NAHB Seeks Nationwide Injunction on WOTUS Rule NAHB joined a broad coalition of farmers, miners and foresters Feb. 7 to ask the U.S. District Court in Texas to issue a nationwide preliminary injunction prohibiting the federal government from enforcing or implementing the 2015 WOTUS rule, which defines the extent of the Environmental Protection Agency and Army Corps of Engineers’ regulatory jurisdiction under the Clean Water Act. The rule has been stayed since October 2015 when the Sixth Circuit issued a nationwide injunction that kept the EPA from enforcing the rule and allowed the 1986 definition to remain in effect. Then in September 2015, the District Court in North Dakota enjoined the rule from taking effect in 13 states. Both courts ruled that allowing it to come into force and effect would cause irreparable injury to regulated entities, including home builders. After the Supreme Court’s January decision holding that only the district courts have jurisdiction to hear challenges to the rule, NAHB and its coalition partners believed it was imperative to obtain a nationwide injunction. The coalition motions explains that the WOTUS rule is likely unlawful for three reasons. EPA and the Corps violated federal regulations regarding appropriate notice and comment, putting at a disadvantage the builders, miners and farmers directly affected by the rule.  The rule is inconsistent with the language in the Clean Water Act (CWA)and scientific evidence, making it “arbitrary and capricious,” the motion says. “In its most recent CWA cases, the Supreme Court could not have been more clear that the word ‘navigable’ continues to have meaning under the CWA, and yet the WOTUS rule asserts jurisdiction over countless isolated waters and desiccated land features.”  The rule is unconstitutionally vague because it does not provide fair notice to the regulated community and allow regulators to act in arbitrary and discriminatory ways. “The definition of ‘ordinary high water mark,’ for example, turns on factors like ‘changes in the character of soil’ and ‘presence of litter and debris’ and allows bureaucrats to rely on whatever ‘other . . . means’ they deem ‘appropriate’ in deciding when a high water mark is present and where it lies,” the motion says. “Plaintiffs and their members must be able to plan their operations often years in advance of beginning projects and putting employees to work,” the motion says. “Such planning requires, first and foremost, stable and predictable legal rules—and that much-needed stability and predictability will undeniably be absent if the definition of ‘waters of the United States’ is constantly changing with every court decision on every challenge to every intervening rulemaking. It is no exaggeration to say that billions of dollars and many thousands of jobs hang in the balance.” 

Dan Lindquist, NDAB President Once again, North Dakota was well represented at the International Builders Show (IBS) in Orlando last month. The show offered three exciting days of over one million square feet of exhibit space featuring new products and trends for 2018, outstanding educational sessions, Dan Lindquist and events so members may network with President key business partners. Because NAHB holds its key meetings and events in conjunction with IBS, it’s a great way to gain a wealth of knowledge on every level, and in a short amount of time making it a valuable investment in your business. If you missed it, I encourage you to attend next year in Las Vegas, February 19 – 21. NDAB Associate member Dawn Cruff, Dakota Plains Realty, Home Builders Association of Fargo Moorhead; and member Ken Callahan, MDU, Williston Area Builders Association were two of seventeen finalists for the NAHB 2017 Associate of the Year award. Volunteering at the National Level As we return from Orlando and look back at our week of warmer weather, great company, lots of steps and new information we are reminded of all the great opportunities to be Kim Schneider involved at the national level with National CEO Association of Home Builders. NDAB members from across the state and representing each of the six local associations traveled to Orlando to be a part of NAHB Board of Directors meetings and the International Builders Show. Annually, NAHB hosts the International Builders Show (IBS) and next year will be doing so again in Las Vegas, February 19-21, 2019. At these meetings, committees made up of Builders and Associates meet to discuss what is happening in the building industry, discuss membership numbers and how to increase, discuss issues across the nation, BUILD-PAC, they recognize their peers with various National awards for the work they do and they have an opportunity to network.

At NAHB meetings, it is always a great opportunity to reconnect with old and new friends, network, and gather new ideas and information. Another fun gathering at IBS is the North Dakota Reception. We are pleased each year to invite North Dakota attendees and our friends to a reception with great food, drinks and of course fun company. We have around 200 people stop by and we recognize the student chapter attendees for their hard work and the competition they participate in. For the past two years, NDAB has teamed up with members from the Area 10 Caucus to co-host a fun evening. The association celebrated its 59th Annual Dinner on Jan. 23. Captain Jack Sparrow swore in the new board and 2018 President Lynn Klein. The 2018 Home Show is Feb. 9-10 at the Bismarck Event Center. More than 200 exhibitors will fill 42,500 sq. ft. of floor space. Government Affairs Committee members recently rallied in front of the Bismarck City Commission to share concerns about rising regulatory fees. 2018 brings an increase to permit, planning and connection fees for builders. The Spring Parade of Homes dates are set. Builders will showcase their homes April 26-29.

The City Leaders Luncheon was held on January 18. Over 30 people attended the event that was the perfect opportunity to bring MAB members closer to city officials. Minot's City Manager, Tom Barry, lead the discussion that featured an update on happenings around Minot as well as what's in store for the North Dakota Association of Builders

Williston Area Builders Association held the first GMM of 2018 on Tuesday, January 16, sponsored by American State Bank and Trust Company. American State Bank & Trust was also the evening’s presenter, discussing commercial and residential lending. They also presented new renovation loan programs available through FHA and Fannie Mae. McKenzie County Builders Association will be holding their first GMM on January 22, hosted by Cornerstone Bank and sponsored by BDS Land. The meeting will be held at Cornerstone Bank, located at 106 8th Ave SE in Watford City. We will be updating the membership on all the exciting things this new association has been working on.

Members-Only Webinar: Tax Reform and Your Bottom Line Monday, March 5, 2018 at 1 p.m. (ET) The landmark tax reform legislation, which took effect Jan. 1, created significant changes in the tax code that will affect the housing industry and our small business members. To help you understand how these changes could impact your business, NAHB is providing a members-only webinar on March 5 at 1 p.m. ET. The webinar will feature NAHB tax experts and outside tax counsel who will focus on the specific changes that will most directly impact small businesses, including the 20-percent pass-through deduction, limitations on the business interest deduction and new depreciation guidelines. Members will have the opportunity to ask questions during the webinar. If you are not able to join the webinar, a replay will be posted on NAHB remained actively engaged throughout the tax reform debate and fought hard to ensure that our industry’s priorities were addressed. Legal Action Fund Fights Building Challenges The new year has already seen a rise in legal challenges pertaining to the home building industry. At the 2018 International Builders’ Show, the NAHB Legal Action Committee addresses several cases in Nevada, Michigan, Colorado and Idaho. Grants were made in direct support of issues that affect builder members nationwide, including impact fees and growth controls. In the cases presented, local governments are trying to curtail development by charging egregious fees and setting limitations on housing growth in more populated metro regions. One case that is likely to set state precedent is a challenge to Nevada’s construction defect reform law. With help from NAHB, the Nevada HBAs fought for the passage of this law, which provides contractors with important protections including a six-year statute of repose for all claims. This lawsuit is the first substantive challenge to the law, and NAHB is pleased to again support Nevada’s efforts. Funds totaling $70,000 were granted to four different applicants for member litigation. Applications for consideration at the 2018 Midyear Meeting are due Friday, June 22.
