{Order expired by order of the Main Department of Civil Service N 214 ( z1089-10 ) of 04.08.2010} On approval of the General Rules of conduct for public servants According to the Decree of President of Ukraine of 26 July 2000 N 925/2000 ( 925/2000 ), orders of the President of Ukraine from June 8 2000 N 1-14/647 and Prime Minister of Ukraine on June 12, 2000 , the 10,145 N / 2 and pursuant to paragraph 2 of decision of the Coordination Council of Civil Service under President of Ukraine of 18 September 2000 N 2/2000-3, in order to create conditions for increasing the authority of public service and awareness of behaviors that they have expect from public servants: A. To approve the General Rules of Conduct for Public Servants (attached). 2. Law Department MDCSU (Smiyan OA) to prepare in due course materials for state registration of the general rules of civil servant in the Ministry of Justice of Ukraine. 3. Management Department (Kuzmenko MM), the central government agencies (Gapon II) and management of territorial government agencies (Tsymovskyy BI) after state registration in Ministry of Justice of Ukraine to ensure our top General Rules central executive bodies, the Council Ministers of the Autonomous Republic of Crimea, Kyiv and Sevastopol city state administrations, regional, Kyiv and Sevastopol city councils and other bodies in which civil servants work. 4. Scientific Research Department (Forty-VM) after registration with the Ministry of Justice of Ukraine Order MDCSU approval of the General Rules of conduct for public officials to ensure its publication in "Journal of Civil Service of Ukraine "and posting on Web-page MDCS. 5. Control over the implementation of this Order shall be in the first Deputy Head of MDCS Pavlenchyka PT Head of the MDCS H.Lelikov

Approved by Order MDCSU Ukraine October 23, 2000 N 58 Registered with the Ministry of Justice of Ukraine on November 7, 2000 , N 783/5004 General rules of conduct for public servants These rules are generalizations of standards of conduct and integrity of civil servants. They are based on the Constitution of Ukraine ( 254k/96-VR ) and certain laws of Ukraine the principles of public service, aimed at creating conditions for increasing the authority of the civil service and strengthening the reputation of public servants as well as informing citizens about the behavior they should expect from public servants. In taking the civil service civil servant familiar with these rules, which is a written testimony in his personal file.

Limits of application A. General rules of conduct set basic requirements for the ethics of public authorities that occupy positions classified in the appropriate categories of civil servants under the Law of Ukraine "On Civil Service" ( 3723-12 ). 2. For civil servants who work in the office of prosecutors, courts, diplomatic, customs, tax services, the National Bank of Ukraine, Security Service, Internal Affairs, the Armed Forces and other military units, relevant bodies may be approved code of conduct to the peculiarities of these organs. Terms 3. State Service of Ukraine is based on the principles of service to the Ukrainian people and Ukrainian state, democracy, humanism and social justice, rule of law, which provides priority of human rights and citizen professionalism, initiative, integrity, commitment, personal responsibility for the implementation of authority and respect service discipline, political impartiality, openness, transparency and controllability. 4. Public purpose of the Civil Service is to ensure effective implementation of the tasks and functions of the Ukrainian state through conscientious implementation of state employees assigned to them of authority. 5. The behavior of public officials should meet the expectations of the public and ensure public trust and citizen public service to promote the rights and freedoms of citizens, the Constitution ( 254k/96-VR ) and laws of Ukraine.


6. Civil servants have to worry about a positive image and credibility of public authorities and public service in general, cherish your name and status. 7. Public officials, including constitutional rights, may participate in political or other social activities just outside their official duties and leisure time to not undermine the faith community in an impartial exercise of their functions. Own political views they can use when performing their duties. 8. A civil servant, like other citizens entitled to privacy and should respect the privacy of other state officials to keep these issues confidential information, unless otherwise provided by laws of Ukraine. General obligations of civil servants 9. State employee on duty shall act on the basis of the extent and in the manner envisaged by the Constitution ( 254k/96-VR ) and laws of Ukraine and signed in due course ratified international treaties of Ukraine on the basis of honesty, fairness, responsibility, openness and transparency. Acts of local authorities and local self-government, adopted within their powers, which do not conflict with the law in the territory is also mandatory for civil servants of any organ of state power. 10. A civil servant must faithfully carry out their duties, take the initiative and creativity, to continuously improve the organization of work. 11. Civil servants have to perform their official duties honestly, fairly, not to provide any benefits and does not show favor to certain individuals and entities, political parties strongly oppose anti manifestations and forces that threaten the order of the society or the security of citizens. 12. State employee should respectfully treat people, managers and employees to observe high- culture communication, not abstain from actions that could harm the interests of public service. 13. Civil servants have with due respect the rights, obligations and legal interests of citizens and their associations, as well as legal persons shall not exercise discretion or indifference to their lawful action or requirements prevent manifestations of bureaucracy, vidomchosti and localism, incontinence in statements or other way to behave in a way that discredits the public authorities or defaming the reputation of a civil servant. 14. Civil servants have to show tolerance and respect for different religious organizations, respect for and observance of national customs and traditions set by the protocol in its relations with international organizations, foreign institutions and foreigners. 15. In carrying out its powers civil servant has to ensure that material and financial resources it charged, used efficiently, effectively and economically. 16. A civil servant shall continually improve the status of compliance with their skills, knowledge and skills Functions of the position, increase their professional, intellectual and cultural level of educational and professional programs through self-education.


17. A civil servant is obliged to timely and accurately carry out the decisions of public authorities or officials, orders and instructions of their leaders. 18. State employee must act within their powers. Public employees can not participate in strikes and perform other actions that interfere with normal functioning of public authorities. 20. Civil servant may not disclose authorized him to state secrets and other information with restricted access, under the law of Ukraine "On Information" ( 2657-12 ) and "On State Secrets "( 3855-12 ), including after leaving his public service, and also use such information for self-interest or interest of others by advice or recommendations. At the same time civil servant should not hide from the public the facts and circumstances that threaten life, health and safety, except barring disclosure of information constituting state secrets, an exhaustive list of which is determined by the law and harm the public information policy, the subjects of information relations by avoiding or refraining from taking measures to protect state secrets and other classified information. Conflict of interest and prevent corruption 21. A civil servant shall on request to declare the presence or lack of conflict of interest. Conflict of interest arises from a situation where the public official has private interests that benefits him or his family, relatives, friends or individuals and organizations with which he has or had a joint business or political interests that affect or may affect the impartial and impartial performance of official duties. Any such conflict should be resolved before the adoption of the civil service or the appointment of a new post. 22. A civil servant in accordance with the Laws of Ukraine "On Civil Service "( 3723-12 ) and "On the Suppression of Corruption" ( 356/95-VR ) shall not: contribute by using his official position, physical and legal persons in the conduct of their business, and also to receive subsidies, subventions, grants, loans or benefits to obtaining it for themselves, their relatives or other persons of wealth, services, benefits or other benefits; do business directly or through intermediaries or dummies, represent third parties in matters of state agency where he works, and perform the work under the conditions (except for research, teaching, creative activity, and medical practice); 4

enter independently, through a representative or straw to the board or other executive bodies of enterprises, financial institutions, companies, organizations, unions, associations, conducting business; deny individuals and legal entities in the information provision which provides legal acts intentionally delay it to give false or incomplete information; refuse or delay the preparation and issuance of persons or entities under the law of certificates, permits and other documents; demand or accept from individuals and entities gifts, services, or any other benefits that are or may appear as a reward for decisions or actions that belong to his official duties; contribute by using his official position, physical and legal persons in the conduct of their foreign trade, credit and banking and other activities in order to get at it for themselves, their relatives or other persons of wealth, services, benefits or other benefits; unduly interfere with using his official position in the activities of other agencies or officials to prevent the execution of their duties; represent third parties for a government agency, where he works, or public authorities, enterprises, institutions and organizations whose activities are controlled; provide illegal benefits to persons or entities in the preparation and adoption of regulations or decisions. 24. A civil servant is obliged to declare their income and their family income in the manner and within the period specified by the legislation of Ukraine; carefully to fulfill their civic responsibilities, including financial obligations in the manner and amount prescribed by law. 25. A civil servant is obliged to refrain from execution of other work permitted by law, if it prevents him from properly perform their duties or which he must pay attention during their time. Liability for failure to comply with the General Rules of Conduct for Public Servants 26. Breaking the rules of civil servants is the basis for the application to them of disciplinary measures envisaged by the Labour Code of Ukraine ( 322-08 ), and the Laws of Ukraine "On Civil Service" ( 372312 ) and "On the Suppression of Corruption "( 356 / 95-BP ). 27. Public employees who supervise other public servants or control their work, must take steps to compliance with the General Rules of Conduct in accordance with the law and within the authority.
