DAKOTA COUNTY COMMUNITY DEVELOPMENT AGENCY PUBLIC HEARING NOTICE NOTICE IS HEREBY GIVEN that the Board of Commissioners of the Dakota County Community Development Agency (“CDA�) will hold a public hearing on June 17, 2014, at or after 3:30 p.m. in the CDA’s offices at 1228 Town Centre Drive, Eagan, Minnesota, regarding two actions under Minnesota Statutes Sections 428A.11428A.21 as follows: 1. Adoption of a resolution establishing the Town Homes at Wildwood Pond Housing Improvement Area (“Wildwood Pond HIA�). 2. Adoption of a resolution imposing fees on housing units within the Town Homes at Wildwood Pond Homeowner’s Association (“Association�). Within the Wildwood Pond HIA, the CDA proposes to facilitate various improvements to the Town Homes at Wildwood Pond. The boundaries of the proposed Wildwood Pond HIA are shown in the map below. Fees imposed on the owners of units in the Association would finance the improvements.

Details regarding the hearing, the improvements, and the fees are as follows: 1. Persons to be heard: All persons owning housing units in the proposed housing improvement area that would be subject to a fee for housing improvements, and all other interested persons, will be given an opportunity to be heard at the hearing. 2. Proposed Improvements: The proposed improvements include the following: • Exterior wall repairs for 5 buildings including, but not limited to, replacing sheathing, mold remediation, and insulation as needed; • Replace siding, water proofing and other exterior feature improvements for 5 buildings; • Concrete walk replacement and excavation and remediation of underlayment to prevent heaving; 3. Estimated Cost of Improvements to be paid in whole or in part by Housing Improvement Fee: The total cost project cost is estimated to be $296,385. The project costs are estimated to be $272,370 for construction costs, $8,015 for capitalized interest, $16,000 for CDA administrative, legal and financial advisor fees. 4. Amount to be charged against each housing unit: Fees to be imposed on housing units in the Wildwood Pond HIA will not exceed the amounts set forth in the attached table. Fees will be allocated among the units on the same basis as assessments are payable under the Association’s organizational documents. Accordingly, the 7 interior units will each pay 5.576 % and the 10 exterior units will each pay 6.097% of the total cost. Annual Fees shown on the attached table include interest at the rate of 5.5% per annum. 5. Owner’s right to prepay the Housing Improvement Fee: Housing unit owners may prepay their share of the Housing Improvement Fee, without interest, by paying the Total Prepayment Fee shown on the attached schedule on or before August 5, 2014. After August 5, 2014, housing unit owners may prepay their share of the Housing Improvement Fee at any time in whole or in part, but (a) if a prepayment is made by November 30 in any year, the amount prepaid must include interest at the rate of 5.5% through the end of that calendar year, and (b) if a prepayment is made after November 30 in any year, the amount must include interest through the end of the following calendar year. 6. Number of years the fee will be in effect: If owners do not pay the Total Prepayment Fee by August 5, 2014, the Annual Fee will be imposed and collected at the same time and in the same manner as property taxes. The Annual Fee will be payable in equal semiannual installments over a period not to exceed 15 years beginning in 2015. 7. Compliance with Petition Requirement: Owners of more than 55 percent of the housing units that would be subject to the proposed Housing Improvement Fee in the Association have filed a petition with the Dakota County CDA requesting a public hearing on the proposed Housing Improvement Fee.
