MARKETING AGREEMENT – TERMS AND CONDITIONS ASKING PRICE The asking price does not represent a formal valuation of the property and may change during the term of the agency but this will not affect the agreement itself. We should mention that no structural examination has been undertaken by us and our advice on the asking price is on the understanding that there are no onerous covenants or conditions attached. All negotiations will be subject to contract and vacant possession being given on completion of the sale. FIXTURES AND FITTINGS To comply with the requirements of the Property Misdescriptions Act 1991, all fixtures and fittings that are mentioned in our sales particulars will be deemed to be included in the sale unless otherwise specified in writing. COMMISSION FEE ENTITELEMENT The commission fee will be earned by us if we introduce directly or indirectly a person who contracts to purchase the property. AGENCY TYPE Two weeks notice, in writing, is required to change the Agency Type, subject to any Sole Agency period having elapsed. SOLE AGENCY You will be liable to pay our fee, in addition to any other costs or charges agreed, if at any time unconditional contracts for the sale of the property are exchanged with a purchaser introduced by us during the period of our sole agency, or with whom we had negotiations about the property during that period, or with another purchaser introduced by any other agent during that period. MULTI AGENCY You will be liable to pay remuneration to us at the agreed Multi Agency rate + VAT (Standard Commission Rate) if at any time unconditional contracts for the sale of the property are exchanged with the purchasers introduced by us during the period of this Multi Agency. SIGNBOARDS Town and Country Planning Regulations forbid the erection of multiple signboards. You agree not to allow the display of any other signboards whilst ours is displayed. CANCELLATION OF AGREEMENT If this agreement has been completed in your home or place of work and not within our office, you have the right to cancel within a period of seven days. You must do this in writing by addressing a letter to the Partners. Our address is shown overleaf. You may also cancel by e-mail. The cancellation is deemed to be served as soon as it received by us. PAYMENT Our fees become due when contracts are exchanged. You agree to give irrevocable authority to the legal representative appointed at the time of sale to pay our fees, plus VAT from the proceeds of the sale. OTHER SERVICES Alexandre Boyes, when selling your property will be offering enquirers the services of an Independent Financial Advisor. We will also be offering our usual marketing service for the sale of their own property, property lettings, the auctioning of chattels, Home Information Packs and Energy Performance Certificates. All of which may earn us a commission.
