A finales de junio, las partes continuamos haciendo ofertas y contraofertas, dentro de la dinámica normal de las negociaciones colectivas, sin soslayar los impactos y pérdidas que un posible cese de actividades podría generarle a la región, al país y a la economía familiar de nuestros empleados y demás colaboradores que participan en las operaciones. Por esto, manteniendo una posición abierta al diálogo, exhortamos a nuestros trabajadores y a las comisiones negociadoras a la sensatez y la reflexión, para así avanzar en el proceso.
At the end of June, the parties continued to make offers and counteroffers within the normal dynamic of collective bargaining, without considering the impacts and losses that a possible work stoppage could cause for the region, the country and the families of our employees and other partners involved in our operations. Therefore, we maintained a position that was open to dialogue. We urged our workers and the bargaining committees to be sensible and to reflect in order to move forward in the process.
Sin embargo, los trabajadores afiliados a Sintramienergética, en sus asambleas, decidieron declarar la huelga, que se hizo efectiva el 23 de julio del 2013. Este hecho no fue un obstáculo para seguir negociando y haciendo ofertas. Lamentablemente, no se pudo llegar a un acuerdo que pusiera fin al conflicto colectivo de trabajo.
However, the workers who are members of Sintramienergética decided at their meetings to declare a strike, which took effect on July 23, 2013. This was not an obstacle to continue negotiating and making offers, and unfortunately, an agreement could not be reached to end the collective dispute.
Después de unos días de estar en este cese de actividades, un grupo de trabajadores organizó unas asambleas generales de todos los empleados de la empresa, con el propósito de someter el conflicto a un tribunal de arbitramento, de acuerdo con lo establecido en la ley colombiana. Finalmente, después de dos asambleas generales, la mayoría de los trabajadores decidieron tomar el camino de solucionar el conflicto a través de un tribunal de arbitramento, lo cual tuvo como consecuencia que la huelga llegara a su fin.
After several days of this work stoppage, a group of workers organized several general meetings of all company employees in order to submit the dispute to an arbitration tribunal in accordance with Colombian law. Finally, after two general meetings, a majority of the workers decided to take the path of resolving the dispute through an arbitration tribunal, which resulted in the strike coming to an end.
El 18 de septiembre del 2013 se firmó una convención colectiva con Sintradrummond y Agretritrenes, y el conflicto colectivo con Sintramienrgética quedó pendiente por resolverse a través de un laudo arbitral.
On September 18, 2013, a collective agreement was signed with Sintradrummond and Agretritrenes, and the collective dispute with Sintramienergetica was left pending resolution through an arbitration award.
En el año 2014 la empresa fue notificada de la creación de un nuevo sindicato, Sintradem, con el cual iniciamos una nueva negociación colectiva; sin embargo, al no llegar a ningún acuerdo, el proceso también será definido a través de un tribunal de arbitramento.
In 2014, the company was notified of the creation of a new union, Sintradem, with which we began a new collective bargaining process. However, we were unable to reach an agreement and the process will be decided through an arbitration tribunal in the future.
