JERSEY LENDING MARKET

Regulations introduced in the UK last year continue to restrict the ability of local lenders to offer the maximum size mortgage that many borrowers, especially First Time Buyers are looking for. Shopping around the lenders can be time consuming and depressing, especially if you have to wait up to six weeks to see an adviser and to then be told that your bank can’t help you! Fortunately no two lenders use the same lending criteria, so there are still facilities available to satisfy most borrowers’ expectations. Without doubt, one of the most contentious areas of property ownership is in relation to boundaries. The legal status of the boundaries of a property appear to take on an importance all of their own (and perhaps understandably so). From the Jersey perspective, this may in part stem back to previous centuries when Jersey’s main source of income was agriculture and the Island was heavily planted with potatoes, tomatoes and other crops and with every spare piece of land available being utilised. There is a saying that an Englishman’s home is his castle and, in local terms, that is an even greater truism. The boundaries of a property (be they natural or man-made) are considered by the property owners to be an integral part of their domain and are therefore protected and guarded jealously. This position and approach has to be tempered with the fact that people have to live next door to each other and any disputes on boundaries can certainly affect and possibly sour, beyond repair in some cases, neighbourly relationships. That is why such importance is placed upon the legal status and integrity of property boundaries by law firms acting on behalf of prospective purchasers. It should be remembered that if your legal advisers are raising boundary concerns with you, it is because they simply wish to ensure that your decision to purchase a property (possibly in spite of those stated concerns) is an informed one.

It is perfectly natural for a purchaser to get caught up in the excitement of a new purchase and (at that time) to consider boundary issues as irrelevant to their enjoyment of the property. However, and in the most severe of cases, such a decision made in haste can be regretted for a much longer period. The significance of unclear boundaries and the effect of neighbourly disputes in that regard have been recently highlighted in the widely reported judgement given by the Bailiff in the case of Fogarty v. St Martin’s Cottage Limited.

An 87 year-old grandmother’s second appeal against plans for a development of flats next to her 19th century home, Seymour Cottage, was upheld by the Royal Court in May. The decision provides some helpful guidance on the application of planning policy for developers and affected parties alike. Round 1 When plans were passed for a development of flats on the coast of Grouville Bay next to Mrs Herold’s home, she lodged an appeal against it. The first appeal succeeded because the Court agreed that the Minister had failed to take into account that Seymour Cottage was a ‘potentially listed building’. Island Plan Policy HE1 offers protection for listed buildings and their settings. The Minister argued that the policy did not apply to mere ‘potential’ listings, but the Court disagreed. This decision was key to the success of her appeal. However, the Court also decided that, apart from the Policy HE1 failure, the original decision to grant permission was within what is known as the Minister’s ‘margin of appreciation’ as to what is reasonable. Given the complexities of the Island Plan, it is inevitable that development policies will pull in different directions. A proposed development might comply with some policies and yet be contrary to others. The margin of appreciation permits decision makers to look at the overall impact of a plan and, if justified, to grant permission even when certain policies are not fully satisfied.

Round 2 So, following the first appeal, the developer commissioned a report which effectively concluded that the setting of Seymour Cottage (now a Grade 4 listed building) would not be adversely affected by the development. Unaltered plans were submitted reliant on this new report.

However, the Historic Environment Team (HET) on behalf of the Planning Department also assessed the impact on Seymour Cottage. They concluded that the plans did not comply with Policy HE1 and would have a detrimental impact upon the setting of Seymour Cottage. Certain steps were recommended for how to mitigate the impact, but the developer chose not to alter the plans to the extent proposed by the HET or to address similar objections filed by members of the public. A scaffold profile was erected on site so that the Minister could visualise the impact for himself. After visiting the site he suggested minor amendments to the plans, which still did not address the concerns of the HET. Planning permission was granted.

Policy HE1 clearly states that proposals which do not ‘preserve or enhance’ the setting of a listed building ‘will not be approved’. The Court found that because the setting was not being preserved or enhanced, the development was contrary to Policy HE1. Under these circumstances, the appeal was again successful.  This case underlines the importance of presumptions within the Island Plan and specifically those relating to historic buildings. Approximately 4,000 buildings in Jersey are listed as having historic interest. We all know that listing creates restrictions for owners, but this case makes it clear that listing can also provide useful protections against potentially harmful changes to a building or its setting.

On appeal, Mrs Herold invited the Court to conclude that given the public opposition and the HET’s repeated concern that the development did not comply with Policy HE1, the decision to approve the development was outside the margin of appreciation afforded to the Minister.
