Prejudiced Priorities T

he City’s inner roads are a mess – the roads that are travelled daily by the residents. The City has inadequate basic civic facilities – like water and power; sanitation is poor, garbage is strewn all over, there are no public toilets, no bus stands, no parking facilities, slums abound…. And yet, the Administration has committed hundreds of crores on 2 projects, on roads that did not even need repair (let alone renovation or renewal), and that residents have not even asked for. Following the announcement and digging up of the Golf Course Road, to make an intra-city Highway, we now have the announcement on relaying of the MG Road ! At a fraction of the cost all the inner roads of Gurgaon, that affect all the residents, could have been repaired. Clearly the Administration has no clue of what the residents need – or it just does not care ! The priority for this govt. and Administration seems to be the satisfaction of just the builders. Beware, HUDA and Hooda ji, elections are not far off…..and the monsoon is even nearer.

The lacey diamond creation was trimmed with pearls, while the citrine and gold combination was an eye catcher. The square topaz with a giant drop on the chain, the danglers in gold with pear ruby shaped ends and the droplets of turquoise on the shoulder dusters were great additions. The strands of rice pearls with the angular double pendant and the final “S” shaped ruby and diamond creation with a gleaming droplet at the centre was a dramatic piece. Monica ended the show with her award-winning arrow shaped pendant on a chain of black pearls adorned by Star Cricketer Atul Wassan. One of the critics says, “Monica Kapur’s “Anupam” collection was truly incomparable on all fronts.” When asked about her experience at the show, she says, “After a positive response from the critics, I am encouraged to design unique, more creative, and affordable jewellery, keeping in mind the needs of today’s modern women.”

he moment one crosses the traffic conundrum at Rajiv Chowk and takes a left turn for MiniSecretariat—the sanctum-sanctorum of Gurgaon Administration—one catches a glimpse of an entity that signifies yet another important pillar of the State – the Judiciary. Gurgaon's District Court, the hallowed abode of truth and justice, is the biggest district court in the whole of Haryana, Punjab and Chandigarh – in terms of members. But the apartheid, better known as administrative negligence, from the side of the State doesn't spare anybody – not even these lords of justice. The District Court lies in a shambles, with hundreds of lawyers and their clients forced to discuss the cases under tin shades – because most of them don't have any chambers to sit in. “At present we have 26 courts in this judicial complex, with 1 District Session judge, 1 Session judge Family Court, 7 Additional Session judges, 17 Civil judges, 1 Chief Judicial Magistrate, 1 Consumer Court and 1 Utility Court. We have around 3,700 members, increasing at a breathtaking rate of 300 members each year. The 26 courts have just 299 chambers for the thousands of members. If we include the clients, the accused and the victims, along with their relatives, this number would certainly cross the 5,000 mark. But unfortunately this Court doesn't have proper infrastructure to house even 5 people comfortably. And that's the tragedy due to the State's negligence and apathy,” said Santokh Singh, a senior advocate, and former Gurgaon Bar Association President. Gurgaon District Court is one of the oldest judicial complexes in the State, and it has been operational for the past 38 years (Court was shifted to this complex in 1975). To start with, this Complex was one of the avant garde complexes in the State, with 10 courts and 250 chambers. Today, this complex is even inadequate to hold all its functions under one roof; we have to carry out our proceedings in a borrowed complex in Vikas Sadan, in front of the Mini-Secretariat. Five out of 17 Session judges sit in Vikas Sadan – including the Consumer Forum and Juvenile Justice Board,” added a dejected Singh.

Obsolete infrastructure

Every small and big case that happens in Gurgaon comes to this Court first, before it goes to the High Court in Chandigarh. It's often claimed that both the judges and the advocates are lazy in Gurgaon, and that's why people don't get their cases heard on time, which eventually results in the delay of justice. But the reality is that the courts don't have enough infrastructure in place. None of the courts in this judicial complex is air conditioned, which makes it very difficult for both the judges as well as the masses to sit (in hearings) for a long time. I have requested the Building Committee in Chandigarh many a times to give the courts ACs as well as computers (in Hindi also). The computers would bring more transparency in the system,” said Singh. Even smaller and less significant districts in Haryana have a better judicial infrastructure. “Even the facilities provided to the advocates are much better,” said another senior advocate.

New Complex: a distant dream

The Building Committee has allotted a piece of land adjacent to Vikas Sadan for the construction of new judicial complexes, with state-of-the-art facilities similar to international courts. But this project remains a dream. “I have been to the Building Committee meeting in Chandigarh. It was decided that Gurgaon would have a new judicial complex. This new proposed complex would have a 5 floor building with 60 courts, a canteen and two big halls – one for the meeting of lawyers, and another for the clients to sit down and discuss their cases with their lawyers. Chambers for the lawyers would also see an increase. We have met Justice S.K Mittal, inspecting judge of Gurgaon Session division, who also happens to be the Chairman of the Building Committee in Chandigarh, and requested him to look into the matter,” Singh added. Alok Yadav, another advocate, said that in a few of the newly constructed chambers, the air conditioners have been installed – but they are not operational. "At present we normally get dates at an interval of six to nine months, but after the new set-up it is expected that more cases will be cleared. As the dates will be given at shorter intervals, the cases will end sooner," said a senior advocate. u

t is rare that I am out at three a.m. However, I was compelled to return from Delhi at the hour. I was a bit uneasy. I had recently been told that policemen stop cars for random checking, and then invariably find an excuse to levy a heavy challan. It was a full moon night. As I drove through MG Road, I passed many police patrol cars on the way. The road under the Metro line felt safe; thankfully it was well-lit by

the neon hoardings, as there were no street lights. I had imagined this stretch to be a lonely one; but even at that time of the night people were still on the road – and cars were stopping at the red light ! I was jolted out of my complacence as soon as I entered the circle near Sikanderpur. It was dark. This is not a new road – in fact is has been there well before NH 8. Why has this stretch been so neglected? The Metro lines have been constructed above this stretch too; and yet, below lies sheer negligence. Are the authorities (as usual) waiting for a tragedy to occur…before they act? u

veryone aspires for a dream home in the Millennium City. However, there seems to be little space for the poor—the economically weak— though they have played an important role in its development. The State’s EWS Housing has been poorly misused – or lies unused. While the Department of Town and Country Planning (DTCP) says that EWS Housing is meant for Below Poverty Line (BPL) families, the plots and flats have been sold (and resold) to others. Delhi, on the other hand, has been credited with a fairly successful model of EWS Housing. With various schemes such as Janta Flats and EWS Complexes, the Delhi Development Authority (DDA) has been able to plan, construct, and allot houses to the deserving BPL families. Narender, a daily wage worker in Gurgaon, saved up, and also took a loan, to book an EWS apartment near a condominium in South City I. The construction of the apartments has been completed, he has also paid a few installments – but the allotment has not been done. “I had taken a loan from Gramin Bank. Now they tell me that all applications have been blocked, because some people had furnished fake BPL cards. With my dire financial situation, how do they expect me to wait? They should either refund my money or allot a flat at the earliest,” says Narender. There are over 20 people whose applications have been blocked for this Complex. On the other hand, EWS apartments in Sector 47 have remained vacant for more than two years. “Construction has been completed, but due to some issue regarding their allotment, almost 1,000 EWS apartments are lying vacant,” says Manak, an RWA member. According to the provisions of the Department of Town and Country Planning, 15 per cent of the area developed by a builder has to be kept for affordable housing (for BPL families). A developer is entitled to get the Completion Certificate only after meeting this requirement. These flats/plots are supposed to be handed to the beneficiaries by a draw of lots, a lottery, or any other similar medium. But owing to (deliberate?) confusion regarding the rules for their allotment, and sometimes conflict between builders, the plots/flats remain vacant.

Capital’s success story

DDA has made an allotment of over 1,54,700 flats to the Economically Weaker Sections of society in the last three decades. DDA constructs residential flats for the poor under two categories: Janta Flats and EWS Housing Complexes. As soon as the construction of flats is completed, they are offered for allotment to the applicants. Allotment of the flats is made through a computerised draw, after scrutiny of the applications as per the eligibility criteria and the terms and conditions. Just like Gurgaon, DDA also keeps 15 per cent of an area exclusively to meet the housing needs of BPL families.

Proper planning

The Planning department of DDA has amongst the largest planning teams of any development authority in the country. DDA spokesperson Neemo Dhar says, “We have made structural changes to adapt to the changing times. In 1967, when we started, we laid down a very basic structure of a one-room EWS apartment. Over time, we concentrated on the maximum utilisation of space, as well as provision for amenities in the area – like

parks, schools and community centres. If you compare flats made under Rohini Residential Scheme 1981, and the recently constructed Janta Flats in Dwarka and Narela, you will find a big difference. The prefabricated technique is now used to construct even EWS houses. This technique ensures that the pre-casting of walls and columns, and the assembling of flats, takes place at the site itself.” Rabish Jha, a resident of an EWS complex in Dwarka, Sector 23, smiles and says, “Our complex boasts of shops, parks and a big community hall. It is a pedestrian-friendly area, with no vehicular movement. For us, it is like a different world altogether.” He recently moved from a 'JJ Colony' to Dwarka. Each flat in Sector 23 has one bedroom, a bathroom with ceramic tiles, a Gurgaon needs EWS houses for a specific local reason also – as residential spaces are laid out in condominiums and sectors, where there is a constant demand for 'service staff' – eg. those who run the water supply systems, manage the power supply, maintain and manage the lifts, and provide security. “Today, we are dependent upon either private companies that provide maintenance staff, or the RWA. Although services provided by them are not poor, there is always a delay, because these people don’t live near the condominium. Had there been an EWS Complex close to our condominium, we would have got these services instantly,” feels Manmohan Chawla, a resident of Heritage City.

A few residents feel that EWS should not be allotted near a condominium. “All sorts of people live in unauthorised colonies and slums. I don’t think it is a good idea to relocate them from slums to the flats made in the vicinity of a condominium,” says Garima Pandey, a resident of Sector 57. A resident of The Palms seconds her view and says, “If you look at the EWS model in the Capital, it has set up separate colonies for Janta Flats and EWS flats. Moreover, the cost of even a one-room flat near a condominium increases manifold in a short period of time. That is why builders prefer to sell these apartments in the independent market rather than allocate them to the actual beneficiaries. So building an EWS complex near a condominium is not a good idea at all.” kitchen and a small lobby area. The planning for a residential complex in DDA areas has always been guided by Master Plans, Zonal Plans, Action Area Plans, and Urban Development Plans. “Under the Master Plan 2020-21, all EWS Complexes will have amenities like grocery shops, parks, community centres, a ‘chowkidar’ hut, parking spaces, and ‘Aanganwadi’ Centres in each block,” says Dhar. The Master Plan has also paved the way for private participation in EWS Housing. DDA has started the groundwork for constructing 50,000 houses for BPL families, with the help of private players. Construction for the first set of houses under the EWS category in Narela will be started soon. DDA has invited tenders from private developers, and so far 15 developers have responded.  Unlike in Gurgaon, where the standard size of an EWS plot ranges between 33 and 60 sq yards, DDA plans Janta Flats or EWS houses on at least an area of 50 sq yards. The architecture also plays an important role. For instance, there is a huge difference between a

Foolproof Allotment Norms

It’s important that EWS houses go to deserving beneficiaries, and continue to be in their possession. Sometimes the asset changes hands and the allottee ends up once again in a slum. An RWA member from Rohini, Sector 35 says, “Most of the BPL families who were the actual beneficiaries of Janta Flats have gone back to the 'unauthorised colonies'. They sold their apartments within five to six months of acquisition, since they got five to 10 per cent higher prices.” To keep a check on this practice, DDA has now introduced a new method. “In some of our new projects, like the one in Kathputli Colony in West Delhi, we are carrying out a biometric registration of slum dwellers before the construction of the EWS complex. With the help of this, we can also find out if an allotee of a EWS flat has gone back to the slum or any other house. This will help in curbing the resale of EWS houses,” says Dhar. The authorities have also revised the income criteria for the allotment of EWS houses. It has been announced that a person having an income up to Rs. 1 lakh per annum is eligible to apply for EWS and Janta Flats. This step has been taken to curb the practice of 'false income certificates'.

Land Pooling Policy

To provide a momentum to the development of EWS Housing in the Capital, DDA has implemented a unique Land Pooling Policy. Since the first Master Plan of Delhi in 1961, DDA’s normal policy has been to acquire large tracts of land, develop them and then sell them as residential properties. The Land Pooling Policy now allows owners to pool their land and give it to DDA for development. Instead of compensation, the erstwhile owners will be given 40 to 60 per cent of the developed land. “Acquiring land is a long process, and land owners complain about inadequate compensation. That is why DDA was not able to meet the growing demand for EWS Housing in Delhi. We expect Land Pooling Policy to make a big difference,” says a DDA official. The Policy has been introduced last year only.

Replicating the Capital’s success story

Despite EWS flats having been constructed in various condominiums and sectors in Gurgaon, the authorities don’t have a list of BPL cardholders to whom these flats are to be allotted. The Administration plays 'confused'. As per the rules of the Haryana government, only BPL families belonging to the State are eligible for an EWS apartment. Last year, the allotment of EWS apartments was stopped, as many applicants were found possessing fake BPL cards. This has led to the rampant misuse of available EWS apartments, and some builders are selling them in the independent market. Many RWAs have approached the Competition Commission of India (CCI), and even the Court, to prevent such builders from misusing this facility. Kanupriya, a resident of ‘The Legend’ on Golf Course Road, says that the residents of their condominium have obtained a stay order from the Court, to ensure that their EWS flats are sold to the BPL families only. Sood, an RWA member of Heritage City, says, “We have approached the CCI to provide clear directions regarding the Housing law – that EWS apartments are meant only for Economically Weaker Sections in the society.” The Real Estate sector in the City has received a lot of attention in the last two decades. The Administration has also benefitted from the growth of this sector. However, housing for the poor still seems to be a distant dream. Whatever has been constructed has been given to 'buyers'. The irony is that these EWS flats are easily registered by such people, without them even furnishing any BPL card. There is a need to review the current rules and regulations. If the Capital can set up EWS Complexes in its old crammed localities, Gurgaon can easily replicate the model, as real estate is still in its nascent stage here. u

he life of residents living in condominiums on MG Road, amidst malls and heavy traffic, would seem to be chaotic. The residents of Beverly Park II, however, have a different story to tell. “Once you enter the condominium, you step into a different world altogether. Despite Beverly Park II being located close to the MGF Mall and MG Road Metro station, we enjoy a peaceful life here,” says Saurabh, a resident. According to him, the RWA should get credit for this. “You just can’t park your cars anywhere; and you can’t honk unnecessarily. You have to strictly follow the rules. You also have to support the green initiative undertaken by the RWA,” he informs. Further, along with security, key attention is paid to concierge services, street lights, parking lots, and the design and care of parks. Megha, a 28-year-old Communications Manager at Convergys, says that security was at the top of her mind when she moved into an apartment in Beverly Park II. She chose this over an independent unit

trong earthquake tremors were felt all across the National Capital Region (NCR) twice in the last fortnight. MNC executives, government officials, BPO workers – all came running out. But as soon as the moment passed, everything became normal. Nobody talked about it beyond a day. Nobody gave a thought as to what would happen if some day an earthquake with a higher intensity came and crumbled this hallowed City of growth and prosperity into a heap of dust. Do we have a contingency plan? Do we have a disaster management plan in place, which could save us from danger? Gurgaon should worry more, because the density of population in some areas is very high, and it has the maximum number of high-rises in North India. “Gurgaon falls in Seismic zone 4, which makes it pretty vulnerable to earthquakes. And with such a high number of high-rises, this City can be seriously affected. National Disaster Management Authority (NDMA), established by the Government of India in 2005, is doing good work in this regard. However, Gurgaon's District

Captain D.S Yadav, from the RWA of Beverly Park II, says, “It is so unfortunate that in some condominiums, though people live in close proximity to their neighbours, they don’t really know who they are. At Beverly Park II we

Since the condominium is located near one of the arterial roads, it was important to create good walkable spaces within the condominium. “People are interested in walking. That is why we have wide and clean parks, and walking tracks; the condominium boasts of good horticulture,” says a member of the RWA. Manjeet, 58, doesn’t feel like stepping out of the condominium. “People plan world tours after their retirement – but I have planned to stay at home. I enjoy swimming, evening walks, and various sports within my condo only. When I moved to Beverly Park II in 1996, I didn’t know I would fall so much in love with it,” he says.

Rainwater Harvesting

The RWA gives credit to residents for this initiative. “It is important to spread awareness on the need for conservation of water. Here, even kids know about the benefits of saving water,” says a member of the RWA. He calls Veronika, a 12-year-old resident, who takes us to the rainwater harvesting plant. She explains, “Once the water is stored in this pit, it helps recharge the groundwater. You can use this water to build baby ponds, water some small flowering plants, and even wash your school dress!” u

For Disaster Management to work well, all branches of the Administration have to play their role simultaneously, as well as collectively. During a disaster, there is a huge sudden demand for resources, and tremendous pressure on civic facilities – such as hospitals, roads, the fire department, transport, and of course the police. Disaster Management broadly means an effective usage and deployment of the available resources,” said Maj Gen (retd) R.K Kaushal, who works as a specialist in Disaster Management, with NDMA. “No city can claim to be hundred percent safe from disaster, and no amount of planning can always save any city from damage; but adequate planning, along with flawless implementation, ensures a lesser loss of lives and resources. As of now, Gurgaon neither has proper roads in place, nor is the transport adequate; and the biggest drawback is that the Gurgaon Fire department doesn't have

adequate infrastructure and equipment. Simultaneously, new construction is going on at a breathtaking pace, and there is inadequate attention to building structures. The buildings standing on pillars are most vulnerable. 'Old' Gurgaon is a different story altogether. There the density of population is much higher, and the streets are narrow, which would make it very difficult for the rescue teams to carry out their operations. Burnt bricks were used in the older times, which I believe are less than useful when it comes to resisting tremors. The most vulnerable areas are the urban villages with their narrow streets, and heavy concretisation that has recently taken place. An earthquake is also not the only form of disaster that Gurgaon should be wary of. Fires and floods are also extremley dangerous for a city like Gurgaon. There are areas in Udyog Vihar where people have stored flammable substances much beyond the capacity or the prescribed limit, but no action has been

taken by the Administration or the concerned department. This would one day cost Gurgaon dearly. Gurgaon is a dry area with a limited amount of rainfall, which makes most people think that a flood is not a possibility. But I don't exclude the possibility of flood disaster in Gurgaon. With choked sewers and the overlapping of storm water drainage with sewage lines, urban flooding is very much possible in Gurgaon. To me, that would present a very grave situation,” added Kaushal. “NDMA has till now carried out many mock drills and seminars, to educate the masses about disaster

management, and how people can save themselves in the time of crisis. In Gurgaon too we have carried out many mock drills in many MNCs and highrises, by joining hands with the District Disaster Management Authority. We have used the National Disaster Response Force (NDRF) to conduct numerous programmes. Video films have been shown in various seminars, on how the masses can save themselves and their families, even if the rescue team is not around. We have also educated the masses on various types of disasters,” added Kaushal. “Unfortunately, progressive states like Punjab and Haryana pay less attention to disaster management plans – maybe because the fear of disaster is quite less compared to the states that have a coastline. States like Orissa and Gujarat have formidable disaster management authorities, which have put in place effective contingency mechanisms, to take care of many types of disasters. Orissa, after the super cyclone in 1999, and Gujarat, after the 2001 earthquake, have invested heavily in their disaster management plans,” added Kaushal. Let Gurgaon and Haryana not be taken for surprise. Mother Nature can be very unnatural – very unpredictable. u

Just open the daily newspaper – one's   attention   is drawn to sensational news items everyday. Like, "a 23 yr old son kills his mother over a property dispute", "a son gets his father killed by  paying heavy 'supari'", "a husband murders his wife", “ a father kills his children and wife, and commits suicide", "a father rapes his teenaged   daughter"   "a son throws out his old parents  from his house". The courts are flooded with family dispute cases, mainly over property.Once promising a good and healthy life, families are breaking up; children are suffering or going astray. The institution of marriage, and respect for parents, is no longer sacrosanct. One wonders what has happened  to our   culture,social values and ethics. There can be   wide-ranging debates/discussions on the welfare  of senior citizens – at home with their children, or when they are discarded by them. Can we say that the social

Life Minus, Life Plus

fabric of our culture/tradition has been punctured beyond repair/rehabilitation? The aged have started realising that   the major part of their life has been devoted to the welfare of their children, and they have forgotten to spare time for themselves. A Senior Citizen's Home has been promoted by a builder in Bhiwadi, 45 kms away   from Gurgaon.   A living complex   of flats (ground plus   four floors), of one, two and three -bed -rooms, with gated security, besides a Medical Centre, has been running for the past 7 years. There is a decent restaurant, to serve food/snacks at reasonable rates, separate AC rooms for reading and playing cards, a TV room, a full-fledged Activity Centre, monthly parties, and regular festival celebrations – all run by its own RWA. The Complex has elderly people from across India, participating in many social activities – and even dressing well. The active senior citizens living in the complex  are well -to-do, and maintain decently furnished flats, and cars for mobility. There is a need to have many more complexes in different cities. They can add  to the Life-plus of the elderly, so that the Life-minus feeling–away from their children and grandchildren–is partly compensated. u

Apartment Owners Beware

‘There is no relationship between Group Housing Complexes and the new Societies Act 2012’. Reference the article on page 10 of Friday Gurgaon issued dated 26.04. 2013 - 2.05.2013 titled “A Sinister Act” . Factual details regarding registration of associations for such complexes is attached. This note will clearly establish that there is no relationship of Group Housing complexes with new Societies Act 2012 - B.K Dhawan. Annexure Factual details regarding registration of Associations for Group Housing Complexes under the provision of the Haryana Apartment Ownership Act 1983; Registration under new Society Act 2012 not warranted. Ref:1. The Haryana Development and Regulation of Urban Areas Act, 1975 (Hereafter referred to as Act 1975); 2. Haryana Apartment Ownership Act 1983 /Rules 1987 (Hereafter referred to as Apartment Act 1983 /Rules 1987) 3. Haryana Registration and Regulation of Societies Act, 2012 (Hereafter referred to as Society Act 2012 ) A confusion has arisen about registration of apartment owners association /Condominium for Group Housing complexes. It is clarified that it is mandatory for all such associations to be registered as per the provisions of the Haryana Apartment Ownership Act 1983. A proper/comprehensive understanding of this issue is explained below. 1. Societies Act 2012: Sec 6 describes the application of Act. And Sec 6(X) specifies – (a) “formation of associations of flats or tenement or condominium or floor space owners pursuant to the requirements as laid down under the Haryana Apartment Ownership Act 1983 (Act 10 of 1983)” or – (B) “a welfare organisation formed for housing projects or a resident welfare organisation for the operation, management and maintenance of facilities for the residents or civic amenities of any defined area.” 2. All Group Complexes are required to be registered under category A i.e under the provisions of Apartment Act 1983. As for B categories is concerned - Societies would be required to be registered under the new Society Act by the plotted Colonies and those not covered by Apartment Act 1983. 3. Coloniser are granted license for Group Housing under Sec 3 (3) (a) (1) of Act 1975. Along with this license the Coloniser executes a bilateral agreement with the State Govt under Rule 11 (1) (h) of Rules 1976. The agreement is based on form LC –IV-A in which the Coloniser inter alia gives the following undertaking: (a) Clause “(f) -the flats /dwelling units are sold/leased / transferred by him in keeping with the provisions of Haryana Apartments Ownership Act 1983; and (b) Clause “(g)-that the owner shall abide by the provisions of the Haryana Apartment and Ownership Act 1983” 4. Accordingly  the Coloniser registers/files the declaration and bye-laws within 90days of the issue of part completion certificate as required vide Sec 2 of the said Act 1983; and  on bookings, in the agreement to sell apartment buyer gives the same undertaking to the Coloniser. These statutory clauses restrict all business transactions within the provisions of Apartment Act’1983 and Rules’1987 and each clause of the said Act ipso facto becomes part of the agreement which also includes formation of association of apartment owners within the provisions of this Act; 5. It is further clarified that –  ownership of all apartments is given in accordance with Sec 4 and Sec 5 of the Apartment Act 1983 for which each apartment buyer executes deed of apartment, in the manner prescribed in Rule 4 of Rules 1987 which entitles them to the exclusive ownership and possession of an apartment in accordance with the declaration;  an apartment buyer/owner executes deed of apartment in Form B (Rule 4) wherein a statutory contractual undertaking is given by him /her as follows: “I hereby declare that I, my heirs, executors, administrators and assigns and the said apartment referred to in paragraph 1 of

this declaration, shall hereafter be subject to the provisions of the Haryana Apartment Ownership Act, 1983 and all amendments thereto and I further declare that I shall comply strictly with the covenants, conditions and restriction sortforth in the declaration and with the bye-laws forming part thereof, and attached hereto, as Exhibit “B” and with the administrative rules and regulations adopted pursuant to such bye-laws (as either of the same may be lawfully amended from time to time) and in the Deed of Apartment” This undertaking is given in the deed of apartment by the apartment owners in the presence of Magistrate, and filed with the Competent Authority under Rule 4 of Rules 1987. This undertaking is permanent in character which gives ownership of an individual apartment and to make such an apartment heritable and transferable property and all matters connected therewith. 6. Further, specific features of the “association of apartment owners” which are fully outside the scope of the Societies Act are as follows: (a) Section 3(b) of the said Act states: “ apartment owner” means the person or persons owning an apartment and undivided interest in the common areas and facilities in the percentage specified and established in the declaration; (b) Section 3(d) of the Apartment Act 1983 states: “association of apartment owners” means all the apartment owners acting as a group in accordance with the bye-laws and the declaration; (c) The statutory ‘Declaration’ is executed in Form A prescribed under Rule 3 which inter alia contain: Percentage of interest in common facilities and voting rights of each apartment owner. This facilitates and determines proper functioning of the Association along with other provisions of Apartment Act 1983. This process is not part of the Society Act 2012 and hence beyond its jurisdiction. (d) ‘Declaration’ vide section 3(j) is an instrument by which the property is submitted to the provision of the Apartment Act 1983. The prescribed mandatory bye-laws for administration of every property are described in Section 16, a true copy of which is annexed to the Declaration and registered under the Registeration Act 1908 as enumerated in Section 13(1) with a true copy of each of the declaration and By laws filed in the office of the respective Competent Authority. Formation of association of apartment owners is thus deemed to be registered and formed. (e) Details of apartment owners ho can form “association of apartment owners” are also given in the declaration after they execute deed of apartment, in the absence of which the association cannot be formed. Note: A member of association of apartment owners has to be an apartment owner with percentage of interests in common areas and facilities and with percentage of voting rights as shown in the declaration. These conditions are absolutely out of contexts of the Societies Act 2012. 7. It needs to be clearly noted that –  the formation of “Apartment owners Association “ is part of the Declaration;  the prescribed bye laws are directly related to the contents of the Declaration according to which the Association of apartment owners functions; and  the percentage of share of apartment owners is indicated in the declaration also denote percentage of voting rights; and  percentage of share of profits, after adjusting maintenance cost earned from common areas and facilities (Sec 3(h) Apartment Act 1983 refers ) Note: These have no relevancy to the Societies Act 2012 whatsoever and hence outside the purview of the Registrar of Firms and Societies. 8. Further, please note – (a) Vide Sec 5: Ownership of apartments envisages that  each apartment owners shall be entitled to the exclusive ownership and possession of his apartment in accordance with the declaration; and

 each apartment owner shall execute a deed of apartment in relation to his apartment in the manner prescribed. (b) Execution of deed of apartment (Sec 5(2)) gives the ownership right to the Apartment buyer. Comments: 1. Apartment owner/ownership of apartment is of a specified apartment is described in the declaration after execution of deed of apartment. 2. Percentage of interests in respect of an apartment and voting rights are specified in the declaration. 3. Note that only apartment owners can be member of the association which is related to the contents of the declaration. 9. The certificate of incorporation by the Registrar of Societies Act 2012 to Condominium Associations in Group Housing complexes would be highly irregular because  the bye-laws adopted are mandatory bye-laws prescribed under the provisions of 1983 Act which are outside the scope of Societies Act’ 2012.  matters pertaining to the transfer, management and maintenance etc of apartments do not fall within the jurisdiction of Societies Act 2012 ;  Societies Act 2012 and Apartment Act 1983 Act are two distinct Acts dealing in separate fields with different aims and objects, enacted for different reasons with separate distinct statutory operating procedures as provided for in the respective Acts. It is also to be noted that the legislatures have enacted two different Acts for different purpose as described therein: (a) The Societies Act 2012: “An Act to consolidate the law relating to the registration and regulation of Societies in the State of Haryana, promoting art, fine arts, charity, craft, culture, education, literature, philosophy, political education, religion, sports, science, any public or charitable purpose and for matters connected therewith or incidental thereto.” (b) Apartment Act 1983: “An Act to provide for the ownership of an individual apartment in a building and to make such apartment heritable and transferable property and matters connected therewith.” Note: The above two Acts have different objects of views of the legislatures. 10. Finally, it needs to be understood that maintenance of high rise building in Group Housing complexes is a high tech and high cost affair. To meet these challenges and ensure safety and danger free living by the residents strict enforcement of Apartment Act 1983 is imperative which unfortunately today is being less understood and more abused. It needs to be realised that this Act is fined tuned to meet these challenges, specially for high rise buildings which are more prone to disasters. Any infringement, such as now being proposed will indeed be grossly harmful. In view of the above, we feel that further registration under the Societies Act 2012 is not required. Please note that any registration under the Societies Act 2012 would not only be gross infringement of Haryana Apartment Ownership Act 1983 but would provide a back door entry to strike a death knoll for the rights and interests of the apartment owners/ associations. The Societies Act 2012 is neither supportive, helpful or constructive for proper maintenance of Group Housing Complexes. In this connection the following judgment should clarify any doubts. “Two Acts in same field : When two Acts are enacted in the same field, one dealing with general law and the other dealing with the special law, then in case of inconsistency between the two, the special law will prevail. When two enactment’s are passed one later than the other, then it becomes a business for the courts to consider the exact effect of the later enactment upon the earlier enactment to see whether they can wholly or in part stand together”. (Antaryami Patra v. State of Orissa, 1993 Cr LJ 108 (Ori)) Note: Haryana Ownership Act 1983 is special law for Group Housing Complexes whereas the Societies Act 2012 deals with general law for various other purpose. Hence, Apartment Act 1983 has to prevail for all Group Housing complexes.

APS Earth Day

A

merican Public School hosted an event, titled Save Earth, on the occasion of Earth Day. The School was decorated with posters displaying the various causes of depletion of the Earth’s resources, and the ways and means to conserve the natural resources. A Special Assembly was held in the Junior wing for Classes I and II, where children narrated poems and spoke abut the causes of pollution. A song on “ Mother Earth” was also sung by the children.  A  drawing competition was held for the students of Classes I and II. Children from Montessori I to Class II planted saplings.

n 2004, Shiksha was born to Malini Devi. Malini’s motherly instincts told her that something was not right with Shiksha – she was later diagnosed with Attention Deficit Hyperactivity, a common psychological disorder among toddlers. For one month, Malini was in acute depression. But life turned around the day she came across a trained educator, who told her that Attention Deficit Hyperactivity is a common problem, and can be cured easily with intervention at an early age. Malini thanked God that there was hope for her child. Like Shiksha, there are many children who are going through some psychological

The Right to Education for all children calls for an inclusive approach, that is every child must be educated to his/her potential. The primary school teachers, in particular, have a major responsibility to ensure that poor performing children, and those with special needs, learning difficulty or behaviour problems, are not left out or given inappropriate learning. Given proper training, the teachers can work wonders, in close collaboration with parents. To provide them the requisite knowledge and skill, Venkatesh Trust for Education and Excellence, and Expressions India, jointly organized (in collaboration with India International Centre), a 3 days Workshop, from 18th to 20th April, 2013. There was enthusiastic participation from over 89 teachers, and more than a dozen specialists in this area. The teachers came from even distant areas - such as Coimbatore in Tamil Nadu, and Hyderabad in Andhra Pradesh. Dr. Jitendra Nagpal of Expressions India, and Prof. Vimala Veeraraghavan of Venkatesh Trust provided inputs on mental disorders and behaviour problems. Dr. Renu Malviya talked about the developmental stages; Dr.Runjhun Jashi, Dr. Astha Sharma, Dr. Vandana Tara, Dr. Tulika Talwar, Dr. Pooja Jaitly, Dr. Jayanti Banerkee and Ms. Ritu Dhingra provided specialized knowledge and skills. Among the topics covered were: the emotional and behavioural problems in children, developmental stages, ADHD, Autism Spectrum Disorder and several other learning disabilities and disorders. There was a lively Panel Discussion at the end, on ‘inclusive schools and inclusive education’. The teachers expressed satisfaction on the knowledge gained, and suggested that there be many more such workshops – to cover other schools and teachers, and to carry the good work forward.

ameshwar Sir was very annoyed, as Radha had come to the school late, as always. He is a disciplinarian, and does not like his students coming late to school. His school is situated almost at the periphery of the Village Gokuldham. Students from this Village, as well as from nearby villages, attend classes in his School. He is proud that his school is the only one within an area of 10 km. He was annoyed with Radha as she was spoiling the discipline

communication for each child,” says Dr. J. Veeraraghavan, one of the founding members of Venkatesh Trust For Education and Excellence. Working in the field of education for the last 40 years, he strongly believes that special education is not imparted properly in schools. This encouraged him to lay the foundation of the Venkatesh Trust. Venkatesh Trust works to create a deeper understanding of the rights of children, and to introduce the needed interventions to ensure the same. “Children in government schools sometimes come from disturbed backgrounds. They witness a lot of violence. So there are greater chances of them being psychologically or emotionally affected,” feels a teacher. She suggests that apart from having special educators in the school, all teachers should also be trained to deal with such problems, because they work closely with children. “Every child can’t be simply sent to a psychiatrist. A teacher should therefore also know what specialist a particular child should go to,” she says. When such children join a school, they should be assessed as per their abilities, and should be grouped with those who are similarly skilled and are around the same age group. If a 10-year-old boy, even with the capabilities of a three-year-old, is grouped with toddlers, his selfesteem will drop. In fact, each child has different intellectual challenges. So they have to be grouped carefully. Venkatesh was a student of Psychology at Pennsylvania State University in the US. Venkatesh evinced keen interest in group cohesiveness, psychodrama, psychotherapy and post modernism. He devised a test in group cohesiveness, which was later appreciated by many psychologists across the world. The Trust has been working in line with his thinking.

How can you help? Since a large number of villages in the City don’t have proper infrastructure in schools, one can contribute in any of the following ways:  Provide them study materials and equipment, such as computers.  Professionals can offer their time and expertise.  A qualified medical practitioner can offer services for the children’s health centre.  Provide medical supplies.  Donate funds.

Vocational skills

While scholastic milestones are important, Venkatesh Trust believes that vocational training helps in focussing on functional academics. “An education that doesn’t make a person independent is no education. That is why we started computer training and a tailoring course in a school in Badshahpur. The Trust also provides institutional scholarship to students,” informs Dr. Veeraraghavan. By the age of 15, children are ‘too old’ for psychologists to fix their disorders; the vocational training helps them develop confidence, apart from providing them with possible livelihood options. Besides, the Trust has devised a special screening test to identify the different types of psychological and intellectual difficulties. The Trust has provided counselling to hundreds of children, to enhance their level of confidence – and the children have shown vast improvement after the counselling sessions. Through trained teachers and suitable infrastructure, the Trust focuses on increasing the level of concentration, attention, reading/writing practices, and mathematics skills among children. This not only enhances the children’s performance in academics, but a change is also felt in their behaviour at home. u

The Stark Reality in the School. “Why can’t you start a little early from your home and come on time?” he asked Radha in an angry voice. Radha was terrified and started crying. This was becoming a daily routine. Meera, her best friend, came to her rescue and told Rameshwar Sir, “Sir, Radha gets up in the morning at 4.30, tends to the only cow that the

family owns, cleans up the hut and its surroundings, washes her own clothes along with the clothes of her ailing mother, brothers and sisters, prepares the food for the family, then sits down to hurriedly do the home work that you give us every day, dresses up and then rushes to the School. Her hut is about 10 km from here. It takes almost one and a half hours for her to

reach here on foot. This is the reason why she gets late.” Rameshwar Sir was not convinced. He roared, “If she can’t come to School on time, why doesn’t she leave the School?” “So many girls do not join the School, and spend their time at home, doing the household chores.” Hearing this, tears again started pouring from the eyes of

Radha. She could not muster the courage to speak. Her friend came to her rescue again. She said, “Sir, she has to keep attending school as her household is run on the money she gets from the Government for attending the school. One with Oneself

enjamin Franklin commented on the difficult path to self-discovery: “There are three things extremely hard - steel, a diamond, and to know one’s self.” One learns a lot by studying oneself - particularly the feelings that influence one’s thoughts, and motivate one’s actions. Pope wrote a poem that began thus: “Know then thyself, presume not God to scan, the proper study of mankind is Man.” Syllogistically, understanding oneself would also enable one to better understand others. Can one really know oneself ? Is one ever somebody? When will I ever see that Am that I Am? Scores of poets and philosophers dedicated their lives to enquiring about the Self and trying to understand its elusive mysteries. Some attained remarkable results, as attested by the legacy of their works; others remained thirsty. Every thinking human being feels that “I have an inner self of whom I am ignorant. Who is the real I, where does he hide from Me? How and what—if at all He is—I have never discovered, although for the whole of my life I have been looking for him”. One of my neuroscientist friends told me that “we are on the verge of a breakthrough in the understanding of self, thanks to neuroimaging, neurochemistry and neurogenetics; that Man, haughty Man, will no longer be a mystery to himself. The heart of all our mysteries will soon open, and we will be able to understand and control certain human habits”. It is difficult even to conceive what a scientific understanding of self would look like. Another friend, a psychologist, told me that his patients often ask him, ‘Doctor, why am I like this?’ or ‘Why do I do the things I do?’ Finding oneself is a journey…not a destination. A lot of it is trial and error; more often than not, one hits a bump on the road, or falls flat on one’s face. One must be prepared to understand and accept that this is a part of a process, and commit to getting up and starting over. The Gita tells us about seeking the self. Responding to Arjuna’s confusion and moral dilemma on fighting his cousins, Lord Krishna explains to Arjuna his duties as a warrior and prince, and also the different ways in which the soul can discover self, and reach the Supreme Being: “Wake up! Be thyself ! The glory of the Self is beheld by few. The Self is un-manifested, beyond all thought, beyond all change. This is true knowledge - to seek the self as the true end of wisdom always. To seek anything else is ignorance”. One must resist the urge to feel unique in going through this dilemma of discovering oneself. In

It took me a long time and much painful boomeranging of my expectations, to achieve a realization everyone else appears to have been born with: that I am nobody but myself.” “Who am I?” This question is not static. One should continue to ask this of oneself throughout one’s life. It updates one’s understanding of who one is, and how one changes. One must take time out for oneself, to introspect. In solitude, one should feel independent and selfsufficient – not lonely, needy or afraid. Every person needs time alone – whether one is introverted or extroverted, single or in a relationship, young or old. Solitude is time for rejuvenation and a talk with self – for trying to attain peace, and for realizing that purposeful “aloneness” is a liberating part of one’s overall existence. As long as one continues to exist just to fulfill other people’s ideas of who one should be, one will never know who one really is. By all means listen to others and learn from them, but let the final choices, decisions and acceptances be one’s own. Mahatma Gandhi once said that “the best way to find 'you' is to lose yourself in the service of others”. Just introspecting, and not reaching out to others, can cause you to navel-gaze and shut yourself off from the world. Most people who have made a great contribution in life have gone through a period of disenchantment – a time in the wilderness – during which they came to know themselves better; they not only came to terms with the defeats in their little stories, but also found their place in the big ones. When you know yourself closely, know your potential, you can unleash huge energy. Remove the lid of your ego and find the clear waters below: a vast source, a sea of energy, which can be tapped for living a wholesome, constructive and satisfying life. Our busy lives are keeping us out of touch with ourselves. Do take a look inside. If needed, do introduce yourself to your own self. Do not exercise your mind in knowing others. iwifruit is often associated with New Zealand, which is the leading producer of the fruit. In fact the fruit originated from China, and is also known as ‘Chinese gooseberries’. These furry fruits were introduced to New Zealand in the early 1900s, and were named after the country›s unique bird. The name Kiwifruit was adopted officially in 1974.

The Kiwifruit is the edible berry of a woody vine. The most common variety has an oval shape, and measures about the size of a large hen’s egg. The fruit has a hairy brown peel, with green flesh and tiny black seeds on the inside. Kiwifruit is ripe to eat when it yields to gentle pressure; the immature

fruit has a hard central part and a harsh taste. Kiwifruit looks unpalatable at first glance, but beneath that hairy brown peel is a succulent juicy green fruit. The fruit is often used to decorate and garnish cakes, puddings and pies. Raw Kiwifruit is rich in the protein-dissolving enzyme actinidain, which is commercially useful as a meat tenderizer. This enzyme makes raw Kiwifruit unsuitable for use in desserts containing milk, or any other dairy products that are not going to be served within hours, because the enzyme results in the curdling of milk. ermal fillers, commonly used in cosmetic treatments, are a “crisis waiting to happen” – and are largely unregulated, according to a British report on cosmetic surgery released recently. The review board, set up to produce the report after the PIP breast implant scandal, said that there had been an “explosive growth” in the market for dermal fillers, most of which were subject to “no more controls than a bottle of floor cleaner.” Procedures range from surgery, such as face-lifts and breast implants, to non-surgical treatments such as dermal fillers and Botox. Non-surgical procedures make up 90 per cent of treatments. “A person having a nonsurgical cosmetic intervention has no more protection and redress than someone buying a ballpoint pen or a toothbrush,” the report said. “Not only are fillers not regulated as a medical device,” added Bruce Keogh, who chaired the review, “the most striking thing is that anybody, anywhere, anytime, can give a filler to anybody else,

and that is bizarre.” Concerns were raised about cosmetic surgery in 2011, when the French government advised women who had used breast implants made by Poly Implant Prothese (PIP) to have them removed, because the silicon used in them was substandard. European regulators are currently

developing new standards for aesthetic surgery and non-surgical procedures, but these are only voluntary. The British report recommended that fillers, which are used to plump up lips or get rid of wrinkles, should be prescription only. They should be subject to the same regulations as medical devices, and all people who administer cosmetic treatments should be formally trained

It said that in the United States there were only 14 fillers available on the market – while in Europe 190 types were available. “Previous attempts at selfregulation in the industry have failed, largely because voluntary codes have meant that only the best in this disparate sector commit themselves to better practice, whilst the unscrupulous and unsafe carry on as before,” the report said. It also criticized advertising practices by cosmetic surgery companies, saying they sometimes: “trivialize the risks of procedures, target vulnerable consumers, or mislead by portraying an outcome that may not be attainable for many.” Plastic surgeons’ associations welcomed the recommendations. A prescription requirement would “kill three birds with one stone: regulating which ones come onto the market, who can inject them and automatically banning their advertising,” said Rajiv Grover, President of the British Association of Aesthetic Plastic Surgeons. u

Selection and Storage

One should select Kiwifruit that are unblemished and firm. The flesh should yield to gentle pressure, like a ripe peach. It makes sense to ignore Kiwifruit that are shrivelled, mouldy or have soft spots. We can easily ripen Kiwifruit by leaving it at room temperature for a few days; or, to speed up the process, put the Kiwifruit in a dry paper bag, along with an apple or banana. It is best to consume Kiwifruit within a week, though the uncut fruit can be refrigerated to last up to 2 months (by placing in a plastic bag that has been punctured with a few holes). We should not store Kiwifruit along with other fruit. It is important to note that the enzyme actinidain, found in Kiwifruit, can cause allergies in some people. u

Squeeze an orange, add a pinch of wild turmeric to the pulp, massage it for 10-15 min; and seal it with a  cool cucumber juice and gramflour mask. Watermelon is the king of nutrition in these summer months. You can mix some orange peel powder in watermelon juice and make a scrub, which can cleanse your skin. Massage your skin with the watermelon pulp for 20 min; and seal it with a nutritious mask of watermelon pulp and oats. The idea is to seal the nutrients into the skin. The Throat Chakra

Also called the ‘Vishuddha Chakra’, it is situated between the seventh cervical vertebra and the first thoracic vertebra. This is the energy field of thoughts and feelings from our path or journey, reflecting clearly what we have learned so far. That is why language and communication are so important at this level. We need to keep this Chakra cleansed, as the integration of energies will help us turn inwardly in a truly positive way. In reality this is where our education for the spiritual level begins. Slowly straighten your knees, then walk your feet forward until your hips are directly aligned over your head. Bend your

hat the United States is a land of great opportunities, a nation where you know true freedom, a place where work is worship and which has a truly classless, casteless society, I had known even before my first visit to the country. But it called for an extended stay to discover its ‘capitalist’ side. Many years ago I was staying with friends in the suburban New Jersey town of Wayne. Wanting to take a flight to Chicago from Newark Airport, I took a bus to some place not far from the air terminal - 5 minutes by taxi, I was told. I tried to hail many cabs, but all were occupied at that peak hour. It was now getting dangerously close to the flight departure time. I started waving my hand at every passing car. Soon a beautiful long limousine stopped, the driver lowered the window glass and asked me where I wanted to go. I started to pour out my tale of woe. “Never mind”, he interrupted, “I can take you for $20”. The guy looked prosperous and I thought he was joking; nevertheless I got in, and sure enough he drove straight to the departure terminal at Newark. Twenty dollars and many thanks later I managed to check in for my flight. It’s a different matter that the taxi would have cost just a dollar.

Any imbalance in this Chakra will result in mental, physical and emotional problems. There could be memory and multiple personality disorders, excessive gullibility and nightmares. The second encounter was classic. I was entertaining a European couple in one of the swankiest restaurants in New York. From the moment we entered this glittering place we were treated like royalty. Vikas Malpani, one of the three founders of Commonfloors dot com, believes that only technology can offer an effective solution to the common, and seemingly unsurmountable, problems being faced by apartment residents across India. To specifically cater to the needs of apartment communities, the founders decided to launch a portal that allowed apartment owners to organise, manage and interact as a community. “The software, which is absolutely free, helps an RWA to create groups, share information, manage accounts, and allow residents to interact with each other on a realtime basis, so that there is greater efficiency and transparency in working,” says Malpani. Another contention put forth by panelists was that the entry and exit barriers to becoming a developer were very low. Any person with a large parcel of land can now become a developer, irrespective of whether he has the knowledge or experience in realty. Sanjay Sachdev of AIPL Builders, representing the Real Estate players, said that all builders cannot be branded as exploitative. He admitted that a majority of participants might have had a bitter experience with builders, but in his own company they were already following the rules enunciated by the proposed Real

Federation Seeks Regulation o clean the Augean stables of the Real Estate sector, a powerful regulator is required, to take the necessary action against erring developers and other agencies that are responsible for the problems being faced by home buyers. It is time also that Real Estate is given industry status, so that builders can get easier access to capital, and the funding of residential projects becomes transparent. These were the main demands of various stakeholders, who had come together under the aegis of the Federation of Apartment Owners’ Association (FAOA), which organised a Real Estate Consumers’ Seminar on the proposed Real Estate Regulatory Bill 2013. There were more than 200 representatives from different RWAs who attended the Seminar, and expressed their views on the real estate scenario, and what needs to be done to correct the anomalies. Union Housing Minister Ajay Maken, who was scheduled to be the Chief Guest, was conspicuous by his absence. Explaining the agenda of FAOA at the start, Gautam Gulati, Senior Vice President of FAOA, said that they wished to create awareness, set up a knowledge bank, and guide RWAs in matters pertaining to maintenance, customer rights, and rules and regulations related to Real Estate. “We want to push for the legitimate rights of the apartment buyers – but we are not a trade union. We want to engage with policy makers and developers, to ensure that the interests of the buyers are factored in when policies are made,” he asserted. A number of residents demanded that the government must play an active role in regulating this crucial sector, in which a person invests almost half of his/her life’s savings. His contention was opposed by many members of RWAs, who alleged that builders had no interest in following the spirit of the law, and their only concern was raking in profits. They also said that courts and consumer forums were being used by developers to delay the resolution of disputes, and it was just a ploy to tire out the complainants. Brigadier Madanjeet Singh explained how builders like DLF had used the legal process to ensure that a large number of buyers were denied an apartment, after they refused to pay additional ‘illegal’ charges. “I bought an apartment from DLF in 1994, but could not take possession due to a legal dispute. Since 2007, not a single hearing of the case has been held in the Supreme Court, and justice stands denied to me due to the clout of the builder,” he said. An RWA representative from Faridabad recalled how hundreds of plot owners were duped by a powerful builder, right under the nose of the government – and nothing much has been done to resolve the problems of buyers. When asked about the challenges faced by portals like Commonfloor, Malpani says that a large number of RWAs do not work professionally, and have no standardised systems. u

I’ve been thinking about it ever since. dpa: In interviews about your other books, you were quite frank about your aims. It was not only to make people think, but also to act in a specific way. What was your aim with this book?   Vollmann: One of the most interesting projects to me in life is to figure out how to help others; it seems to be much easier to harm people than to help them.

I continue to be amazed at how complicated people’s problems are, and how random our efforts and objectives are. I agree with Gandhi when he says that we should scrupulously avoid a desire for results. All you can do is your best; it’s better not to have a lot of hopes and expectations.

abourdonnais is well equipped for life on the golf course. To protect him from errant golf balls, this old-timer wears body armour on his back - permanently. Labourdonnais is a 100-yearold giant turtle. Up on his legs, he is nearly a metre tall, and resides in the middle of the Anahita course, on the southeast coast of Mauritius – which counts six magnificent golf clubs. Labourdonnais lives in a compound cordoned off with tuffstone, right behind the green at Hole 9, together with Cleopatrae, a fellow member of the species who is 70 years younger. Labourdonnais is the mascot of Anahita, and the darling of golf visitors from many nations of the world. Mauritius offers

perfect golfing weather the whole year round. Golfers take time off to visit the two giant turtles, which bask in the attention, and enjoy being fed bananas and apples. The course at Anahita was designed by South Africa’s top golfer Ernie Els. It boasts a huge clubhouse, and is the perfect choice for amateur golfers.     The broad fairways of the course, belonging to the Four Seasons Resort, are very forgiving, enabling novices and the more experienced to improve their game. The views of the shimmering turquoise ocean are also a dream. Le Touessrok, the golf course designed by German ace Bernhard Langer, over on the Ile aux Cerfs opposite, is of a different calibre. The often hidden greens demand a high degree of golfing precision.

dpa: Would you like people to read it as purely a novel, or as history with some fiction? Vollmann: I wouldn’t want to tell people how to read the book, but certainly what made me interested in writing it was the issue of moral choice. I try to imagine what I would do if I were in Kaethe Kollwitz’s situation, or (SS officer) Kurt Gerstein’s, or even (Red Army General Andrey) Vlasov’s. I would be OK with it if people read it as just a novel... but for me, I’m trying to think about these questions. And so, if I were in Vlasov’s situation, I would say, ‘where did he go wrong? How excusable was his mistake?’ These are the things that fascinate me.

Vollmann: I would be very bored investigating only myself. I feel an obligation to understand other people who suffered more than me. And I feel a great joy in investigating people and things that are very alien to what I know. u

explores the subculture of cat people. Interview subjects are more than eager to share their expertise on “everything cats,” leaving the viewers a bit puzzled, and sometimes amused. As Bub became an internet phenomenon, Bridavsky started selling Bub-themed T-shirts and mugs, which, according to one of his co-workers, sell better than the music he produces. While this lighthearted film doesn’t lead to any profound revelation, and borders on superficiality at some points, there’s a sense of catharsis in Bridavsky’s love for Bub – underpinned by her story of survival. u

earing the same pair of closed shoes every day is not a good idea. Even on office days without much movement, feet perspire up to a small tumbler of liquid, says Claudia Schulz from the German Shoe Institute in Offenbach. During rainy days, the moisture from the outside is added to that. And shoes need about 24 hours to fully dry. When you need the shoes to dry more quickly, Schulz says the shoes should not be placed on or directly under heating devices. That can make the shoes’ material—especially leather— brittle and porous. Instead, stuff newspaper into the shoes, as that soaks up additional liquid, according to the expert. u

ew internet advances have compressed space between people as thoroughly as Skype. The internet telephony service began in 2003, and is now used by more than 300 million people. The plan was to spark new ways of behaviour, when Swedish software designer Niklas Zennstrom met with Dane Janus Friis in Copenhagen. Both had experience in online music exchanges, and wanted to try their hand at online telephony. As with their prior project, Kazaa, they relied on peer-topeer technology. Using a vast number of private computers is not just cheaper than setting

The design features tougher security protections, including a 3-D security ribbon and a colour-shifting image of a bell inside an inkwell. It retains other security measures such as a watermark. The notes, which feature a portrait of US inventor and leading statesman Benjamin Franklin, will begin circulating October 8. US officials announced the redesigned bill in 2010, but its use has been delayed by production problems, the Federal Reserve said. u

ho doesn’t have this problem? Once again you urgently need to make an elephant disappear, or a bus filled with passengers but lack the know-how for the magic trick. That’s when you might turn to Andreas Meinhardt for help. The Stuttgart man is a magician, and inventor of new illusions. Or, as the 39-year-old describes himself – a “magic technical consultant.” Magicians from around the world go to him for new magic gadget inventions – ranging from a small trick with hidden pockets, to illusion acts with giant-sized objects. But in contrast to the glittering show-biz world of his clients, Meinhardt’s workplace is surprisingly common-looking. It’s a large room in an old factory building, stuffed with materials and tools - a typical workshop. Except for a few paper flowers, nothing points to what is being created here. And yet, “Everything lying around here has a function,” Meinhardt says. He shows items such as folding coins, knotted spoons and magical books. But technology is only one part of a trick. “I have to divert attention away from the mechanical or the electronic element. That’s why a psychological component is part of every trick,” Meinhardt explains. And he provides clients with help on this as well. “It’s only at the point when the viewer gives up and says, ‘I can’t figure this out’, that you have created a magical effect,” says Meinhardt. That can take months, or even years, of practice. Tricks are often adapted to individual magicians, “almost in an orthopaedic fashion,” he says. “Every trick is a new invention. After all, nobody wants to do something that someone else has already done.” Dirk Omlor, a board member of the German

Usually, old principles are refashioned, and then a new trick is concocted. All the same, people like Meinhardt, of whom there are only a handful in Germany, are extremely important for the magic-trick business, Omlor adds. Omlor says the price for a new trick can be anything from 20 euros to many thousands of euros. Meinhardt, who is a master goldsmith by trade, has been doing his magic invention work full-time for six years now. “I just sort of slipped into it,” he says. He

monument containing a stone from the Dead Sea was recently placed on Mount Everest, in a symbolic link between the lowest and highest points on Earth. The monument is part of an exchange programme between Nepal and Israel. A stone from the highest mountain will be placed in a matching monument by the Dead Sea on May 16. “The main objective of these projects is not only to promote natural beauty and cultural heritages of the two countries, but also to mark the mutual long standing and the friendly relations,” the Israeli embassy in Kathmandu said. A similar cultural exchange programme saw the simultaneous issuance of stamps bearing images of Mount Everest and the Dead Sea in both countries last year. u

ootball’s governing body, FIFA, said on Thursday that they expected their football museum to be opened early 2015. In a statement the organisation said that the Museum would no longer be housed in a building on FIFA  grounds, but in the “Haus zur Enge” in Zurich-Enge. FIFA president Joseph Blatter symbolically started the construction work on Thursday. “You see a very happy President standing before you in this building today. It may still be a building site, but soon this will be a true meeting place for football and its millions of fans from all over the world,” he said. “Today is a great day for me personally, and for FIFA. I am delighted that we are going ahead with this project.” He also stressed that the plans represent yet more evidence of FIFA’s commitment to Zurich. The football museum and exhibition areas will occupy the second basement level, through to the first floor of the building, FIFA said. “The plans for the Museum include a Hall of Fame, 3D displays and interactive games, as well as a collection of trophies and shirts, to captivate fans from all over the world. “Various exhibitions will focus in a particular way on FIFA’s social responsibility programmes, as well as on the promotion and development of football, fair play and the Football for Hope programme. “The Museum will not only be a place to store and display memorabilia, but also a vibrant meeting place and discussion forum for all members of the football family – including fans, clubs, associations, friends, suppliers, partners and sponsors.    “Furthermore, events such as award ceremonies, autograph sessions, media conferences and readings will also be held in a special event area,” the statement said. u

ach day, more than 70 million litres of mineralrich water bubbles forth from the 118 thermal springs around Budapest. No other major city in the world has such a big resource. The thermal-bathing culture is as old as the city itself. The early Roman occupiers were already aware of the beneficial effects of the hot springs. Later on, the Turks enjoyed the baths. Today, it’s the young set that likes to party in the thermal waters. Laszlo Laki is fond of old black-and-white films, including the silents. “I wanted to rent a cinema to show films that had been scored with new background music,” the musician said. “But the search for the right place proved to be difficult. At some point I got the idea of showing the films in one of Budapest’s baths.” Officials were initially sceptical about the idea, but then went along with it. The premiere drew 130 people and afterwards, everyone agreed it should continue. That was 16 years ago. Today, a Cinetrip Party night can attract young people from all over urope to Budapest’s

baths. The party crowd are clad in bikinis and bathing shorts, as they dance to the wild rhythms pounding from the loudspeakers. Visitors are thrilled by the unique mix of modern music, cinematic effects and the historical setting. Tickets are in hot demand and must be booked well in advance. Several parties take place simultaneously. A bus shuttles partygoers for free, from one thermal bath to the next. Up to 2,000 visitors are permitted at the parties in the Széchenyi spa. It is one of Europe’s largest bath complexes, and is located in a small forested area on the City’s Pest side - the eastern side of the Danube River. It was opened in 1913, and was expanded in 1927, with an openair bath. Here you can still find a scene that has been immortalized in art photos and on postcards: people playing chess amid clouds of rising vapour. Handing a visitor a ticket costing around 10 euros (13 dollars), the lady at the counter says, “Go on through the entire complex - you’ll be amazed.” And indeed there is a special atmosphere inside the Neo-

Because the thermal waters emerge at 74 degrees from the springs, there is plenty of energy available, and the site’s expansive open-air bath is also open in the winter. At water temperatures of between 27 and 38 degrees, visitors can relax in the pool, while watching the snow fall around them - or spend some time playing chess on floating chess boards. Bathing inside a monument: this could be the slogan for the Gellert baths. With its Art Deco architecture it is the jewel among Budapest’s baths. Particularly worth seeing is the two-storey-tall swimming hall, with balconies and a glass skylight. The interior is richly decorated with colourful mosaics, columns, statues and vases. The thermal bath for men has been preserved in its original state, dating back to 1918. The floors, walls and basins are covered by Zsolnay ceramic tiles, of various shades of turquoise. A wave-making machine dates back to 1927. As in many of the other baths, there is a broad range of therapeutic treatments – from tuff-stone

To bathe just once like a Turkish pasha is something visitors can do in the Rudas bath, located directly on the Danube River not far away from the landmark Chain Bridge. A huge dome, supported by eight red marble columns, stretches over the main pool. The four pools located in the corners contain water at various temperatures – slightly smelling of rotting eggs, an odour that comes from the sulphur in the water. The new party-scene culture has also arrived at the Rudas bath. Wearing only bathing costumes and flip-flops, the young people arrive to attend the latest Cinetrip Party. “This is a mixture between recuperating at a spa and partying,” event host Laki says. “Music and a laser show ensure a great atmosphere. The people while away their time in the water, splashing around or cuddling until 4 o’clock in the morning.” That this is possible today is a sensation, he adds; for as late as the year 2005, in keeping with the Turkish tradition, women were still not permitted in the Rudas bath. Budapest’s first outdoor bath, the Palatinus Bath, was open to everyone from the outset. It is nestled in a well-manicured park on Margaret Island. The huge bathing landscape, with its 11 pools, a wave-making pool and five waterslides is fed by thermal waters. Spa hotels on the northern part of the island also take the water for their pools. u
