What sets you apart as an estate agent? Personal service, enthusiasm and willing to do that little bit extra to conclude a deal. How do you think technological advancements will affect the way property is sold? There is definitely a movement towards being online, with virtual tours and new apps popping up. But on a small Island there really is no reason not to be visiting property and talking to experts faceto-face, so I don’t ever see our role becoming redundant.

QUICK FIRE QUESTIONS Born: Jersey School attended: Victoria College If you weren’t an estate agent what would you be? I had aspirations when I was young of being a vet as I love animals. Instead I’ve settled for owning two cats. How do you unwind? Year-round walks on the beach with my wife Marta, or a spot of golf when I can. East or West? I should probably be impartial, but it has to the West! I’ve always lived on this side of the Island. Describe your ideal home: It would need to be in St Ouen with sea views and let in sunlight all day long. Preferably an open living space that would lend itself to entertaining friends and family. If you could live anywhere in the world where would it be? Although I spent two years working in the Costa Blanca, there really is no comparison to Island life. Roaring fires or outdoor BBQs? It is interesting to note that some sellers are not as committed to moving as they might be, and are prepared to remain on the market until what they regard as an acceptable offer comes along. Likewise, some buyers, whilst generally remaining committed to a purchase, do not exhibit a great deal of urgency, and believe that they are entitled to submit a relatively low offer in the hope that the seller might just take it. There are two issues here and I would advise caution to buyer and seller alike. Firstly, if, as a seller, your house fails to sell for whatever reason and you are on the market with a proven good agent, then it is probably priced too ambitiously for the current conditions. If you allow it to remain on the market at that price, it could become stale on the market, resulting in an inevitable fall in price greater than a minor repositioning effected now.

“So the rule of thumb is this; if you see a property that you can afford, which offers you the accommodation you need in an area you like, and you could be happy there, then snap it up” From a buyer’s perspective, I suggest you focus on securing the right home for your needs, within your budget, more than on finding the greatest bargain. A percentage off the asking price is irrelevant if the asking price is too much to begin with, but a wellpriced property is always in demand. Unless you act decisively, you could miss out. So the rule of thumb is this; if you see a property that you can afford,

FURTHER REGULATION OF JERSEY RESIDENTIAL LETTINGS WORDS Tim Hart, Partner at Appleby

Since then, the Residential Tenancy Law has been supplemented by the Residential Tenancy (Condition Reports) (Jersey) Order 2014 and the Residential Tenancy (Deposit Scheme) (Jersey) Regulations 2014. The latest legislative development is the Public Health and Safety (Rented Dwellings) (Jersey) Law 201- (the “Rented Dwellings Law”), which the States Assembly approved last December. It will come into force once it has been sanctioned by the Privy Council. The Rented Dwellings Law was prepared with input from officers from Planning, Housing, Health and Social Services and Jersey Fire and Rescue. Its aim is to set minimum standards across the rented dwelling sector to match those already adopted by the Social Housing sector.

The past few years have seen a transformation of the Jersey legal landscape in relation to residential lettings. Until the advent of the Residential Tenancy (Jersey) Law 2011, the sector was a virtual regulation-free zone. These Ministerial powers are given teeth by the powers of investigation and enforcement contained in the Rented Dwellings Law. There is a range of enforcement options, from the issuing of “hazard awareness advice” to the landlord and/or the tenant through to the issuing of an “improvement notice” to the landlord or, in the most serious cases, the issuing to the landlord of a “prohibition notice”. Perhaps more controversially, the Rented Dwellings Law gives the States the power to make Regulations to establish a scheme of licensing rented dwellings, and in particular to enable the Minister to issue and charge for licences. Unlike Orders, which are made by Ministers and presented to the States Assembly, Regulations are made by the States Assembly itself, so any proposed Regulations to introduce a licensing system would require a vote of the Assembly.

“Perhaps more controversially, the Rented Dwellings Law gives the States the power to make Regulations to establish a scheme of licensing rented dwellings, and in particular to enable the Minister to issue and charge for licences.”

Under the Rented Dwellings Law the Minister for the Environment is made responsible for introducing measures to ensure minimum standards of health and safety are met by rented dwellings. This will be achieved by the Minister making Orders, which among other things may prescribe what structural or other defects to be found in rented dwellings will be regarded as hazards, the method of assessing risks posed by these hazards and the level of risk that is acceptable for any hazard. The Minister is also given the power to prepare, issue and revise codes of practice to provide practical guidance in respect of any provision of the Law or its Orders.

The meaningful detail in relation to the Rented Dwellings Law will be contained in the Orders and Regulations which are made pursuant to it. Whilst it will, as always, be a case of suspending full judgement until the detail is known, it is heartening that the Minister has made clear to the States Assembly his commitment to achieving the right balance: “I can ensure Members that I will work with them across government to ensure that whatever is necessary to have a strong, vibrant rental sector, where tenants are protected, but landlords can also run their businesses without unnecessary bureaucracy.”
