Participation Agreement PARTICIPATION WAIVER: Please read any waivers carefully. They include releases of liability and waiver of legal rights and deprive you of the ability to sue certain parties. Do not agree to these documents and do not register unless you have read and understood it in its entirety. By agreeing you acknowledge that you have both read and understood all text presented to you as part of the registration process. You also understand and agree that events carry certain inherent dangers and risks which may or may not be readily foreseeable, including without limitation personal injury, property damage or death. Your ability to participate in the event(s) is/are subject to your agreement to the waivers and by agreeing herein, you accept and agree to the terms of the waiver and release agreements. DIVERSITY SPORTS reserves the right to use any photograph or videography taken during a DIVERSITY SPORTS sponsored event without the expressed written permission of the subjects included within the photograph or video. Photographs may be used in publications or other media material produced, used or contracted by DIVERSITY SPORTS including but not limited to: view books, catalogs, search pieces, newspapers, magazines, television, websites, etc.

LIABILITY WAIVER: In consideration for being permitted to participate in the described activity and related activities, I hereby agree, acknowledge and appreciate that:
1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named persons or entities, herein referred to as Diversity Sports. 2. To release the releasees, their officers, directors, employees, representatives, agents, and volunteers from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caus ed by active or passive negligence of the releasees or otherwise. By executing this document, I agree to hold the releasees harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of my engaging in the above activities. 3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releasees, other than what is set forth in this Agreement. 4. This agreement shall apply to any and all injury, disability, death, or loss or damage to person or property occurring at any time after the execution of this agreement.
REFUND AND CANCELLATION POLICY: Diversity Sports has committed resources for the duration of the season/program based on opening enrollments. Diversity Sports incurred costs the moment you register and the bulk of our costs are not recoverable after we reach the program’s deadline. There are No Refunds after the Registration Deadline. (Registration Deadline is 7 days prior to team meeting). Once a program is set up and players assigned, you have paid for a space in that program, not for a certain amount of games or periods of instruction, so there are no partial refunds for missed days. If a player chooses not to play for any reason, including injury and is unable to play, it is mandatory that the player/parent submits a written request for refund which clearly indicates that the player chooses not to play. Season transfers are an option usually afforded participants who do not finish the season for any reason other than for disciplinary action due to violation of our policies or sportsmanship violations. If Diversity Sports cancels your program prior to the start of the season, you will be given written notice. You may be provided with a refund if you complete the Refund Request Form in a timely manner. If the season cancellation is not the fault of DYS, you will not be approved for a refund. If a refund request form is not completed, it is our assumption that you wish receive a credit for a future season. All refund requests must be in writing on a Diversity Sports refund request form. The date of receipt of written statement will determine, with the schedule below, the amount of refund if approved. The most current Refund Request Form may be found on the FORMS section of this site. • Requests POSTMARKED or RECEIVED At least 7 Days prior to the Team meeting: A refund will be issued for any reason, minus a $30 processing fee. • Requests POSTMARKED at or after the team meeting: A refund will not be given. All requests will be denied, regardless of reason. All refund requests must be accompanied by the purchase/registration receipt, if not, the request will be denied. Regardless of reason, refunds will not be given for seasons that were registered with a voucher or credit. By registering you are stating that you agree with this policy.
