QUESTIONS FOR NEW LANDLORDS Several years of low interest rates have seen savers investing in buy to let properties in an effort to keep their money working for them. If you are considering spending your savings on a second property, what should you think about? 1. What kind of property should I look for? In Jersey your main choice is between an apartment or a house.   As a rule, there are more tenants available for apartments, but they will pay less rent, and may stay for shorter periods of time.  Houses command higher rentals, and tenants are more likely to be families or groups of professional people.  These tenants may be harder to find, but are more likely to enter in to an extended tenancy agreement. You may find that you have to redecorate and renovate an apartment more often than a house occupied by a family; you should account for this when calculating you income and outgoings.   2. Do I have to pay tax on rental income? Income from rent must be disclosed on your tax return and will be assessed for income tax.  Non-resident landlords will also pay Jersey income tax, but this is collected under a separate system.  You should take specialist tax advice to ensure you comply with the law and ensure you remain tax efficient.   3. How do I keep the right side of the Housing law? If you buy a freehold or flying freehold property, you will need to obtain a registration card before completion to ensure that you comply with the Control of Housing and Work (Jersey) Law 2012.   The Population Office and Social Security can issue registration cards.

Whatever type of property you purchase, it can only be occupied by an appropriately qualified tenant. A ‘qualified’ property can only be occupied by an ‘entitled’ or ‘licensed’ tenant.  A ‘registered’ property (previously ‘unqualified’) can be occupied by tenants holding registration cards showing them to be ‘registered’ or ‘entitled for work only’.  The Population Office will be able to confirm in to which category your property falls. You must take and keep a copy of your tenant’s registration card before they move in to the property.  Failure to comply with the law may result in a criminal record. 4. Should I insure the property, or should the tenant have their own insurance? Blocks of flats will usually be covered by a collective buildings insurance policy, but you may wish to take out an additional policy to cover the fixtures and fittings that may not be covered.  It is usual for tenants to cover their own personal belongings, and you can include this in the tenancy agreement. 5. Do I need to prepare a written lease? All tenancy agreements need to comply with the provisions of the Residential Tenancies (Jersey) Law 2011, which sets out the details that must be and cannot be included in a residential lease. In particular you must give a tenant time to read the lease before requiring them to sign it, and deposits must be documented. While

many of the provisions of the law are to protect tenants, compliance with the law can assist you if you wish to evict a difficult tenant. 6. Can I get a mortgage for a buy to let property? Most of the major lenders do offer buy to let mortgages, but you will probably need a bigger deposit than you would for a normal residential lease. Your lender may restrict the terms of the tenancy agreements you use. 7. Can I restrict the kind of tenants I have? Some apartment blocks will contain restrictions relating to the age of tenants, pets and the use of apartments and common areas.  You can include more detailed restrictions in your lease, but you may find that this is unacceptable to some tenants. In general tenants occupying flats are more likely to accept restrictions on their behaviour, but tenants occupying family homes may think it is important to be allowed to keep their family dog, or redecorate kids’ bedrooms. With the weather remaining unpredictable, and all those tools you received at Christmas still sitting in their boxes, spring seems a good time to assess what small jobs you can complete around the house.

So the job is good to go and the family are happy to live through the disruption. Do you have the correct tools for the job? Don’t make do. It’s worth hiring good quality equipment if the Christmas gifts won’t cover it. It will probably make the job quicker to do and will most likely be safer as a result. Are you going to be using electrical tools? Check for obvious things such as damage to electrical cables, plugs and the body of the tool. Get the tool repaired or replaced if there is any damage. Use battery power tools, when possible, so you can avoid tripping over the cables. Always fit a residual current device and, when not using the tools, make sure little hands can’t get to them.

First step: don’t be over ambitious. The reason professional tradespeople are called professional is because they are trained, skilled and have experience. If a job looks too big it probably is, so talk to a JeCC member. Be honest, have you got the time and skills to do the work; as frustration and short cuts can lead to accidents.

Do you enjoy breathing? Don’t forget to open windows when using a power sander or painting, to keep the room well ventilated. Safety goggles and dust masks are essential when sanding. Do you need to get up high? Falls from height are one of the main causes of DIY accidents. Never use chairs, up-ended bins or random pieces of furniture. Get yourself a decent ladder, follow the manufacturers instructions, (usually found on the ladder), and check for damage before using it. What are you going to wear? If you are going to use power tools then try not to wear loose clothing, which could get caught. If working with cement, cover up, cement attacks the nerve endings so you don’t always realise how much skin you’ve lost. Accidents are more likely to happen if you rush or simply do not know what you are doing. According to the Jersey House Price Index published for the fourth quarter of 2013 by the States of Jersey Statistics Unit “the mix adjusted average (mean) price of dwellings sold in Jersey in calendar year 2013 was 1% lower than in 2012” all of which is good for buyers. Similarly they reported that 2013 represented the fourth consecutive year in which the average dwelling price decreased marginally on an annual basis… stating “over the five year period from 2009 to 2013 the overall mean price has fallen by 6%, which again is good for buyers. In addition the number of properties sold (the turnover) increased in the latter half of 2013, which observation is good for buyers and sellers alike. Jersey’s property market has always been different from the UK’s and until the due court date arrives, anything can happen!! The JEAA has put together a few steps for purchasers on negotiating and making offers to assist in the process: Step One – The most important point when purchasing a property is to arrange the finance and as any potential purchaser will already know, first time buyers, buyers with no chain ie no property to sell and buyers with mortgage approval in principal, all have a head start.

Step Two – When discussing your requirements with an agent, ensure that they are aware of your financial position as this puts you in a favourable position to negotiate. Step Three – Make sure you know your budget in terms of the maximum figure you can go to and be sensible on your starting price. Vendors can be offended by extremely low offers and this may not improve your chances of negotiating upwards at a later stage. Step Four – Consider that all vendors are selling for very different reasons and where one might be desperate to sell at a reasonable price, another might be holding off for the asking price. Step Five – Once you put forward an offer be prepared to proceed to completion in a timely manner, subject to survey, if applicable.
