Let’s Make a Deal & Get it Sold! Welcome to the winter edition of Texas Farm & Ranch magazine, featuring my new ranch listing with the great Terry Bradshaw and the beautiful ranch he built on the banks of the Red River of Texas & Oklahoma. I invite you to enjoy his story on page 26. Without question, the highlights of 2014 have been the honor and privilege of representing the famous half million acre W. T. Waggoner Ranch in Vernon, TX as well as Terry Bradshaw’s fantastic spread in Oklahoma, two most distinctly different propositions; however, each being among the finest ranches of their category. After 20 plus years in the Ranch, Land & Luxury markets from California to Texas and beyond, I am fortunate these days to choose the clients, wealth management, lenders, brokers and others with whom I engage in portfolio management, acquisitions, sales and marketing or development challenges in Texas, across the nation or overseas. I’ve been lucky to have made a career on successfully closing deals that some said were impossible to list and market or, on others, that some said would never sell. I have sold all types of real estate in all kinds of complicated situations, learned a lot and had fun along the way. These days I am privileged to partner, network and co-broker on deals across the nation and here in Texas with some of the best local brokers in the business like Sam Middleton of Chas. S. Middleton and Son in Lubbock on the Waggoner and Angie Nelson of Briggs Freeman Sotheby’s International Realty on the Bradshaw Ranch. Sam is a third-generation expert in West Texas and Angie a Southern Oklahoma professional. Teaming up on marketing missions with great people like Sam & Angie, I am able to help bring an optimum mix of international reach through my networks, as well as tactical and strategic marketing savvy across worldwide connections, along with a deep client base of repeat buyers to connect with as a co-broker on a listing to together, get it sold.

W. T. Waggoner Ranch, 2014

So, if you are a property owner or manager with a challenge to sell, or if you require help on acquisitions or a complicated deal, or if you need assistance with receiverships, workouts, or as an expert witness –let’s talk and see if I can help. If you are a broker with a potential listing or unusual opportunity that wants to team up for success, I invite you to call and discuss the chase or the challenge.

Let’s make a deal and get it sold. My Very Best,

The legal term for an unrepresented buyer (a buyer who calls broker marketing listing) is “third party” to the deal (your deal). For no extra money enjoy full protection

Sellers add easements and separate wind, water, and minerals to the point where a Buyer needs the protection of a Buyer’s Broker. Many larger ranches are legacy investments where holistic practices of conservation, mitigation, and stewardship are the basis for evaluation and should be driving principles in your broker as well.

From the National Account Manager Welcome to the 74th issue of Texas Farm & Ranch! There are few more recognizable faces in sports than that of football legend Terry Bradshaw, and we are pleased to feature his Red River Ranch, listed by Bernie Uechtritz, advisor to Briggs Freeman Sotheby’s Farm and Ranch Division, in this issue. Mr. Bradshaw candidly shares his thoughts on the ranch, as well as some beautiful photography, beginning on page 26. Whether you currently own property or plan on buying property in the future, the Rancher’s Corner (page 24) on the relationship between surface and mineral owners is a must-read. Industry veteran Robin Forte´ addresses the dominance of the mineral estate and how it may impact you if you don’t own all of the minerals under your property. You will find dozens of brokers and hundreds of exciting properties between the covers of this magazine, but did you know that you can find us online as well? Visit and use the search feature to gain access to even more properties. Like us on Facebook or follow us on Twitter (@farmandranchmag) to see beautiful properties right in your news feed and share your photos with us, like those included in the premier of Farm & Ranch Little Boots on page 23. Thank you to the many brokers, readers and certainly staff who have made me feel right at home. The team at Farm & Ranch Publishing is committed to bringing you premier properties offered by the best brokers in Texas. Please feel free to drop us a line with suggestions!

Did You Know?… Microsoft founder Bill Gates recently purchased a 229-acre horse farm in Rancho Santa Fe from weight-loss guru Jenny Craig for $18 million. Gates reportedly plans to indulge his daughter Jennifer, who jumps horses competitively, by turning the ranch into a grand prix circuit for hunters and jumpers.

For the surface owner to completely control the surface he must own 100% of the minerals. Obviously, the more of the minerals the surface owner owns, the less offensive the pump jacks are. But remember, in many jurisdictions, even if you own 75% of the minerals you probably will be unable to prevent use of the surface by the 25% owner.

“The rancher and the mineral owner should be friends.”

But the surface owner has to be reasonable too. There is an old Montana case where the surface owner was not happy with the damages offered by the oil company so he met them at the gate, shotgun in hand, and prohibited entrance of the drilling rig and equipment. Of course, the oil company proceeded to get a restraining order against the surface owner and entered the land. Later they sued and countersued. The rancher was awarded $25 for a broken fence and the oil company was awarded $25,000 for having the

Certainly, restrictions on surface use may be included in the deed to limit the dominance of the mineral estate, but this needs to be done at the first severance of the property or it will not bind the mineral owner who first reserved. Absent a deed restriction on surface use, the common law will apply. Both parties to a transfer of property need to consider the mineral ownership in their evaluation and understand how the surface may be shared. In spite of being dominant, there are real limits to the use of the surface by the mineral owner. The doctrine of accommodation was established in a case called Getty v. Jones in Texas in 1971 in which it was held that the oil operator must reasonably accommodate other surface uses, particularly those uses already established. In Getty, Mr. Jones had a circular irrigation system. It seems that Getty’s pump jacks were so tall as to block the irrigation system from going in its circle. Getty said, “gosh we’re sorry but it’s not our problem.” The court disagreed and ordered Getty to go to each well site, remove and reinstall each pump jack after digging up enough dirt so that when it reinstalled the pump jacks in the newly created “cellar” they were low enough that the irrigation system could pass overhead freely. So the dominance of the mineral estate is not absolute.

drilling rig and equipment (for which it was being charged) delayed from entering. If it is at all possible a purchaser of the surface should obtain some percentage of the minerals. This will greatly reduce the otherwise natural conflict. If one chooses to acquire the surface with no minerals, he must be prepared to share his surface with the mineral owner as prescribed by the common law. Landowners, being pretty smart, soon learned that they could sell land reserving all or some of the minerals. So minerals began to be reserved a hundred years ago and still are today. The problem grows and grows – if you

everything – unless you buy it. And that means it must be for sale. In today’s world 100% of the minerals are hardly ever going to be for sale. The best solution was suggested in the play “Oklahoma!” There it was said “the rancher and the farmer should be friends.” So perhaps we should say “the rancher and the mineral owner should be friends.” But certainly we say the dominance of the mineral estate should be given careful consideration when buying your farm or ranch. v Robin Forte´ is an oil and gas producer whose companies collaborate with oil and gas professionals across the country to develop prospects, acquire acreage and build reserves for investors. consider severed minerals to be a problem. As we consider the purchase or sale of any property today, we must consider severed minerals and how to best negotiate a deal satisfactory to the buyer and seller. We must think about owning less than 100% of the minerals (which is going to be the case most of the time) and understand the consequences thereof. In addition to lack of surface control (which remember happens anytime you get ownership of less than 100% of the minerals) you are giving up a proportionate part of future lease bonuses and royalty. In many cases today, since shale-gas and shale-oil drilling was perfected, the minerals are worth much more than the surface - multiples, in fact. Volume 74 Texas Farm&Ranch

My Prize Ranch Goes on the Market

From immaculate reception to immaculate ranch – Terry talks about his horses, hogs, cattle and the therapeutic rewards of ranching, while transforming almost a thousand acres of oncediscarded dirt into picturesque serenity for his family, friends and prized livestock.

By Terry Bradshaw Terry Bradshaw is a former American football quarterback who played for the Pittsburgh Steelers in the National Football League. He has been a TV analyst and co-host of Fox NFL Sunday. He played for 14 seasons with Pittsburgh, won four Super Bowl titles in a six-year period, becoming the first quarterback to win three and four Super Bowls, and led the Steelers to eight AFC Central championships. He was inducted into the Pro Football Hall of Fame in 1989. He is ranked #44 on the list of 100 of the Greatest Football Players ever, and in 1972 threw one of the most famous plays in NFL history, known as the “Immaculate Reception.”

Volume 74 Texas Farm&Ranch

What most people don’t know is that Terry, at heart and at home, is a rancher…a really good one… As the old saying goes, there is a time and place for everything. At my ranch in Thackerville, Oklahoma overlooking the Red River, I have devoted a lot of time over the last 14 years and a huge amount of money turning about 740 neglected acres into a place that I am proud to say I love. My wife, Tammy, tells me that being a Virgo, I have to have everything perfect. Of course, that is why I married her. She is right that I require perfection, whether it was on the football field when I was playing for the Pittsburgh Steelers, in the studio at FOX Sports Sunday or at the ranch. Everything about this ranch is perfect from my sprawling western-style lodge I built for my family and friends to the care I give my horses to the miles of pipe and cable fencing that surrounds the pastures to the eight bucolic lakes. On Building My Ranch I built it to satisfy my passion for being outdoors, working with animals, particularly horses and cattle, but also the hogs I raise to feed the hungry. This ranch meets all those needs. I raise a large herd of cattle and top quality horses on one of the finest spreads you will find anywhere. More important, in my hectic life of airplanes, television shows, speaking engagements and meetings, I have to have a spot on this Earth where I can walk out my front door and feel the peace, but get to anywhere in the country or the world in an hour’s drive to DFW airport. This ranch has been the perfect spot for me. A Well-Situated Ranch DFW International Airport — 70 miles Lovefield Airport — 80 miles Winstar Casino — 2 miles Oklahoma City — 125 miles Lake Texoma — 45 miles Denton, Texas — 40 miles Lake Murray State Park — 25 miles

It was not always that way. When I first laid eyes on this property, it was a mess. No one had taken care of it for years. There were a few head of cattle grazing on it, but mostly the acres were overgrown with brush and trees. The creek bottoms needed to be cleaned out. The fencing was

mostly gone. There was an old run-down barn and a worn-out, old school bus. There were no paved roads, just old tracks. Getting around the property required four-wheel drive. There was almost no surface water. The first time I saw the property, I walked away. I had looked for ranches all over Texas, and I didn’t think this one just across the river in Oklahoma was right for me either. Then on a whim, I drove up here in my jeep and spent hours driving over the old trails that Indians and stagecoaches once used, thinking about the potential the land offered. I pulled up on one of the hills, parked my jeep facing the setting sun. I stood on top of the jeep and looked back across the river. I decided then I could build a house on that spot. I did, and to this day, I find quiet peace and tranquility enjoying that setting sun from my back veranda. It took me two years to clear the trees and brush, clean out

the bottoms, erect miles of fencing and start work on the house and barn. I knew where I would build the house and the direction it would face. But other decisions, like where to build the barns, the arenas, the paddocks, took more time. What if I built them in the wrong place? I didn’t. While I was turning the property into something special, I was taking every job I could to pay for it all. Millions of dollars later, I have created something that is very special. Just an hour north of Dallas/Fort Worth Airport and a few minutes from the world-class Winstar Casino, my ranch has everything for someone who wants a versatile ranch, who likes to entertain friends and family and who needs a place to escape. That person could take the keys, move in, start raising horses and cattle, and fall in love like I have with this ranch. My manager, Chad, who built this over the years, would like to stay. He’s the perfect manager for this place.

feet under a gorgeous green roof, it has six bedrooms and eight baths. One of my favorite places to sit to watch the sunset is our outdoor patio that is more than 1,000 square feet and has a kitchen and a bar, a fireplace and a fire pit. I built a pool for my two daughters and their friends and a two-story doghouse. The horses have it just as good. There is a four-stall stallion barn, a 20-stall show barn, a 50-stall mare barn with a laboratory and office and a 75 by 140 foot covered arena. The property also has fenced-in pastures and paddocks and eight ponds.

“Millions of dollars later, I have created something that is very special.”

I currently have 50 brood mares, three stallions and 100 Black Brangus cattle. The ranch, particularly in rainy years, could handle more. I built trails all over the property so my family, friends and I can enjoy viewing this fabulous place on four wheelers, on horses, or on foot. Once you needed a four-wheel drive just to get on the ranch—now you can drive a Ferrari from Highland Park, DFW Airport or Winstar Casino to my front door on sealed asphalt at any time of the year. So you are wondering why I would ever let go of a place I have put so much of myself into. This ranch is a part of me. I will miss it. But at 66 years old, it is time to downsize. On Choosing My Broker I had considered various agents over time but could never really find the right fit. Then I was introduced to Bernie through as he likes to say, “one of his mates in his network,” a guy called Fandel in Telluride, Colorado. Bernie (who’s an Aussie) and I hit it off right away when he came to the ranch. He’s a competitive horseman and polo player with a background in cattle and ranching who sells ranch properties all over the world. He’s also selling one of America’s biggest and most famous ranches, the Waggoner Ranch – over half million acres – so I figure he can certainly handle my ranch! Bernie brings a team approach with Angie Nelson and Briggs Freeman Sotheby’s of Dallas, so it’s all a great fit for me. I’m gonna miss my ranch! v

Even though Dipper Ranch possesses incredible native whitetail genetics, an intensive pasture management program has been designed and implemented. To support their program, the owners constructed a deer breeding facility in 2007 to further enhance the development and quality of their whitetail population. The trophy breeding herd consists of ten 200+ Boone & Crockett-class whitetail bucks and 150 does of superior genetic quality. The Dipper Ranch has abundant water with 13 lakes and ponds, stocked with fish, as well as 1 water well. There are 20,000+ square feet of new facilities, which include a main house, guest quarters, ranch foreman’s house and a ranch facilities manager’s house. In addition, a 10,000-square-foot operations hub includes a mechanics shop, welding and fabrications facility plus a wood working shop. Last, there is a 11,250-square-foot equipment storage facility that includes a ranch office with a game processing and storage room. Owner will convey of all owner’s minerals which is approximately a 1/8 plus 50% royalty on 640 acres. No production and no oil drilling activity on the ranch. Property ID: 46261

Neches Mountain Ranch Central Texas v Anderson Co. v Neches

Just outside of the quaint little town of Neches, about 10 minutes north of Palestine, this beautiful ranch offers diverse terrain: rolling hills, woods, pasture and numerous spring-fed creeks. These 664.58 acres are of some of the best in Anderson County with right at a mile of FM 2267 frontage. The focal point is definitely the 360-degree mountaintop view made available thanks to the 600-foot elevation. This has to be one of, if not the highest, elevations in the county. All the underbrush has been removed from the mountain, leaving just the large trees to provide for

seemingly endless views. This would, without a doubt, make the finest spot in the county to build a magnificent home. The entire perimeter has just been high fenced with attention paid to every detail concerning water gaps and creek crossings. There was an extensive amount of work done with dozers and other heavy equipment on the soft surface roads, underbrushing the hillsides, construction of multiple lakes and ponds, creek enhancements and other projects that have laid the foundation for the creation of a true “showplace” hunting ranch. Improvements include a new metal barn on a slab, a new 41-foot, fifth wheel travel trailer that is top of the line, three top-notch 10-foot tower blinds and a deep water well. This turn-key ranch is ready for your enjoyment and personal touches, so load up the family and the four-wheelers and come to Anderson County to see this beautiful place before it sells. Current owner respectfully asking for serious, qualified inquiries only please. Recently reduced to $2,490,000.
