M ost New Zealand em ployees ar e guar anteed a m inim um of five paid sick days a year after the fir st six m onths of continuous em ploym ent. Those five days can be used up pr etty quickly if you get sick, so it's tem pting to go in to w or k w ith a "just a cold". But as you sneeze over your colleagues, your vir al infection spr eads like w ildfir e and can r esult in m ass

absenteeism , r educed pr oductivity and low m or ale. Accor ding to the M inistr y of Health, r espir ator y vir uses such as colds and flu ar e spr ead by coughing, sneezing and dir ect contact w ith an infected per son. To avoid infecting other s, people w ith these sym ptom s should stay at hom e until w ell. Em ployees w ith diar r hoea and vom iting illnesses such as food poisoning and gastr ic vir uses should stay hom e until w ell, and for 48 hour s after the last episode of diar r hoea or vom iting. Car oline Sandfor d, executive dir ector at The Car eer Developm ent Com pany, says it's im por tant to infor m your boss or HR depar tm ent of your sickness as soon as possible.

"A phone call is best for this r eason and, if possible, befor e you nor m ally star t w or k ." How ever , som e or ganisations m ay pr efer a differ ent for m of com m unication such as em ail or inter nal m essaging, and Sandfor d suggests finding out w hat m ethod they pr efer befor e you need to use it. Som e people ar e hesitant to shar e the per sonal r easons they need tim e off, and other s m ay over shar e, pr oviding all the gor y details in or der to pr ove they'r e not playing hooky. Sandfor d says you'r e entitled to keep the r easons for your sickness to your self. "If you've been sick for thr ee consecutive days, your em ployer can r equest a doctor 's cer tificate

stating that you'r e sick, but this should not include pr ivate or ir r elevant infor m ation. And if they ask for one befor e the thr ee days ar e up, they w ill need to r eim bur se you for the doctor 's appointm ent." She notes that if a doctor has let you know how m any days you'll need to r ecover , it's im por tant to pass this infor m ation on to your boss and it's a good idea to r equest a doctor 's cer tificate at the sam e tim e, stating this. If you've taken sick leave because you'r e infectious but not too sick to look at your laptop, it m ay be tem pting to stay connected w ith w or k, r eplying to em ails and w or king on pr ojects. Sick leave is a benefit that is due to you as par t of your com pensation package, and ther e shouldn't be any guilt in taking tim e off to get w ell. How ever , som etim es you can genuinely fall ill after a long w eekend, the office Chr istm as par ty or the Rugby Wor ld Cup final, and then it can be har d to sound believable w hen you call in sick .

"Of cour se, this happens," says Sandfor d. "If your boss doubts that you ar e r eally sick, they m ay ask for pr oof fr om a doctor , but they w ill need to r eim bur se you for this if you have been sick for less than thr ee days."

Em ployer s m ay occasionally be confr onted by a situation w her e an em ployee has been diagnosed w ith a ser ious illness that m ay r equir e w eeks or m onths off w or k . Sandfor d says this situation needs to be handled w ith car e and em pathy.

"Your em ployee is m ost likely feeling vulner able and sensitive at this tim e. W hile being suppor tive and positive, it's par am ount that you find out as m any details as possible and seek m edical advice so you know w hat you'r e dealing w ith. The num ber of entitlem ents the em ployee has and the natur e of their em ploym ent w ill im pact on how you handle the situation. It's im por tant to stay infor m ed thr oughout the illness to keep the balance betw een m anaging the best tr eatm ent of the em ployee and looking after the business."

Evidence is m ounting that full-tim e w or ker s in New Zealand m ay have an incr eased chance of suffer ing a str oke.

That level of hour s puts Kiw is am ongst the har dest-w or king in all developed nations w ith only people in Colom bia, Costa Rica, M exico, Tur key, Chile, South Afr ica, Isr ael and Iceland w or king longer hour s.

The latest of sever al studies analysing the link betw een long w or king hour s and str okes sur veyed alm ost 150,000 people in Fr ance. The r esults, published by the American Heart Association, found that those w or king days of 10 hour s or m or e, for m or e than 50 days per year , have a 29 per cent incr eased chance of a str oke. Fur ther m or e, those w ho kept up those hour s for m or e than 10 year s incr eased their potential for a str oke by 45 per cent. In New Zealand, the aver age full-tim e w or ker put in a hefty 42.7 hour s per w eek in 2018 accor ding to the Or ganisation for Econom ic Co-oper ation and

it seem s New Zealander s m eet the cr iter ia for an incr eased chance of str oke. The Str oke Foundation r ecom m ends getting r egular blood pr essur e tests and eating a diet low in salt as tw o pr actical m easur es to pr event str okes. Know ing the signs of som eone having a str oke can also save their life. The Str oke Foundation r ecom m ends calling 111 if you see som eone exper iencing the follow ing sym ptom s: -

$26m underpaid to Michael Hill in Aussie An independent r eview of jew eller M ichael Hill Inter national has found it under paid its r etail staff in Austr alia for the past six year s. M ichelle Davidson took her for m er boss Rober t Hem m ingson? to the Em ploym ent Relations Author ity, successfully claim ing she w as unjustifiably dism issed. She w or ked for Hem m ingson at the Foxton Hotel in 2017, doing the cleaning and w or king behind the bar. He never gave her a w r itten em ploym ent contr act, but said he asked another em ployee to give her the usual ver bal agr eem ent: a 90-day tr ial on $17 an hour inclusive of holiday pay, w ith a per m anent contr act after that. Her job w as to clean the bar thr ee days a w eek and do shifts behind the bar. Things star ted w ell, but by Novem ber 2017 he w as r aising concer ns about the standar d of cleaning. One of the biggest flash points in the em ploym ent r elationship happened on M elbour ne Cup day in 2017, w hen Davidson w as w or king behind the bar. She said people w er e intoxicated, but not "dr unk dr unk", w hen a fr acas br oke out. It descended into a bar fight, w ith punches thr ow n. Although ther e w er e ar gum ents about w hat happened ? Davidson said she tr ied to stop the fight, w hile Hem m ingson claim ed she thr ew punches at a patr on ? she did push som e of those involved out the bar.

But the pr oposed tr ial w as unenfor cable because the law r equir ed it to be in w r iting. Given she did not need counselling or m edical assistance after w ar ds, her com pensation w ould usually be $5000. But Tetitaha slashed it to $2500 for Davidson's contr ibutor y behaviour. Her explanation about stained toilets, claim ing it w as due to leaving cleaning pr oduct on them too long, w as not cr edible, Tetitaha said. The bar scuffle w as also concer ning, as Hem m ingson w ould have been under police scr utiny. She also could have exposed Hem m ingson to cr im inal action as she adm itted to ser ving dr unk patr ons. How ever , she w as also ow ed holiday pay, as Hem m ingson had no legal ability to include it w ith her w ages, Tetitaha said. It denied M r Nath's allegation that it contacted Im m igr ation to advise that he w as not r etur ning to his em ploym ent. It said that it w anted him to r etur n. The Em ploym ent Relations Author ity said M r Nath w or ked betw een 50 and 60 hour s a w eek but w as only paid for 30 hour s. It has or der ed he be paid $54,238.06 in unpaid w ages. The ERA found that on the evidence, Spice Room found it m or e convenient to em ploy another chef to r eplace M r Nath than w ait for his r etur n. It found M r Nath w as unjustifiably dism issed and did have a per sonal gr ievance. It has or der ed Spice Room to also pay M r Nath $10,424.96 as r eim bur sem ent for lost w ages and $22,000 as com pensation for hur t, hum iliation and injur y to feelings.
