UNCLEAR TITLE & CONSUMER FRAUD This course will equip the practicing real estate professional with an overview of the ways in which real property can be encumbered by encroachments, deed restrictions, and liens and claims of every type. Sometimes archaic in form, these common roadblocks to the smooth transfer of title must be recognized and understood when encountered, and resolved or figured into the terms of sale. The material will be delivered with reference to the common law of real property, as well as to New Jersey case, statutory and regulatory law, with special attention paid to relevant clauses in commonly used agreements of sale. Upon successful completion of the course, the student should be better able to assist the consumer client to understand and manage impediments to clear title in the acquisition and transfer of residential real estate, the second part of the course will equip the practicing real estate professional with a conceptual framework to recognize, to distinguish, and hopefully to avoid the different types of fraud and deceit examined. As a side note, the often referenced Statute of Frauds will be explained and distinguished. The material will be delivered with reference common law tort principles, as modified by New Jersey case, statutory and regulatory law. Upon successful completion of the course, the student will have been alerted to the many kinds of actionable misrepresentation in a real estate transaction, and made aware of the punitive consequences that our laws pin on dishonesty, deception, and sharp practice in this field.

LEGAL AFTERMATH & CONTRACTS In this fragile economy, as never before, the practicing real estate professional needs a roadmap to the legal landscape of breach of contract, where today’s witnesses become tomorrow’s defendants, and today’s decisions support tomorrow’s claims issue. “Unsettled: The Legal Aftermath of Failure to Close” presents the conceptual tolls needed to address proactively the too-common problems on the path from injury of a lost commission to the insult of litigation. The objective of the course being to forearm the licensee with an understanding of the arc leading to a court-imposed remedy for breach of contract sale. The Second part of the course will equip the practicing real estate professional with an overview of the inherent legal principles and the required formalities for legally binding contract revision.
