New Mexico Courts Announce Interactive Forms Project

T

he New Mexico Administrative Office of the Courts, the administrative arm of the Supreme Court, announced that it has signed an agreement with Pro Bono Net to use LawHelp Interactive™ to manage and host interactive forms that will allow people without access to an attorney to address civil legal issues on their own. The goal is to make it easier for anyone with access to a computer to complete forms that must be filed in court. Every year, millions of Americans unable to afford an attorney face potentially devastating legal problems such as domestic violence, foreclosure, eviction, and child custody disputes. The volume of unmet legal needs in New Mexico by far exceeds available legal services. A 2010 Legal Services Corporation report, Documenting the Justice Gap in America, states that for every client accepted by a legal service provider, another eligible client is turned away for lack of resources to provide services. The number of people without lawyers is spiking even further in these difficult economic times as job loss leads to foreclosures, evictions, bankruptcies, and the inability to pay child support. The people who are turned away cannot afford an attorney, and therefore turn to the courts with their legal issues, desperately requesting court staff to help them. Online document assembly allows those without a lawyer to quickly and accurately prepare critical legal forms via an easy-to-use online interface. Utilizing a grant from the State Justice Institute, New Mexico will use LawHelp Interactive™ to create interactive basic civil and family law forms for legal areas such as landlord/tenant and divorce. In addition to allowing courts to host and manage online forms, LawHelp Interactive provides training and support on how to create user-friendly forms using software donated by HotDocs and A2J Author, and provides support to court staff and end users. LawHelp Interactive receives support from the Legal Services Corporation via its Technology Initiative Grants program.

Internet Helps Consumers Investigate Home Financing Options

N

ot only are more people moving toward online banking (62 percent, according to an American Bankers Association survey), they’re also using the Internet to research such big decisions as selecting a home loan. A survey of homeowners by Wells Fargo found that nearly half visited their financial institution’s website to learn more about products and services. A home loan is one of the most important financial decisions most people will make and the difference in a few key variables can have a significant effect on your borrowing costs over the life of the loan. Here are a few questions and answers you may want to consider when researching your home financing options: What type of loan do I need? • There are two basic categories

of home loans. A mortgage loan can be used to purchase a home or to refinance an existing mortgage. A home equity loan or line of credit lets you access your home’s equity to fund such things as home improvements or large purchases, or consolidate outstanding debts. What will the money be used for and how much could I borrow? • Whether you’re buying your first home, fixing up an existing home, refinancing, looking for a home equity line of credit or trying to identify ways to manage existing debt, researching how much you can borrow is an important step. Credit experts, such as the National Foundation for Credit Counseling and others, suggest spending no more than 28 percent of your monthly pretax income on housing payments, which include principal, interest, property taxes and

insurance. homeownership life cycle, visit www. Should I get a fixed- or adjustablewellsfargo.com/mortgage/home-loans. rate mortgage? (NAPSI)— • Depending on your personal financial situation, either choice could be an option for you. If you’re planning on staying in your home for a long time, a fixed-rate mortgage may be a good choice since it offers predictable monthly payments and guarantees that your interest rate will not increase over the life of the loan. However, if you’re planning to refinance or move within a few years, an adjustable-rate mortgage (ARM) might be better. Typically, ARM loans have lower initial rates and then adjust within a predetermined range, usually annually. Saving Time, Trouble And Money

I

t’s that time of year again-tax time! But with the average tax refund over $3,000 last year, for millions of Americans, this isn’t such a bad time of year, especially with all the free tax filing options available to taxpayers. Now more than ever, taxpayers are looking for ways to save money on tax preparation while ensuring they get the biggest refund possible. One of the easiest ways to save time and money is to go online. For the estimated 80 million Americans who have a fairly simple return, online tax preparation is not only easy, accurate and convenient—It’s FREE! “Online tax preparation is really easy and fast and I can e-file so I get my refund back in about a week,” said Shelby, a 29-year-old professional from Santa Monica, Calif. “And using a free service is a lifesaver. The money I would have used to pay someone else to prepare my taxes can now go toward buying gas and groceries.” With more free and low-cost tax preparation options than ever before, low-income taxpayers and filers with simple returns are seeing the benefits. Some things to consider before you go online to prepare your taxes: • Look for free filing options: Free online tax preparation websites are a great option for people with simple tax returns. Taxpayers can prepare and e-file their federal tax returns at no cost with free options from IRS.gov or TurboTax.com. • Consider using your smartphone: Now

taxpayers can easily prepare and file taxes from their mobile devices. SnapTax, an app for simple returns (1040EZ), allows people to prepare their return from an iPhone or Android phone. Just snap a photo of your W-2, answer some simple questions, review your return for accuracy and tap to e-file in minutes. • Get the most out of your tax software: Online tax preparation websites are not all the same. For example, TurboTax offers free one-on-one expert tax advice for everyone, live by phone or chat, to give you the confidence that your return is done right. • E-file for a refund in record time: E-filing is the fastest way to receive your refund. You can receive your tax refund in about seven days with direct deposit. If you don’t have a bank account, you can still e-file and collect your refund quickly by choosing options such as the TurboTax Prepaid Visa® Card. With few expected tax law changes, now is the time to use online or mobile tax filing options. It will make tax time easier and ensure that you get every dollar you deserve back in your pocket, fast. With all these easy and affordable options available, don’t wait. For more information, go to www.turbotax.com.

Uncle Sam Wants You To Save For Retirement

I

f you ever feel your finances are too stretched to save for retirement, there could be good news for you. The Saver’s Credit-a little-known tax credit made available by the IRS to low-to-middleincome workers—could make saving for retirement more affordable than you think. It may reduce your federal income taxes when you save for retirement through a qualified retirement plan or an individual retirement account (IRA). “The Saver’s Credit is particularly great because it offers many workers an added incentive to save for their future retirement, while potentially lowering their tax bill today,” said Catherine Collinson, president of the Transamerica Center for Retirement Studies®. Here’s how it works: 1. Check Your Eligibility For singles, anyone earning up to $28,250 in 2011 or $28,750 in 2012 is eligible. For the head of a household, the income limit is $42,375 in 2011 or $43,125 in 2012. For those who are married and file a joint return, the income limit is $56,500 in 2011 or $57,500 in 2012. (All income requirements are based on Adjusted Gross Income.) You must be 18 years or older by January 1 and cannot be a full-time student or be claimed as a dependent on another person’s tax return. If

you fit within these parameters, the Saver’s Credit may be for you. Depending on your filing status and income level, you may qualify for a nonrefundable credit of up to $1,000 (or $2,000 if filing jointly) on your federal income taxes for that year when you contribute to a 401(k), 403(b), 457, 501(c)(18)(D), SEP or SIMPLE plan, or an IRA. 2. Save for Retirement If your employer offers a retirement plan, make sure you enroll. Or open a traditional or Roth IRA with the financial institution of your choice. If you are enrolled in your employer’s retirement plan, you may already qualify for the credit. In general, for every dollar you contribute to a qualified retirement plan or IRA, up to the lesser of the limits permitted by an employersponsored plan or the IRS, you defer that amount from your current overall taxable income on your federal tax returns. 3. File Your Tax Return and Claim the Credit When you prepare your federal tax returns, you then claim your Saver’s Credit by subtracting this tax credit from your federal income taxes owed. If you use a professional tax preparer, ask about the Saver’s Credit, called the “Retirement Savings Contributions Credit” on Forms

1040, 1040A and 1040NR. Or if you use tax preparation software, be sure to use Form 1040, Form 1040A or Form 1040NR to file your return. The Saver’s Credit is not available with Form 1040EZ, although the IRS has included instructions with the EZ directing you to a different form if you choose to claim the credit. Lastly, if you prepare your tax returns by hand, start with Form 8880, “Credit for Qualified Retirement Savings Contributions,” to determine your credit rate and corresponding credit amount. Then use Form 1040 or Form 1040A to file your return. Transfer the amount of the Saver’s Credit from Form 8880 to line 50 of Form 1040, line 32 of Form 1040A or line 47 of Form 1040NR. Have questions? See IRS publication 590, ask a tax professional or log on to the IRS website at www.irs.gov. The 12th Annual Transamerica Retirement Survey found that just 21 percent of American workers with an annual household income of less than $50,000 are aware that the credit exists. Don’t overlook Uncle Sam’s Saver’s Credit; it may help you pay less in your current federal income taxes while saving for retirement. About the 12th Annual Retirement Survey (Full-time and Part-time Workers) This survey was conducted online within the United States by Harris Interactive on behalf of Transamerica Center for Retirement Studies® between January 31, 2011 and March 10, 2011 among 4,080 full-time and part-time workers. Potential respondents were targeted based on job title and full-time and part-time status. Respondents met the following criteria: All U.S. residents, age 18 or older, full-time workers or part-time workers in for-profit companies, and employer size of 10 or more. Results were weighted as needed for the number of employees at companies in each employee size range. No estimates of theoretical sampling error can be calculated; a full methodology is available.
