EB-4 Visa Employment Fourth Preference visas (EB-4 visas) are designed for special immigrants. These visas are assigned to religious workers. In addition, EB-4 visas are also designed to cater for broadcasters, Iraqi or Afghan translators, physicians, military members, international organization workers, Panama Canal Zone employees, Iraqis who have assisted the United States, and retired NATO employees.

EB-5 Visa Employment Fifth Preferences visas (EB-5 visas) are designed for foreign investors. Capital investment of $500,000 or $1 million must be made to a U.S. business that creates at least 10 full-time jobs by the investor. The mandatory capital requirement depends on where the U.S. company receiving the investment is located. EB-5 investors have the option to invest in regional centers which are business centers which receive the designation to manage these foreign investment projects.


Every investor must fulfill one of the below-given rules to truly qualify for the business : They need to be established after Nov. 29, 1990 on or before Nov. 29, 1990 Restructured or reorganized a purchased and the existing business in a way that yields a new commercial enterprise result A 40-percent increase in the net worth or in the number of employees occurs through an expansion through the investment.


Commercial enterprise means any place formed for the prospect of business and generation of profits which might include: A sole proprietorship Partnership (whether limited or general) Holding company Joint venture Corporation Business trust, or Any Other entity, which may be publicly or privately owned.


This includes a definition of a commercial enterprise that consists of a holding company and its completely owned subsidiaries, provided that each such subsidiary is engaged in a for-profit activity formed toengage in an activity which generates business and a commercial activity. There are 10,000 visas reserved for EB-5 applicants each year. Out of these visas, there are 3,000 visas reserved for foreigners who invest in the Regional Centers dedicated to EB-5.
