. Furthermore, director Jessie Chapman not only changed the time period to a post World War Isetting, but included modern music as well. Accordingly, the costumes were changed to fit the era, including the soldiers uniforms. Despite consisting of one location, the set design was convincing, and the actors used it efficiently. Speaking of which, the majority of the cast lived up to the characters they portrayed, with several standouts. The lighting design had its own intricacies, with the color of the background light changing based on the time of day or when certain characters appear. The sound only played a role when the background music played, of which I question the choices for music. Although the playplodded during certain scenes, other scenes, like that of Benedick and Beatrice eavesdropping on conversations, never ceased to entertain. Ultimately, the play served as a worthy adaptation of Shakespeare s classic story.

In Much Ado About Nothing, Don Pedro and his company returns from the First World War as a guest of Leanata, the governor of Messina, Italy. The don s army emerged victorious over his traitorous half brother Don John, who accompanies Pedro and his men. Upon their

Hinduism Paper

HUMANITIES 130

Hinduism is a diverse body of religion, philosophy, and cultural practice native to and predominant in India, characterized by a belief in reincarnation and a supreme being of many forms and natures, by the view that opposing theories are aspects of one eternal truth, and by a desire for liberation from earthly evils (GodWeb, n.d.). In this paper I will further explore what the Hindu religionis encompassed of. And delve into what makes the religion of Hinduism vital to the region it is originated in. Hinduism differs from Christianity and other monotheistic religions in that it does not have a single founder, a specific theological system, a single concept of deity, a single holy text, a single... In Hinduism the soul is immortal while the body is subject to birth and death. Samsara is considered to be a state of wandering and is caused due to being ignorant of one s true purpose. This idea is directly linked to karma which means action, and also the consequences of the action. It is said that every action has a reaction and it is believed in the religion of Hinduism that it determines your next incarnation, which is basically being reborn. When the cycle of rebirth comes to an end, a person is said to have attained liberation which is moksha. In other words karma is the results you bring upon yourself, good or bad, based on your actions. And also reincarnationwhich is the belief that the soul, upon death, comes back to earth in another body or form which gives the soul the chance to resolve all bad karma that it puts out so the soul can eventually be free and gain liberation from the cycle of rebirth. In this paper the religion of Hinduism has been further explored. The societal and cultural influences that have made it vital to the region where it originated have also been touched upon. I have gained major insight into the Hindu religion form this experience. Before this class I never knew that karma and reincarnation were a part of the Hindu religion. And I never thought I would have anything in common with the religion or share any of the same beliefs. I strongly believe in karma

CPU I5-6600 Unit 3

CPU i5 6600: We chose the new 6th generation intel skylake core because of the higher performance that comes with the newer generation. We also chose the i5 instead of the i7 because there was no room in the budget for the i7 unless the money is wasted into bottlenecking. In addition, we chose the quad core processors because most games are only beginning to adapt to perform on quad core processors which means an 8 core processor would be unnecessary and overly expensive. Lastly the 3.9 GHz should be fine in stress conditions and is only 0.1 GHz slower than its i7 counterparts. The Evolution of Photography Essay

When going for a walk, a person takes in the beauty around them. On this particular day, the refulgent sun is extra bright, making the sky a perfect blue. White, puffy clouds fill the sky, slowing moving at their own pace. The wind is peacefully calm, making the trees stand tall and proud. There is no humidity in the air. As this person walks down the road, they see a deer with her two fawns. The moment is absolutely beautiful. Moments like this happen only once in a great while, making us wanting to stay in the particular moment forever. Unfortunately, time moves on, but only if there were some way to capture the day s magnificence. Thanks to Joseph Niépce, we can now capture these moments and others that take our breath away. The... Show more content on Helpwriting.net ... In 1888, George Eastman made the first light and portable camera under the company name Kodak (Graham 28). These cameras gave people the ability to take a photo almost anywhere. The cameras had to be sent back to the factory so the photographs could be printed. Twenty years after Kodak s first camera, they produced an improved camera, called Brownie . The Brownie was simple to use, making the art of photography boom. Flash cameras did not appear until the 1930s, letting people take pictures in areas with dim or little lighting. In 1947, Edwin Land invented the instant camera. Land got the idea after his daughter asked to see her picture after he took her photo. The next step in improving the camera was by making it digital, which was done in 1975 by a Kodak employee. As the camera gets smaller and simpler to use, the quality of the photographs it produces gets better. Photographs are created from light rays bouncing off objects. When a person looks through the viewfinder, the image they see are light rays reflected from a penta prism, a specially shaped piece of glass inside the camera. The rays from the penta prism came from a mirror, which reflected the rays it received from the lenses. Lenses are used to focus in or out on objects. They attain the rays from the object reflecting the rays toward the camera. For an image to be captured on a film camera, the button used to take

Berkshire

I have chosen to write my paper about two particular mergers which involve large companies that everyone is familiar with. I will be discussing the successful union

of Heinz Corporation, Berkshire Hathaway/3G and Kraft foods. In addition I will be writing about the unsuccessful merger of K mart Corporation and Sears. I feel that the success and failure of these mergers are important because they involve the future of products that consumers purchase every day and have related to for most of their lives. The following comparison relates to management because it shows how strong companies that are run successfully can continue to grow even if they do

face some hard times. On the other hand it also shows that companies that are not successfully ... Show more content on Helpwriting.net ... In fact, Sears has seen a consistent drop in revenue since 2011 and overall sales have be down since 2006. Even selling off their Lands End division which was in competition with L.L. Bean and Eddie Bauer did little in the way of resolving the problems. Also they have sold off their Sears Hometown as well as Sears Outlet stores. One thing that I think could have been done to prevent the problem

was that Sears should have never merged with K Mart. K Mart had declared bankruptcy three years before and ended up closing a large number of stores. Secondly, I think

that K marts problem lied with the way they tried to be competitive with the number of stores they had over anything else. By this I mean that the company should have followed the strategy of Wal Mart and Target. Like I mentioned previously, Wal Mart focused on small town stores and had distribution centers regionally located to those areas. That is one way they were able to offer such low prices since they did not have to spend large sums of money to ship goods from one end of the country to the other. Target
